Liquidity Wines, Oliver BC.

Dubbed the Wine Capital of Canada, Oliver BC is a great place to visit for anyone interested in sampling wine in a truly stunning location or enjoying outdoor activities. Located in the Okanagan Valley of the Thompson Okanagan region, right in between Penticton and Osoyoos, Oliver is home to some of Canada’s hottest weather, several award-winning wineries, great restaurants, and outdoor adventure.

This small city is surrounded by fruit orchards, fruit stands, beautiful vineyards and wineries, farmland, and the Sonora Desert, Canada’s only desert. While wine lovers will rejoice with the many wineries in the area, outdoor enthusiasts will also get their fix thanks to the array of trails for both hiking and biking. In addition, there are opportunities for fishing, golfing, and other activities as well.

In this Oliver BC travel guide, we’ll fill you in on all the best things to do in Oliver, British Columbia .

Visit a Winery and Do Some Wine-Tasting

Since Oliver is known as Canada’s Wine Capital, we figured we’d start this list of things to do in Oliver BC with wine tasting, wineries, and vineyards. The grapes grown around the Oliver area are said to be of very high quality, thanks in part to the fertile soil and the amount of sunshine that the region gets.

Wine also tends to taste better at the winery in which it is made (at least in our opinion) and Oliver offers many different wineries that offer wine tasting as well as beautiful views. Whether you’re into White, Red, Rosé, or even the occasional Ice wine, you’ll find something you enjoy.

Plus, there’s also a variety of tours you can enjoy, which not only gets you an in-depth experience into how the wines are made but also includes transportation!

Some of the best tours include:

Osoyoos & Oliver Sip Disturber Half-Day Wine Tour : This is a half-day wine tour that is guaranteed to be a sip-disturbing good time! This tour visits 4 award-winning vineyards on the fabulous Osoyoos/Oliver wine trail. Enjoy worry-free pickup and drop-off at your Osoyoos or Oliver accommodation. Click here to check availability and reviews .

Oliver & Osoyoos Wine Tour Full Day : Tour some of British Columbia’s finest vineyards in comfort on this private day trip. You’ll be taken to five wineries in the Oliver and Osoyoos wine country, recognized as the province’s first wine sub-region. Sit back and relax as you’re driven around. You’ll get a chance to taste the red wines the region is famous for at each stop, particularly Merlot, Cabernet Sauvignon, Cabernet Franc, and Syrah. Click here to check availability and reviews .

While visiting the Okanagan, don’t forget to visit Kelowna as well! For more, check out our guide to the best things to do in Kelowna .

Oliver BC's District Wine Village in the Winter.

Visit the District Wine Village

One of the newest attractions in Oliver BC is the District Wine Village , the first of its kind in Canada, offering a fun and easy way to sample wines from many different wineries in one place. Designed in a circular pattern, visitors will find 13 different wineries, one brewery, one distillery, a restaurant, and entertainment all in one place. Even Matthew Good has performed here and combined with the stunning mountain scenery, it would be a magical place to sample wine and enjoy live music.

What makes the District Wine Village extra special though is that each of the wineries actually produces the wine on-site. Some of them only produce it here whereas others, such as Nk’Mip Cellars, produce wine here and in their main winery down in Osoyoos. However, as part of the agreement for being a part of the District Wine Village, the wineries, distillers, and breweries all have to actually make their products here. How cool is that? You can sample all sorts of wine while enjoying live entertainment!

The Wineries include JoiRyde Winery, One Faith Vineyards, Wapiti Cellars, Vintners Cove Winery, Uppercase Winery, Gneiss Wines, Winemaker’s Cut, Nk’Mip Cellars, Eau Vivre Winery, Silhouette, Valley Commons, Time Family of Wines.

This site is open year-round but the entertainment portion is during the busier warmer months.

Wine tasting in Oliver, British Columbia.

Pick Some Fresh Local Fruit at an Orchard

Although Oliver BC is famous for growing grapes and making wine, they’re also well known for growing delicious fruit, such as grapes, apples, plums, cherries, pears and peaches. Even Haskap berries are starting to make their way here. Orchards can be seen all over the region, but best of all, there are many fruits stands around Oliver where you can buy all the fruit your heart, and tastebuds, desire.

