Mexico vows to continue accepting non-Mexican migrants deported by U.S. border agents

Mexico's government has agreed to accept non-Mexican migrants and asylum-seekers deported by U.S. authorities along the southern border even after the pandemic-related emergency rule known as Title 42 lapses next week, Mexican and U.S. officials said in a joint statement late Tuesday.

The agreement between Washington and Mexico City will allow the Biden administration to continue deporting some migrants who U.S. officials have struggled to deport to their home countries due to diplomatic or logistical reasons, such as Cubans, Haitians, Nicaraguans and Venezuelans.

It will also allow the U.S. to continue a major component of the border strategy President Biden unveiled this year — applying "consequences" to, or deporting, migrants who enter the country unlawfully and fail to use a legal migration channel created by his administration. 

The agreement was announced after senior U.S. officials, including Mr. Biden's Homeland Security Adviser, Liz Sherwood-Randall, met with Mexican President Andres Manuel López Obrador in Mexico City to outline their plans to manage migration once Title 42 expires next week.

Since March 2020, Title 42 , a public health authority dating back to World War II, has allowed U.S. border agents to expel hundreds of thousands of migrants to Mexico or their home countries without giving them a chance to seek asylum. The policy is set to sunset on May 11, with the expiration of the COVID-19 public health emergency.

Most migrants have been expelled to Mexico, which has accepted returns of migrants from Guatemala, Honduras and El Salvador, alongside its own citizens, under Title 42. Since January, Mexico has also accepted expulsions of migrants from Nicaragua, Cuba, Haiti and Venezuela.

Senior U.S. officials, including Homeland Security Secretary Alejandro Mayorkas, had previously said that it was their intention to continue deporting migrants from these four crisis-stricken countries to Mexico. But Mexico had not publicly announced their agreement until Tuesday. In the joint statement, Mexico said it would continue receiving non-Mexican migrants for "humanitarian reasons."

The deportations after Title 42 end would be carried out under regulation immigration law, including a process known as expedited removal, which could lead to migrants' swift deportation, and banishment from the U.S. for five years, if they don't claim asylum or are deemed ineligible for protection.

Those deportations are expected to work in conjunction with a soon-to-be finalized regulation that will disqualify non-Mexican migrants from asylum if they failed to seek refuge in a third country before entering the U.S. illegally.

The five-pillar plan unveiled Tuesday by the U.S. and Mexico also highlighted efforts to target human smugglers, including a campaign with Panamanian and Colombian officials to stem the flow of migration near the notorious and roadless Darién jungle connecting Panama with South America

The plan includes references to improving conditions in Central America, expanding legal migration pathways for would-be migrants and modernizing ports of entry along the U.S.-Mexico border to facilitate legal trade and travel. Officials also pointed to the establishment of processing centers in Colombia and Guatemala, announced last week by the U.S., so migrants can be considered for resettlement in those countries, the U.S., Canada or Spain. 

The plan revealed for the first time that the U.S. had committed to admitting up to 100,000 migrants from Guatemala, Honduras and El Salavador under a program that will allow citizens of those countries to enter the U.S. legally if they have approved visa sponsorship requests from family members who are U.S. citizens or legal residents.

Tuesday's agreement underscores the growing influence and role of the Mexican government in U.S. efforts to manage and deter migration to the southern border, where U.S. officials are preparing for what could be a historic spike in illegal crossings.

The Biden administration is preparing for more than 10,000 migrants to enter U.S. border custody each day after Title 42 lifts, a number that would double the daily average in March. In the lead-up to the policy shift, border arrivals have already increased sharply, with U.S. border agents recording between 7,000 and 8,000 migrant apprehensions in recent days.

On Tuesday, the Pentagon announced the deployment of another 1,500 troops to the southern border to relieve some of the pressure on border agents by helping them with operational duties, such as transportation and data entry. In accordance with federal law and long-standing practice, the active-duty service members will not detain or otherwise process migrants.

