USCIS Increases Automatic Extension of Certain Employment Authorization Documents to Improve Access to Work Permits

WASHINGTON — Building on extensive modernization efforts that have streamlined and improved access to work permits for eligible noncitizens, USCIS today announced a  temporary final rule (TFR) to increase the automatic extension period for certain employment authorization documents (EADs) from up to 180 days to up to 540 days. This announcement follows improvements that have reduced processing times for EADs significantly over the past year.

The temporary measure announced today will prevent already work-authorized noncitizens from having their employment authorization and documentation lapse while waiting for USCIS to adjudicate their pending EAD renewal applications and better ensure continuity of operations for U.S. employers. This is the latest step by the Biden-Harris Administration to get work-authorized individuals into the workforce, supporting the economies where they live.

“Over the last year, the USCIS workforce reduced processing times for most EAD categories, supporting an overall goal to improve work access to eligible individuals.  However, we also received a record number of employment authorization applications, impacting our renewal mechanisms,” said USCIS Director Ur M. Jaddou. “Temporarily lengthening the existing automatic extension up to 540 days will avoid lapses in employment authorizations. At the same time, this rule provides DHS with an additional window to consider long-term solutions by soliciting public comments, and identifying new strategies to ensure those noncitizens eligible for employment authorization can maintain that benefit.”

This TFR aligns with an ongoing effort at USCIS to support employment authorized individuals’ access to work. USCIS has reduced EAD processing times overall and streamlined adjudication processing, including:

  • Reducing by half EAD processing times of individuals with pending green card applications from FY2021 to date,
  • Processing a record number of EAD applications in the past year, outpacing prior years,
  • Engaging with communities to educate work-eligible individuals who were not accessing the process and provide on-the-ground intake support of applications,
  • Reducing processing time for EADs for asylum applicants and certain parolees to less than or equal to 30-day median,
  • Extending EAD validity period for certain categories from 2 years to 5 years,
  • Streamlining the process for refugee EADs, and
  • Expanding online filing for EADs to asylum applications and parolees.

This temporary measure will apply to eligible applicants who timely and properly filed an EAD renewal application on or after Oct. 27, 2023, if the application is still pending on the date of publication in the Federal Register. The temporary final rule will also apply to eligible EAD renewal applicants who timely and properly file their Form I-765 application during a 540-day period that begins with the rule’s publication in the Federal Register.

Absent this measure, nearly 800,000 EAD renewal applicants – including those eligible for employment authorization as asylees or asylum applicants, Temporary Protected Status (TPS) applicants or recipients, and green card applicants – would be in danger of experiencing a lapse in their employment authorization, and approximately 60,000 to 80,000 employers would be negatively impacted as a result of such a lapse. EADs are generally valid for the length of the authorized parole period. This TFR does not extend the length of parole.

Since May 12, 2023 to March 13, 2024, DHS has removed or returned over 617,000 individuals, the vast majority of whom crossed the Southwest Border, including more than 97,000 individual family members. The majority of all individuals encountered at the southwest border over the past three years have been removed, returned, or expelled. Total removals and returns since mid-May exceed removals and returns in every full fiscal year since 2011.

The trains and stations of the Moscow Metro

The Moscow Metro is the third most intensive subway system in the world after Tokyo and Seoul subways. The first line was opened on May 15, 1935. Since 1955, the metro has the name of V.I. Lenin.

The system consists of 12 lines with a total length of 305.7 km. Forty four stations are recognized cultural heritage. The largest passenger traffic is in rush hours from 8:00 to 9:00 and from 18:00 to 19:00.

Cellular communication is available on most of the stations of the Moscow Metro. In March 2012, a free Wi-Fi appeared in the Circle Line train. The Moscow Metro is open to passengers from 5:20 to 01:00. The average interval between trains is 2.5 minutes.

The fare is paid by using contactless tickets and contactless smart cards, the passes to the stations are controlled by automatic turnstiles. Ticket offices and ticket vending machines can be found in station vestibules.

Jack Smith argues "not a single" Trump official has claimed he declared any records personal

Washington — Special counsel Jack Smith urged a federal judge to keep a presidential recordkeeping law out of instructions that would be provided to the jury in the classified documents case against former President Donald Trump , according to court documents filed by Smith's team late Tuesday. Prosecutors warned that including the law in the instructions risked jeopardizing the proceedings, and signaled they would appeal the judge's decision if she ruled against them.

