The new year comes with some new updates for travellers. The UK government has updated its visa policy to allow travellers on tourist visas to work while visiting the country. The change in immigration rules, effective from 31 January 2024, will allow visa holders to conduct work-related activities in the UK as long as their reason to visit is tourism, visiting family, or any non work-related activity.

In November 2023, the UK government expanded its immigration rules to allow a wider range of paid engagements for business travellers. As part of this update, the Permitted Paid Engagements (PPE) visa for experts coming to the UK to undertake paid engagements will now cease to exist, with everything allowed under the PPE visa incorporated into the six-month visitor visa . This will include activities such as attending meetings, interviews, and conferences; site inspections; negotiations; and signing off on deals and contracts. What it will not include is remote work as a digital nomad, as those looking to visit the UK primarily for work will need to apply for a relevant skilled worker visa.

The work being conducted should be finished during their stay in the country (up to six months), and meet the requirements and allowances as per the new rules. These include:

  • Those working in the UK on a visitor visa must not have paid work as their primary reason for visiting.
  • Those employed by an overseas company may consult or provide training or services on an internal project with UK-based employees of their corporate group.
  • Those employed by companies with both British and overseas branches may engage in direct client work as long as it constitutes a small part of their overseas responsibilities and is required by their UK branch.
  • Scientists, researchers, and academics may conduct research in the UK, and lawyers may also engage in activities such as providing advice, acting as an expert witness, participating in legal proceedings, and teaching.

The United Kingdom has announced significant revisions to its visa regulations, set to take effect on January 31, 2024. In a move aimed at enhancing both business opportunities and tourism, holders of tourist visas will now be permitted to work within the country.

Under the updated guidelines, employees of companies operating both in the UK and internationally can undertake work involving clients abroad. However, this work must constitute only a minor aspect of their responsibilities outside the UK and must be integral to a project or service based in the UK. While remote work is permissible, the primary purpose of the visit must not be remote employment.

The UK government will also extend permissions for scientists, researchers, and academics conducting research within the country. Exceptions include academics who may apply for a 12-month visit visa, with the option to seek extensions while in the UK. Additionally, lawyers will have the opportunity to engage in various activities such as providing legal advice, acting as expert witnesses, participating in legal proceedings, and teaching.

In a bid to streamline processes, the Permitted Paid Engagement (PPE) Visitor route will be incorporated into the Standard Visitor route. This integration eliminates the need for a separate visa for individuals involved in paid engagements, provided that such engagements are arranged within 30 days of arrival.

The revisions follow the earlier commitment made by Chancellor of the Exchequer Jeremy Hunt to expand business visitor regulations. This expansion aims to afford business professionals a wider array of approved activities, including participation in paid engagements, thereby facilitating increased business opportunities within the UK

Standard visitor visa

A standard visitor visa is required for visitors from most non-EEA countries temporarily coming to the UK to undertake activities, but not paid work by a UK employer.

The normal visa arrangements for visiting the UK apply - ie they must obtain a visitor's visa if they are from a country listed as requiring a visa. Check for UK standard visa requirements here: https://www.gov.uk/check-uk-visa

Permitted activities allowed in the standard visa

  • Attending meetings, conferences, seminars, interviews
  • Giving individual or a short series of presentations, provided that these are not organised as commercial events and will not make a profit for the organiser
  • Undertaking some forms of academic-related activities (see below)

Academic-related activities

If applying for a standard visa as a visiting academic individuals can stay in the UK for up to 12 months. They must:

  • be highly qualified within their field of expertise
  • be currently working in that field at an academic institution overseas
  • visiting either to take part in a formal exchange with a UK counterpart, to carry out their own research on sabbatical leave from their home institution, or to take part in someone else's research or clinical practice - as long as this does not involve filling a permanent academic post.

An academic from an overseas academic institution accompanying students to the UK as part of a study abroad programme may provide a small amount of teaching to the students at the host organisation.

Individuals must apply for a biometric residence permit if they are staying in the UK as an academic for longer than 6 months.

Letters of Invitation

The individual will need a letter of invitation from the University in relation to their visit.

The letter should be produced by the department, signed of by the Head of Department, and should clearly state in a non-technical manner the purpose and duration of the visit.

Applications

Applications for permitted paid engagement visas are made directly by the individual to to UK Visas and Immigration using the on-line application system . The application does not require University sponsorship.

