U.S. Citizenship and Immigration Services (USCIS) issues Refugee Travel Documents to persons with refugee or asylum status (and in some cases to lawful permanent residents who obtained their permanent residence through refugee or asylum status).

Who Needs a Refugee Travel Document

You must have a Refugee Travel Document to return to the United States if you:

  • Have refugee or asylum status but are not a lawful permanent resident (green card holder); or
  • Are a derivative asylee or refugee.

If you do not obtain a travel document before you leave the U.S., you may be unable to re-enter the United States or you may be placed in removal proceedings before an immigration judge.

Lawful permanent residents who obtained their status through refugee or asylum status may also apply for a travel document. Although permanent residents can generally enter the United States with the green card (after an absence of less than one year), a travel document may be needed to enter other countries. In this way, the travel document is much like a passport.

An asylum “applicant” cannot obtain a Refugee Travel Document. Instead, asylum applicants may apply for an Advance Parole Document . Advance Parole allows certain aliens to return to the United States without a visa after traveling abroad.

Form I-131, Application for Travel Document

To apply for a Refugee Travel Document, file Form I-131, Application for Travel Document . You should file a Form I-131 before you leave the United States and expect processing times of approximately three months. However, it may take longer. Expedited processing may be available for your situation.

Should you need to leave the United States before USCIS grants the travel document or you want to apply outside the United States, please consult with an immigration attorney .

Mistakes on your Form I-131 can cause costly delays or a denial.

Period of validity.

A Refugee Travel Document is valid for up to one year. During this time you can use the document multiple times.

USCIS will not renew your travel document. Instead, you’ll need to apply for a new one with Form I-131, Application for Travel Document.

Traveling to the Country of Persecution

Traveling back to the country where you experienced past persecution or claim a fear of future persecution is highly discouraged.

I-131, Application for Travel Document

ALERT: On Jan. 31, 2024, we published a  final rule in the Federal Register, that adjusts the fees required for most immigration applications and petitions. The new fees will be effective April 1, 2024.

Applications and petitions postmarked on or after April 1, 2024, must include the new fees or we will not accept them.

What to Know About Sending Us Your Form

The new filing fee is effective for filings postmarked April 1, 2024, and later. If you are filing an acceptable prior form edition on or after April 1, 2024, you must include the new filing fee.

Alert:  Beginning July 1, 2022, we will issue a new travel authorization document to Temporary Protected Status (TPS) beneficiaries: Form I-512T, Authorization for Travel by a Noncitizen to the United States, at our discretion if we find the beneficiary merits this authorization. We will no longer issue advance parole documents as evidence of our prior authorization for a TPS beneficiary to be permitted to reenter the United States if the beneficiary travels outside the United States.

Beginning July 1, 2022, we will issue a new travel authorization document to Temporary Protected Status (TPS) beneficiaries: Form I-512T, Authorization for Travel by a Noncitizen to the United States, at our discretion if we find the beneficiary merits this authorization. We will no longer issue advance parole documents as evidence of our prior authorization for a TPS beneficiary to be permitted to reenter the United States if the beneficiary travels outside the United States.

If you are a TPS beneficiary with an existing, unexpired advance parole document, you may continue to travel and seek reentry to the United States after a trip outside the United States through the period of validity printed on your advance parole document.

If you are a TPS beneficiary applying for a new travel authorization document, you should continue to use Form I-131, Application for Travel Document. If you have a pending Form I-131, you do not need to file a new application.

We will continue to issue advance parole documents to noncitizens with pending initial applications for TPS (Form I-821).

TPS beneficiaries and individuals with pending initial TPS applications should carefully read the Form I-131 Instructions which contain warnings about certain risks an individual may face if they are outside of the United States while USCIS is considering their TPS reregistration or initial application, such as missing important request for evidence or other notices or being denied TPS while outside the United States.

ALERT: Court decisions regarding DACA.

