How to Register Your Airbnb: Cost & Requirements

T he government requires all operators of short-stay accommodation units or Airbnb to be registered and issued with an operating license by the Tourism Regulatory Authority.

In recent days, the government has introduced new measures for these accommodation facilities as a way of mitigating increasing cases of murders in Airbnb’s in the country.

These measures include the government coordinating with booking platforms to restrict unregistered rentals and further institute severe penalties, including fines and revocation in cases of non-compliance.

It is important to note that the Tourism Regulatory Authority has provisions for registrations of such accommodation units with clearly defined requirements for different categories of such establishments. 

“The operator with TRA licenses will benefit greatly in that the license will facilitate: Promotion and marketing, Access to Government incentives e.g. custom duty waivers, Access to training and capacity building programmes by government agencies, and Access to Government financing, Endorsement for membership to industry associations,” the authority notes on its website.

This article details the different types of accommodations that are categorized under online bookings by the authority and the cost of licensing among other requirements.

Service Flats/Apartments 

A service flat or apartment is described as a fully furnished apartment with a separate living area, kitchen/kitchenette, bathroom and sleeping quarters and available for short-term or long-term stay and providing guests with amenities for daily use.

The requirements for the application of a license of such an establishment include a certificate of registration or incorporation.

Additionally, the operator will be required to submit CR 12 companies and or ID copies of the directors of the companies.

The authority also requires the submission of a KRA PIN Certificate of the tourism enterprise, a CV for a manager or a Professional certificate of the person running the business.

Finally, the authority will require an entry or work permit from the directors in case of foreign ownership.

To apply, sign into the website, and fill in a provided application form upon which o ne is then required to pay the application fee.

After that, the application goes through a verification process and when approved, the licence is sent to the operator through their email. 

Payable License Fee

The License application fee under this category is Ksh1,000. However, the operator will be required to pay an annual license fee of Ksh26,000 and a license renewal fee of Ksh26,000.

Guest Houses 

For guest houses, the authority requires submission of a copy of the identity card or passport of the owner or director of the establishment for registration of a license. 

Other required documents include a copy of the lease agreement or title deed of premises, a copy of the applicant’s pin nu mber (or company pin number (where applicable) and a copy of the certificate of registration/incorporation of the company (where applicable).

In addition, the authority requires submission of a copy of the current health clearance certificate (less than three months old) and a Medical Certificate of food handlers.

To apply, sign into the website, and fill in a provided application form. One is then required to pay the application fee. After that, the application goes through a verification process and when approved, the license is sent to the operator through their email. 

The License application fee under this category is Ksh1,000. However, the operator will be required to pay an annual license fee of Ksh11,000 and a license renewal fee of Ksh11,000.

Homestays are described by the authority as a form of accommodation located in rural, urban or peri-urban areas in which the guest stays with the homeowner of the family unit.

The guest regularly interacts with the host, sharing common family facilities and taking part in family activities and in this way availing the guest a more intimate interactive experience of the host’s way of life.

To get a license, the operator is required to submit a copy of the identity card or passport of the owner/director, a copy of the lease agreement or title deed of premises, a copy of the applicant’s pin number (or company pin number (where applicable).

Homestays are divided into three categories: Economy, Standard and Executive.

The License application fee under Economy is Ksh500. However, the operator will be required to pay an annual license fee of Ksh1,000 and a license renewal fee of Ksh1,000.

For the Standard category, the license application fee is Ksh500. However, the operator will be required to pay an annual license fee of Ksh2,000 and a license renewal fee of Ksh2,000.

Finally, for the Executive category, the license application fee is Ksh500. However, the operator will be required to pay an annual license fee of Ksh3,000 and a license renewal fee of Ksh3,000.

Hostels 

These establishments are described as an accommodation system designed to suit people on a budget.

“It is usually inexpensive, catering mainly to the youth and usually lacking in privacy and comfort with shared sleeping and bathroom quarters,” the authority indicates.

