U.S. citizens have pretty unrestricted access to most international stops. However, that doesn't mean you never have to check if your destination of choice requires a visa. Despite any restrictions placed on travel during the first two years of the coronavirus pandemic, U.S. citizens continue to have one of the world's most powerful passports , allowing for visa-free access to most countries around the globe. In fact, the Henley & Partners Passport Index ranked the U.S. passport seventh in its 2023 list of the world's passports because it provides citizens visa-free access to 187 destinations, including countries that require Electronic Travel Authorization (often called an eTA) or a visa on arrival.

Americans can travel to most European, Caribbean, and Central and South American countries without a visa, along with many other popular tourism destinations. Countries that U.S. passport holders need visas to enter include Russia, India, China, Vietnam, Turkey, and more, and others require e-visas to visit.

ETIAS is an electronic travel authorization, similar to the United States ESTA . It prescreens visa-free travelers before they arrive in the Schengen Area. The system enhances security and improves border management.

From 2025, visa-free visitors from the United States must have a valid ETIAS linked to their passport.

A United States passport is a powerful document to have, ranking 7th in terms of travel freedom according to the 2021 Henley Passport Index . The Henley Passport Index is a global ranking of countries' passports according to the travel freedom they afford their holders. The U.S. passport is tied for 7th place with passports from several other countries: Czech Republic , Greece , Malta , Norway , and the United Kingdom .

Where can U.S. passport holders travel visa-free?

As of October 1, 2021, US citizens can travel visa-free to 185 countries and territories (though a few require a visa on arrival). Note, however, that some of these countries do implement stiffer requirements after one has stayed a certain length of time—typically 30, 60, 90, or 180 days.

Perhaps most importantly considering Europe 's popularity as a vacation destination, US citizens do not need a tourist visa to enter any of the 27 countries of the European Union —or the United Kingdom, which recently left the EU.

Countries that still require a visa ... and possibly something more

In countries where visas are required, travelers must typically pay registration fees, departure taxes, and travel fees. For example, if a U.S. citizen wants to travel to Russia , a visa is required, can take up to three weeks to process, and costs $139.

Many countries require potential visitors to be fingerprinted and photographed. Additionally, countries including Chad , the Democratic Republic of Congo, and Niger , require an International Certificate of Vaccination. This practice has become particularly prevalent since the global COVID-19 pandemic that began in early 2020.

Finally, some countries screen potential visitors based upon their previous destinations. In Libya , Sudan , and Syria , anyone with Israeli entry or exit stamps on their passport may be denied entry into the country.

China also requires a travel visa for US citizens. The application must include travel dates, itinerary, and proof of onward travel out of China. The application must also be typed and have no handwritten corrections. Additionally, every visitor to China between the ages of 14 and 70 is fingerprinted upon arrival and departure.

Which country is off-limits to U.S. citizens?

US citizens are not permitted to travel to North Korea , with or without a visa. The travel ban took effect in 2017 after a United States student died after being released from a North Korean prison. Failure to adhere to the rules can result in criminal penalties and having one's passport revoked. To travel to North Korea, US passport holders need to obtain a special passport validation from the United States government.

Before traveling, it is necessary to check the visa requirements of one's destination. It's also important to check any travel advisories a country might have, which are issued by the U.S. Department of State for unsafe countries .

The weight and the travel freedom attached to a passport vary drastically across nationalities. International visa-regulations are very complex and often non-transparent. They reflect the economical and geopolitical situations as well as the relationships of countries.

This project aims to cast some light on these structures. The default Visa-free destinations mode shows a choropleth map , which is shaded based on the number of destination countries/territories an individual of a certain nationality can travel to without a visa or with visa on arrival.

In order to display the visa regulations for a certain nationality, the source country/territory can be intuitively selected by clicking/tapping the map, via the live search field or by choosing it from the country list. In the Visa-free sources mode, you can alternatively explore the number of countries/territories whose nationals can enter a specific country without a visa or with visa on arrival. The GDP and population modes are added for reference. Other modes can be implemented in the future.

For certain passport holders like certain special types of british nationalities it can be more complicated. For this visualization, some simplifications had to be made, ie. only the most common citizenships are used as a data reference.