Commonwealth Ancestry Visa

The Commonwealth Ancestry Visa is designed for citizens of the Commonwealth. It applies to people whose grandparent was born in the UK. It also extends to Commonwealth citizens whose grandparent was born before 31 March 1922 in what is now Ireland.  This visa allows you to work and live in the UK for an extended period of time. You don’t need to apply for a regular work visa and you have complete freedom of movement. The paperwork for this visa is different from most. You must provide birth certificates and marriage certificates that prove your heritage.

Tier 2 Visas

The majority of people coming to work in the UK do so with a Tier 2 visa, which is sometimes called a long term work visa. The Tier 2 category covers a number of workers, including those in the UK for an intra-company transfer, some religious leaders, and sportspeople. However, for most workers not from the European Union, the General Work Visa is the category that applies to them.

The Tier 2 General visa is intended for all skilled workers who have already been offered a job. As such, you need a certificate of sponsorship from your employer to apply. You can come to the UK for a total of 5 years and 14 days on a Tier 2 General visa. As well, you’re permitted to enter the UK 14 days before your employment contract officially begins, which gives people time to find housing and get settled.

Tier 2 Visa versus Standard Visitor Visa

The UK Standard Visitor Visa has replaced many other categories of visas, including the former Business Visitor Visa. If you’re coming to the UK for business meetings, conferences, training, research, seeking funding, and a whole host of other business-related activities, this is the visa for you. It differs from the Tier 2 General Visa in that the holder is not allowed to work and earn money in the UK. It’s also for a much shorter period of time. In general, the Standard Visitor Visa only allows stays of 6 months. However, there are some exceptions, including a 12-month stay permitted for academics conducting research.

What is the Tier 5 Working Holiday Visa?

The Tier 5 category of visas is designed for temporary workers. This includes people doing charity work, creative or athletic activities, and certain religious work. It also includes people between the ages of 18 and 30 who want a working holiday experience.

Working holiday visas are offered as part of the Youth Mobility Scheme . There is a cap on the number of visas that are issued each year. This visa option allows the holders to travel and take on both short-term and seasonal work. As such, you don’t have to save the full amount needed to support yourself before you go like with other visa types. The visa application fee is £244.

Unlike many other visas, you can apply up to six months before you intend to travel, as opposed to the standard three months. Decisions are usually made fairly quickly, within 15 days on average.

Options For Entrepreneurs

A Tier 1 Entrepreneur Visa is required for people who want to move to the UK to set up a business. This visa comes with strict requirements. Applicants need to show their business plan, evidence of at least £50,000 in investment funds, plus personal savings to support themselves in the UK. This visa doesn’t allow the holder to maintain any other kind of employment. You’re only allowed to work on your own business.

How Much is a UK Work Visa?

The fee structure for a UK visa is based on things like the kind of visa you are applying for and your nationality. To give you an idea of costs, a Tier 2 visa costs £610. Those who apply for a Tier 2 visa in a field where there is a shortage of skilled labor pay a bit less at £464.

In addition to your visa fees, you also need to pay a healthcare surcharge. The exact amount you pay depends on multiple factors, including the kind of visa you need, how long you will be working, where you are from, and more. You can expect to pay a minimum of several hundred British Pounds for each year your visa is valid. There is a handy online calculator that can help you narrow down your expected fees.

When To Apply for a UK Work Visa

As with all visa applications, the earlier you can apply, the better. You can apply for a visa up to three months before you intend to work in the UK. Applications are processed through the British Embassy or High Commission closest to you. Processing time is about three weeks, though it can take longer for certain nationalities. In general, applications are processed more quickly when they’re made in a Commonwealth country, like Canada or New Zealand. This is because the High Commissions in Commonwealth countries are generally larger than the average Embassy and thus have more staff on hand to process things.

How To Apply for Work in the UK

All UK work visa applications begin online. But to get a biometric residence permit – which is required for some visas – you’ll need to visit your nearest authorized visa center to have your fingerprints recorded. They’ll also take your photograph. If you’re already in the UK and need to switch or extend your visa, you can apply locally. There’s no need to leave the country. If your visa requires you to present your supporting documentation upon arrival in the UK, you usually have ten days to do so.