Vaseux Lake Bird Sanctuary in the winter.

Visit the Vaseux Lake Bird Sanctuary

Whether you’re interested in bird watching or just enjoying some really stunning scenery, Vaseux Lake Bird Sanctuary is a great place to visit. Located off Highway 97, just 10 kilometres north of Oliver, this lovely marshland is home to all sorts of birds as well as other animals. The lake itself can also be used for non-motorized activities such as paddle boarding and kayaking.

The Vaseux Wildlife Centre also has a 300-metre boardwalk along with viewing platforms that makes it easy to walk out into the marshland and spot birds. There’s even a tower at the end for those wanting to get a little higher. We visited during the winter months and saw two bald eagles.

There is parking and toilets on-site. However, there are signs warning of poison ivy, so don’t be using the leaves as toilet paper.

Want to go on a bird-watching tour?

Half-Day Birdwatching in the South Okanagan : Discover the unique species of the South Okanagan and Similkameen Valley on a private, half-day bird-watching tour. Accompanied by your guide, view birds in a variety of habitats, including the wetlands and fir forests. Stay alert for regional highlights as well as rare species, as you’re guided through bird-watching hotspots. Take advantage of your guide’s knowledge, and find more than you would alone on this tour through a birder’s paradise. Click here to check availability and reviews .

Bird watching is popular in Oliver BC.

Visit One of the Mountain Lakes

If you love small mountain lakes or just want to get away from the “town” and deeper into nature, there are actually a few beautiful lakes you can visit.

Madden Lake and Ripley Lake Recreation Sites

Located just 11 kilometres from Oliver, both Madden Lake and Ripley Lake are nice little mountain lakes that can be reached by car or by mountain bike. These lakes can be accessed via Fairview Road, which becomes a dusty dirt road after about 4.5 kilometres. You’ll then continue down the dusty road until you see signs for the lake. Watch out for wildlife and recreation vehicles. Both sites offer a boat launch, tables, toilets, and camping opportunities.

Burnell Lake Recreation Area

Even closer to Oliver and also found by taking Highway 97/Fairville Road Junction, Burnell Lake is another small mountain lake and recreation area. It’s also accessed via a 4-kilometre bumpy Forest Service Road. You can either drive here or ride your mountain bike and there’s an open site with space for a few people to camp next to the lake. This site is popular with fishermen and has a boat launch as well. Keep in mind that the region around Oliver has rattlesnakes, so just be mindful.

Mahoney Lake Recreation Site

Just a little further away, about 22 kilometres, Mahoney Lake Recreation Site offers really beautiful scenery. From Oliver BC, take Highway 97 North to Secrest Hill Road, west onto Secrest Hill Road, turn north onto Willowbrook Road and proceed north to White Lake Biodiversity Ranch kiosk. From here, you can park your vehicle and follow the trail to the overlook of White Lake and the Dominion Radio Astrophysical Observatory.

Food In Oliver Bc

Eat Delicious Food

Another great thing about visiting Oliver British Columbia is that there’s no shortage of really, really good food. Whether you’re looking for authentic Mexican food from a food truck or fine dining with views of the valley, Oliver has something for everyone. We’ve always had a great time dining at the Miradoro Restaurant at Tinhorn Creek Winery, which offers fine dining and some of the best views in the entire Okanagan region. However, it certainly doesn’t stop there. Other crowd favourites are Terrafina at Hester Creek, the Sonora Room, Backyard Farm, Masala Bistro at Kismet Winery, and more.

Hike McIntyre Bluff

Known as Oliver BC’s signature hike, McIntyre Bluff is a must for anyone looking for a scenic hike. In fact, the iconic McIntyre Bluff (also known as Indian Head) can be found on many postcards, websites, and even the book covers of South Okanagan travel guides.

The beautiful and striking cliff rises 300 metres above the road and nearby Vaseux Lake. In fact, while you’re in the area, visit the Vaseux Lake Bird Sanctuary (mentioned above). Get a taste of Canada’s only desert on this moderate 10 km return trip. The elevation gain is only 322 m with some steep sections along the way, but the views are worth it. There is no shade, so make sure you prepare for the sunny weather and keep your eye out for wildlife, including rattlesnakes.