Design & technology

This single page web application features a responsive design which works across browsers, platforms and screen sizes. Since WebGL is now supported by iOS, it performs well on recent iOS devices running iOS 8+. Recent Android versions are also supported.

One of the main goals was to be able to render the map in real-time, so that live transformations (spherical to flat) are possible. To achieve this, the powerful Three.js library and its WebGLRenderer are used for display of the map. To keep the map reponsive and save computing power, the map is created as one large BufferGeometry object. The map data are sourced from Natural Earth Data , including the disputed areas maps, then converted to Geo JSON format and simplified to reduce it's complexity . Simplification using MapShaper seems to break the latest map version 5.1.1 – the current data are thus not simplified. It is loaded with D3.js and then transformed to be used in Three.js.

This website is a non-profit experimental visualization of visa regulation data pulled from Wikipedia in regular intervals and matched to the countries via the sovereignty of the respective country.

The data for territories, disputed areas, partially recognized countries and restricted zones cannot be imported from Wikipedia, because the data for those is not entered in a consistent form for all countries yet. For that reason, the number of visa-free destinations might differ from other indexes.

It is also possible that there are glitches in the way the data are read from Wikipedia besides the fact that the information on Wikipedia might not have been correct at the time of the last update.

The Visa Waiver Program  (VWP) enables most citizens or nationals of participating countries *  to travel to the United States for tourism or business for stays of 90 days or less without obtaining a visa. Under the Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015, travelers in the following categories must obtain a visa prior to traveling to the United States as they are no longer eligible to travel under the Visa Waiver Program (VWP):

• Nationals of VWP countries who have traveled to or been present in Democratic People's Republic of Korea, Iran, Iraq, Libya, Somalia, Sudan, Syria, or Yemen on or after March 1, 2011 (with limited exceptions for travel for diplomatic or military purposes in the service of a VWP country).
• Nationals of VWP countries who have traveled to or been present in Cuba on or after January 12, 2021 (with limited exceptions for travel for diplomatic or military purposes in the service of a VWP country).
• Nationals of VWP countries who are also nationals of Cuba, Democratic People's Republic of Korea, Iran, Iraq, Sudan, or Syria.

Requirements for Using the Visa Waiver Program (VWP)

You must meet  all  of the following requirements to travel to the United States on the VWP:

Travel Purpose Must be Permitted on a Visitor (B) Visa

The following are examples of activities permitted while in the United States on the VWP. In addition, transiting through the United States to other countries is generally permitted for VWP travelers.

• consult with business associates
• attend a scientific, educational, professional, or business convention or conference
• attend short-term training (you may not be paid by any source in the United States with the exception of expenses incidental to your stay)
• negotiate a contract

• visit with friends or relatives
• medical treatment
• participation in social events hosted by fraternal, social, or service organizations
• participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating
• enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation)

• work as foreign press, radio, film, journalists, or other information media
• permanent residence in the United States

Must Be a Citizen or National of a VWP Designated Country *

You must be a citizen or national of the following countries *  to be eligible to travel to the United States under the VWP.

• Czech Republic
• Liechtenstein
• Netherlands
• New Zealand
• South Korea
• Switzerland
• United Kingdom**

**To be eligible to travel under the VWP, British citizens must have the unrestricted right of permanent abode in England, Scotland, Wales, Northern Ireland, the Channel Islands, and the Isle of Man.

Each Traveler Must Have a Valid ESTA

In order to travel without a visa on the VWP, you must have authorization through the Electronic System for Travel Authorization (ESTA) prior to boarding a U.S. bound air or sea carrier. ESTA is a web-based system operated by U.S. Customs and Border Protection (CBP) to determine eligibility to travel under the VWP to the United States for tourism or business. Visit the  ESTA webpage  on the CBP website for more information.

Updating Your ESTA

In most cases, your ESTA will be valid for two years.  You also must obtain a new ESTA if you: (1) receive a new passport, including an emergency or temporary passport; (2) change your name; (3) change your gender; (4) change your country of citizenship; or (5) need to change your responses to any of the “yes” or “no” questions on the ESTA application.

These individuals can apply for visas using regular appointment processes at a U.S. Embassy or Consulate.  For those who require a visa for urgent travel to the United States, U.S. Embassies and Consulates stand ready to handle applications on an expedited basis.

