Film Review: Terrence Malick’s ‘Voyage of Time: Life’s Journey’

Terrence Malick has made a reverent and spectacular nature documentary that's suffused with cosmic beauty, and with a little too much cosmic indulgence.

The bottom of the sea, the top of the sky, the swirling psychedelic gasses of outer space, the writhing protoplasm of inner life: When you’re gawking at images like these and they cast a spell of majestic awe, the images need no other justification, and “Voyage of Time: Life’s Journey” is full of them. Written and directed by Terrence Malick , the film is a mystic love poem to the unfathomable splendor of the natural world — which, if you get close enough to it, is out of this world. The version of “Voyage of Time” that premiered at the Venice Film Festival is 90 minutes of spectacularly beautiful nature-ific eye candy. It was shot, however, for IMAX , and when a very different version of it opens next month on IMAX screens, it will be only 45 minutes long. (The feature-length film will be released in select international markets starting next year.)

That, make no mistake, is a good thing. “Voyage of Time” has too many spellbinding images to count, but as a movie it’s just OK. It’s exactly what it sounds like — essentially an expanded version of the cosmic prologue from Malick’s “The Tree of Life.” But that sequence seduced you with its trippy splendor, presented the entire formation of the Earth, and turned that into a heavy contemplation of a higher power… all in 20 minutes.

In “Voyage of Time,” more of this becomes less — not because the film is boring (it glides by), but because it’s at once captivating and diffuse, a grab-bag of wonder set against a narration of solemn quasi-banality read by Cate Blanchett, with interwoven shots of people from around the planet, most of them photographed with a cell-phone camera (the new equivalent of grainy shaky 16mm), which doesn’t add up to much because these sequences feel arbitrary and vaguely didactic. A montage of American homeless people; an Israeli wedding; a ceremony in a rural Asian town square that involves the ritual slaughter of water buffalo. These sequences tend to sap the film’s momentum (they make it sag), and that’s one reason it loses power as it goes along. “Voyage of Time” is like a more contemplative, fragmented, throw-everything-at-the-wall version of “Koyaanisqatsi” with narration by Rod McKuen.

These days, when everything is divided into oppositional tribes, two camps that are most definitely not speaking to each other are the Creationists and those who believe in evolutionary science. But Malick, as a film artist, is like a walking truce between those two points of view. He’s a New Age Christian sentimentalist who makes explicitly religious movies (more and more, they’re about talking to God), and the theme of “Voyage of Time” is that there’s a Creator, and he has created life, and that is a splendid thing, but we cannot know his grand plan. Here, though, as in “The Tree of Life,” Malick presents a vision of the cosmos that’s essentially “scientific”: the brilliantly multicolored oozing waves of galactic light matter, the otherworldly species under the sea that suggest rungs on the evolutionary ladder.

A vast team of visual-effects artists worked on “Voyage of Time” (led by Dan Glass, the film’s visual effects supervisor), and part of what’s captivating about the movie is that it’s hard to tell where the effects leave off and the natural photography begins. The celestial visions of outer space were, for the most part, created, and Malick orchestrates them like a painter of light and gravity — they’re like something on a Sistine Chapel ceiling that moves. But were all of them created? Much of the staggering nebula look like actual telescopic images, and when the film is under the sea, gazing at some creature that looks for all the world like an octopus with tentacles made of Romaine lettuce, we think, “Is that thing…  real ?” The same goes for hellishly billowing volcano smoke and shots of fragmented glacier ice. The confusion is intentional. Malick is telling us that nature will always be the ultimate special effect.

You might say that Malick’s philosophy in “Voyage of Time” is a version of “intelligent design,” yet somehow that phrase sells it short. He sees God’s touch in the glory and strangeness of every natural surface — a flower of extraordinary delicacy whose outer petals look like a wedding dress and whose inner petals look like shark’s teeth, or jellyfish pulsating with such diaphanous synchronization that we can’t help but have the feeling that there’s something purposeful about them. The message of the images in “Voyage of Time” is that if you’re searching for God, you need do little more than cast your eye over everything on Earth.