Documents Needed to Apply for a Work Visa in UK

No matter where you work overseas, you can be guaranteed of one thing: paperwork! Before moving abroad to the UK or applying for your UK work visa, you’ll have to submit supporting documentation. In general, you can expect to provide your current passport (which must have a blank page for the visa to be pasted in), proof of adequate funding to support yourself, and an employer sponsorship (if relevant). In many cases, you must also demonstrate English language proficiency. You may also be required to present a tuberculosis test.

Exceptions for European Citizens

If you are from EU, EEA or Switzerland you can work in the UK for up to 6 months, then you need to apply for a visa. As the UK has left the EU, a transition period has been set until the end of 2020. For the time being, however, the rules will remain the same.

Come January 31, the United Kingdom will introduce significant changes in its visa rules that will expand business activities for individuals carrying visitor visas. The tourist visa holders would be now allowed to work with clients, and work remotely when visiting the UK.  The move is likely to boost business and tourism in the country.

As per the VisaGuide.World, “The UK’s government has published an update to its immigration rules, thus permitting more activities on Visitor Visas, while confirming that the new changes will become effective from January 31, 2024."

The government will also explore further reforms to the business visitor rules, during 2024."

Switching Visas within the UK: Types and Restrictions

Switching visas in the UK means holders of a valid, non-expired visa who are currently in the UK to switch to a different type of visa without needing to leave the country. However, not all visas can be switched to another within the UK. Therefore, it is important to check whether switching is an option available to you. This can be done by checking the switching criteria for the visa you wish to switch to; this will provide a list of visas you can or cannot switch from. In recent years, the rules on switching visas have been relaxed, allowing more visas to be switched to another visa type while in the UK and, hence, providing visa holders greater flexibility.

Restrictions on switching visas within the UK

Before applying to switch to a different visa within the UK, it is important to understand the restrictions that may apply to you, including:

  • Not all visa types can be switched
  • You may be restricted from switching based on your immigration status
  • Your dependant family members will need to apply separately
  • You may be subject to travel restrictions when you switch visa

Which visa types cannot be switched?

You can not switch to another visa within the UK if you currently hold one of the following visa types:

  • short-term student visa
  • parent of a child student visa
  • seasonal worker visa
  • domestic worker visa

Switching restrictions based on immigration status

It is also unlikely that you will be able to switch to a different visa type in the UK if you are on immigration bail or if you received permission to remain ‘outside the immigration rules’, e.g., if granted on compassionate grounds.

Dependants must apply separately to switch

If you plan to switch to a different visa type, your dependants (partner and children) can also do so before their visa expires, but they will need to apply separately. This can be done when you apply or at a later date.

Travel restrictions when switching your visa

Once you have submitted a visa switch application, you must remain within the UK, Ireland, and the common travel area (the Channel Islands and the Isle of Man) until you receive a decision.

What type of visas can you switch within the UK?

Under the current immigration rules, there are several options if you wish to switch from one visa type to another, depending on your circumstances. We commonly assist those who wish to switch from a:

  • Short term work visa to a long-term work visa
  • Graduate visa to a work visa
  • Student visa to a family visa
  • Work visa to a business visa (e.g. innovator visa or start-up visa )
  • Tier 4 student to skilled worker visa
  • Switch from spouse visa to tier 2
  • Switching from fiance visa to spouse visa
  • Switching from dependant visa to tier 2
  • Tier 2 dependant to tier 4 student
  • Switching from tier 5 to spouse visa

In order to switch from one visa type to another, in all cases:

  • You must be in the UK when you apply
  • Your current visa must not have expired
  • The immigration rules must allow the switch you wish to make
  • You must meet the immigration rules for the visa you are applying for
  • You must have adhered to the immigration rules and the conditions of stay for your current visa
  • Not have breached the law while in the UK
  • You must not be on immigration bail or have leave outside the rules (LOTR)

Switching to a student visa within UK

It is extremely common for overseas nationals in the UK to switch to a student visa, for example, from a:

  • Skilled Worker visa to a student visa
  • Family visa to a student visa
  • Dependant family member visa to a student visa

To make a successful application to switch to a student visa, you must have an unconditional offer of a place on a course with an educational establishment with a valid sponsor licence (e.g. school, college, or university).

