SINGAPORE: Former tour guide Yang Yin, who misappropriated S$1.1 million from a wealthy Singaporean widow, has been deported from Singapore after serving his jail term.

The Chinese national was deported on Jun 9, the Immigration and Checkpoints Authority (ICA) said on Friday (Jun 10) in response to CNA’s queries.

He is also barred from re-entering Singapore, ICA added. 

In September 2016, Yang, then 42, was sentenced to six years’ jail for cheating Madam Chung Khin Chun, who was 89 that year, into giving him control over her assets. The jail term was later extended to nine years after an appeal by the Attorney-General's Chambers.

The pair met in 2006 and Yang acted as her tour guide in China two years later.

Yang moved to Singapore in 2009 to live with Mdm Chung when her husband died.

By 2010, the childless widow had made a will leaving all her assets to him. When she was diagnosed with dementia in 2014, her niece took Yang to court.

Court documents during the trial showed that in early 2010, Mdm Chung had S$2.7 million in liquid assets.

By August 2014, shortly before Yang’s arrest, the elderly widow’s bank account contained less than S$10,000.

Yang was also found guilty of duping the authorities into granting him permanent residency by setting up a shell company, falsifying hundreds of receipts and paying small sums in tax. 

Together with a 26-month sentence for fraud, Yang had to serve 11 years and two months in jail. He had been in remand since Oct 31, 2014, and served about two-thirds of his sentence.

On Friday, ICA said that his PR status was revoked on Nov 1, 2016.

Court freezes local assets of ex-tour guide’s wife

SINGAPORE — The niece of wealthy widow Chung Khin Chun has succeeded in getting a court order to freeze the local assets of former tour guide Yang Yin’s wife.

The High Court’s decision to grant the niece, Madam Hedy Mok, an injunction is the latest development in her legal saga with Yang, a Chinese national, over the control of Madam Chung’s assets, estimated to be worth about S$40 million.

At a closed door pre-trial conference yesterday, Justice Judith Prakash ordered the freeze on Madam Weng Yandan’s assets within the jurisdiction of Singapore — which means she cannot transfer her local assets until the outcome of Mdm Mok’s lawsuit against Yang is settled. Mdm Weng, 34, is back in China with her two children.

Mdm Chung’s lawyer Peter Doraisamy said he is satisfied with the order even though they had applied for a worldwide Mareva injunction. 

The court order is meant to prevent parties from disposing of assets locally or worldwide to avoid the risk of having to satisfy any judgment against them in legal proceedings.

Yang’s lawyer, Mr Daniel Zhu, said the order for a local injunction will lapse on Dec 17 if Mdm Weng is not added as a second defendant to the lawsuit against Yang by then. 

Yesterday’s hearing also confirmed that the bank account for Yang’s Young Music and Dance Studio will be frozen under a worldwide injunction against his assets that had been granted in August.

Yang, 40, is also engaged in a separate lawsuit with 87-year-old Mdm Chung, who is seeking to revoke the Lasting Power of Attorney that she had given to him in 2012. The LPA gives Yang the power to make key decisions on Mdm Chung’s behalf when she loses the mental capacity to do so.

Mdm Chung — who met Yang while she was on holiday in China in 2008 — was diagnosed with dementia this year. Her assets include a S$30 million bungalow in Seletar Hills, which Yang moved into five years ago. 

Yang is now in remand over a separate criminal case, where he faces 331 charges of falsifying receipts related to his company.  He had set up Young Music & Dance Studio in 2009 with Mdm Chung and obtained an Employment Pass to work in Singapore. 

Yang was granted permanent resident status in 2011 and his wife and children arrived in Singapore on long-term visit passes last year.

Yang Yin trial: Ex-tour guide admits to lying when convenient

Former China tour guide Yang Yin admitted to lying when it suited him after the prosecution produced evidence yesterday to show that he had lied about a painting he bought from Japan.

By the end of the day, he was left cradling his head in his hands, telling the court that he did not want to discuss his case any more.

Adding to his woes was a decision by the Court Of Appeal on Monday to throw out his application to appeal against a new will by wealthy widow Chung Khin Chun.

Yang, 42, who has been accused of misappropriating $1.1 million from Madam Chung, had paid about $106,000 in 2014 for a scroll painting of deer and pine by artist Shen Quan from Kansai Art Auction, an auction house in Japan.

However, he failed to declare the painting under his list of assets in an affidavit for the civil proceedings despite being told by the court to do so. Yang also said on Wednesday that the painting was one of "Guanyin" or the Goddess of Mercy.

During the ninth day of the trial yesterday, Deputy Public Prosecutor (DPP) Sanjiv Vaswani charged that the reason Yang failed to declare this painting of more than $100,000 was that he wanted to avoid it being detected in the civil suit.

"You are willing to lie when it is convenient and it suits you," said DPP Vaswani.