To apply for a license, the operator is required to provide a certificate of registration/incorporation, a CR 12 companies and/or ID copy of the directors, KRA PIN and a certificate of the tourism enterprise.

Also, the operator will provide a CV for manager /Professional certificate of person running the business and entry /work permit of the directors in case of foreign ownership.

Tourism Regulatory Authority announces fees & regulations for AirBnbs & serviced apartments

The Tourism Regulatory Authority (TRA) has released new regulations on registration and licensing of serviced apartments, homes and villas. The regulator states that the new regulations were prompted by the dynamic and emerging traveller trends that have necessitated different concepts on the local and global spheres.

TRA is a state corporation with the mandate to regulate all tourism activities and services in Kenya. This is achieved through registration, quality assurance audits and licensing of all tourism activities and services countrywide.

The popular AirBnb concept of furnished homes, apartments and villas in residential settings are among the licensable accommodation facilities that offer regulated hospitality activities.

Owners and hosts of these apartments will now be required to do the following to keep their businesses running.

  • Ksh. 1,000 registration fee
  • Ksh. 26,000 annual fee per house/unit
  • NEMA license
  • Single business permit
  • Home insurance
  • 1% Digital Service Tax (DST)
  • 2% Catering levy
  • 16% VAT and corporate tax, because they will register as a Limited Company
  • Every member shall pay one initial license fee for 2021, upon which they will be required to pay up for each unit in 2022.

After registration, TRA shall undertake inspection of all registered units starting April 2021, then offer licenses to approved units.

Tourism licensing is aimed at ensuring customer satisfaction and competitiveness of the country as a tourist destination. Thus, all activities and services as outlined in the 9th Schedule of Tourism Act, 2011 need to manage customer expectations by maintaining minimum standards.

The classification exercises will be overseen by a Standardization and Classification Committee comprising members from both the public and private sectors.

Functions of Tourism Regulatory Authority In Kenya

This article highlights the functions of the Tourism Regulatory Authority in Kenya. Tourism Regulatory Authority (TRA) is a corporate body established under section 4 of the Tourism Act No.28 of 2011. It is one of the parastatals under the Ministry of Tourism and Wildlife .

TRA is mandated to regulate the tourism sector in Kenya. This is through developing regulations, standards and guidelines that are necessary to ensure an all-round quality service delivery in the tourism sector.

The Authority’s mission is to develop and promote a conducive regulatory environment for a dynamic sustainable tourism sector.

Functions Of  The Tourism Regulatory Authority

1. Regulate tourism activities and services countrywide in accordance with the national tourism strategy.

2. Formulate guidelines and prescribe measures for sustainable tourism throughout the country.

3. Register, license and grade all sustainable tourism and tourist-related activities and services including cottages and private residences engaged in guest house services.

4. Develop and regulate, in consultation with the Ministry for the time being responsible for matters relating to education, tourism and hospitality curriculum, examination and certification.

5. Develop and implement, in consultation with relevant stakeholders, criteria for standardization and classification of tourism facilities and services.

6. Develop and implement a code of practice for the tourism sector.

7. Ensure the development and implementation of high quality tourism sector.

8. Monitor and assess tourist activities and services to enhance continuous improvement and adherence to sound principles and practices of sustainable tourism.

9. To undertake annually, an assessment and audit of tourism activities and services, measures and initiatives at national level, prepare and publish an annual national tourism sector status report, in consultation with the Cabinet Secretary and relevant lead agencies.

10. Perform any other functions that are ancillary to the object and purpose for which the Authority is established.

Understanding Local Regulations

Before diving into the Airbnb business in Kenya, hosts should familiarize themselves with the legal requirements governing short-term rentals. In 2021, the Tourism Regulatory Authority (TRA) enacted new regulations on the registration and licensing of Airbnb facilities in Kenya.

Nairobi Penthouse Airbnb

TRA is a state corporation established under section 4 of the Tourism Act No. 28 of 2011 with the mandate to regulate all tourism activities and services in Kenya. This is achieved through registration, licensing, and quality assurance audits of all tourism activities and services provided countrywide.