We’re going on a very short cruise from California to Mexico this spring. Do we need passports for our kids, even if we don’t get off the ship? — Ben, Springfield, Va.

There’s a difference between what you need and what is a good idea to have.

Let’s begin with the first: On most cruise lines and for most itineraries, a voyage that starts and ends at the same U.S. port and stays in the Western Hemisphere will not require any American citizen — child or adult — to have a passport.

These are called closed-loop cruises, and they only need proof of citizenship, such as a birth certificate plus a government-issued photo ID, according to U.S. Customs and Border Protection . For people under 16, a birth certificate will suffice. Popular cruise lines including Carnival , Royal Caribbean and Norwegian detail their requirements and any exceptions online.

A sailing that leaves from one U.S. port and ends at another — or starts in the United States and ends at a foreign destination — would not be classified as a closed-loop cruise. Everyone, including kids, would need a passport in that case.

There are some caveats, warns Teresa Tennant, senior vice president of the travel planning company Cruise Specialists . Some cruise companies, including Holland America Line and Princess Cruises , say that all members of a party must have a passport if minors are traveling with only one adult.

Some other cruise lines, such as the luxury Regent Seven Seas Cruises, require a passport for all sailings.

“It’s important to always check with the cruise line, because they can set their own rules that are actually above and beyond,” Tennant said.

Customs and Border Protection also urges travelers to check with their cruise company, travel agent and destination to confirm what’s required to enter foreign countries on an itinerary.

Whether or not you are required to have a passport, cruise lines and experts say it’s smart to have one before setting sail. The task isn’t quite as onerous as it used to be, now that wait times have returned to pre-pandemic norms of six to eight weeks for routine service and two to three weeks for the expedited process.

Cruise lines say they strongly recommend that passengers opt for the passport over other forms of identification.

“A passport is the hassle-free, gold standard for traveling between countries,” Royal Caribbean says on its website. “Boarding and disembarking through customs with a passport is usually faster than other types of ID documents.”

The U.S. State Department says travelers might need their passport “in the event of an unexpected medical evacuation or if the ship docks at an alternate port.” Travelers would also need their passports if they showed up late in a foreign port and the ship left without them — which has happened to some U.S. passengers recently.

“You should bring your passport even if your cruise says you won’t need it,” the State Department says on its information page for cruise ship passengers.

Colleen McDaniel, editor in chief of the news and review site Cruise Critic , said in an email that it would be much more difficult to get home without a passport if someone had to leave the ship.

“In such a case, you might have to rely on help from a U.S. embassy or consulate to return, which can take time,” she said.

Cinco de Mayo , which translates to "fifth of May" in Spanish, commemorates the Mexican victory over the French at the Battle of Puebla on May 5, 1862.

“It's the French under Napoleon who sent their troops into Mexico," said Alexander Aviña, associate professor of history at Arizona State University.

"The Mexican army didn't really have any victory in this five-year occupation since the country had experienced the French raid from 1862 to 1867, but this was one of the few that occurred on the outskirts of Puebla and was led by Gen. Ignacio Zaragoza.

"So they lost a bunch of battles in those five years, but the one battle that they did win occurred on May 5 and that's why it's remembered, in Mexico today, but especially remembered in the area of Puebla. That's where most of the national festivities take place,” Aviña said.

Canadian police charged three people on Friday with the murder of Sikh separatist leader Hardeep Singh Nijjar  in the province of British Columbia in June 2023, Canadian media said, citing court documents.

Nijjar, 45, was shot dead outside a Sikh temple in Surrey, a Vancouver suburb with a large Sikh population.

The news broke days after the White House expressed concern about the reported role of the Indian intelligence service in assassination plots in Canada and the United States.

The presence of Sikh separatist groups in Canada has long frustrated New Delhi.

Nijjar was labeled a “terrorist” by India.

Prime Minister Justin Trudeau announced in September that Canadian authorities were pursuing allegations linking Indian government agents to the murder of Nijjar, a Canadian citizen.

