An FDNY firefighter has died of a heart attack just months after he was fired as part of the city’s effort to free up funds for its migrant crisis — leaving his grieving widow and kids struggling to keep a roof over their heads.

Derek Floyd, 36, suffered cardiac arrest and passed away April 15, four months after the city gave him the boot as part of a larger effort to pare staff and pay for housing and services for the tens of thousands of migrants flooding the Big Apple.

Floyd was one of about 10 fire department employees who had been on “long-term duty” — either injured on the job and given office work or out sick for an extended period — and fired weeks before Christmas, FDNY sources told The Post.

Floyd, a veteran who served three tours in the Middle East with the Marines, had been among those working a desk job — toiling in the fire department chaplain’s office — because he had suffered another heart attack in 2019 while he was in the Fire Academy.

In the chaplain’s office, the firefighter, who was on modified duty, helped arrange the funerals of fallen FDNY members.

The married dad of two young children was trying to become medically cleared to re-enter the firefighting force before he was fired.

Floyd had been just shy of vesting additional medical benefits for his family and more than $600,000 worth of death benefits when he was booted, leaving his family with nothing despite his years of service.

“I wouldn’t wish it on anyone,” Floyd’s 34-year-old widow, Christine, told The Post of the family’s experience.

“I think it definitely took a toll once they let him go,” she said of her husband’s firing. “He always tried to, like, stay positive about it, and he wasn’t really angry.

“But you see a person, and the wheels are turning in their brain where they’re just constantly thinking, so I definitely think it did affect us.”

After Floyd was fired, he found a job with a nonprofit that helps veterans, but the pay was a fraction of what he made with the FDNY, the benefits were limited, and the hours prevented him from spending time with their kids, a 6-year-old boy and 2-year-old girl.

“He used to be so present for, like, our kids and stuff,” Christine said. “Being a firefighter was something he was really passionate about. He was really a big-time, like, family person, he was all about his kids.

“If Derek would have stayed on, he would have had a life insurance policy with the FDNY,” the widow said. “That would have helped out financially because right now, it’s really bad. I’m honestly swimming in a lot of debt.”

Floyd’s firing was part of City Hall’s plan to slash the FDNY budget by $74 million by the end of 2025 to make way for migrant spending.

It is unclear how many “long-term duty” staff will ultimately be let go as part of the effort, but there are typically between 800 and 1,000 individuals so designated at any given time.

The NYPD was also facing budget cuts — of $132 million through the axing of five upcoming Police Academy classes — though three of those classes have been restored.

The city Department of Education was expected to lose about $547 million, but those funds were restored in the mayor’s executive budget unveiled last week.

Floyd’s firing — and the problems that have befallen his family since his death because of it — have left some outraged.

“What disturbs me the most is that the FDNY is understaffed by hundreds of firefighters. Terminating [Floyd] was absolutely unnecessary,” Uniformed Firefighter Association president Andrew Ansbro told The Post.

“He had an important job, and the FDNY actually needed him in that unit. He was terminated so the department could prove that they were making cuts. He deserved better,” Ansbro added.

Christine said that watching her husband struggle to make ends meet while being present with his family after the firing was the worst part of everything they’ve experienced.

“I really, really loved him, and so it was hard,” she said. 

“We are heartbroken over the passing of former Probationary Firefighter Derek Floyd, and will explore all financial, legal and legislative options to help his family and ensure they have the support they need during this time,” said Fire Commissioner Laura Kavanagh.

City Hall did not respond to The Post for comment

What happens now that Harvey Weinstein's conviction was overturned in New York

Harvey Weinstein 's 2020 rape conviction was overturned Thursday by the New York Court of Appeals and many are wondering what happens next.

Weinstein has been serving a 23-year prison sentence in New York's Mohawk Correctional Facility following his conviction on charges of criminal sex act for forcibly performing oral sex on a TV and film production assistant in 2006 and third-degree rape for an attack on an aspiring actor in 2013.

Where things stand now

In an interview with NBC News on Thursday following the New York Court of Appeal's decision, Weinstein's longtime spokesperson, Juda Engelmayer, said that their first order of priority is to seek medical care for the 73-year-old.

"We’re going to try to bring him for medical care here in Bellevue [Hospital] down here first," he said. "[Weinstein] is still in a walker, still in a wheelchair ... he has audio issues, he has heart issues. Harvey has a lot of health mountains and hurdles to climb but hopefully this cheers up his mood better and helps him fight them better."