Types of premises that can be listed on Airbnb in Kenya

The facilities that can be listed in the Airbnb platform as provided in the Ninth Schedule of the Tourism Act, 2011 include but are not limited to serviced apartments:

  • Condominiums
  • Beach cottages
  • Holiday cottages
  • Tented camps

Business Registration and Licensing

One of the initial steps in establishing an Airbnb business in Kenya is registering it as a business entity. Hosts can choose to register as sole proprietors, partnerships, or limited liability companies, depending on their preferences and business goals. This step ensures legal recognition and compliance with tax obligations.

An Airbnb is regarded as an income-generating business as such the host is required to obtain a business permit from the County Government allowing him/her to run the business.

Section 7(1)(c) of the Tourism Act, 2011, and Part III of the Tourism Regulatory Authority, Regulations 2014 make it mandatory for persons carrying out tourism businesses and services to be licensed by the Tourism Regulatory Authority (TRA)

Documents Required For Airbnb Regulation

For members to be successfully registered by the TRA and be issued a regulatory license, they are required to make a one-off application fee of Ksh. 1,000/= and an annual license fee for each unit owned together with the following documents:

  • A duly filled application form;
  • The original deposit slip/advice for the application & license fee (proof of payment);
  • Tariff/rack rates
  • A copy of Title Deed/Lease Agreement for the premises
  • Copies of ID’s/ passport if one is an individual and a Certificate of Incorporation if one is a Company; and
  • A copy of the applicant’s PIN Certificate.

The annual license fee to be paid varies with the type of Airbnb:

  • Serviced flats & apartments, villas, holiday cottages, and timeshares are charged a license fee of Ksh. 26,000/= per year.
  • Beach cottages and treehouses are charged Ksh. 21,000/= per year
  • Hostels and guest houses are charged Ksh. 11,000/= per year and homestays are charged between ksh1,000/= to ksh3,000/= per year depending on their location.

TRA Standards and Compliance

Before issuance of the license, the TRA will dispatch an officer to inspect the premises. They will confirm if your Airbnb has complied with the standards and requirements. The requirements are listed in the First Schedule of the Tourism Regulatory Authority Regulations, 2014.

Other licenses to be procured

Nema license.

Section 98(5)(c) of the Tourism Act, imposes an obligation on a host/owner of an Airbnb to procure an environmental impact assessment license (NEMA license) over the premise.

Home Insurance

It’s important to obtain home insurance to insure the premises and all the belongings in it against life’s unexpected events such as damage, fire, theft, natural causes, or other losses.

The plan can further be extended to cover your Airbnb’s employees and occupiers against any liability arising from an accident or incident occurring on the premises.

Penalties & Offences

An application for renewal of the TRA license must be made within 3 months before expiry. Failure to make the application for renewal, the host will be liable to pay a penalty of 10% of the license fee for each month they are in default; and

Refusal to apply for a license or furnish the license upon request amounts to an offense under the Tourism Act, 2011, and exposes the host to a fine of Kshs.100000/= or a jail term of up to 18 months or both; and

Failure to comply with the standards and requirements set by the TRA will lead to the suspension of your license and the closure of your Airbnb business.

Safety and Compliance Standards

Recently there have been arising issues linked to Airbnb units in Kenya where serious offences like murders have occurred.

As a result, the government is enforcing the necessary regulations to ensure both host and guest safety. Hosts must adhere to safety and compliance standards set by the government.

Airbnb regulation in Kenya

Guests must provide their identification documents during check-ins for easier identification in case of any incidences. Other regulations for the houses include;

  • Fire safety codes
  • Providing emergency contact information to guests
  • Maintaining a secure environment for visitors

Guest Registration and Reporting

The government now requires hosts to register their guests during check-in as a way of complying with local authorities for security purposes. Hosts should be aware of any reporting obligations and ensure they comply with these requirements to avoid legal issues.