Please note: Different websites mention different lengths. The 10 km version typically starts near Covert Farms but we’ve heard that the trailhead is closed. Another option is to start from the McAlpine Bridge, but this turns it into an 18-km trek. However, the hike still takes roughly 5 hours. Perhaps stop into the visitor centre to make sure.

Hike Sandy Hill to Explore Oliver Mountain

If you’re looking for a decent short hike that reaches a summit overlooking Oliver, this is a great option. This 4-kilometre hike starts at the trailhead at the base of Oliver Mountain. The trail will take you up to the radio tower, reaching an elevation change of 400 metres and eventually reaching the summit at 720 metres.

Although this isn’t a very difficult hike, it can be hot and there is no shade, so make sure you prepare for that. People have also seen rattlesnakes on this trail, so just be alert. You will be rewarded with amazing views all around.

Wine Tours Oliver BC

Hike Stamp Mill Golden Mail

If you’re looking for an easier hike that is also very beautiful, consider Stamp Mill Golden Mail, a moderate 2.5 km hiking trail that begins at the scenic Tinhorn Creek Winery. This is also a great place to grab lunch or dinner, but either way, you can park at the shop and get a trail map. From the parking area, the trail goes through part of the Thorn Creek vineyards, leading uphill until eventually, the trail levels out and reaches a plateau. If you want to extend the hike, the trail that goes right is part of a 10 km trail that leads you north towards the old Fairview Townsite.

Play Golf at Fairview Mountain Golf Club

Those into golfing will definitely want to visit Fairview Mountain Gold Club . Not only can you whisk away your nights sampling wine, but you can also spend your days whacking golf balls while surrounded by truly stunning scenery. Ranked as #47 among the best public golf courses in Canada, not to mention being named a top 100 course in Canada by Canadian Golf Hall of Fame member and TSN golf analyst Bob Weeks, you’ll find remarkable landscapes, more than 200 feet of elevation, and a layout that can be played by all levels of golfer.

In addition to the gold course itself, they also offer an incredible opportunity to play 18 holes at your choice of 60 different golf courses from around the world via their GC Hawk Simulator. This state-of-the-art machine offers advanced tracking technologies, giving you the most realistic ball-tracking data via the overhead camera. It even knows whether you’re right or left-handed, as well as ball speed, launch angle, direction, and yardage. You can even practice playing in the “wind”!

In addition, you can practice hitting into netted cages, pitching into targeted nets, and perfecting your short game in their 3200-square-foot indoor circuit.

Hike and Bike Along the Okanagan River Channel

Another lovely spot to go for a hike or bike is along the Okanagan River Channel, an 18 km mostly paved trail that goes through Oliver and south towards Osoyoos. If you need a spot to park your vehicle, the Oliver Visitor’s Centre is a great option and you can even grab some maps and ask any questions you might have before you embark on your trip.

If you want to do a loop-style ride, come back via Black Sage Road and visit some wineries along the way.

Mexican food in Oliver, British Columbia.

Experience Mexico in Oliver

For those that don’t know, my wife is from Mexico, and during our first visit to Oliver in the very hot month of August, we were reminded of Mexico quite a bit. Not only does the scenery resemble the desert regions of Mexico but there’s also authentic Mexican cuisine thanks in part to the hundreds of Mexican workers that come here each year to help with the wineries.

There are actually three great spots to get Mexican food, including TacoRiendo, Casa Luna, and the El Sabor de Marina Food Truck, pictured above. However, the food truck is seasonal, open between April and October.

Visit Alpacas at Sunkeya Alpaca Farm

If you’re looking for a smile, check out the Sunkeya Alpaca Farm to see those fluffy, awkwardly shaped Alpacas just waiting to gawk at you with those large, glossy, lash-framed eyes. You’ll meet twelve alpacas including young ones and farm tours are only $5. However, you must book ahead. You’ll also get to tour inside and see how fleece is processed and spun before shopping for socks, toques, scarves, and many other goods.

Baldy Mountain Resort is one of the best things to do in Osoyoos in winter.