While he awaits a new trial in New York, Engelmayer said there is a chance Weinstein may be extradited to California where he faces a 16-year prison sentence after being convicted of rape and sexual assault in a separate trial in 2022.

"We don’t know exactly what the process is but we expect within 24 to 48 hours the Los Angeles courts or Los Angeles prosecutor will file an extradition charge to bring him in there," he said.

How we got here

The state Court of Appeals found that the judge in the landmark  #MeToo trial  prejudiced Weinstein, the former film mogul, with improper rulings, including a decision to let women testify about allegations that weren’t part of the case.

“We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,” the court said in a 4-3 decision. 

“The court compounded that error when it ruled that defendant, who had no criminal history, could be cross examined about those allegations as well as numerous allegations of misconduct that portrayed defendant in a highly prejudicial light,” it said.

New York Court of Appeals Judge Jenny Rivera called the errors “egregious”   and said the remedy is a new trial. Weinstein’s   accusers could again be called to testify if prosecutors decide to pursue another trial.

Judge Anthony Cannataro, one of the judges who voted against this decision, said in his dissenting opinion that this was an “unfortunate step backwards.”

Attorney Lindsay Goldbrum, who represented six Weinstein accusers, called the decision a “leap backward for the rule of law” that could deter future sexual assault victims from coming forward.

“To all victims of sexual assault who are retraumatized by today’s ruling, I am so sorry,” said Goldbrum, whose clients included model Tarale Wulff, who testified that Weinstein raped her at his Manhattan apartment in 2005 after having lured her there with talk of a movie audition.

Will there be another trial?

Manhattan District Attorney Alvin Bragg said in a statement following the court's decision that he plans to retry the case, “We will do everything in our power to retry this case and remain steadfast in our commitment to survivors of sexual assault.”

During a news conference Thursday afternoon in downtown Manhattan, Weinstein’s attorney Arthur Aidala said, “His case will be restarted like it just started from the beginning, and he will be transported to a facility down here yet to be determined.”

A hearing is expected to be scheduled as early as next week with a new potential trial date set, according to Engelmayer.

NBC News legal analyst Danny Cevallos said in an interview with NBC News on Friday that, if Weinstein is indeed retried, it won't take as long as his previous trial.

“Depending on the court's dockets, retrials don’t take all that long, they won’t give them a whole new discovery period," he said.

Engelmayer and Aidala have both said that if the case is retried, Weinstein will testify.

Weinstein's California conviction

Weinstein's legal team is currently appealing his California criminal conviction and one of his lawyers on that case, Jennifer Bonjean, said that she believes the decision to overturn Weinstein's New York charges bodes well for their appeal.

"A jury was told in California that he was convicted in another state for rape. Turns out he shouldn’t have been convicted, and it wasn’t a fair conviction," she said in a statement. "It interfered with his presumption of innocence in a significant way in California."

The Los Angeles County District Attorney’s Office said in a statement that the legal issues identified by the New York appeals court “are not present in the Los Angeles County case” because California law does allow for evidence that speaks to a defendant’s character in sexual assault cases, “subject to the judge’s discretion.”

But Engelmayer remained hopeful about their changes for an appeal in Los Angeles.

"We have an even better case [in California] ... He was charged on one alleged victim for someone that we know was not in the room at the same time they claimed Harvey was. We know where she was. We know where Harvey was at the time ... we have the evidence," Engelmayer said.

Adding, "I believe one day he will walk free. He might hobble on his walker, he might be in a wheelchair, but he will be free."

The Honourable Marc Miller, Minister of Immigration, Refugees and Citizenship, announced today that the temporary policy allowing students to work more than 20 hours per week off campus will come to an end on April 30, 2024, and it will not be extended. This fall, we intend to change the number of hours students may work off campus per week to 24 hours.

Students who come to Canada must be here to study. As such, allowing students to work up to 24 hours per week will ensure they focus primarily on their studies, while having the option to work, if necessary.

As we head into the summer session, students who have a scheduled academic break can continue working unlimited hours.

In developing this change, we looked at the needs of students, policies in other countries, as well as research that has shown that academic outcomes suffer the more a student works while studying. It also strikes the appropriate balance so students have the option to work without compromising academic outcomes. More details will be shared in due course.

We also continue to develop the new Recognized Institutions Framework to reward post­secondary institutions that set high standards for selecting, supporting and retaining international students. Recent studies conducted in the US and Canada have shown that there is a considerable decline in academic performance for students working more than 28 hours per week, and that working more than 24 hours per week increases the chances that a student will drop out of their program.

Most countries that welcome international students set limits on the number of hours they may work while they study.