You may also need to prove that you have sufficient funds to support yourself in the UK if you have been here for less than 1 year; you will need to show evidence that you can fund yourself for at least 9 months at £1,334 per month for courses in London and £1,023 per month for courses outside London.

Those switching to a student visa must also speak English to CEFR level B2 (if studying for a degree or above) or CEFR level B1 (if studying at below degree level).

Switching to a UK work visa within UK

Many overseas nationals switch to work visas while in the UK. We commonly see people switching from the student, graduate, business, and family visas to Skilled Worker visas and other specialist work visas such as the Global Talent or High Potential Individual (HPI) visa.

To switch to a work visa in the UK, in most cases, you will need:

  • An offer for a job on the list of eligible occupations from a licenced sponsoring employer in the UK
  • To meet the minimum salary requirements
  • To speak English to a required standard

Certain work visas, such as the Global Talent visa and HPI visa , do not require you to have a job offer, but you will need to meet other criteria.

In the case of the Global Talent visa, you will need to provide an endorsement from an approved endorsing body that you are a leader or potential leader in academia or research, arts and culture, or digital technology. HPI visa applicants must show they have received a degree or higher from a top international university (outside of the UK) in the last 5 years.

Switching into family visa of a British citizen/settled person

It is also extremely common for foreign nationals to switch to a family visa if their partner is a British citizen or a person who has settled in the UK, including those switching from work, student, or business visa. To switch to a spouse/partner visa under the family visa scheme, you will need to prove that:

  • You are married, or in a civil partnership with a British or Irish citizen, or a person who has settled here (e.g. indefinite leave to remain ), or if not married, you have been in a relationship for 2 or more years
  • Meet the English language requirement (CEFR level A1)
  • You and your partner have an annual income of £29,000 or more

Switching to a dependant visa in the UK

You may decide to switch to a dependant family member visa if your partner is a foreign national and they have a substantive visa to remain in the UK (e.g. work, business, or student visa). Examples of this type of visa switch include switching from a:

  • Student visa to a dependant visa
  • Skilled Worker visa to a dependant visa

To switch to a dependant visa in the UK, your partner must have a valid visa type that allows them to sponsor your stay in the UK. Not all visas allow holders to bring dependants to the UK. Applicants must:

  • Be in a civil partnership or marriage with the main visa holder or have been living together in a relationship for at least 2 years
  • Prove they have sufficient funds to support themselves in the UK (£285 for a partner)

How to switch a visa within the UK?

The process of switching visas in the UK will depend on which visa you are applying for. For example, if switching to a UK work visa, you will need to secure a job offer and have a Certificate of Sponsorship . For a UK business visa, you may need an endorsement from an approved endorsing body. Once you have the necessary pre-requisites in place, the main steps you need to complete to switch are as follows:

  • Complete and submit the relevant application form (please note, there is normally a specific application form for ‘in-country’ applications for each type of visa)
  • Pay the application fee and other associated costs (e.g. immigration healthcare surcharge)
  • Arrange an appointment with a UKVCAS service point to provide your biometrics (fingerprints and photo)
  • Upload any documents required to support your application (e.g. passport, copies of qualifications, letter of endorsement, etc.)
  • Attend your biometric appointment

How long can it take to switch a visa within UK?

The application processing time to switch your visa will depend on the type of visa you are switching to. In most cases, you can expect to receive a decision within 8 weeks of your application. This may take longer if you do not provide all of the information needed to support your application or if the Home Office require any further details before they make a decision.

Visa types available to work in the UK

There are a number of different visa routes available that allow individuals to travel to the UK to work in an unsponsored role.

Please note, there are separate web pages for the sponsored routes of  Skilled Worker visa and the  Health and Care visa , that cover details such as applicable job roles and minimum salary thresholds. 

Below are some of the routes used to give people a generic right to work in the UK (other routes such as  family visas and dependents are also available):

  • Youth Mobility Scheme visa.
  • Student visa.
  • Graduate visa.
  • British National (Overseas (BNO)) visa.
  • Global Talent visa.
  • Temporary Worker route.

Immigration Health Surcharge 

Please note, each of these visas require the Immigration Health Surcharge to be paid per person per year, unless they take up a role in public sector healthcare where they will be eligible for a  refund . The current cost is £1,035 per person.

Refugees can work in the UK without any restrictions. Most refugees were working before arriving in the UK and have a background in many different roles. Many refugees want to find work in the UK and to make a contribution.  