Last month, U.S. District Court Judge Aileen Cannon , who is overseeing the case in Florida, asked Smith's and Trump's legal teams to file jury instructions based on two hypothetical scenarios: in one, the president has the authority under the Presidential Records Act (PRA) to categorize any records as personal. Under this scenario, Cannon wrote that "neither a court nor a jury" would have the ability to review the decision, a finding that could nullify much of the special counsel's case against Trump. 

In the other, the jury would be able to examine a record that had been retained by a former president and make a finding that it was either "personal or presidential," under the PRA. Under this scenario, it is possible jurors could find that some official documents were mishandled. 

Federal prosecutors rejected both proposals and wrote Tuesday that the PRA — a 1978 law that manages the maintenance of White House documents produced during each presidency — "should not play any role at trial at all," arguing that Trump's alleged mishandling of classified records occurred after his presidency ended.

Trump and Smith filed separate proposals for jury instructions in the case Tuesday, although a trial date has yet to be set. 

Prosecutors said Tuesday that both of Cannon's hypothetical scenarios "rest on an unstated and fundamentally flawed legal premise." Any jury instructions that include the PRA risked "distort[ing] the trial," they said.  

Instead, the special counsel suggested jurors should only have to determine three elements of the case that amount to whether Trump willfully retained national defense information without the authorization of the federal government. 

Smith's team requested that if the judge opts to include language concerning the PRA, she affords them ample time to appeal the matter to higher courts ahead of trial. 

The former president's legal team took the opposite view, writing Cannon "correctly stated the law" when she suggested the jury instruction that would have granted Trump much broader power under the PRA. 

"If this case is presented to a jury—which it should not be—the jury would be forced to resolve factual issues relating to not only PRA categorizations but also documents' alleged classification status," Trump's defense team argued in their filing . 

In their own proposed jury instructions , Trump's legal team suggested Cannon tell jurors that Trump was authorized to access the classified records during his presidency and that certain precedents allow for former presidents to access certain documents. 

The special counsel charged Trump in a 40-count indictment that includes 32 alleged violations of a national security law that makes it illegal to mishandle national defense information. The former president is also accused of engaging in an obstruction scheme as part of an alleged effort to thwart federal investigators as they probed his retention of documents with classified markings. The FBI ultimately recovered over 300 sensitive government records from Trump's Mar-a-Lago residence that prosecutors accused him of illegally keeping. 

Trump pleaded not guilty to all counts and has denied any wrongdoing. 

Tuesday's late-night filing from the special counsel contended that the question of presidential versus private records under the PRA is not a question for a jury because it doesn't apply to Trump's alleged conduct. Instead, prosecutors said this was a matter of law that should be left up to the judge. 

Trump's legal team has filed a number of motions to dismiss the case against him, including one on the grounds that the PRA granted Trump "unreviewable discretion" over classified records.

"President Trump was still the President of the United States when, for example, many of the documents at issue were packed (presumably by the GSA), transported, and delivered to Mar-A-Lago," they wrote in a February court filing. 

Attorneys for the former president also argued that the PRA "precludes judicial review" over a president's recordkeeping, contending that the court has no jurisdiction in the matter, language that was reflected in Cannon's order asking for input on the proposed jury instructions. 

Smith's team, however, pushed back in responding court filings, writing that the more than 300 documents with classified markings recovered from Trump "are indisputably presidential, not personal." 

"Trump was not authorized to possess classified records at all," prosecutors said. 

The federal probe into Trump's handling of classified records followed a months-long effort by federal officials to collect what they said were missing documents. Investigators ultimately executed a search warrant at his Florida residence and club, Mar-a-Lago, in August of 2022, after the former president allegedly failed to fully respond to a grand jury subpoena. 

In Tuesday's filing, Smith's team again pushed back, alleging that Trump's use of the PRA — namely the claim that he had the power to declare certain government documents as personal in nature — was "invented" as a "fictional" defense for his alleged conduct only after the federal probe was underway. The special counsel said neither communications with his defense team throughout the investigation nor witness testimony backs up Trump's claims. 

Prosecutors revealed that during its grand jury investigation, the special counsel's office interviewed individuals close to the former president, including his chiefs of staff and top White House lawyers.  