On Sept. 13, 2023, the U.S. District Court for the Southern District of Texas issued a decision finding the DACA Final Rule unlawful and expanding the original July 16, 2021, injunction and order of vacatur to cover the Final Rule. However, the court maintained a partial stay of the order for “all DACA recipients who received their initial DACA status prior to July 16, 2021.” See the Memorandum and Order (PDF, 1.35 MB)  and Supplemental Order of Injunction (PDF, 72.53 KB) .

Accordingly, current grants of DACA and related Employment Authorization Documents (EADs) remain valid until they expire, unless individually terminated.  In accordance with this decision, USCIS will continue to accept and process DACA renewal requests and accompanying applications for employment authorization under the DACA regulations at 8 CFR 236.22 and 236.23, as it has since October 31, 2022. We will also continue to accept initial DACA requests, but in accordance with the District Court’s order, we will not process initial DACA requests.

Current valid grants of DACA and related EADs will continue to be recognized as valid under the Final Rule. This means that individuals with DACA and related EADs do not have to submit a request for DACA or employment authorization until the appropriate time to seek renewal.

Use this form to apply for a reentry permit, refugee travel document, TPS travel authorization document, advance parole document (including parole into the United States for urgent humanitarian reasons or significant public benefit), or advance permission to travel for Commonwealth of the Northern Mariana Islands (CNMI) long-term residents.

If you file this form to request an Advance Parole Document authorizing you to seek parole in the United States when you return to the United States after temporary travel abroad, and you depart the United States before we issue your Advance Parole Document, we will consider your Form I-131 abandoned unless you were previously issued an Advance Parole Document that remains valid for the entire time you are outside the United States.

If you file this form to request an advance permission to travel for CNMI long-term residents document, and you leave the CNMI without having an advance permission to travel document, your status will automatically terminate.

The fee is effective for filings postmarked April 1, 2024, and later.

You can pay the fee with a money order, personal check, or cashier’s check, or pay by credit card or debit card using Form G-1450, Authorization for Credit Card Transactions . If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

When you send a payment, you agree to pay for a government service. Filing fees are final and non-refundable, regardless of any action we take on your application, petition, or request, or if you withdraw your request.  If you pay by credit card or debit card, you cannot later dispute the payment. If you are submitting multiple forms, pay each filing fee separately. We are transitioning to electronically processing immigration benefit requests, which requires us to use multiple systems to process your package. We may reject your entire package if you submit a single, combined payment for multiple forms.

Payment if you file at a field office: You cannot pay fees with a money order or cashier’s check when filing at a field office. You can only pay with a personal check, debit card, credit card, or reloadable prepaid credit or debit card.

You do not need to pay an additional fee for Form I-131 if:

  • You are filing Form I-131 Application Type B or D;
  • You filed a Form I-485 with a fee on or after July 30, 2007, and before April 1, 2024; and
  • Your Form I-485 is still pending.

For refugee travel document applications filed from outside of the United States, you must pay the applicable fee(s) to the cashier at the USCIS overseas office or U.S. embassy or consulate with jurisdiction over your location. Please see the website of the appropriate  embassy or consulate  to confirm acceptable forms of payment. Include the fee receipt from the U.S. embassy or consulate when you file your application package.

Please do not mail cash, personal checks or traveler’s checks. If you do not include a fee receipt with your filing, we will reject your application.

Please do not submit this checklist with your Form I-131. The checklist is an optional tool to use as you prepare your form, but does not replace statutory, regulatory, and form instruction requirements. We recommend that you review these requirements before completing and submitting your form. Do not send original documents unless specifically requested in the form instructions or applicable regulations.

If you submit any documents (copies or original documents, if requested) in a foreign language, you must include a full English translation along with a certification from the translator verifying that the translation is complete and accurate, and that they are competent to translate from the foreign language into English.