International recruitment and retention toolkit

Right to work 

The visa routes outlined below all come with a right to work and therefore are subject to  right to work checks . An online checking portal is available for holders of certain types of right to work, such as biometric residence permits (BRPs).  Evisas will be rolled out over 2024 and replace BRPs. 

The  Youth Mobility Scheme visa is a temporary route that provides young people, from participating countries, with an opportunity to experience life in the UK and gives young people the opportunity to live and work in the UK for up to two years. 

Eligible applicants must be aged between 18 and 30 or 18 and 35* at the time of application, have £2,530 in savings and citizens of countries within the arrangements or are a British Overseas Citizen, British Overseas Territories Citizen or British National (Overseas). The application fee costs £298.

The scheme exists between certain countries, which enables young British citizens to benefit from similar opportunities overseas. 

Applicants cannot apply for the Youth Mobility Scheme if they have children under the age of 18 who live with them or who they are financially responsible for.

The UK currently operates youth mobility scheme arrangements with: Andorra, Australia*, Canada*, Monaco, Japan, New Zealand*, San Marino, Hong Kong, South Korea*, Uruguay, Iceland and Taiwan.

Applicants from Hong Kong or Taiwan must be selected in the  Youth Mobility Scheme ballot  before they can apply for a visa.

*The Youth Mobility Scheme visa is available for applicants from New Zealand, Australia, Canada or South Korea if you’re aged 18 to 35. You must be aged 18 or over when your visa starts, or 35 or under when you apply for it.

The  Student visa is available for individuals who are over 16 and have been offered a place on a course by a licensed student sponsor. A student who has been granted permission to work in the UK should have an endorsement which states that they are able to work for 20-hours per week during term time and full time during holidays. This information can be available on their passport, or electronically on their eVisa or a biometric residence permit (BRP).

The student route requires the individual to have: 

  • a sponsor 
  • English language capability
  • the ability to financially support themselves
  • have consent from parents/guardians.

Students may need to prove that they can  support themselves financially and be able to pay for their course. The application fee for a student visa is £490.

Dependents may be allowed to come to the UK or stay longer in the UK if a government-sponsored student starting a course that lasts longer than 6 months or a full-time student on a  postgraduate level course (RQF level 7 or above) that lasts 9 months or longer.

The  Graduate visa  is available to international students who have completed a degree in the UK and is an unsponsored route.

This route enables international students to remain in the UK and work at any skill level for two years after they have completed their studies (or three years if they have a PhD).

Individuals cannot extend a Graduate visa but may be able to switch to a different visa including the  Skilled worker or Health and Care visa .

On 4 December 2023, the UK government announced that the Migration Advisory Committee will review the graduate route. We will keep employers informed of any further developments and you can view more details on the GOV.UK website.

The  British National (Overseas) (BN(O)) visa gives applicants a generic right to work in the UK. The BN(O) visa applies to those who were British Overseas Territories citizens by connection with Hong Kong and registered as a British national (overseas) before 1 July 1997. 

The BN(O) visa allows those who are eligible and their family members to live, work and study in the UK but cannot usually access public funds.

When applying, they will need to show that they have enough money to pay for housing and prove that they can support themselves (and their family) for 6 months.

Once individuals have a BNO visa, they might be able to  apply for access to benefits  if, for example, they:

  • do not have a place to live and cannot afford one
  • have a place to live but cannot afford essential living costs like food or heating
  • are at risk of losing your place to live or being unable to afford essential living costs
  • have a very low income, and not having access to benefits would harm your child’s wellbeing.

Under this route, applicants can stay in the UK from two years and six months up to five years. Their stay can also be extended as many times as they wish, and they have the right to apply to settle in the UK or for British citizenship. 

The BN(O) visa costs £180 for two years and six months or £250 for five years. Applicants will need to show they have enough money to pay for housing and to support themselves and their family for six months. 

On entry, there will be no English language requirement. However, applicants must demonstrate a commitment to learn English in the UK and require a good knowledge of the English language if they choose later to make an application for settled status (indefinite leave to remain) after five years. 

To work in an NHS skilled role, applicants will also have to meet the English language requirements of the relevant regulator, such as the  Nursing and Midwifery Council (NMC)  or the  General Medical Council (GMC) . 