Spend the Winter at Baldy Mountain Resort

Despite being known as one of the warmest places in Canada, Oliver BC and the South Okanagan are also home to some amazing ski resorts! We were incredibly surprised as to how much powder they get in the mountains but it’s pretty remarkable that you can ski during the day and visit wineries after.

Baldy Mountain Resort is the third-highest ski resort in BC and receives approximately 35 feet of dry, light snow each year. With Lifts taking you up to 2,123 metres in elevation, both skiers and snowboarders will find this to be a winter paradise.

The resort offers a number of runs for both beginners and advanced skiers and riders and for those not interested in skiing, they have a variety of snowshoe trails as well. You can even rent skis, snowshoes, and snowboards at the resort.

Go Cross-Country Skiing or Snowshoeing

If you’d rather not ski downhill, there are also options for cross-country skiing and snowshoeing. Perhaps the best place to do these activities is at the McKinney Nordic Ski Club , which is located on the same road that takes you to Baldy Mountain Resort. This locally-operated, non-profit cross-country ski and snowshoe organization, manages nine kilometres of groomed cross-country ski trails for novice, intermediate and advanced skiers, and also five kilometres of marked snowshoe trails.

These trails are maintained by club volunteers, so it’s always appreciated if you purchase an annual membership or contribute a day-use donation.

Craft breweries in Oliver British Columbia.

Drink Some Beer

While wine is certainly the “name of the game” in Oliver BC, there’s also a great option for beer lovers as well. Located in the basement of the Old Fire Hall, which is perhaps the best landmark in Oliver, Firehall Brewery is popular with locals and tourists alike. Since purchasing all the equipment from a local bootlegger, this family-run brewery has been pumping out unfiltered, unpasteurized, & uncompromised artisan beers for you to enjoy, including Lagers, Witbiers, Blondes, Pale Ales, Stouts, and more!

Since this brewery is located in the heart of downtown, don’t forget to check out Main Street, the Visitor Centre in the Old Railway Station, the Oliver Movie Theatre, and more.

Sorry, but this is not the only desert in Canada. Manitoba and Saskatchewan both have substantial desert areas well worth checking out.

I think you’re referring to the sand dunes, but that’s not a desert. Even the Okanagan is not a true desert in many ways but its the only one Canada has: https://www.thestar.com/life/travel/2009/06/24/osoyoos_canadas_lone_desert.html

What a wonderful comprehensive list of things to do around Oliver. We love Oliver and are presently working on turning a church into an apartment building there. I’m sharing this in an investment forum.

About Oliver BC

In the spring of 2020, I chose the small town of Oliver to be my temporary home for when I’m not on the road.

Oliver is nestled between forested mountains and is home to farming, orchards, and over 35 wineries. This South Okanagan town with a population under 5000 stretches along busy Highway 97 and offers all the services typical for a small BC town. The dry, mild climate attracts retirees from all over Canada looking for small-town living as well as the many snowbirds spending the winter during the US border closure.

What I love about Oliver the most is the extensive hiking and biking trail network and the beautiful mountain lakes only a bike ride away.

Delicious East Indian to Greek, Mediterranean Mexican, and Asian food all can be found in Oliver. Stop for a quick lunch at a food truck or treat yourself to a fancy winery restaurant overlooking the vineyards, Oliver has it all. And don’t miss a visit to the famous Firehall Brewery.

How to get to Oliver, BC

Oliver is located in the south end of British Columbia’s Okanagan Valley along Highway 97, 21 km north of the U.S. border, and 20 km from the town of Osoyoos. This is a major north-south transportation link that connects California to Alaska.

Penticton Regional Airport (YYF) is 40 km north of Oliver and offers daily flights to Vancouver International Airport and Calgary International Airport.

A Step Back in Time

Aboriginal people occupied the South Okanagan for thousands of years. Traditionally they moved throughout their large territory to follow seasonal food resources.

The first people from the outside world arrived in the 19th century when fur traders came to the area searching for better trade routes.

In the 1880s, free gold-bearing quartz was found at Camp McKinney which became a busy gold mine, attracting all kinds of characters from miners and merchants to a few outlaws. At Fairview. (just west of Oliver) miners found gold and fueled the growth of a boomtown. The boom lasted only a few years and sadly, so did Fairview. Today, only a few heritage markers remind us of Fairrview’s golden era.