What documents do I need to travel outside the United States? Form I-131, Application for Travel Document, is used to apply for three different types of travel documents: --o Advance Parole --o Refugee Travel Document --o Re-Entry Permit WARNING:   If you have been in the United States illegally, then you may be subject to a bar to admission if you depart the United States, even if you have been issued a travel document. For more information please see Section 212(a)(9) of the Immigration and Nationality Act (INA). If you are an asylee who applied for asylum on or after April 1, 1997, then your asylum status may be terminated if you return to the country from which you were seeking protection. Advance Parole Advance parole is issued solely to authorize the temporary parole of a person into the United States. The document may be accepted by a transportation company (airlines) instead of a visa as an authorization to travel to the United States. Please note that an advance parole document does not replace your passport. Advance parole is most commonly used when someone has Form I-485, Application to Register Permanent Residence or to Adjust Status, pending. If you depart the U.S. while your I-485 application is pending without first obtaining advance parole, your case will be denied unless you fit into a narrow exception for those maintaining certain nonimmigrant statuses. Advance Parole for Asylees An asylum applicant who has a pending Form I-589, Application for Asylum and for Withholding of Removal, and has not received a final decision may be allowed to travel outside the United States. If you are an asylum applicant and you intend to travel outside the United States and return you must apply for and receive advance parole. If you leave the United States without first obtaining advance parole, USCIS will presume you abandoned your asylum application. Advance parole does not guarantee that you will be allowed to reenter the United States, rather, an immigration inspector from U.S. Customs and Border Protection (CBP) must inspect you and determine whether you will be allowed to reenter the United States. Refugee Travel Document A refugee travel document is issued to a person who has been granted refugee or asylum status, or to a permanent resident who obtained a green card because they were a refugee or asylee. If you hold refugee or asylee status and are not a permanent resident, you must have a refugee travel document to return to the United States. Derivative asylees and refugees must also obtain a refugee travel document before leaving the United States. If you do not obtain a refugee travel document in advance of departure, you may be unable to re-enter the United States, or you may be placed in removal proceedings before an immigration judge. Re-entry Permit A re-entry permit allows a permanent resident or conditional resident to apply for admission to the U.S. upon returning from abroad during the permit’s validity, without having to obtain a returning resident visa from a U.S. Embassy or consulate. Permanent or conditional residents should apply for a re-entry permit if they will be outside the United States for one year or more.

What is a ‘Type P’ Passport?

When you travel internationally, a passport is required to enter a foreign country or to return home. These government-issued documents verify your identity and enable you to travel freely. 

But did you know that there are multiple types of passports? And the most common type is referred to as Type P. 

A Type P passport is the standard passport that Americans use as identification when traveling internationally. This government-issued identification can also be used within the United States as an alternative to a driver's license as proof of identity.

5 different types of U.S. passports

In the U.S., there are five types of passports available. Each passport type is for a different kind of traveler. However, only the Regular "Fee" passports can be used for personal travel.

Regular "fee" passports . These blue passports are the most commonly issued. They are also known as "tourist" or Type P passports because they are for personal use.

Diplomatic . Black diplomatic passports are for foreign service officers and others with diplomatic statuses, such as the president of the United States.

Official . These passports are maroon and are issued to officials and employees of the U.S. government who travel on official duties. Military members also receive official passports when required by the country they're stationed in.

Service . These gray passports are issued on a limited basis to contractors supporting the U.S. government in a foreign country when a Type P passport won't work.

No-Fee Regular . These passports are identical to Type P, but the traveler does not pay standard fees. They are issued to certain U.S. Department of Defense employees, American Red Cross and Peace Corps volunteers assigned overseas.

Benefits of having a passport

A passport provides travelers with numerous benefits while traveling abroad and at home. Here are a few benefits of having a U.S. Type P passport:

Traveling internationally . When you travel internationally, you need a passport to enter a foreign country and upon returning to the U.S.

Prerequisite for visas . Some countries require a visa to enter. Travelers must have their passports to apply for a visa.