East Midlands Council has produced a  promotional video  and has a  Hong Kong BNO Welcome Hub  available online.

There is also the national  Hong Kong Nursing Association UK .

Individuals can apply for a  Government Authorised Exchange visa if they want to come to the UK for a short time for work experience, training or to do an Overseas Government Language Programme, research or fellowship through an  approved government authorised exchange scheme . They also need to make sure to have:

  • meet the other  eligibility requirements
  • at least £1,270 available.

A certificate of sponsorship from a licensed sponsor is needed before applying to come to the UK to work. They will also need to pay the application fee of £298.

Depending on the scheme applied for, the visa can be for a maximum of 12 months or 24 months. On this visa applicants cannot take on a permanent job, however, they can study, work in a secondary job or do a job on the immigration salary list for up to 20 hours per week. Applicants may be able to apply to extend their visa if they meet the  requirements . 

The  Global Talent visa allows highly skilled individuals, such as top scientists and researchers who achieve the required points, to enter the UK without a job offer. Individuals need to be endorsed by a relevant and competent body and can stay in the UK for up to five years at a time. 

Applicants can also work in the UK on a Global Talent visa if they’ve won an  eligible award , and can benefit from a quicker endorsement process as part of a fast-track STEM scheme. 

To get a Global Talent visa, individuals may need to apply for an ‘endorsement’, as well as for the visa itself. However, they do not need to apply for an endorsement if they’ve won an  eligible award , this will allow them to  apply for the visa  straight away.

If an endorsement is needed, the application process will depend on whether an eligible job offer as an  academic or researcher  is in place, whether they have an  individual fellowship , a  research grant  approved by UKRI, or an application that is being  peer reviewed .

The total cost for the visa, and endorsement, is £716. If you’re including your partner or children in your application, they’ll also each need to pay £716.

The  High Potential Individual (HPI) visa  is intended to attract overseas individuals who demonstrate exceptional promise and are at the early stages of their careers. These individuals help to provide an additional pool of talent from which UK employers can recruit.

To be eligible, candidates must have been awarded a qualification by an  eligible university  in the last five years. Individuals can apply from within or outside the UK. They will not need a sponsor for work purposes and will have a general right to work for most jobs.

The HPI visa usually gives individuals the right to work for two years. If they have a PhD or other doctoral qualification, this will be extended to three years.

After that time, they will not be able to extend their HPI visa but may be able to switch to other routes such as  Skilled Worker  and the  Health and Care Visa . 

Individuals can only apply for a HPI visa once and cannot apply for a HPI visa if they have already been granted a  graduate visa .

As part of their application, individuals will need to ensure that they have enough money to pay for fees, £210 for  Ecctis  (an organisation which provides official UK national agency services on behalf of the UK Government in qualifications, skills, and migration), to check that the qualification is valid, pay the £822 application fee, and be able to support themselves on arrival in the UK with at least £1,270 available.

Can visitors to the UK work remotely?

Since the pandemic, the idea of working remotely has become increasingly popular and has allowed greater flexibility to travel. The shift to hybrid work models has also raised an important question regarding whether or not a person visiting the UK is lawfully able to work remotely during that visit. Here we explore this question. 

Visitors cannot work in the UK unless they are in the UK for a ‘permitted activity’. These are set out in Appendix Visitor: Permitted Activities .

What are the general rules on permitted activities?

Visitors to the UK are not allowed to:

  • take up employment in the UK;
  • work for an organisation or business in the UK;
  • establish or run a business as a self-employed person;
  • undertake a work placement or internship;
  • directly sell to the public; or
  • provide goods and services

However, a visitor may conduct general business activities in the UK. The following business activities are permitted:

  • attend interviews, meetings, conferences, and seminars;
  • negotiate and sign deals and contracts;
  • attend trade fairs to promote your business (you cannot sell things);
  • do work-related training if you are employed overseas and the training is not available in your home country;
  • give a one-off or short series of talks as long as they are not for profit or a commercial event (you must not be paid);
  • carry out site visits and inspections;
  • oversee the delivery of goods and services provided by a UK company to your overseas company or organisation;
  • deliver training or share knowledge on internal projects with UK employees of the company you work for overseas; and
  • install, dismantle, repair, service or advise on equipment, computer software and hardware, if your overseas company has a contract with a UK company or organisation.