If an individual who is exempt from the Act because of his or her diplomatic or military presence in one of the seven countries has his or her ESTA denied, he or she may go to the  CBP website , or contact the  CBP information Center . The traveler may also apply for a nonimmigrant visa at a U.S. Embassy or Consulate.

U.S. Customs and Border Protection strongly recommends that any traveler to the United States check his or her  ESTA status  prior to making any travel reservations or travelling to the United States. More information is available on the Department of Homeland Security (DHS) website . 

Have the Correct Type of Passport

You must have a passport that is valid for at least 6 months after your planned departure from the United States (unless exempted by  country-specific agreements ). For families, each member of your family, including infants and children, must have his/her own passport. 

In addition, you must have an e-passport to use the VWP. An e-passport is an enhanced secure passport with an embedded electronic chip. The chip can be scanned to match the identity of the traveler to the passport. E-Passports must be in compliance with standards set by the International Civil Aviation Organization (ICAO). You can readily identify an e-passport, by a symbol on the cover. See the example below. More information about e-passports is available on the DHS website .

Emergency and Temporary Passports

If you use an   emergency or temporary passport to enter the United States on the VWP, the passport must be an e-passport. This includes VWP travelers who are transiting the United States.

May I apply for a visa instead of using the VWP?

Yes, you may apply for a visitor (B) visa, if you prefer to do so or if you are not eligible for VWP travel. Additionally, you need to apply for a visa if you will be traveling on a private aircraft or other non-VWP approved air or sea carrier. Review the  approved carriers list . Also, if you intend to stay longer than 90 days, then you need to apply for a visa. 

I was denied a visa under section 214(b). May I use the VWP?

A recent visa refusal for any reason could result in denial of ESTA authorization, additional review at the port of entry, or denial of admission to the United States. If you are uncertain if you qualify for VWP travel, you may  apply for a visa.

Trips to Canada, Mexico, or nearby islands

If you are admitted to the United States under the VWP, you may take a short trip to Canada, Mexico, or a nearby island and generally be readmitted to the United States under the VWP for the remainder of the original 90 days granted upon your initial arrival in the United States. Therefore, the length of time of your total stay, including the short trip, must be 90 days or less. See the  CBP website . Citizens of VWP countries *  who reside in Mexico, Canada, or a nearby island are generally exempted from the requirement to show onward travel to another country *  when entering the United States. How can a country* join the VWP?

A country *  must meet various requirements to be considered for designation in the Visa Waiver Program. Requirements include, but are not limited to:

• enhanced law enforcement and security-related data sharing with the United States;
• issuing e-passports;
• having a visitor (B) visa refusal rate of less than three percent;
• timely reporting of both blank and issued lost and stolen passports; and
• maintenance of high counterterrorism, law enforcement, border control, and document security standards.

Designation as a VWP country *  is at the discretion of the U.S. government. Meeting the objective requirements of the VWP does not guarantee a country *  will receive VWP designation.

Entering the United States

An approved ESTA allows you to travel to a U.S. port-of-entry (generally an airport) and request permission to enter the United States, but an approved ESTA does not guarantee entry into the United States. The Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States. Learn more on the  CBP website .

Extending your stay

If you enter the United States under the Visa Waiver Program, you are not permitted to extend your stay in the United States beyond the initial admission period. You must depart the United States on or before the date on your admission stamp when you entered the United States. Change of status

If you enter the United States under the Visa Waiver Program, you are not permitted to change status in the United States. See  Change My Nonimmigrant Status  on the U.S. Citizenship and Immigration Services (USCIS) website.

What if I am traveling to Guam or the Northern Mariana Islands?

Citizens of Australia, Brunei, Hong Kong, Japan, Malaysia, Nauru, New Zealand, Papua New Guinea, South Korea, Singapore, Taiwan and the United Kingdom do not need a visa or ESTA to visit both Guam and the Northern Mariana Islands because of the Guam-CNMI Visa Waiver Program, though they must complete Form I-736 prior to travel.  People's Republic of China Passport holders also do not need a visa if they complete Form I-736 for temporary admission into the Northern Mariana Islands. For more information on the Guam-CNMI Visa Waiver Program,  click here

No. 96-8, Section 4(b)(1), provides that “[w]henever the laws of the United States refer or relate to foreign countries, nations, states, governments, or similar entities, such terms shall include and such laws shall apply with respect to Taiwan.” 22 U.S.C. § 3303(b)(1). Most people think that a Schengen visa is only for the Schengen zone. Yes, of course, it is. But many non-Schengen countries also honor Schengen visa as their own visa.