An Alternative to a Real ID . Starting May 7, 2025, travelers must have a Real ID to fly, even on domestic flights. However, if you have not upgraded your driver's license or ID card by then, your passport will be an acceptable alternative.

Lost or stolen ID . You can use your passport as a government-issued ID when your other identification is lost, stolen, or misplaced.

Jobs or school in a foreign country . You're not restricted to your local area in today's global economy. With a passport, you can travel globally for jobs or education in other countries.

How to get a passport

The U.S. State Department has a simple process for people to apply for a Type P passport. Follow these steps:

Complete the application form (DS-11) for a U.S. passport . You can download the form or fill it out online.

Gather proof of U.S. citizenship . You'll need to submit proof of citizenship along with your passport application. You must submit an original or certified copy of a U.S. birth certificate, valid U.S. passport, certification of birth abroad, or certificate of naturalization or citizenship.

Bring current identification . When you submit your passport application, an official will review your identification to ensure the application is for you. Acceptable forms of ID include a driver's license, previous or current passport, military identification, certificate of naturalization or citizenship, or federal, state or city government employee identification.

Get passport photos . Attach a 2-inch x 2-inch color photo to your application. The photo should have been taken within the last six months, with your head facing the camera. Wear everyday clothing and do not wear a uniform. Do not smile, remove eyeglasses and head coverings.

Pay application fees . Applicants can pay the passport fees with a personal check, cashier's check or money order made payable to the "U.S. Department of State." The execution fee charged by the acceptance facility must be paid separately. For those 16 and older, the application fee is $130. It's $100 if the applicant is younger than 16. Execution fees run $35 regardless of age. 

Receive passport . You may receive your passport and proof of identity in two separate packages. If you're also applying for a passport card, that may arrive in another package. Standard processing times are six to nine weeks, while expedited processing takes three to five weeks.

If you're getting a Type P passport for your child, both parents must attend the application appointment. Otherwise, the parent unable to attend must provide a notarized statement of consent to the issuance of the passport.

When do passports expire?

The expiration date of your passport depends on what type of passport you have. For example, blue Type P passports for adults are good for ten years from the date of issue, whereas Type P passports issued for children under 16 expire after five years.

The U.S. Department of State may revoke your passport earlier if you owe money to the U.S. government, have a history of lost or stolen passports, or cannot provide the required documentation.

Special issuance passports have different expiration dates based on which type you have. However, all special issuance passports have a maximum duration of five years.

Can I renew my passport?

Yes, a Type P passport for an adult can be renewed if you apply when it is still valid. Passports for children under 16 expire five years after issuance and cannot be renewed.

Do I need to update Global Entry when I get a new passport?

Global Entry is a membership program that expedites your entry into the U.S. when returning from international travel. Your membership is based on your current passport. When you get a new passport, you must log into your Global Entry account and update your passport information.

Passport Type P recapped

Whether you have an international trip already planned or are considering booking one, now is the time to get your passport. While it may sound ominous, applying for a Type P passport means getting a personal passport for international travel. 

The process is relatively simple and the fees are reasonable given that adult passports are good for ten years. However, it takes around two months to get your passport back, so you should apply now to avoid paying extra fees to expedite your passport.

Standard processing takes six to nine weeks to get a U.S. Type P passport. You’ll pay an extra $60 for expedited processing of three to five weeks. Additionally, applicants can pay $19.53 for faster return shipping of one to two days.

When applying for your passport, you’ll also have the option to request a passport card. Passport cards are primarily used when crossing the border into Canada or Mexico. A passport ID card is available for $30 for adults and $15 for children.

You can get a passport photo at various businesses and online stores. Companies that offer passport photos include drugstores, photoshops and passport acceptance facilities. You may also use the pictures from a photo booth or your camera if they meet the application criteria.

It is recommended that travelers get a Type P passport, even if they have a special-issued passport. Other passports have shorter lifespans than the ten years for a Type P passport. Additionally, the other types can only be used for official purposes. Therefore, you'll need a Type P passport for travel and personal use.