Established between 1918 and 1921 as a settlement for unemployed veterans of the First World War, a gravity-fed canal was built to provide irrigation to this dry Sonora desert region, which transformed the desert region into lush orchards and farms.

Today, Oliver is a thriving community with agriculture, orchards, and vineyards being the prime industry.

My 9 favourite Hiking and Cycling Trails in Oliver BC

Sign up for AllTrails for Free to find tails near Oliver and trail information.

For hiking and cycling enthusiasts, Oliver and the South Okanagan region are full of opportunities. I never considered British Columbia to be bike-friendly until I moved to Oliver.

I left my bike collection behind when I sold my ranch in the North Okanagan. Just after the Covid era started I visited a bike store in Pentiction to check out mountain bikes. What I ended up buying was a TREK Mountain eBike and it was an excellent decision. Whenever I’m back in Oliver, I head into the hills or ride the trails along the Okanagan River.

Black Sage Road Oliver BC

1. Sandy Hill Hike

This is a great hike to build up your fitness level with steep and sandy hills to get up to. Proper footwear is a must, and don’t forget the water bottle. You will be rewarded with amazing views all around. Look for a nice spot to have your lunch while overlooking the whole valley!

Explore the South Okanagan three ways with nature, art and wine

Rebecca Bollwitt (aka Miss604)

Oliver, B.C. is home to more than 35 of B.C.’s wineries, the Black Sage Bench, the Golden Mile Bench - which has been recognized as a distinctive sub-Appalachian wine region - three lakes, thousands of bird species, indigenous history, and Nçaylintn - one of the province’s most distinctive rock formations.

Oliver has been proclaimed the Wine Capital of Canada while still maintaining its status as a true hidden gem, with internationally recognized winery restaurants alongside local events full of community spirit. To truly get a feel for this South Okanagan community, you need to experience Oliver three ways: through its nature, art, and wine.

Begin your #OkanaganExploring adventure by checking into Tourism Oliver's website.

Rhoda from the Oliver Visitor Centre points out some of the flora along the Bike & Hike Trail.

Start your adventure at Oliver ’s Visitor Centre, located in a historic CPR railway station alongside the Okanagan River. There, you can get trail maps, event listings, winery passport brochures, and more.

Pick up a book or learn about local history at the Oliver Archives just across the street from Town Hall.

Interested in heading to Oliver? Here's an itinerary to make your trip even better!

Nature in Oliver

Larry Shannon from the Oliver Archives describes the landscape: “When a person comes to Oliver  they’re going to see a prosperous town, they’ll be aware of the wine industry, they’ll see orchards, vineyards, valley bottom. They’ll see the grassy slopes on a hillside, coniferous forests going up to the grassland.”

Oliver BC

The Bike & Hike Trail in Oliver follows the Okanagan’s legendary Kettle Valley Rail Trail.

Starting at the Visitor Centre, you can hop onto the 18.8-km Hike & Bike Trail that follows an old CPR rail line beside the Okanagan River, starting out from Lions Park. Pedestrian bridges connect both sides of the trail where you’ll hear birds, spot some turtles, indigenous plant life, and get great views of the valley.

“ Oliver is booming but we still have that small-town hospitality,” Rhoda Brooks told me as we walked along the Hike & Bike Trail. Rhoda works in the Visitor Centre and believes that Oliver ’s nature is its biggest asset. “The hiking is so unique. There’s a juxtaposition of the orchards and the desert landscape, and the wildlife that make it like nowhere else.”

For more of a challenge, there are two trails that Rhoda recommends, both featured in detailed brochures found at the Visitor Centre.