Reason 2: Countries trust the Schengen visa screening process

Schengen visa applicants are screened thoroughly for their strong ties with their home countries. Countries simply trust the Schengen visa application screening.

Reason 3: Countries that lack infrastructure, technology or resources

Countries may not have the required infrastructure, technology or resources to screen applicants as thoroughly as a Schengen visa.

What countries are included in the Schengen visa?

The following 27 countries are included in the Schengen visa.

• Czech Republic
• Liechtenstein
• Netherlands
• Switzerland

Apart from the above 27, there are about 53 non-Schengen countries and territories you can visit with a Schengen visa.

What Schengen visas are eligible for non-Schengen countries?

Depending on the country, any of the below Schengen visas can be used.

• Short-term C-Type Schengen visa (tourism/business)
• Long-term D-Type Schengen visa (study/work)
• Transit A-Type Schengen visa (transit)
• Residence permit from any Schengen country

• Permitted visas: All valid used/unused multiple-entry D-Type Schengen visas (student and work only)
• Schengen C-Type short-stay visas are NOT accepted

• Residence permit must be in the form of a “card”, residence permits in the form of visa stickers are not accepted

38. United Kingdom

• Permitted visas: All valid used/unused multiple-entry Schengen D-Type visas only (Short stay C-Type visas are not eligible)
• Entry granted: 24 hours only (Transit Without Visa)
• Visa is NOT EXEMPT, but are eligible to request a 24-hour entry at London (LHR) or Manchester (MAN) airports
• Must be traveling to or from the visa-issuing Schengen country only
• Must arrive and depart by air only
• Must hold the boarding pass for the onward flight
• Onward flight must be within 24 hours (on the same day or the next day before midnight)
• Granting the 24-hour entry is at the sole discretion of the immigration officer

39. Vatican City

• Entry granted: 1 day (there are no accommodation facilities for tourists in Vatican City)
• Entry rule: Vatican City doesn’t require any visa, but entry/exit to Vatican City is only through Italy which requires a Schengen Visa

8 Beautiful Places Where You Can Go Without a Passport

R ight now, there are unprecedented delays with the State Department issuing new passports and passport renewals , due to a bottleneck after pandemic shutdowns. With 500,000 weekly applications now rolling in, there's a huge backlog for passports. And if you're one of the unlucky Americans anxiously waiting for the State Department to catch up, you may be wondering what places you can travel to without a passport.

If you don't have a passport altogether, you're also not alone. In 2022, according to the State Department, there were 151,814,305 valid U.S. passports in circulation, while the U.S. population was 333,287,557—meaning approximately 55 percent of Americans don't have a passport.

Luckily, there are many exciting places in the U.S. that you can check off your travel bucket list without a passport or visa. America is home to adorably quirky small towns , beautiful national parks, and even gorgeous beaches —all reachable without a passport. And there are even U.S. islands and some territories, such as the U.S. Virgin Islands, where you can visit without a passport.

It can get confusing, however, as there are also other U.S. territories, like Guam, where you do need a passport to visit. You may also have concerns about whether to bring a passport when it comes to closed-loop cruises, especially ones that dock in other countries like Canada and Mexico. After all, bringing a passport when you don't need it makes for just one more important thing you have to worry about losing. 

To help make your trip planning as stress-free as possible, we spoke with travel agents and citizenship advisors to better understand where exactly U.S. citizens can travel without a passport—and why it's smart to travel with one in certain circumstances.

Why Don't I Need a Passport to Travel to Certain Areas?

If you're traveling within the U.S. and certain territories, you may not need a passport, says Tonya Waite , travel agent and founder of Belle Vie Travel .

"This encompasses the familiar 50 states and the U.S. territories including destinations like Puerto Rico, the U.S. Virgin Islands, and the Northern Mariana Islands," Waite explains. Travel to these areas is considered domestic travel, similar to a flight from New York to Chicago.