Passport colors make it easy for customs officials to determine which country you’re from and what type of passport you have. In the U.S., most travelers have a blue Type P passport. However, government officials, military personnel, and contractors on official business have different passport colors.

Form I-131 Travel Application Guide

What is the form i-131 travel application.

Form I-131 is a travel application. This travel document often is used by green card holders.

You can use it to apply for a re-entry permit, refugee travel document or advance parole travel document.

  • A Re-entry permit enables a lawful permanent resident or conditional permanent resident (Green Card Holders qualify for both of these categories) to apply to be admitted into the United States, after returning from travel abroad, without the need to obtain a returning resident visa from a U.S. Embassy or U.S. Consulate.
  • Individuals who hold asylee or refugee status and are not lawful permanent residents must have a Refugee Travel Document to return to the United States after travel abroad, unless they possess an Advance Parole Document.
  • You should apply for a Refugee Travel Document BEFORE you leave the United States.
  • This document can authorize you to appear at a port of entry to seek parole into the United States. However, someone who has been “paroled” has not been permanently admitted to the United States and remains an “applicant for admission” even while paroled.
  • Although the document may be accepted by a transportation company instead of a visa as permission to travel to the United States, an Advance Parole Document cannot replace a required passport. Most Advance Parole Documents are issued for multiple entries; however; some are issued for single entries.

What supporting documents do I attach to Form I-131?

You will need the following documents in order to fill out and submit I-131:

  • Your application with the filing fee.
  • These include: your current Employment Authorization Document, if available; a valid government-issued driver’s license; passport identity page; Form I-551, Permanent Resident Card; or any other official identity document.
  • Form I-94 Arrival-Departure Record is not acceptable as a photo identity document.

  • If you have not yet received your Form I-551, a copy of the biographic pages of your passport and a copy of the visa page showing your initial admission as a lawful permanent resident, or other evidence that you are a lawful permanent resident
  • A copy of the Form I-797, Notice of Action, approval notice of an application for replacement of your Form I-551 or temporary evidence of lawful permanent resident status.

Additional Documentation Required for Refugee Travel Document Application:

  • A copy of the document issued to you by USCIS showing your refugee or asylee status and the expiration date of this status.

Additional Documentation Required for Individuals Currently In the U.S.:

What is the processing time for Form I-131?

USCIS does not specify an average processing time for review and acceptance of Form I-131. However, USCIS processes forms in the order in which they are filed, so the sooner you submit your form, the faster it’ll be approved.

What is the Form I-131 mailing address?

You may submit Form I-131 by mail or online to USCIS. The direct filing addresses differ based on the type of travel document for which you are applying and immigration status you hold. You can find direct filing addresses on the USCIS website . For online applications, information about where to send your supporting documentation is provided when you submit your application electronically. How long does my travel authorization last as granted through Form 1-131?

Travel authorization lasts for different periods of time for the following documents:

  • Typically, a Reentry Permit issued to a lawful permanent resident is valid for 2 years from the date of issuance. It may not be extended.
  • A Refugee Travel Document is valid for 1 year. It may not be extended.
  • An Advance Parole Travel Document is valid for up to 1 year. Individuals may be granted a multiple entry or a single entry document.

What is the Form I-131 filing fee? Do I qualify for a fee waiver?

The Form I-131 filing fee ranges from $105 to $575 depending on your age and type of travel application you are requesting. Biometric service appointments are required in all cases and cost either nothing or $85 depending again on your age and type of travel application.  You do not need to pay a fee to file Form I-131 under the following conditions:

  • You are filing Form I-131 Application Type B or D.
  • You filed a Form I-485 with a fee on or after July 30, 2007.
  • Your Form I-485 is still pending.

You may qualify for a fee waiver under 8 CFR 103.7(c). If you are eligible for a fee waiver, complete and submit Form I-912 (Request for Fee Waiver) with any required evidence of your inability to pay the filing fee with this application. What if my documentation is in a language other than English?