The first is the Golden Mile Stamp Mill Trail , which starts out from the winery parking lot at Tinhorn Creek. Follow the dirt road straight up the vineyard as you walk by vineyard rows of Chardonnay, Petit Verdot, Kerner Pinot Gris, Sauvignon Blanc, Viognier, Muscat, Malbec, and Gewurztraminer. The trail will cut up the hillside, like the wine country version of Vancouver’s Grouse Grind, and you’ll reach a plateau along with the ruins of the old Stamp Mill. Bring a picnic and enjoy the valley views from this vantage point. (11 km return, elevation gain 200 m)

The second is Nçaylintn (Ny-lin-tin) Bluff Hiking Trail (formerly McIntyre Bluff). Start out from Covert Farms. This gradual climb will take you to the top of the South Okanagan’s most recognizable rock formation. Get a bird’s eye view of the valley below, more than 300 m down to the Okanagan River below, and the area’s three main lakes: Vaseux, Tuc-El-Nuit, and Gallagher Lake. (7 km return, elevation gain 265 m)

Art in Oliver

Art in Oliver BC

Artists Lorraine Horn and Katherine MacNeil use collage and paint to decorate their wine barrels for the Art Walk Auction.

You’ll find local art at most of Oliver ’s wineries, which perfectly complement the wine touring experience, but one of the best places to find a collection of paintings, mosaics, and collages is at Beyond Bliss Day Spa downtown. In fact, all along the main street there are corridors, shops, and retailers showcasing the works of artists like Marilyn Marsel, Marion Trimble, Sally Franks, Leza Macdonald, Linda Blaschek, Leann Parrent, Bev Alexander, Marlene Slater, Janice Goodman, Leza Macdonald, Sagebrushers president Sally Franks and more.

However, the best place to find a large number of artists all at once is at the Oliver Art Walk, which takes place every May. Artists like Sally Franks and Marion Trimble participated this year, along with local non-profits like CreateAbility and The Painted Chair.

Wineries donate barrels, artists and organizations paint the barrels with a theme or inspiration from that individual winery, and then the public can come view the finished works which are then auctioned off.

Marion Trimble toured me around and showed me her barrel, from Hester Creek, which is celebrating 50 years of their vines in her painting.

Used barrels that are normally sold have been generously donated by local wineries and after they are transformed by the artists, the opening bids start at $150 (with 70 percent to the artist and 30 percent to the Oliver  Community Arts Council).

You’ll want to follow the activities of the Oliver Sagebrushers, the local artist group for the latest shows, exhibits, and events along with the  Oliver  Community Arts Council.

Rust Wine Co’s rust-inspired art in their Golden Mile tasting room

Oliver ’s wine growing region spans from Road 22, off Okanagan’s Highway 97 to the south, and Nçaylintn Bluff at the north end. I stopped by Rust Wine Co., along the Golden Mile Bench, for a spot of lunch with Kane Morgan, assistant GM, and Rust’s internet-famous winery dog Kaya.

“Our main focus at the end of the day is hospitality,” Kane said while cutting up some steaks that he grilled out on the patio - a new offering that will be available to winery guests this summer. You’ll visit a gorgeous tasting room, complete with an art gallery featuring local paintings and photographs but feel like you’re visiting a pal who just happens to have an amazing panoramic view of the entire valley from his front porch. Oh, then there are the delicious wines like the winery’s Golden Mile Zinfandel or the 2016 rosé.

Across the valley on the Black Sage Bench, gorgeous purple and white blossoms line the driveway at Silver Sage, where you can bring your own picnic to enjoy with your wine in their gazebo. Pick up a wine passport so you don’t miss anything. Each winery is unique when it comes to terroir, location, views, and vintages, but they all offer warm and welcoming Oliver hospitality.

About The Oliver & Osoyoos Regions

The Oliver & Osoyoos regions (which are right next to each other) are 2 hours south of Kelowna.

If you’re coming from Kelowna it is a bit of a drive but definitely worth it.

The Oliver and Osoyoos region has around 24 wineries you can visit.

Because the climate here is hotter than Kelowna (it’s more of a desert climate) red grapes thrive in this region.

The wineries here are known for making big bold reds, as opposed to the more white dominating wineries in the rest of the Okanagan.

If you love a big bold red, you’ll definitely want to make the trip to try out some of the many amazing Oliver & Osoyoos wineries.

Now, onto the list of some of the best wineries in Oliver & Osoyoos!

Even though these two regions are right next to each other, I’ve divided them by region to make planning your visit and winery route easier!