Kenya Guide Licensing Legal Framework

In order to operate legally as a guide in Kenya, guides must posess a valid 'Tour Guide License' issued by the Tourism Regulatory Authority (TRA). These can be issued any time during the year, but are only valid until 31st December of the same year, so we suggest our members apply early each year (January).  This application is done in person at your nearest TRA office/HQ.

The TRA Tour Guide License is issued upon application with the following criteria:

  • TRA Class E Enterprises (Citizen Driver) Application form duly filled
  • Valid Kenya National ID
  • Current/Valid Police Clearance Certificate
  • Valid certificates/diplomas in 'Tour Guiding & Administration' from a recognized training institution
  • Recommendation letter from a recognized tour guides association (e.g. KPSGA) or employer
  • Application fee of KES 500/- for new applicants
  • License fee of KES 2,000/- per annum

Tourism Service Vehicle (TSV) Licenses are issued by the National Transport Safety Authority (NTSA). A valid TRA Class E Enterprise license, and a valid Kenya drivers license with Class D endorsement are required for eligibility.  This application is done online via the NTSA PSV/TSV Portal

DUBAI AND MOSCOW: REVOLVING FLATS

Dubai and Moscow are the first world’s destinations that will have a so called Dynamic Tower. This building’s floors will be designed to revolve all the time. Each of the floors will be able to rotate 360 degrees. The Italian architect, David Fischer who came up with the idea says it came to him when he was in Miami. There he learned that an apartment overlooking the ocean was worth $3million but another that did not have such a view was worth only $1.8million. The Dynamic Tower will make it possible for the inhabitants to have an ever-changing view.

He also claims that the towers will never look the same because they will always be changing their shape. The Dubai Dynamic tower will have 80 floors an will be 420-metre high. There will be a 6 star hotel, offices and apartments. The real luxury will be on the top 5 floors. There will be 5 villas, 1500 square meters each.

The inhabitants of these luxury villas will also have the possibility to control the spin by a voice-activated computer. The rest of the building will spin according to specially designed patterns. The villas’ owners will also have their own parking and elevator for the cars on the very floor where they will reside. On the roof there will be a swimming pool and a garden. There will also be wind generators and solar panels that should make the building completely energy self sufficient.

Not only the idea of a Dynamic Tower itself, but also the method of its construction, seems very bold. Mr. Fisher claims that the building will be assembled in 20 months by only 80 technicians from pre-fabricated components made in a plant in Altamura, southern Italy. This should save as much as 10 per cent of the construction cost. The Dubai tower should cost $700 million to build.

TOURISM REGULATORY AUTHORITY OF KENYA

Board of directors.

The Authority’s Board comprises of ten (10) members led by a non-executive and independent Chairperson, four (4) independent non-executive directors, representatives of the Principal Secretaries responsible for The National Treasury, State department of Planning and Statistics, State department for Tourism & Wildlife, Ministry of Environment and Forestry, and the Director General of the Authority. Hon. Halima Yusuff Mohammed

Hon. Halima Yussuf Mucheke is the Chairperson of the Board of Tourism Regulatory Authority. She has a Bachelor’s Degree in Psychology from the University of Nairobi, a Diploma in Business Administration and currently pursuing a Master’s Degree in Business Administration.

She previously worked as nominated member of Parliament with vast experience in the Public Service, having served as a Sub-county Administrator and a District Officer.

Hon. Peter Muriithi Njenga

Mr. Peterson Muriithi Njenga holds a Bachelor’s Degree in Economics and currently undertaking a Master’s Degree in Economics.

He joined the then Ministry of Planning, National Development and Vision 2030 in April 2008 as an economist/statistician II and has risen over the years to the level of Chief Economist in the State Department for Planning During his working career, he has gotten extensive training and experience in Economic Development, Policy Formulation & Analysis and Strategic Planning and Budgeting in the public sector.