To this, Yang said through a court interpreter: "Agree."

Yesterday, the court also heard that the Chinese national had faked his credentials on two namecards. One of these was used when he tried to sell a fake painting of a cat by Chinese artist Xu Beihong.

One namecard listed several fake titles including director of the Singapore Chinese Chamber of Commerce, as well as arts broker of Beijing Arts and Cultural Company.

On his other namecard, he identified himself as Simon Yang Yin and an antique art investment adviser.

When DPP Vaswani asked Yang if he had ever pretended to be someone else, he replied: "In order to make a living in society, perhaps...

"I was worried that others would ask about my status, but I've never used that to deceive others for my own personal interests."

However, the prosecution showed a namecard Yang had given to an art dealer when he was trying to sell the fake painting.

Documents were also produced to show that Yang had faked his degree, which he earlier claimed to have obtained from the University of Financial Trade Beijing.

Yang later requested to take his leave from the witness stand, saying: "I don't wish to discuss my case. Can I?"

Deputy Presiding Judge of the State Courts Jennifer Marie granted his request, but told his lawyer Irving Choh to tell Yang that he had agreed to answer questions and give evidence. Yang returned to the stand about 15 minutes later. Mr Choh said his client understood he has to be cross-examined.

The trial continues today.

Separately, Yang had lost his bid to appeal against Madam Chung's new will - which leaves most of her assets to charity - after it was thrown out by the Court of Appeal. This closes one chapter in the ongoing saga.

The new will replaces an earlier one made in 2010, in which Yang stood to inherit all the widow's assets, which are estimated to be worth $40 million.

Former China tour guide Yang Yin was charged in court on Friday for falsifying the accounts of his company.

This is the latest drama involving Yang, who is embroiled in a legal tussle over the about $40 million worth of assets of 87-year-old widow Madam Chung Khin Chun.

Yang, 40, was slapped with 11 charges for falsifying the accounts Young Music and Dance Studio between 2009 and 2014.

He allegedly created receipts for payments which did not exist.

If found guilty, he can be jailed for up to 10 years and/or fined.

Ex-tour guide Yang Yin indicates he will plead guilty to immigration and falsification charges

SINGAPORE - Former China tour guide Yang Yin has indicated he will plead guilty to charges relating to immigration offences and the falsification of receipts made to his company.

However, his lawyers and the deputy public prosecutors are disputing some facts of the case. The hearing has been adjourned to Tuesday (May 31) morning for them to iron out the facts.

His criminal case was mentioned on Monday (May 30) before Deputy Presiding Judge of the State Courts S. Jennifer Marie.

Dressed in purple overalls and sporting neatly-trimmed hair, the 42-year-old looked tense when he appeared in court with his hands and legs shackled. He has been in remand since October 2014 after he was denied bail and has been charged with a total of 349 charges.

His most serious offences are two criminal breach of trust charges for allegedly misappropriating $1.1 million from wealthy widow Madam Chung Khin Chun. These charges will be heard in June and July.

Monday's trial involves charges of falsification and immigration-related offences.

Also in court on Monday were Madam Chung, her niece Hedy Mok and her long-time friend, retired teacher Chang Phie Chin.

Madam Chang, who is now 86, had lived with Madam Chung and her husband, Dr Chou Sip King, in their Gerald Cresecent bungalow before moving out in 2011. Dr Chou died in 2007.

Yang, who seemed to have lost weight, looked around the court room and when he spotted Madam Chung, he tried to make eye contact with her.

The case broke when Madam Mok started legal action against Yang for allegedly manipulating the widow to hand over her assets.

Yang first met Madam Chung when he acted as her private guide during a China trip in 2008. Madam Chang had introduced her friend to Yang.

He came to Singapore a year later and moved into the bungalow, subsequently setting up a company and obtaining an Employment Pass to work here.

He was later granted permanent residency and brought his wife and two young children over, with the entire family living in Madam Chung's bungalow.

Timeline of the case

2006 : Madam Chang Phie Chin introduces Yang Yin to Madam Chung Khin Chun and her husband, Dr Chou Sip King.

2007: Dr Chou dies.

2008 : Yang acts as the private tour guide for Madam Chung and Madam Chang while they are on holiday in Beijing.

Yang keeps in touch with Madam Chung after the trip.

2009 : Yang visits Madam Chung and stays in her bungalow. He also sets up his company, Young Music and Dance Studio . In September, Yang fires Madam Chung's driver of 30 years. He obtains an Employment Pass to work in Singapore.

2010 : Madam Chung makes a will leaving her assets, including the bungalow, to Yang.

2011 : Madam Chang moves out of the Gerald Crescent bungalow. She had lived there since 2004, after Dr Chou's health deteriorated.

Yang becomes a Singapore permanent resident.