Any document containing foreign language must be accompanied by a full English language translation which the translator has certified as complete and accurate. What do I do after I fill out I-131?

After processing your application for a Reentry Permit, USCIS will inform you in writing when to go to your local Application Support Center (ASC) for your biometrics services appointment. This appointment is to gather physical data by which a person can be uniquely identified. Everything You Need To Know About TPS Travel Authorization and How To Apply for It

Temporary Protected Status (TPS) is a temporary immigration status granted to people in the U.S. who come from certain countries they can’t return to. If you have TPS or have applied for TPS and you want to travel outside of the United States, you need to apply for travel authorization. Getting travel authorization allows you to return to the U.S. after leaving without having your immigration status revoked. Applying for travel authorization can take up to five months, so it’s important to plan ahead.

What Is TPS? 

Temporary Protected Status (TPS) is a temporary immigration designation. It allows individuals to work and live in the United States regardless of their immigration status. But this special status only applies when it would be unsafe for them to return to their home country. With TPS, a person doesn’t have to worry about getting detained or deported even if they overstay an immigrant visa or are an undocumented immigrant. 

Only those who have come from countries that qualify for TPS are eligible to receive it. There are currently 15 designated countries that have Temporary Protected Status, including:

Afghanistan

Burma (Myanmar)

El Salvador

South Sudan

This list of Temporary Protected Status countries is subject to change. To confirm the current countries on the list, visit the U.S. Citizenship and Immigration Services’ (USCIS) Temporary Protected Status website .

How Does a Country Receive Protected Status? 

The Secretary of the Department of Homeland Security (DHS) can designate a country for TPS if certain temporary conditions make it difficult and/or dangerous for individuals from that country to return. These conditions include:

An ongoing armed conflict, like civil war; 

A natural disaster, such as a disease outbreak or earthquake; or

Another type of temporary and extraordinary condition that makes it dangerous for someone to return home.

In addition to staying in the United States without risk of removal, beneficiaries of TPS are also eligible to apply for work authorization , like receiving a work permit or Employment Authorization Document (EAD).

As beneficial as TPS is, it has a few limitations. Unlike those who receive asylum status , TPS recipients don’t have a pathway to lawful permanent residency with an adjustment of status.

Also, if you have TPS, you can’t automatically return to the United States if you leave. You can travel to and from the United States, but you first need to apply for travel authorization. This is called Advance Parole.

What Is Advance Parole? 

Despite its name, Advance Parole has nothing to do with the criminal justice system. Rather, it’s a type of travel authorization that allows certain immigrants to return to the United States after traveling abroad. Without Advance Parole, immigrants who leave the United States while their immigration application or status is still pending may:

Have their immigration status revoked

Have any pending applications denied

Be barred from re-entry to the United States

Generally speaking, if someone is eligible for TPS, they’re also eligible for Advance Parole or a TPS travel authorization document. This means if you apply for TPS, you can apply for Advance Parole at the same time. In other words, you don’t have to wait until your TPS application is approved before applying for Advance Parole.

How Can Someone With TPS Apply for Travel Authorization? 

You can get permission to travel through either Advance Parole or TPS travel authorization. Either method requires you to complete Form I-131 . It costs $575 to file this form, and the USCIS normally takes about three months to process it.

Applicants most often submit Form I-131 to the USCIS by mail. The address you mail your completed form to depends on who you are and what other immigration relief or benefits you’re requesting. 

For example, if you’re filing Form I-131 along with Form I-821 (the form you use to apply for TPS), you’ll send your Form I-131 to the address assigned to your country. If your Form I-821 has already been approved or you’re requesting Advance Parole with Form I-821 that’s pending approval, then you’ll send your Form I-131 to one of two addresses. If using the U.S. Postal Service (USPS), you’ll send it to:

When completing Form I-131, you don’t need to give a reason for your request if you’re already on TPS and applying for Advance Parole. However, you do need to give a reason if you have a different immigration status, such as DACA or a green card.