Mr. Kennedy Olwasi

Mr. Kennedy Olwasi is currently an Assistant Director Programmes & Strategic Initiatives, Ministry of Environment & Forestry, Kenya having previously worked as District Agricultural Officer in a number of stations in Kenya. He has also worked as a Policy and Institutional Capacity specialist for over 5 years and a further 4 years as a Research Assistant at the International Centre for Insect Physiology and Ecology (ICIPE, Kenya). Mr. Kennedy Olwasi is currently the technical lead in the development of Integrated Masterplans for Rehabilitation and Restoration of Cherangany Elgeyo Hills ecosystem as well as the Tsavo landscape. He also represents the Ministry of Environment & Forestry in a number of platforms including technical Committee on Environment and Forestry at the EAC Sectoral Council of Ministers (SECOM)) and Intergovernmental Relations Technical Committee, he is a member of the International Association of Impact Assessments (IAIA) and the Environment Institute of Kenya.

He holds a BSc and MSc degree in Agronomy from Egerton University and currently undertaking a PhD on climate change Adaptation, Institute of climate Change Adaptation, University of Nairobi. He also holds a number of certificates including on Green and Circular Economy, Copenhagen University, Denmark, Strategic Leadership, Kenya School of Government Kenya, Environmental Impact assessment and Audit, Kenya School of Agriculture and multidisciplinary, Monitoring and Evaluation and adaptive learning, Egerton University. He holds a certificate in ISO Audit by Bureau veritas International among other trainings.

Grace Wangui Kamau

Grace Wangui Kamau is a lawyer by profession and an Advocate of the High Court with 19 years experience. She holds a Bachelor of Laws degree (LLB) from University of Nairobi and Certified Secretaries (CS) foundation level, qualification.

She is currently a Deputy Chief State Counsel in the Ministry of Tourism & Wildlife and has previously worked at Ministry of Transport and Infrastructure. While at Ministry of Transport and Infrastructure she was a member of the Secretariat to the Steering Committee that established Nairobi Metropolitan Area Transport Authority (NaMATA). She has worked as Ag. Corporation Secretary for NaMATA and legal advisor to the Engineers Board of Kenya. She also worked as a litigation lawyer at the Office of the Attorney General for 6 years.

She is a member of the Ministerial Human Resource Management and Advisory Committee (MHRMAC) and Medium Term Plan Committee and has served in various other key committees in Ministries.

Mr. Nobert Talam

Joseph is a highly motivated professional with over 25 years’ experience in Finance, Economics and Investments. He has demonstrated expertise in financial management, and Corporate Governance.

He has vast experience in both private and public sectors having served in the banking sector and currently serving as an economist at the National Treasury. He is experienced in Economic Development, Policy Formulation & Analysis and Budgeting in the public sector.

He holds MBA (Finance), from Korea Advanced Institute of Science & Technology (KAIST) in South Korea, MA Economics, Finance & Banking (Financial Sector Policy) from Moi University and Bachelor of Arts in Mathematics    & Economics from the University of Nairobi.

During his working profession, he has acquired extensive training in Advanced Trainers Skills Development for Senior Trainers (from Kigali Rwanda), Audit Committee Training, Compensation Committee Training and training on Making Boards More Effective (from Harvard Business School), Project appraisal and Risk Management (from Duke University), Senior Management Course (KSG), Corporate Governance Course for Directors(from Center for Corporate Governance),  and Oil & Gas Commercialization Transactions Training (from Simmons & Simmons).

Mr. James Sitieney

Mr. James Sitieney holds a Master of Arts in Public Policy and Administration (MPPA) from Kenyatta University; A Bachelor’s degree in Economics and Business from the University of Nairobi, Senior Management Course from Kenya School of Government and a member of the Kenya Association for Public Administration and Management (KAPAM).

He also possesses a Certificate in Leadership and Policy Implementation from ESAMI; Effective Audit and Oversight (Institute of Directors); Computer Application and Proficiency from African Institute of Research and Development Studies.

He has a wealth of hands-on experience in Corporate Governance; Leadership and Policy implementation; In addition, he has worked in the Public Sector spanning over twenty-five years in various Departments and agencies.

Currently, Mr. Sitieney works at the Inspectorate of State Corporations-Office of the Prime Cabinet Secretary (PCS)-Executive Office of the President.