The film’s narration, unfortunately, is of a less intelligent design. It’s meant to be incantatory, a poem of sacramental inquiry, with Blanchett speaking to the higher power of nature, to the very spirit of life , whom she personifies as “Mother” (how’s that for ancient and post-feminist at the same time?), asking Her questions that have no answer: “Who are you, life giver? Light bringer?” A little of this goes a long way, especially when, half an hour later, Blanchett is still at it, saying things like “All life. Giver of good. Creating yourself. In ever-changing shapes. You give. Without asking.” Or the slightly perplexing “Who am I to you? You devour yourself, only to give birth to yourself again.” I kept waiting for Blanchett to add, “I’m here till Tuesday. And are you, life giver?” If an Imax nature movie is going to turn into a prayer, it should be one that’s a bit more varied.

Making a film that has the contemporary aspect of a planetarium show is, in its way, a deeply cool and populist thing to do, and “Voyage of Time” is likely to connect with audiences in a way that the blurry poetic narratives Malick has been making of late — “Knight of Cups,” “To the Wonder” — have not. “The Tree of Life” was a masterpiece, because it wedded visual poetry to masterfully staged scenes.  It was filmmaking, not dithering, and it proved that Malick could indeed find a form for his metaphysical obsessions. He finds a form in “Voyage of Time,” but if he continues down this path, it would be nice to see him shake off a little of the excess mysticism and make a nature movie whose final effect is an honest “Wow!” rather than a semi-enraptured “Hmmm.”

In 2003, noted author (and personal hero) Harlan Ellison chided me for saying that the reprinting of some of his short stories was "awesome." "The Grand Canyon is 'awesome,'" he shouted theatrically. "The Heavenly Cosmos are 'awesome!' This? Maybe interesting. But definitely not 'awesome!'"

I thought about that definition of "awesome" as I watched the 45-minute cut of writer/director Terrence Malick's cosmic nature documentary "Voyage of Time: The IMAX Experience." Malick's film, a combination of gorgeous documentary footage and vividly detailed computer-generated imagery, is majestic but so broad in its scope that I left it feeling like I'd seen something beautiful whose spark of genius only lasted as long as it was in front of my eyes. Malick's idiosyncratic marriage of spiritual speculation and nature photography is frequently amazing. But altogether awesome? Not quite.

Narrated throughout by Brad Pitt , "Voyage of Time" starts at the beginning of time and ends with the demise of the world as we know it. We see swirling nebulae, smoky volcanoes and multiplying bacteria while Pitt tells us about the "restless" character of life. 

Malick has an elemental view of life's origins, so Pitt offers general poetic speculations instead of specific information about what we're looking at. He suggests, in his placating authorial whisper, that "Nature" is constantly perfecting life on Earth. "Death" pushes Life along towards "Perfection." "Community" leads to the individual "Self," and we witness a vast array of crabs piling onto and climbing over each other. Life teems with mysterious "Goodness" as translucent white jellyfish float gently towards the water's surface.

There's something fundamentally sanitized about this dreamy, placid view of life. Ellison once said that life was a series of confrontations. But Love unites Malick's world, as we see when two blue whales hover near each other. And we are just like the dinosaurs, since we also have the capacity to feel affection for each other and, yes, to feel awe. 

But there is no violence in Malick's world, just a cycle of becoming that comes to an end for one large fish after he's bitten by a sea lion. Herons dive deep into the ocean and pick at a school of fish, who rally in unison to escape. Life thrives, just as Malick insists that "dark" is necessarily "bound" to "light." We see humanity in a flurry of images at the end of this cut of "Voyage of Time," because our story is the same as the story of growing trees, cooling Earth, and the catastrophic meteor that salted the Earth with plant-killing ash. Or at least, that's what an introductory scrolling text suggests when it tells us that we are seeing ourselves when we examine the objects and animals in the film.

I struggle with Malick's expressive, supra-human vision of life because its philosophy is bound up in its simultaneously pat and viscerally enchanting expression. I knew something was off when footage of computer-generated dinosaurs left me cold. Similar dino footage used in Malick's majestic " The Tree of Life ," a superior companion film that shares footage and a general outlook with "Voyage of Time," felt genuinely mysterious because of contextualizing footage. The narration is similarly nuanced in that earlier film while it is purposefully simplified in "Voyage of Time." These two films provide fundamentally different viewing experiences: "The Tree of Life" pulls you along with the speed and variety of life as it's experienced from a God's eye view while "Voyage of Time" summarizes that perspective, putting it in terms that a "child" could understand. We are all "children of the Good," we are told, because we are just another part of Nature's constant yearning for Perfection. 