"Not a single one had heard Trump say that he was designating records as personal or that, at the time he caused the transfer of boxes to Mar-a-Lago, he believed that his removal of records amounted to designating them as personal under the PRA," according to the special counsel. "To the contrary, every witness who was asked this question had never heard such a thing."

In response to Cannon's order, however, Trump's lawyers reiterated their contention that the former president was shielded from prosecution under the PRA. 

"There is no basis for the Special Counsel's Office, this Court, or a jury to second-guess President Trump's document-specific PRA categorizations." 

Cannon has yet to rule on any of Trump's motions to dismiss the indictment, and the former president's legal team urged her again on Tuesday to rule in his favor. Two of the former president's aides, Walt Nauta and Carlos de Oliveira, also face charges in the case and filed their own motions, which also remain unresolved. Nauta and de Oliveira pleaded not guilty to allegations that they worked with the former president to obstruct the federal probe.

The judge has yet to set a trial date in the case — originally scheduled for late May — and has not issued any order related to a request from Smith that she reconsider a ruling tied to protected witness names. She held a hearing on those two issues on March 1.

Trump originally argued that a trial should not go forward before the fall election, but conceded that August would be feasible, should the judge decide to proceed. The special counsel pushed for the trial to begin in July, a proposal that seems less likely to be adopted, since Cannon's docket still contains several unresolved motions.

EAPA Case 7818: AMVC-Midwest LLC aka Midwest Livestock Systems, LLC (Notice of Determination as to Evasion, April 9, 2024)

WASHINGTON— On April 9, 2024, CBP issued the notice of determination as to evasion for EAPA case 7818 filed by Hog Slat, Inc., against U.S. importer AMVC-Midwest LLC, also known as Midwest Livestock Systems, LLC (Midwest Livestock), for evasion of AD/CVD orders A-570-947 and C-570-948 on steel grating from China.  Specifically, evidence on the record indicates that Midwest Livestock misclassified steel gratings as farrowing crates and gestation pens.  CBP has determined that there is substantial evidence of evasion of AD/CVD duties by Midwest Livestock and, therefore, CBP issued a formal notice of determination as to evasion and has taken enforcement actions.

In light of CBP’s findings, CBP will:

  • CBP will suspend or continue to suspend the entries covered by this investigation, until instructed to liquidate.
  • For those entries previously extended in accordance with Interim Measures, CBP will rate adjust and change those entries to type 03 and continue suspension until instructed to liquidate these entries.
  • CBP will continue to evaluate Midwest Livestock’s continuous bonds in accordance with CBP’s policies.

Despite its small size, Montenegro beckons thousands of British travellers every month with its idyllic lakes and mountains.

The European country can be reached by plane, train and even by boat, but failing to meet the country's passport validity requirements could see tourists denied entry.

The Foreign Office (FCO) has issued an update urging Britons to double-check the validity of their travel documents before entering Montenegro.

The requirements to enter the country include travelling with a passport issued less than 10 years before the date a visitor crosses Montenegro's border. Passports must also be valid for at least three months after the day you plan to leave.

Montenegro beckons many Britons with its picturesque landscape 

The FCO said: “This advice reflects the UK Government’s understanding of current rules for people travelling on a full ‘British Citizen’ passport from the UK, for the most common types of travel.

“The authorities in Montenegro set and enforce entry rules, if you’re not sure how these requirements apply to you, contact Montenegro Embassy London.

“Land and border crossings may close at short notice and entry into neighbouring countries may be subject to entry requirements.”

The FCO added that Britons can enter the country for up to 90 days in “any 180 days without a visa”.

“If you are travelling to Montenegro without a visa, make sure your whole visit is within the 90-day limit," it added.

“Visits to Montenegro within the previous 180 days before you travel count towards your 90 days.

“Montenegro is not part of the Schengen Area, so your time spent in Montenegro does not add to your total number of days spent in the Schengen Area.”

It comes as the small European country was named as one of the best to move to in 2024 for expats seeking a lower cost of living than in the UK.

The YouTuber Wealthy Expat said British residents who move to Montenegro frequently maintain their pension benefits after moving to the country.

“Montenegro is very similar to Serbia, very traditional,” the YouTuber pointed out. “It still preserves that traditional culture.”

“It’s a country that has amazing beaches and mountains. The nature is incredible. If you get residence in Serbia, you can get easy access to Montenegro, it’s a one-hour flight."