How To Get Updates on the Status of Your Travel Authorization Request

If you want to receive progress updates via email or text notifications, you can submit Form G-1145 along with your I-131 application. The USCIS will send you an e-Notification within one day of accepting your application. This e-Notification also has a receipt number that you can use to get further application status updates as it’s processed.

Tips for Filling Out Form 1-131

To ensure the proper and efficient processing of your Form I-131 application, there are several tips to keep in mind. One of the biggest is to make sure you sign all the necessary places. 

Another important tip is to complete the form on a computer, if at all possible. This ensures you’re using the correct version of the form and allows you to easily correct any mistakes before printing out your completed form and mailing it off.

If you make a mistake on a paper form, you’ll have to start all over. This is because USCIS’s electronic scanners can’t process forms containing portions covered up with correction tape or fluid. The USCIS has a form filing tips page with more advice on completing its forms.

What Limitations Are There for Someone With TPS Traveling on Advance Parole?

If you have TPS or are applying for TPS, you shouldn’t travel outside the United States unless you first receive travel authorization. If you don’t have travel authorization, you may be unable to reenter the U.S.

In certain situations, it could take more than a year to approve your travel authorization. So the moment you know you’ll need to go overseas or think there’s a chance you may have to, it’s best to begin the travel authorization application process. If you want to have a rough idea of how long the USCIS might take to process your Form I-131, you can use the USCIS’s processing times online tool .

Another limitation is the length of time you can be outside the United States. The exact length of time can vary, but in most cases, the maximum amount of time you can expect to stay out of the United States and still return is one year. You may be able to extend this time by applying for a second Advance Parole while traveling with an approved Advance Parole that’s still valid. Just make sure you return to the United States before your designated period of Advance Parole expires.

Finally, if your TPS application is pending and you leave the country, you may miss important notifications about your application. It might also be difficult to schedule appointments like a biometrics appointment .

What Are Travel Documents?

A  travel document  is a form of identification that governments give to citizens or visitors so they can cross international borders. The U.S. government issues many different types of travel documents. The type of travel document you need depends on your immigration status and the purpose of your trip.

Travel documents are essentially your permits for world travel. Without the necessary ID, your venture abroad can become a nightmare. You always want to ensure you are carrying the correct travel documents pertaining to your specific trip to avoid disastrous consequences.

Types of Travel Documents

The most basic forms of travel documents are passports, passport cards, and arrival/departure records. These required documents allow U.S. citizens to travel abroad and re-enter the country legally upon return. Arrival/Departure records are used for non-citizens entering the country temporarily.

The U.S. Department of State (DOS) gives passports to U.S. citizens. A U.S. passport lets you reenter the U.S. after traveling abroad. U.S. passports act as identification and proof of U.S. citizenship. They are accepted as valid forms of identification in most countries.

Passport Cards

A passport card lets U.S. citizens travel to Canada, Mexico, the Caribbean, and Bermuda at land border crossings or seaports of entry. The DOS introduced passport cards in the summer of 2008 as a cheaper alternative to traditional passports. Any U.S. citizen can apply for a passport card. They are the size of a traditional driver’s license or credit card.

Form I-94 and Arrival/Departure Records

Form I-94, Arrival-Departure Record, is used to record when and where foreign citizens enter and exit the U.S. The form is for people who are visiting the U.S. temporarily and aren’t U.S. citizens or permanent residents (green card holders). Form I-94 documents the date the traveler entered the country and the date the traveler is required to leave.

As of 2013, Form I-94s are created electronically by the U.S. Customs and Border Protection (CBP) and are not given to travelers. If a traveler wants a copy of their Form I-94, they can get one through the  CBP Arrival/Departure Record page .

Citizens of a foreign country usually need a  visa  to travel in the U.S. You can apply for a U.S. visa from a U.S. embassy or consulate in the country where you live. The type of visa you would need depends on why you want to travel to the U.S.