Still, it is exciting to see such a personal theological vision writ large on an IMAX screen. Who else but Malick could make me puzzle over the meaning of a description of a "pre-mammalian" quadruped lizard creature? What other documentarian would revel in the unfathomable passage of time while also presuming to speak of a Natural plan? What other storyteller would have the audacity to make a cinematic poem that's largely comprised of documentary footage, and bookended by simulated versions of the Big Bang and Earth's destruction? What's my problem anyway?

I don't know how to answer that last question, but I can tell you something Ellison wrote, this time in a 1980 issue of  Future Life . In a column later anthologized in his  An Edge in My Voice  essay collection, Ellison rhapsodizes eloquently about the Voyager I mission. He was awed, then crestfallen at the thought of the news cycle concentrating on the war between Iran and Iraq, and not NASA's latest photographs and speculations about the spokes on Saturn's rings. "Ain't we a wonderful species," he muses sarcastically after reveling for thousands of words in the thrill of discovery, and the shock of the new provided by NASA's scientists. I didn't need "Voyage of Time" to confirm my spiritual point-of-view to be great: I just wish it were a little less flat. As it is, Malick's film feels incomplete, like a sampler platter version of a hearty meal. Awesome? Maybe not. But intriguing? Oh my yes.

Crime and public safety | mckinley park man gets 50-year sentence for 2016 killing of brighton park teen, attorney general says.

A McKinley Park man was sentenced to 50 years in prison Friday for the 2016 drive-by shooting on the city’s Southwest Side that left a teenager dead, the office of Attorney General Kwame Raoul announced.

A Cook County jury in December convicted Sergio Gonzalez, 29, of first-degree murder in the slaying of David Gonzalez, 17, court records show. Sergio Gonzalez and David Gonzalez were not related, authorities said.

David Gonzalez was shot eight times from a moving vehicle in the late evening of Jan. 7, 2016, in the 3100 block of West 41st Place in Brighton Park .

Sergio Gonzalez and a second man, Jose Juarez, were quickly apprehended following a police pursuit that ended 11 blocks from the shooting scene, police said. Each man was later charged with murder.

Authorities said they believed hostilities between longtime gang rivals Latin Kings and Two-Six led to the slaying.

Juarez was found guilty of murder in 2019 and sentenced to 45 years in prison, according to Raoul’s office. The Illinois Appellate Court upheld Juarez’s convictions two years ago following an appeal, according to court records.

Sergio Gonzalez has another case pending related to an alleged 2010 murder and was also charged separately with attempted murder and participation in a nine-person group attack while in custody at the Cook County Jail, according to records.

He is next set to appear in court on May 21.

The U.S. Justice Department has agreed to pay approximately $100 million to settle claims with people who say they were sexually assaulted by Larry Nassar, a source with direct knowledge of the negotiations told The Associated Press.

DETROIT (AP) — The U.S. Justice Department announced a $138.7 million settlement Tuesday with more than 100 people who accused the FBI of grossly mishandling allegations of sexual assault against Larry Nassar in 2015 and 2016, a critical time gap that allowed the sports doctor to continue to prey on victims before his arrest.

When combined with other settlements, $1 billion now has been set aside by various organizations to compensate hundreds of women who said Nassar assaulted them under the guise of treatment for sports injuries.

Nassar worked at Michigan State University and also served as a team doctor at Indianapolis-based USA Gymnastics. He’s now serving decades in prison for assaulting female athletes, including medal-winning Olympic gymnasts.

Acting Associate Attorney General Benjamin Mizer said Nassar betrayed the trust of those in his care for decades, and that the “allegations should have been taken seriously from the outset.”

“While these settlements won’t undo the harm Nassar inflicted, our hope is that they will help give the victims of his crimes some of the critical support they need to continue healing,” Mizer said of the agreement to settle 139 claims.