According to WTM Global, 2022 saw 52,000 travellers visit Montenegro, with 268,000 overnight stays recorded.

Year-on-year, this was an increase of 374 per cent from January to January 2022, and 87 per cent from the same recorded period in 2019.

The destination is a top pick for Britons who enjoy warm weather, cheap food and drinks. It is also just a few hours from the UK.

Montenegro's capital city, set in the centre of the country, is surrounded by beautiful ranges of mountains with direct flights from the UK.

More than 5 of 10 patients that show up at a hospital are being diagnosed with bronchitis and nearly one in 10 patients is diagnosed with pneumonia, according to healthcare specialists across the UAE.

“I see a surge in the cases of acute bronchitis in my OPD and pneumonia cases recently,” said Dr Raiza Hameed KH, specialist pulmonology, Aster Clinic, Bur Dubai.

“⁠Now, 50-60 per cent of patients visiting chest OPD suffer from acute bronchitis and 10 percent of cases are from pneumonia. Asthma and COPD patients also come with worsening symptoms nowadays. Dubai Health Authority has also alerted physicians regarding an increase in influenza and acute bronchitis [cases] lately,” he added.

At Burjeel Hospital, Abu Dhabi the doctors have recorded at least 6 patients with bronchitis and pneumonia over the last month.

Causes of rising cases

Healthcare specialists attribute this rise to the sudden weather fluctuations and a dusty hot environment. In climate variations, which leads to respiratory infections, and acute bronchitis, triggering exacerbations in asthma and COPD patients.

“The rise in the infections can be attributed to including increased travel for Umrah, spring vacations, lack of influenza vaccination, and gatherings during Ramadan,” said Dr Rania Zein Eldien, respiratory specialist at Burjeel Hospital.

“The poor air quality lately has led to many people getting cough which lasts for 3-4 weeks. Smoking or vaping worsens the cough of acute bronchitis which makes the treatment more difficult,” said Dr Eldin.

What is bronchitis?

According to doctors, bronchitis is the inflammation of airways or windpipes and can happen after a viral infection most commonly, triggered by weather fluctuations and irritant exposure.

There are several symptoms of bronchitis, the disease is characterised by the followin symptoms, according to Dr Hameed:

  • Chest tightness
  • Mucus production

“Chronic bronchitis is seen in smokers, asthma, and COPD patients,” he added.

All about pneumonia

Pneumonia is caused by an infection with bacteria, viruses, or fungi and the risk is increased in the elderly (above 65 years), those with chronic illness and other co-morbidities, uncontrolled diabetes mellitus and poor immunity. The disease can lead to respiratory failure and death also in severe cases.

Pneumonia is the infection of one or both lung parenchyma by a bacteria, virus, or fungi. “The symptoms of pneumonia are fever, cough, chest pain, mucus production, difficulty in breathing and lethargy. Pneumonia can be serious and should be treated with caution.

“Typically, symptoms start with flu-like symptoms such as a runny or blocked nose, fever, body pain, and fatigue, which persist longer than usual. Additional symptoms include a prolonged cough, abnormal-colored mucus, chest tightness, abnormal breathing, and chest pain,” says Dr Eldin.

Is it contagious?

Yes. According to Dr Eldin, “the illness is often contracted by coming into contact with sick patients without taking proper precautions.”

“Pneumonia is not contagious, but bacteria or viruses that cause the disease can be contagious. It can cause flu or pneumonia in other people depending on the person’s immunity level,” said Dr Hameed.

Healthcare specialists say that bronchitis is not contagious though the microorganisms that causes bronchitis are contagious.

Preventive measures

Healthcare specialists not that that controlling these diseases require adequate control measures - primarily pneumococcal and influenza vaccination.

Other preventive measures are:

  • Avoid going out during the days of weather fluctuations
  • Adequate layering of clothes to avoid wind and cold exposure
  • Wear a mask if you are going to crowded areas
  • Smoking cessation
  • In case of cough and cold, do not delay in getting your treatment
  • In case you have symptoms, avoid close contact and sharing things with other people
  • A healthy diet and lifestyle always help to keep infections away
  • Avoiding contact with sick individuals
  • Practising respiratory hygiene
  • Correcting any vitamin deficiencies can reduce the risk of contracting bronchitis and pneumonia

“Treatment for bronchitis is usually symptomatic and includes supportive measures such as cough syrup, mucolytics, antipyretics for fever control, and bronchodilators for wheezing,” said Dr Eldin.