Visitors are prohibited from undertaking paid or unpaid work for a UK company, or as a self-employed person. If an individual’s intention is to come to the UK to work for a company based in the UK (regardless of whether this will be in an office or from home), they will need to apply for a Skilled Worker visa.

Visitors can work remotely in some circumstances

The most recent Home Office guidance for visitors sets out the circumstances in which an individual can work remotely in the UK whilst on a visit visa.

The guidance states that visitors are permitted to undertake activities relating to their employment overseas remotely whilst they are in the UK, such as responding to emails and answering phone calls. However, the main purpose of the trip must be for a ‘permitted activity’. A visitor cannot come to the UK with the main intention to work remotely.

If it is indicated that a visitor will be working remotely in the UK, the Home Office is likely to question this to ensure the main purpose of the visit is not to work in the UK. The Home Office guidance states:

‘Where the applicant indicates that they intend to spend a large proportion of their time in the UK and will be doing some remote working, you should ensure that they are genuinely employed overseas and are not seeking to work in the UK’.

In such cases, it would therefore be prudent to provide evidence of employment overseas.

Genuine visitor

The Home Office will also need to be satisfied that the individual is a genuine visitor and will not be making the UK their main home through ‘frequent and successive’ visits. A number of factors will be considered such as:

  • the purpose of the visit;
  • the number of visits made in the past 12 months;
  • the length of previous visits; and
  • links to their home country.

This is still an evolving topic and more guidance would certainly be helpful regarding what is and isn’t permitted when remote working in the UK. The examples given in the Home Office guidance are fairly vague.

Unfortunately we are unable to provide ad hoc advice to individuals who work for an overseas employer on whether or not they may work during a visit to the UK.

With the purpose of the Visitor visa being that of temporary visitation, UK immigration law does not allow one to switch from a Visitor visa to a Worker visa as this could potentially enable bypassing the strict purpose of the Visitor visa. This also includes preventing visa fraud.

As such, those hoping to reside in the UK for work should understand that the Visitor visa does not provide a ‘route’ or pathway to a visa that will allow work due to its intended purpose. Despite this, you may conduct up to 30 days of voluntary service for a charity, as well as attend business meetings and conferences, though you cannot operate a business.

Short-term work may be undertaken should one acquire a special Temporary Worker visa such as the Religious or Creative Worker visa that differs from the more common Standard Visitor visa in allowing you to conduct the relevant type of work. These must be applied for from outside the UK, with holders potentially being able to later apply for a Family visa, as well as a Skilled Worker visa, should the eligibility requirements be met.

Those wanting to work for a longer-term who feel they may be able to acquire a certificate of sponsorship from a prospective employer should inquire about such Worker visas as the Skilled Worker visa. Changing Visitor Visa to a Student Visa

Likewise, as with those hoping to change to a Worker visa, it isn’t possible to switch to a Student visa from a Visitor visa: you must typically apply from outside the UK up to 6 months before the beginning of your course.

You also may not switch to a Student visa from a Short-term Study visa, which can be applied for outside the UK in order to enroll in an English Language course for up to 11 months.

Despite not allowing long-term courses of study like a full 3-year degree course, there are many activities the Standard Visitor visa allows such as short-term study at an accredited institution or conducting research as long as this does not exceed the 6-month term of stay.

As you cannot ordinarily extend this visa, it does not offer a pathway to study long-term, and as such those who wish to should apply for the Student visa from outside of the UK.

What Visas Can I Switch to from a Visitor Visa?

Unfortunately, if you are in the UK on a Standard Visitor visa your options of which visa you may stay on are extremely limited unless you can meet specific requirements.

Switching to a UK Family visa from inside the UK could potentially be an option if granted permission should a family court case or divorce proceedings oblige you to stay or you have exceptional circumstances which might qualify you to remain on the basis of your family life on a 10-year route.

The cost for a Family visa depends on who you are joining, how many dependents are being added to the application, the duration of stay, and if you are applying from inside or outside the UK.

There are options to also extend the Standard Visitor visa, such as for medical reasons if you are receiving treatment for more than 6 months. This can last up to 11 months and you would be able to extend this an indefinite amount of times as long as you are still eligible.