The Justice Department has acknowledged that it failed to step in. For more than a year, FBI agents in Indianapolis and Los Angeles had knowledge of allegations against him but apparently took no action, an internal investigation found.

FBI Director Christopher Wray was contrite — and very blunt — when he spoke to survivors at a Senate hearing in 2021. The assault survivors include decorated Olympians Simone Biles, Aly Raisman and McKayla Maroney.

In an AP interview, former gymnast Rachael Denhollander, who was the first person to publicly detail Larry Nassar’s abuse, says this is a unique outcome.

“I’m sorry that so many different people let you down, over and over again,” Wray said. “And I’m especially sorry that there were people at the FBI who had their own chance to stop this monster back in 2015 and failed.”

After a search, investigators said in 2016 that they had found images of child sex abuse and followed up with federal charges against Nassar. Separately, the Michigan attorney general’s office handled the assault charges that ultimately shocked the sports world and led to an extraordinary dayslong sentencing hearing with gripping testimony about his crimes.

“I’m deeply grateful. Accountability with the Justice Department has been a long time in coming,” said Rachael Denhollander of Louisville, Kentucky, who is not part of the latest settlement but was the first person to publicly step forward and detail abuse at the hands of Nassar.

“The unfortunate reality is that what we are seeing today is something that most survivors never see,” Denhollander told The Associated Press. “Most survivors never see accountability. Most survivors never see justice. Most survivors never get restitution.”

Michigan State University, which was also accused of missing chances over many years to stop Nassar, agreed to pay $500 million to more than 300 women and girls who were assaulted. USA Gymnastics and the U.S. Olympic and Paralympic Committee made a $380 million settlement.

Mick Grewal, an attorney who represented 44 people in claims against the government, said the $1 billion in overall settlements speaks to “the travesty that occurred.”

A retired federal judge, Gregory Sleet, served as a mediator in the federal claims.

“It took more than six years of tears, pain, and unrelenting effort by Nassar’s victims, including many of our nation’s most celebrated athletes, to shine the bright light of justice on the horrific misconduct by senior officials in the FBI and demand accountability,” said John Manly, one of the lead attorneys.

Prosecutors at hush money trial say Trump led 'porn star payoff' scheme to 'corrupt' 2016 election

Donald Trump "orchestrated a criminal scheme to corrupt the 2016 presidential election," a prosecutor told jurors Monday during opening statements in the first criminal trial of a former president.

"This case is about a criminal conspiracy and a cover-up,” prosecutor Matthew Colangelo told the 12-person jury and six alternates. Trump, he said, conspired to corrupt the 2016 presidential election by scheming with his lawyer Michael Cohen and David Pecker, who was the publisher of the National Enquirer at the time.

“Then, he covered up that criminal conspiracy by lying in his New York business records over and over and over again,” Colangelo said.

Pecker was called as the prosecution's first witness following opening statements from both sides. Trump's lawyer Todd Blanche told the jury his client was not guilty because no crime was committed.

Trump, who had his eyes closed for periods during the morning proceedings, seemed much more engaged when his old ally and friend Pecker was taking the stand. Trump craned his neck when Pecker walked in, almost as if to see whether Pecker would meet his eye. Trump also poked at his attorney Emil Bove and whispered something as Pecker, 72, got situated, and he leaned forward attentively when he began testifying.

Pecker did not get to his relationship with Trump by the time the court day ended. The proceedings ended early because a juror had an emergency dental appointment.

Trump told reporters afterward that the case was "unfair" and launched into an attack against Cohen, who's expected to be called as witness.

"When are they going to look at all the lies that Cohen did in the last trial? He got caught lying in the last trial. Pure lying," Trump said, apparently referring to Cohen's statement in the civil fraud case against Trump that he lied under oath during part of his 2018 guilty plea. "When are they going to look at that?” Trump said.

The comments are likely to come up at a hearing Tuesday morning, when Manhattan District Attorney Alvin Bragg's office is scheduled to argue that Trump has repeatedly violated a partial gag order barring him from making "public statements about known or reasonably foreseeable witnesses concerning their potential participation in the investigation or in this criminal proceeding."

Prosecutors have said Cohen and Pecker, the longtime former publisher of the Enquirer, are central figures in the alleged scheme to bury claims from women who said they had had affairs with Trump.