“Pneumonia is treated with antibiotics, mucolytics and bronchodilators. In mild cases pneumonia can be treated as an outpatient case, but any signs of respiratory failure or inadequate recovery warrants admission and proper evaluation,” said Dr Hameed.

All receipts for payment of Machine-Readable Visa (MRV) fees issued before October 1, 2022, expired September 30, 2023. There will be no extensions of fee validity. Applicants must have scheduled an appointment or submitted an interview waiver application before September 30, 2023 to avoid paying a new fee. If you paid the MRV fee on or after October 1, 2022, you must have scheduled the appointment within one year of your MRV payment date. Please note that the interview itself does not need to take place within one year, but an interview appointment needs to be made in the system, even if it is scheduled months into the future. Peter Dutton’s office claimed nearly $6,000 in public expenses for staff and security to travel to Perth with the opposition leader when he attended Gina Rinehart’s lavish birthday party.

Dutton’s office has said he travelled at his own expense to the party for Australia’s richest woman , which included a horseriding performance, multiple large cakes and onstage pyrotechnics. But travel information obtained under freedom of information shows members of Dutton’s team – which his office said included a staffer and a security detail – claimed travel from Melbourne to Perth and back again on 29 February, the night of the party on the banks of the Swan River.

It was reported in March that Dutton attended Rinehart’s party after the end of a parliamentary sitting week, before appearing in Melbourne the next morning to campaign for the Dunkley byelection. The Australian Financial Review reported Dutton was spotted flying from Canberra to Melbourne, then travelling on to Perth before returning to Melbourne that same evening – potentially joining Rinehart’s party for as little as an hour.

Dutton was criticised at the time by 2GB host Ben Fordham for choosing to fly to Perth instead of spending more time campaigning in Dunkley, calling the opposition leader’s decision “a bad call” and suggested he should have “brushed” the party to campaign more in the crucial byelection.

“Peter Dutton spent more time on the aeroplane than he did at the party, which sounds like a waste of time to me,” Fordham said.

Labor’s Jodie Belyea won the byelection against Liberal challenger Nathan Conroy by a 53-47 margin.

The Independent Parliamentary Expenses Authority (IPEA), the government body which manages parliamentarians’ work expenses, released information under FoI on Thursday to show Dutton’s office claimed flights between Melbourne and Perth on the day of – and the day after – Rinehart’s party. All were classified as having been claimed by “personal staff”, rather than Dutton himself. Guardian Australia understands that any claim for Dutton himself would have been recorded and classified differently on the documents.

IPEA records show staff from Dutton’s office claimed a Melbourne to Perth flight on 29 February, the day of the party, costing $2,221.63. The same day, staff also claimed a Perth to Melbourne air fare, at $2,680.80.

The following day, 1 March, was another staff claim for a Perth to Melbourne air fare at $1,028.93.

In total, the three air fare claims between Melbourne and Perth came in at $5,931.36.

Guardian Australia contacted Dutton’s office for clarification on the claims. A spokesperson responded that the opposition leader travelled with one staff member and his security detail, which they said was appropriate and within travel rules.

Dutton is typically accompanied in public by a security detail, as are other senior politicians like prime minister Anthony Albanese and deputy PM Richard Marles.

Dutton’s spokesperson also referred back to his remarks in March, at the time of the initial reporting on his Perth trip.

“The air fares were at my expense, there was no accommodation. I flew back on the redeye so that I could be back into Melbourne at 4.30 the next morning,” Dutton said at the time.

“My security detail operates exactly the same as the governor general and the prime minister.”

The lavish celebration for Rinehart, according to her company’s websites, included “a horse show backed by the fantastic Aussie music, The Man from Snowy River, with riders … carrying large Australian and company flags”.

The Perth lord mayor, Basil Zempilas, told 6PR radio he attended the event, calling the horseback show “an incredible sight”, and saying the pop star Guy Sebastian had sung the national anthem.

Last year Dutton was flown to another Rinehart party at Hancock Prospecting’s Pilbara mine by another billionaire rich-lister , where he praised the mining magnate and her family as “pioneers” who had “given so much to this country”.