The Best Wineries in Oliver

If you’re heading to Oliver & Osoyoos from the Kelowna and Penticton areas, you will first reach the region of Oliver.

Here are the best wineries in Oliver that you have to visit during your time in this region (in no particular order).

Bartier Bros. Vineyard & Winery

One of my all time favourite Oliver wineries is the beautiful Bartier Bros. Vineyard & Winery .

I'm passing through Oliver and Osoyoos tomorrow. I'm really intrigued by Road 13 it's so beautiful looking and I love the sound of the Oliver Twist winery. Thanks for sharing!

Hi Carolyn, I hope you enjoy your day in Oliver & Osoyoos! I definitely recommend both wineries, but especially make sure you visit Road 13 as I've heard its now under new ownership and they will be getting rid of the castle soon. So sad! You're lucky you get the chance to visit before that happens :)

British Columbia to recriminalize use of drugs in public spaces

Province says people who don't pose threat to public safety will not be charged for mere possession.

Playground swings are shown in front of a play structure.

Social Sharing

After weeks of troubling stories about problematic street drug use in hospitals, parks and at bus stops, the province of British Columbia announced plans to recriminalize the use of drugs in public places Friday — radically altering a pilot program aimed at addressing the toxic drug crisis.

In a statement, Premier David Eby insisted that his government is "caring and compassionate for those struggling with addiction," but that patience for disorder only goes so far.

"Keeping people safe is our highest priority," said Eby.

"We're taking action to make sure police have the tools they need to ensure safe and comfortable communities for everyone as we expand treatment options so people can stay alive and get better," he said.

With an election looming, Eby's NDP government has been bombarded with a string of headlines about concerns with decriminalization — a pilot program introduced in January 2023 allowed adult drug users in B.C. to carry up to 2.5 grams of drugs for personal use without facing criminal charges.

The program was possible through an exemption granted by Health Canada under the Controlled Drugs and Substances Act which allowed for open drug use in some public spaces.

  • Opposition alleges open drug use, dealing at Vancouver hospital
  • Scrutiny of B.C. drug decrim pilot program intensifies

Eby's political opponents have seized on concerns from hospital workers and patients about illegal drug use and trafficking in the hallways of hospitals .

And last week, Vancouver Police Deputy Chief Fiona Wilson testified at a House of Commons health committee hearing about the struggles police are having responding to public complaints involving disturbances related to public drug consumption.

B.C. recriminalizes drug use in public spaces

In a release, the province says it is "working with Health Canada to urgently change the decriminalization policy to stop drug use in public and has requested an amendment to its … exemption to exclude all public places."

"When police are called to a scene where illegal and dangerous drug use is taking place, they will have the ability to compel the person to leave the area, seize the drugs when necessary or arrest the person, if required," the province said in a statement.

"This change would not recriminalize drug possession in a private residence or place where someone is legally sheltering or at overdose prevention sites and drug checking locations."

B.C. Health Minister Adrian Dix said the province is also introducing specific measures aimed at curbing illicit drug use in health care facilities — including the prohibition of street drug possession or use.

"We are taking immediate action to make hospitals safer and ensuring policies are consistent and strictly enforced through additional security, public communication and staff supports," Dix said in a statement.

  • 8 years and 14,000 deaths later, B.C.'s drug emergency rages on

"The action plan launching today will improve how patients with addictions are supported while they need hospital care, while preventing others from being exposed to the secondhand effects of illicit drug use."

The province said it is working with police to come up with guidance to ensure that people who merely possess drugs are not arrested unless they're threatening public safety or causing a disturbance.

Vancouver Police Deputy Chief Fiona Wilson said at the announcement that decriminalization has to be part of a broader strategy to address the province's drug crisis.

"We've heard loud and clear from the front-line police officers who continue to see the unintended ramifications that unchecked public drug use has on the safety and well-being of neighbourhoods," she said.

"And the feedback has been unequivocal — public consumption is a significant issue that needs to be addressed and major changes are required."

14,000 lives lost

The decriminalization pilot was introduced in January 2023 and allows adult drug users in B.C. to carry up to 2.5 grams of opioids, cocaine, methamphetamine and ecstasy for personal use without facing criminal charges.