Colangelo told the jurors they will hear about a 2015 meeting at Trump Tower with Trump, Cohen and Pecker. Both Cohen and Pecker had specific roles to play in the scheme, Colangelo said. “Cohen’s job really was to take care of problems for the defendant,” he said. “He was Trump’s fixer.” Pecker, meanwhile, would act as “the eyes and ears” for Trump and would let him and Cohen know about any allegations that could hurt his campaign.

The DA alleges the three conspired to hide “damaging information from the voting public.” That included allegations from a former Playboy model named Karen McDougal who said she had a 10-month sexual relationship with Trump that ended in April 2007. Pecker’s AMI agreed to pay her $150,000 in a deal to essentially buy her silence — a practice that was referred to as “catch and kill.” Trump has denied McDougal's claims.

The situation took on a greater sense of urgency for Trump in October 2016. That's when The Washington Post published the " Access Hollywood " tape, which caught Trump on a hot mic saying he could grope women without their consent because "when you're a star, they let you do it."

Judge Juan Merchan barred the DA from playing the tape for the jury for fear it would be too prejudicial, but he did allow prosecutors to use a transcript of Trump's remarks.

Colangelo said the impact of the tape was “immediate and explosive.”

“The defendant and his campaign were concerned that it would irrevocably damage him with female voters,” he said, and "the campaign went into immediate damage control mode."

It was around that time that the Enquirer heard that adult film actress Stormy Daniels was interested in coming forward with a claim that she had a sexual encounter with Trump in 2006. Trump was "adamant" he didn't want that claim, which he denies, to become public for fear it would be "devastating" to his campaign, Colangelo said.

Cohen then struck a deal to buy Daniels' silence for $130,000, Colangelo said.

"It was election fraud, pure and simple," Colangelo said, adding “We’ll never know, and it doesn’t matter, if this conspiracy was a difference maker in the close election.”

Colangelo said the Trump Organization, Trump’s company, couldn’t cut Cohen a check with the memo “reimbursement for porn star payoff” so "they agreed to cook the books" and make it look like the reimbursement was income.

"The defendant said in his business records that he was paying Cohen for legal services pursuant to a retainer agreement. But, those were lies. There was no retainer agreement," Colangelo said.

“It was instead what they thought was a clever way to pay Cohen back without being too obvious about it,” he said. But what they did was a crime, Colangelo said. “Donald Trump is guilty of 34 counts of falsifying business records in the first degree,” he concluded.

Trump's attorney Blanche countered in his opening statement that his client hasn’t committed any crimes. “The story you just heard, you will learn, is not true,” he said. "President Trump is innocent. President Trump did not commit any crimes."

He said the only thing Trump did was sign checks for legal services rendered by his lawyer.

“The invoice is processed, somebody at Trump Tower generated a check, the check was ultimately signed, and there was a record in the ledger,” Blanche said. “He’s the only signatory on his personal checking account, which is why he signed the check.

"So what on Earth is a crime? What’s a crime, of what I just described?” Blanche said. "None of this is a crime," he said, adding that nondisclosure agreements like the one Daniels signed are legal.

As for the election interference argument, Blanche said, “I have a spoiler alert: There’s nothing wrong with trying to influence an election. It’s called democracy.”

In a preview of his trial strategy, Blanche also attacked Daniels' and Cohen's character and credibility. He accused Daniels, whom he described as "extremely biased," of trying to "extort" Trump, a word that the judge ordered stricken from the record. Blanche then said what Daniels had been threatening to do by going public with her allegation was "sinister" and "damaging to [Trump] and damaging to his family.”

Blanche also said Daniels' testimony, while salacious, doesn't matter because she doesn't know anything about how Cohen was repaid.

The bulk of Blanche's attacks were reserved for Cohen, who pleaded guilty in 2018 to numerous crimes, including some that he said he carried out on Trump's behalf.

“Michael Cohen was obsessed with President Trump. He’s obsessed with President Trump, even to this day,” Blanche said, calling him a "convicted felon" and a "convicted liar."

“He has talked extensively about his desire to see President Trump go to prison,” Blanche said, including in public on Sunday.