New Delhi rejected Trudeau’s claim as “absurd.”

CTV and Global News first reported the news of those arrested on Friday, with CTV saying all three were Indian nationals.

The Royal Canadian Mounted Police are due to brief media about the case at 3:30 p.m. EDT (1930 GMT).

Neither the RCMP nor the Indian mission in Ottawa were immediately available for comment.

Canada had been pressing India to cooperate in its investigation.

Last November, U.S. authorities said an Indian government official had directed the plot in the attempted murder of Gurpatwant Singh Pannun , a Sikh separatist and dual citizen of the U.S. and Canada.

Canadian Public Safety Minister Dominic LeBlanc, in charge of Canadian law enforcement agencies, did not directly confirm the arrests but told reporters the probe into Nijjar’s murder was “still an active police operation”.

The Canadian Broadcasting Corporation earlier cited a source saying investigators had identified the suspects in Canada some months ago and had been keeping them under tight surveillance.

DOL Increases Compensation Threshold for Exempt Employees

Starting July 1, 2024, employers must satisfy a higher salary threshold in order to consider employees as exempt from Fair Labor Standards Act (FLSA) overtime rules. Following proposed rulemaking in August 2023 , the U.S. Department of Labor (DOL) finalized a rule on April 23, 2024, setting the standard salary level for the “white collar” exemptions under the FLSA at $844/week as of July 1, 2024 (up from the current $684/week). The weekly salary requirement for white collar exempt employees will then increase to $1,128/week on January 1, 2025. This represents an almost 65% increase in the minimum exempt salary threshold by January 1. It is important to note that paying the minimum salary alone does not establish that an employee is properly classified as exempt. Rather, white collar exempt employees must also satisfy the relevant “duties test” under the FLSA, the content of which remains unchanged by the final rule.

The final rule also increases the total annual compensation threshold required for an employee to qualify for the FLSA’s “highly compensated employee” exemption (HCE). As of July 1, the annual total compensation [1] requirement for the HCE exemption rises to $132,964/year (up from $107,432/year). The HCE requirement further rises to $151,164/year on January 1, 2025. This represents more than a 40% increase by January 1. Of note, the January 1 threshold compensation requirement for the HCE exemption matches that used by the Federal Trade Commission to define “senior executive” in relation to noncompete agreements; however, the non-monetary criteria are not identical.

These increases will be the first since January 1, 2020. Future updates will occur every three years starting January 1, 2027, per the final rule. Future updates will use then-current wage data to determine increases. The DOL will publish a notice in the Federal Register with the new earnings levels at least 150 days prior to scheduled updates. The final rule does allow the DOL to temporarily delay a scheduled update to the salary levels when “ unforeseen economic or other conditions warrant .”

While the final rule affects a large portion of the U.S. workforce, the DOL regulations remain unchanged for the earnings thresholds for white collar exempt employees in U.S. territories, the motion picture industry, and computer employees. Also unchanged are the treatment of bonuses for the purposes of satisfying the compensation threshold. Employers may use nondiscretionary bonuses and incentive payments (including commissions) to satisfy up to 10% of the standard salary test requirements for white collar employees, so long as the bonuses are paid at least annually. Additionally, employers may use nondiscretionary bonuses and incentive payments earned during a 52-week period for calculating the compensation threshold for the HCE exemption, so long as they are not used to satisfy the weekly standard salary level portion of the exemption test.

At least 4 million workers are expected to be impacted by the final rule by 2025.

Although no litigation has yet been filed, litigation impacting the effective date and enforcement of this final rule is possible. For example, in 2016, a federal judge in Texas issued a nationwide injunction preventing a DOL final rule regarding white collar exemptions from taking effect.

In advance of the July 1 and January 1 deadlines, all employers with salaried workers should audit the exempt status and salaries for their employees to ensure compliance with the DOL’s final rule. Employers will then need to work on raising salaries and/or reclassifying any employees who no longer qualify as exempt due to the increased salary thresholds.