Once you are approved for a visa, the consular officer at the U.S. embassy or consulate will place a visa into your passport. A visa is usually a stamp or loose piece of paper that shows the purpose of your travel and how long your visa is valid. Your visa validity is shown with an “expiration date”—you cannot enter the U.S. after this date. 

At your U.S. port of entry, the Department of Homeland Security will determine the length of time you are allowed to stay in the U.S. They will enter your “departure date” on your Form I-94. This is the date when you are required to leave the U.S. It is the date when your immigration status expires.

Travel Documents Under Special Circumstances

The U.S. Citizenship and Immigration Services (USCIS) issues three types of travel documents for special circumstances. These travel documents allow people to reenter the country without getting a visa. However, a person might need a passport in addition to a travel document in order to reenter the U.S. 

You can file Form I-131, Application for Travel Document, to apply for:

  • An advance parole document
  • A refugee travel document
  • A reentry permit

People who were in the U.S. illegally might not be allowed to reenter the U.S. even if they have a travel document. People who are classified as asylees and applied for asylum on or after April 1, 1997, can lose their asylum status if they return to the country that they sought asylum from.

Advance Parole

An advance parole document allows people who are in the process of adjusting their status, refugees, and asylum seekers who are applying for an immigrant visa to reenter the U.S. These people could be prevented from reentering the U.S. if they didn’t get advance parole before they left. Also, their applications could be denied.

Airlines can accept an advance parole document instead of a visa, but people with an advance parole document will still need a passport to reenter the U.S. You must apply for and receive advance parole before leaving the U.S. To apply for advance parole, file Form I-131.

Adjustment of status applicants might be eligible for a special card that shows they can travel and work. Eligible people can receive this card when they file  Form I-765, Application for Employment Authorization , and Form I-131 at the same time (concurrently). You can file them with your Form I-485, Application to Register Permanent Residence or Adjust Status, or after.

Advance parole status doesn’t guarantee that you will be allowed to reenter the U.S. The decision is left to the CBP officials who inspect you at your U.S. port of entry.

Refugee Travel Documents

The  USCIS  gives refugee travel documents to people who are classified as refugees or asylees or to green card holders who have refugee or asylee status.

You must have a refugee travel document to return to the U.S. if you hold refugee or asylee status and are not a permanent resident. Your family members who are classified as derivative asylees or refugees will also need refugee travel documents to reenter the U.S. 

Failing to get a refugee travel document before leaving the U.S. could cause a person to be denied reentry into or deported from the U.S.

Reentry Permits

A reentry permit allows a permanent resident or conditional resident to apply for reentry after they were outside of the U.S. for one year or more. People who get a reentry permit don’t have to apply for a returning resident visa from a U.S. embassy or consulate.

Emergency Travel

The USCIS might process an application for a travel document faster in the case of an emergency. The USCIS considers the following situations to be emergencies:

  • Not leaving could cause severe financial loss to you or the company you work for.
  • You’re in a life-threatening situation.
  • You need to leave the country because of a humanitarian situation, such as a natural catastrophe or other extreme situation abroad that requires your assistance.
  • A nonprofit organization has requested that you leave the U.S. to participate in a cultural or social program abroad that’s in the U.S.’s interest.
  • The U.S. government has requested you leave the country to participate in a situation abroad that concerns the U.S.’s interests. (This request must come from an official U.S. government agency and say that a delay would harm the U.S. government.)
  • USCIS committed an error with your paperwork.
  • Your departure from the country is in the interest of the USCIS.

Business trips, weddings, holiday parties, and other planned events would usually not be considered emergency situations.

An award of injunctive relief shall be stayed during any such appeal. The members of the three-arbitrator panel will be selected according to AAA rules. The three-arbitrator panel will issue its decision within one hundred and twenty (120) days of the date of the appealing party’s notice of appeal. The decision of the three-arbitrator panel shall be final and binding, subject to any right of judicial review that exists under the FAA.