He told the jurors that if they listen to the evidence, they'll return "a very swift not guilty verdict."

Cohen said in a statement afterward, “The facts will come out at the time of trial that contradicts Todd Blanche’s mischaracterizations of me.”

Trump faces 34 counts of falsifying business records related to the hush money payment to Daniels. Trump, who has pleaded not guilty , could face up to four years in prison if he is convicted.

On his way into the courtroom Monday morning, he told reporters: “It’s a very, very sad day in America. I can tell you that.”

The day got off to a rough start for Trump, with Merchan, the judge, ruling that if he winds up taking the stand in his own defense, prosecutors can cross-examine him about another New York judge's finding that he and his business committed "persistent" fraud and violated a gag order, juries' finding him civilly responsible for sexual abuse and defamation in the E. Jean Carroll cases and a settlement in a case that found he used his now- shuttered foundation to improperly further his campaign in the 2016 election. Trump's attorneys had argued that all of those topics should be out of bounds.

Trump didn't show concern — he sat with his eyes closed through much of Merchan's ruling. He briefly opened his eyes when the jury was brought in for the judge's instructions and then closed them again.

Bragg was sitting in the front row of the courtroom ahead of opening statements.

Cohen, Daniels and McDougal are also expected to testify during the trial, which is estimated to take six weeks.

The jury consists of seven men and five women. The final day of jury selection, Friday, was particularly intense , as some potential jurors broke down in tears and said they were too anxious to be seated. They were excused. A man also set himself on fire outside the courthouse.

Trial proceedings Tuesday will be abbreviated, ending at 2 p.m. ET because of the Passover holiday.

A secret pact at Trump Tower helped kill bad stories in 2016

Fighting two legal battles at his trial, trump seems poised to be punished for allegedly violating a gag order.

NEW YORK — Donald Trump ’s 2016 presidential campaign was repeatedly aided by the National Enquirer, which squelched potentially damaging stories about him and pumped out articles pummeling his rivals, the former boss of the supermarket tabloid testified Tuesday during the ex-president’s trial on charges of falsifying business records.

Trump, the first former U.S. president to face a criminal trial, spent his day in the Manhattan courtroom fighting two pitched battles — one against the testimony of former tabloid executive David Pecker, his longtime friend, and another against the increasingly likely prospect that he will be punished by the trial judge for allegedly violating a gag order.

On both fronts, prosecutors seemed to inflict significant damage. At one point, New York Supreme Court Justice Juan Merchan warned Trump lawyer Todd Blanche that he was “losing all credibility.” At another, Trump grimaced and shook his head as Pecker described how he helped kill an allegation — ultimately found to be false — that Trump had a child with a maid at his building.

The busy court day was punctuated by prosecutors detailing the full factual and legal foundation of their case against Trump, one built around a misdemeanor state charge of trying to illegally influence an election.

Pecker, the former CEO of American Media Inc., the company that once ran the Enquirer and other celebrity gossip publications, said he met with Trump and Trump’s then-lawyer Michael Cohen in 2015 to discuss how the tabloid, which had a long relationship with the real estate mogul and reality TV star, could help Trump’s bid for president.

“I said what I would do is I would run or publish positive stories about Mr. Trump, and I would publish negative stories about his opponents,” Pecker testified.

That wasn’t all he pledged to do.

Pecker said he told Trump: “I would be your eyes and ears. … If I hear anything negative about yourself, or if I hear anything about women selling stories, I would notify Michael Cohen as I did over the last several years.”

The deal Pecker described was a mutual back-scratching arrangement in which Cohen would feed stories to the tabloid about Republican rivals like Ted Cruz, and the paper would publish glowing stories about Trump. Pecker said he had a “great relationship” with Trump dating to the late 1980s, but that didn’t seem to be his primary motivation. Stories about the brash celebrity businessman helped sell copies of the tabloid.

“I needed the help,” Pecker said.

The Trump Trials

Prosecutors used the testimony by Pecker — who appeared cheerful and relaxed, and occasionally laughed as he testified — as a kind of guide into the world of celebrity gossip, backroom dealmaking and Trump’s secret fear that stories about his private life could damage his presidential bid.