This exception likewise exists for academics who may potentially extend their Standard Visitor visa to a total of 12 months should they be considered highly qualified in their field and are involved with a relevant occupation at an overseas academic institution.

It typically costs £1000 for each time extending the Standard Visitor visa, but can be much cheaper if applied for in advance before arriving in the UK. The partner or children of the visa holder are also entitled to extend or apply for these special-requirement temporary visas.

Applying for the Standard Visitor Visa

The Standard Visitor visa, the most common visa under this umbrella of temporary visas, must be applied for online up to 3 months before your visit and requires paying a £100 fee as well as attending a meeting at a visa application centre. This will allow up to 6 months of stay and is usually intended for purposes of tourism, family visits, travel, or short-term study.

As such, you are heavily restricted on what activities you can do while in the UK on a Visitor visa, including being precluded from paid or unpaid work (including self-employment), long-term study, receiving state benefits, and as mentioned, switching to most other types of visa.

A lady, Jumtel, who wanted to relocate to the UK and lost R198k to a work visa agent, has come out to tell her story years after the ugly event left her penniless.

She said she was introduced to a company where she was supposedly being trained in preparation for work in the UK.

After a year, it became clear to Jumtel that the woman was not going to get any job despite all the preparations for the interview.

Graduate visa

A Graduate visa gives you permission to stay in the UK for at least 2 years after successfully completing a course in the UK.

You must be in the UK when you apply.

Eligibility

You can apply for a Graduate visa if all of the following are true:

  • you’re in the UK
  • your current visa is a Student visa or Tier 4 (General) student visa
  • you studied a UK bachelor’s degree, postgraduate degree or other eligible course for a minimum period of time with your Student visa or Tier 4 (General) student visa
  • your education provider (such as your university or college) has told the Home Office you’ve successfully completed your course

You can ask your education provider if you’re not sure whether they’ve told the Home Office you’ve successfully completed your course.

Check if your course is eligible and how long you need to have studied in the UK .

If you’re not eligible for a Graduate visa, you may be eligible for another type of visa to stay in the UK .

How long you can stay

A Graduate visa lasts for 2 years. If you have a PHD or other doctoral qualification, it will last for 3 years.

Your visa will start from the day your application is approved.

If you want to stay longer in the UK

You cannot extend your Graduate visa. However, you may be able to switch to a different visa, for example a Skilled Worker visa .

Check you can apply for another type of visa to stay in the UK .

How to apply

You must apply online .

Your partner and children can also apply to stay in the UK if they are eligible.

When to apply

You must apply before your Student visa or Tier 4 (General) student visa expires.

You can apply after your education provider (such as your university or college) has told the Home Office that you’ve successfully completed the course you took with your Student or Tier 4 (General) student visa. You do not have to wait until you’ve graduated or have been given a certificate.

As part of your application, you’ll need to prove your identity and provide your documents.

Your application may take longer if you need an appointment to do this. You’ll find out if you need one when you start your application.

Getting a decision

Once you’ve applied online, proved your identity and provided your documents, you’ll usually get a decision on your visa within 8 weeks.

You can stay in the UK while you wait for a decision.

How much it costs

When you apply for a Graduate visa, you’ll need to:

  • pay the £822 application fee
  • pay the healthcare surcharge - this is usually £1,035 for each year you’ll be in the UK

If you work in public sector healthcare

If you’re a doctor or nurse, or you work in health or adult social care, check if you’re eligible to apply for the Health and Care Worker visa instead. It’s cheaper to apply for and you do not need to pay the annual immigration health surcharge.

If you get a job in public sector healthcare after you have paid the healthcare surcharge, you may be able to get a refund .

What you can and cannot do

With a Graduate visa you can:

  • work in most jobs
  • look for work
  • be self-employed
  • continue living in the UK with your partner and children , if they’re eligible
  • do voluntary work
  • travel abroad and return to the UK

You cannot:

  • apply for most benefits ( public funds ), or the State Pension
  • work as a professional sportsperson

If your application is successful, you’ll get a full list of what you can and cannot do with a Graduate visa.

Studying with a Graduate visa

You can only study with a Graduate visa if your chosen course is not eligible for a Student visa . If your course is eligible for a Student visa, you can extend your Student visa instead.

You may need an Academic Technology Approval Scheme (ATAS) certificate if you’re studying or researching sensitive topics.