Relying on an exemption granted by Health Canada under the Controlled Drugs and Substances Act, it also allows for open drug use in some public spaces.

  • Backlash against drug decriminalization and safe supply 'terrifies' B.C.'s exiting chief coroner
  • B.C. top court upholds pause on law restricting public drug use

The pilot is part of a government response to the public health emergency declared eight years ago due to a rise in deaths from toxic, illicit drugs.

More than 14,000 people have died since the emergency was declared in 2016, largely due to the opioid fentanyl.

A white sign at a New West Naloxone training event that says "I love someone who uses drugs" but the love is represented by a purple heart.

By reducing stigma associated with drug use, officials say they hope to provide better access to lifesaving care along with a less deadly safe supply.

But it has come with criticism about a lack of guardrails.

On April 15, Vancouver Police Deputy Chief Fiona Wilson testified at a House of Commons health committee hearing about how the pilot is limiting police response to problematic public drug use, including inside hospitals and at bus stops.

"In the wake of decriminalization, there are many of those locations where we have absolutely no authority to address that problematic drug use, because the person appears to be in possession of less than 2.5 grams," Wilson said.

"So, if you have someone who is with their family at the beach, and there's a person next to them smoking crack cocaine, it's not a police matter."

Courts previously stopped legislation

Friday's announcement is the government's latest attempt at curbing public drug use.

Last October, it tabled  new legislation in an attempt to ban illegal drug use in many public places .

The bill would have banned the use of illicit drugs within six metres of all building entrances and bus stops; within 15 metres of playgrounds, spray and wading pools, and skate parks; and in parks, beaches and sports fields.

But in December, B.C. Supreme Court Chief Justice Christopher Hinkson  ordered the law paused until March 31, ruling it would likely result in more deaths , displacement and criminalization of people who use drugs.

"Irreparable harm will be caused if the act comes into force," Hinkson wrote in his ruling.

The provincial government appealed the ruling, but it was upheld by the B.C. Court of Appeal .

B.C.'s debate over drug decriminalization | Canada Tonight

Eby says he expects the changes to go through this time because he is asking them to come from Health Canada.

"The resolution of that court issue is potentially more than a year down the road and we cannot afford to wait. We need to act now," Eby said.

"I have talked to the prime minister about this. He assures me that the federal government will provide full support to ensure that police have the tools that they need."

Eby said it's possible the government could face another legal challenge in response to these changes, but he thinks the risk is low.

"In order for it to be successful, the court would have to find that the entire Controlled Drugs and Substances Act at the federal level was unconstitutional," he said.

Eby said criminalizing drug use costs lives and taxpayer money while not making the public safer, but "police do need the tools to address extraordinary circumstances where people are compromising public safety through their drug use."

Election looms

Vancouver Mayor Ken Sim said in a statement that he welcomed the change.

"Today's changes will make public drug use effectively illegal and provide the VPD with actual tools to maintain public safety. This change aligns with the critical work we have already undertaken with the federal and provincial governments to address open drug use in public areas, especially around playgrounds, splash pads, beaches, and sports fields."

The premier said the issue has been intensely politicized as the province heads into an election.

British Columbians go to the polls on Oct. 19.

Opposition B.C. United Leader Kevin Falcon and his critic for mental health and addiction Elenore Sturko issued a joint statement calling the government's move a "desperate attempt to salvage a failing policy."

"Instead of upholding their commitments to scrap the decriminalization pilot when it clearly wasn't meeting its goals, David Eby and the NDP have stubbornly persisted with this dangerous policy," the statement says.

"From its inception, the decriminalization experiment has failed to connect drug users with any necessary treatment or recovery services."

B.C. Conservative Leader John Rustad said in an interview that "decriminalization has been an utter failure in this province."

"This should have never happened in the province of British Columbia," he said.

In a statement posted online, B.C. Green Party Leader Sonia Furstenau expressed concerns about the increase in arrests that could be associated with the policy, writing, "Police discretion is especially likely to stigmatize Indigenous and racialized British Columbians."

"This issue is intrinsically linked to the housing and affordability crisis. Rolling back decriminalization isn't going to fix that. No jurisdiction in the world has arrested their way out of this problem, and we won't either."