As far as closed-loop cruises go (cruises that depart from the U.S. to Bermuda, Canada, Caribbean, and Mexico that end at the same port), Ilisa Oman , a travel agent at One World Family Travel , assures travelers that they don't need proof of passport because of the Western Hemisphere Travel Initiative (WHTI) . For this type of travel, a state-issued driver's license or ID is typically fine.

However, there are exceptions. Keep reading for specific identification requirements related to certain areas.

Where Can I Go Without a Passport?

U.s. territories.

With its stunning white sand beaches, snorkeling, and Danish colonial architecture, St. Thomas is beloved a Caribbean island. As a U.S. citizen, you don't need a passport to visit U.S. Virgin Islands, but you do need one to visit the British Virgin Islands. St. Thomas is located in the U.S. Virgin Islands, as Global Residence Index founder Mark Damsgaard notes, so you only need to present a government-issued ID with your photo.

Tropical paradise St. Croix also has pristine beaches, turquoise waters, and championship golf courses. And it's also another one of the U.S. Virgin Islands. Thus, you're not required to bring a passport when traveling to and from the island, Damsgaard says.

The smallest of the three U.S. Virgin Islands, St. John boasts the Salt River Bay National Historical Park and Ecological Preserve, which offers scuba diving, hiking, and prehistoric archaeological sites. Damsgaard notes that because St. John is part of the U.S. Virgin Islands, you don't need a passport in order to travel there.

Northern Mariana Islands

The same rules apply to the Northern Mariana Islands, which consist of 14 tropical islands, with sandy shores and blue waters, and offer activities like windsurfing, cavern dives, and jungle treks. "U.S. citizens can visit the remote islands of the Northern Mariana Islands without a passport, but you need to have a government-issued proof of identification with you," Damsgaard explains.

Puerto Rico

An unincorporated U.S. territory, this Caribbean island features its sandy beaches, mountains, waterfalls , and the only tropical rainforest in the U.S. National Forest System. If you're a U.S. citizen traveling from anywhere within the U.S., then you don't need a passport, Damsgaard says. However, by May 2025, the Real ID Act will be in effect, he adds, "so if your state isn't compliant with this Act, you will need a passport to visit Puerto Rico."

You do need a passport to visit the westernmost territory of the U.S. "In general, Guam requires U.S. citizens to have a valid passport when entering the island," Damsgaard says. "On a case-by-case basis, you might only be required to have a valid proof of identification or citizenship." However, it's better to travel with one, just in case. And it is well worth it to explore its white-sand beaches, the culture of the local Chamorro people, and unique stone structures.

American Samoa

An unincorporated U.S. territory, American Samoa includes seven volcanic islands in the South Pacific. "The U.S. Citizenship and Immigration Services (USCIS) does not exercise jurisdiction over the islands," Damsgaard explains. So, you still need to have a passport when traveling to its islands.

Closed-Loop Cruise Destinations

The Bahamas

With 16 islands, the Bahamas feature both white and pink sand beaches, blue-green waters and coral reefs, and golf courses—making it a popular cruise destination. According to Nassau Paradise Island, an island in the Bahamas, those arriving to the Bahamas on a cruise ship that departs from U.S. soil may be able to provide WHTI documents instead of a passport. But travelers should confirm that before setting sail. Also, be careful of making sure your passport won't expire within six months of your departure.

The Central American country is home to unparalleled natural wonders, including hot springs, tropical rainforests, and one of the most important nesting spots for sea turtles. For cruises stopping in Costa Rica, as long as the cruise begins and ends at the same U.S. port, you don't need a passport to travel there, per CostaRicaCruises.com. You will, however, have to show proof of U.S. citizenship, which can be done with a government-issued ID with a photo or a certified copy of your birth certificate.

Turks and Caicos

An archipelago of 40 coral islands, Turks and Caicos is renowned for its gorgeous white sand beaches and luxury resorts. According to Travel Visa Pro, closed-loop cruise passengers can use WHTI documents in replace of a passport.

The British Virgin Islands

Part of a volcanic archipelago, the British Virgin Islands incorporates about 60 islands of varying sizes. If your cruise docks at the British Virgin Islands (BVIs), you will need to present a passport to enjoy the islands.

Cruises to Mexico highlight the country's tropical jungles, sandy shores, and ancient architecture. Similar to Costa Rica, you only need a government-issued ID with a photo or a certified copy of your birth certificate if traveling via a cruise ship that begins and ends on U.S. soil.