Prosecutors say the 34 criminal counts at issue in the case — falsifying business records — grew out of the original idea of the Trump Tower meeting with Pecker: that Trump and his allies would find a way to “catch and kill” bad stories about him to protect him and his campaign.

Trump defense lawyer Emil Bove objected to some of Pecker’s testimony, arguing that the Manhattan district attorney’s office was trying to make legal conduct — meetings and discussions of celebrity gossip stories — sound like a criminal conspiracy, when Trump was not charged with any such conspiracy, and that the events described in testimony so far were not crimes.

Assistant District Attorney Joshua Steinglass said the prosecution’s entire theory “is predicated on the idea that there was a conspiracy to influence the election in 2016,” adding, “Mr. Bove may interpret some of the evidence in a way that’s different from the way that we interpret it.”

Under New York state law, falsifying business records is a misdemeanor, unless it is done to further or conceal another crime. Then it can be charged, as it was in Trump’s case, as a felony. Since indicting Trump, prosecutors have often been vague about what, exactly, was the underlying crime that was allegedly being concealed or furthered.

In court Tuesday, Steinglass said the statute in question is state election law 17-152 — conspiracy to promote or prevent an election. That law makes it a misdemeanor when two or more people “conspire to promote or prevent the election of any person to a public office by unlawful means.”

The defense and the prosecution did agree on one thing: Both sides expect continued disputes at trial over how much testimony about political figures, and political activity, should be presented to the jury. Trump is the likely Republican nominee in the November presidential election.

Manhattan District Attorney Alvin Bragg has charged that Trump falsified business records to conceal a $130,000 payment made ahead of the 2016 presidential election to adult-film actress Stormy Daniels, to prevent her from saying publicly that she had a sexual encounter with Trump years earlier.

Cohen later pleaded guilty in federal court to a campaign finance violation for arranging that payment and later getting reimbursed by Trump. Trump’s lawyers say their client was unaware of the particulars of how Cohen made the payment and was not part of any criminal pact.

Throughout most of the trial Tuesday, Trump was attentive as Pecker described their relationship.

Pecker recalled buying the rights to a doorman’s claim that Trump had a child outside his marriage — a claim that Pecker said was untrue but nevertheless could have damaged Trump’s campaign. The Enquirer paid $30,000 for the tale and kept it quiet until two months after the election, Pecker said.

Pecker is scheduled to be back on the witness stand Thursday — the trial is not in session on Wednesdays — and is expected to describe discussions with Cohen about other potentially scandalous stories involving Trump and women that they tried to keep from becoming public.

Cohen, a disbarred, convicted lawyer and admitted perjurer, is expected to testify in the case, and Trump has spent much of his time out of court publicly denouncing him — despite a gag order issued by Merchan barring him from making comments about witnesses in the case.

The trial resumed Tuesday with a hearing on the prosecutor’s request that Trump be found in contempt for at least 10 violations of the gag order.

Prosecutor Christopher Conroy asked the judge to remind Trump that “incarceration is an option” if he continues to violate the order. Some of the alleged violations occurred in the hallway just steps outside the courtroom.

“His disobedience,” the prosecutor said, “is willful, it is intentional.”

Trump has previously declared that he would be willing to go to jail over the issue of the gag order.

Trump “says whatever he needs to say to get the results that he wants,” Conroy said. “He’s doing everything he can to undermine this process. It has to stop.”

Prosecutors have asked the judge to impose a $1,000-per-violation fine for the statements.

Blanche, Trump’s lawyer, argued against punishing his client, saying he is a presidential candidate who has to be allowed to respond to political attacks, even if those attacks come from Cohen. He also said social media posts that repost what others say are not a violation of the gag order.

Unimpressed, the judge asked what legal precedent he could cite for that argument.

“We don’t have any case law to support that, but it’s just common sense, your honor,” Blanche replied.

As the hearing wore on, Merchan grew more impatient with what he said were Blanche’s vague and nonresponsive answers.

“You’ve presented nothing. I’ve asked you eight or nine times, show me the exact post he is responding to. You’ve been unable to do that even once,” Merchan said.

“Mr. Blanche, you are losing all credibility,” the judge said. “You’re losing all credibility with the court.”