If you're headed to Canada on a cruise, you'll likely see beautiful natural scenery, charming shorelines, and world-class cities. The same identification requirements apply to closed-loop cruises that stop in Canada.

Within the U.S.

The Florida Keys

The Florida Keys are a tiny collection of islands nestled between the Atlantic Ocean and Gulf of Mexico, about 120 miles off the tip of the state of Florida. The tropical destination is a southern extension of the state of Florida and home to Key West, an ultra-popular vacation spot in the spring and summer. Despite being super close to the Caribbean, U.S. citizens don't need a passport to travel there.

Hawaii is the only U.S. state that is both an archipelago and located in the tropics. And you don't need a passport to visit it and take in its gorgeous beaches, Polynesian culture, or epic natural wonders. However, similar to Puerto Rico, the state of Hawaii will be instituting the Real ID Act in May 2025, so be sure to obtain your Real ID by then.

The northernwest U.S. state, Alaska—with its snowy terrain, extraordinary wildlife, and famed dog sled races—might seem a world away from the continental U.S. Alaska is home to the country's largest national park (13 million-acre Wrangell-St. Elias) , highest peak ( 20,310-foot Denali) , and longest coastline, with 66,000 miles of Arctic and sub-Arctic shorelines.

But U.S. citizens only need a Real ID to travel to Alaska; a passport isn't required. The one caveat to this rule is if you're traveling to Alaska via Canada. Those driving to Alaska from Canada, taking a ferry, or with a layover in Canada, will need to bring a passport with them.

Can Americans go to Europe without a passport?

In short, the answer is no. Whether you're flying or setting sail, you will be prompted to show proof of passport identification upon arrival to a European border control officer. "Americans need a passport when traveling to Europe and the passport must be valid for at least three months prior to your departure from a European country," Damsgaard says.

For example, let's say you've had your passport for two months and three weeks. You will be allowed into the European country, but you will not be allowed back into the U.S. until you hit that three-month validation mark.

Should I bring my passport with me, even if I don't need to?

It's better safe than sorry, Damsgaard advises. "It's better to carry your passport with you even when your destination doesn't require it," he says out of caution.

Waite agrees, noting that traveling with a passport can serve as a valuable contingency plan. "Having a passport on hand can be highly beneficial in situations such as an unplanned layover in a foreign country or any unforeseen travel disruptions," she explains.

Can I use my birth certificate in place of a passport?

Very rarely does a birth certificate carry the same weight as a passport. "Your birth certificate isn't a substitute for a passport," Damsgaard warns. "You can only use it in place of a passport when you travel to other U.S. territories or closed-loop cruises, where you need a proof of identification and nationality."

That said, if you're traveling to an unfamiliar territory or are concerned about unplanned international affairs (like a flight change), Damsgaard highly recommends bringing a valid passport just to be safe. It's better to be prepared, especially if you're traveling solo or to a destination where you don't know anyone.

What happens if you travel without a passport?

Traveling domestically, including to U.S. territories, without a passport typically isn't an issue. It's traveling internationally without a passport when you start running into problems. If you travel without a passport to a country that requires proof of one, you likely will be denied entry, says Oman. Realistically, you probably won't even make it that far because security won't let you board the plane, or a ship if you're traveling by sea.

In terms of closed-loop cruises, you could get stranded in a foreign country, due to missing the ship or a medical emergency. In those cases, you will need to go to the nearest U.S. embassy and obtain an emergency passport to fly home. Oman warns that is an expensive and time-consuming process.

From Alaska's stunning arctic landscape to Puerto Rico's lush, tropical jungles and the pristine white sand beaches of St. Thomas, there are many beautiful and transportive places you can travel to without a passport as a U.S. citizen.

But while there are several places where you can go without one, it doesn't hurt to travel with a passport in the event of an emergency or unplanned travel disruption, such as a layover or flight cancellation. In any case, double check what identification documents are needed to enter the country you're visiting.

If you are a nonresident of the United States filing Form 1040-NR, U.S. Nonresident Alien Income Tax Return , you may be able to use one of the three filing statuses: single, married filing separately (MFS), or qualifying surviving spouse (QSS). Two other filing status available for Form 1040-NR filers are foreign trust and foreign estate.

Married filing jointly (MFJ)

Generally, you cannot file as married filing jointly if either spouse was a nonresident of the U.S. at any time during the tax year. However, nonresidents married to U.S. citizens or residents can choose to be treated as U.S. residents and file joint returns. For more information, refer to Nonresident spouse .

Qualifying surviving spouse (QSS)

You may be eligible to file as a qualifying surviving spouse (QSS) and use the joint return tax rates if:

• You were a resident of Canada, Mexico, South Korea, or were a U.S. national (see Instructions for Form 1040-NR ),
• Your spouse died during one of the two prior tax years, and you have not remarried before the end of the current year, and
• You have a dependent child living with you

Head of household

You cannot file as head of household if you are a nonresident at any time during the tax year.

Married nonresidents filing separately

If you are married nonresident of the U.S., but your spouse is not a U.S. citizen or resident, you must use the Tax Table column or the Tax Rate Schedule for married filing separate returns when determining the tax on income effectively connected with a U.S. trade or business. You normally cannot use the Tax Table column or the Tax Rate Schedule for single individuals.

Standard deduction

If you are a nonresident of the U.S., you cannot claim the standard deduction. However, students and business apprentices from India may be eligible to claim the standard deduction under Article 21 of the U.S.A.-India Income Tax Treaty. Refer to Publication 519, U.S. Tax Guide for Aliens and to Revenue Procedure 93-20 for more information.

You can claim deductions to figure your effectively connected taxable income (shown on page 1 of Form 1040-NR). You generally cannot claim deductions related to income that is not connected with your U.S. business activities (shown on Schedule NEC (Form 1040-NR) PDF ). Except for certain itemized deductions, you can claim deductions only to the extent they are connected with your effectively connected income.

Nonresidents of the U.S. can deduct certain itemized deductions if they receive income effectively connected with their U.S. trade or business. These deductions include:

• State and local income taxes,
• Charitable contributions to U.S. non-profit organizations,
• Casualty and theft losses, from a federally declared disaster, and
• Other itemized deductions.

Use Schedule A (Form 1040-NR) PDF to claim itemized deductions. For a discussion about certain itemized deductions refer to IRS Publication 519.

For tax years beginning after December 31, 2017, nonresidents of the U.S. cannot claim a personal exemption deduction for themselves, their spouses, or their dependents.

Adjustments to gross income

Nonresidents of the U.S. may claim certain adjustments to gross income on Schedule 1, Part II (Adjustments to Income) if they meet the relevant qualifications, including the following:

• IRA deduction
• Archer MSA deduction
• Health savings account deduction (see the Instructions for Form 8889 )
• Student loan interest deduction

Moving expenses (for members of the Armed Forces only)

• Self-employed health insurance deduction
• Self-employed SEP, SIMPLE, and qualified plans
• Nontaxable scholarship and fellowship grants (only if such income was included on Schedule 1, part I, line 8r in the first place)

Qualified business income deduction

You may be able to deduct up to 20% of your qualified business income from your qualified trade or business, plus 20% of your qualified REIT dividends and qualified PTP income. For more information, refer to Qualified business income deduction for details.

If you are a nonresident of the U.S. and receive effectively connected income, you may be able to claim some of the following credits:

• Foreign tax credit

Education and earned income credits

If you are a nonresident of the U.S. for any part of the year, you generally cannot claim the Earned Income Tax Credit, the Hope Credit, or the Lifetime Learning Credit. However, you may claim an adjustment for the student loan interest deduction. Refer to IRS Publication 519 for details.

Self-employment tax

Nonresidents of the U.S. are not liable to pay self-employment tax.

Note: In spite of the general rules mentioned above, self-employment tax may be imposed on a nonresident of the U.S. under the terms of an international Social Security agreement ( totalization agreements ). If you're a self-employed nonresident living in the United States, you must pay SE tax if an international Social Security agreement in effect determines that you're covered under the U.S. Social Security system. If you have questions about international social security agreements, or to see if any additional agreements have been entered into, you can visit the Social Security Administration's (SSA) International Programs website. If your self-employment income is subject to SE tax, complete Schedule SE and file it with your Form 1040-NR, U.S. Nonresident Alien Income Tax Return PDF .