2012 : Yang is given Lasting Power of Attorney (LPA) by Madam Chung, giving him control over her welfare and assets.

2013: His wife Weng Yandan and their two children move in to live in the Gerald Crescent bungalow.

2014 : In April, Madam Chung is diagnosed with dementia. The LPA is revoked in November after Madam Chung's niece, Madam Hedy Mok, starts court proceedings against Yang.

Yang is arrested in September and charged in October. He is later denied bail.

2015 : Madam Chung's new will is recognised by the Family Justice Courts in April. Her new will leaves most of her assets to charity and nothing for the former tour guide.

2016 : The High Court dismisses the appeal made by Yang in April this year regarding the new will. The criminal trials are scheduled to take place from May to July.

Former China tour guide Yang Yin, who is in a tussle for a widow's $40 million assets and facing 349 criminal charges, has claimed trial to the two most serious charges - that of siphoning $1.1 million from the widow.

The two charges for criminal breach of trust said that Yang misappropriated $500,000 and $600,000 from Madam Chung Khin Chun, 89. He had claimed previously that the monies were used to buy paintings for her.

Deputy Public Prosecutor Sanjiv Vaswani said in court today (July 1) that the prosecution is challenging the authenticity and value of the paintings, Channel NewsAsia reported.

For criminal breach of trust, Yang faces up to seven years' jail or a fine, or both.

Yang was convicted in May of 120 charges, including those of falsifying receipts and company accounts, and duping the authorities into granting him permanent residency here.

Yang has been in remand since October 2014, after he was denied bail.

Yang acted as Madam Chung's private guide in China during a trip in 2008. A year later, he came to Singapore and moved into Madam Chung's bungalow, claiming that she wanted him as her "grandson".

He then set up a sham company and later obtained permanent residency in Singapore. His wife and two children also moved here.

Madam Chung's niece, Madam Hedy Mok, applied to become her aunt's guardian after Madam Chung was diagnosed with dementia in 2014. After discovering that Yang already had Lasting Power of Attorney over Madam Chung's matters, Madam Mok sued Yang. She also confronted Yang's wife at the bungalow in September that year, trying to get Yang's family to leave.

6 learnings from former China tour guide, Yang Yin (杨寅) on how to be a better crook

The curious case of former China tour guide, Yang Yin (杨寅) , 40 and his relationship with multi-millionaire widow, Mdm Chung Khin Chun, 87, has been widely reported by the Singapore media, captivating the attention of the nation.

Yang had been in the news in recent weeks for a court case over his Lasting Power of Authority (LPA) over the assets of Mdm Chung. Mdm Chung’s niece, Mdm Hedy Mok, filed the court application to have his LPA revoked on the grounds that Mr Yang had manipulated and ill-treated Mdm Chung in order to control her assets worth some S$40 million. After the case came to light, it was later discovered that Mr Yang may have also falsified other claims, among other juicy updates.

Admittedly, I am not perfectly informed of all the salacious details or latest developments. Nonetheless, when piecing the story together based on what I have read, it is obvious that Yang Yin had the intention to swallow up Mdm Chung’s fortune, never mind whether it is via legal or illegal means. I am of the theory that Yang would have gotten the S$40 million and more if he was a better crook and used his brain more.

If you have the intention to scam wealthy old folks of their fortunes, here are some learnings from Yang Yin to be a better crook:

1. Do not keep a diary of your crime. Yang allegedly kept a diary on his roadmap to wealth, documenting his plots and deeds. This is really dumb. He had ample time to destroy the book when the case first surfaced, but somehow, it has now landed in the hands of the police. Dumber.

2. Patience. Yang claimed that Mdm Chung had adopted him as a god-grandson. If Yang treated Mdm Chung well, took care of her, be courteous and nice to Mdm Chung’s friends, relatives, employees and loved ones, no one would harbour any ill wills towards him. Yang alleged that trouble started brewing when he cut off Mdm Chung’s monthly remittance to her sister and niece. He also fired her driver and kicked out Mdm Chung’s good friend who had been staying with her for ages. He really should have just played the good guy and waited for his time.

3. Do not boast and flaunt your wealth online, leaving loads of digital trails and records for investigators. Yang seems to enjoy flaunting his unaccounted wealth online, uploading pictures of expensive vacations with his wife and kids, as well as boasting that he will become very rich soon. There is a reason why many politicians drive cheap cars and live in humble homes. Do not count your chicks before the eggs hatch.

4. Do not sell away stolen art items and other stuff online, again, leaving loads of digital trails and records for investigators. As I said, Yang does not seem to have much of a brain. Worse still, he appeared to have sold the rare art pieces at bargain prices, without reaping the full worths.

5. Do not self-inflate your personal status with bogus titles on crazy name cards. Unless you are as rich as the eccentric Chinese multi-millionaire, Chen Guangbiao , people are going to check all your credentials on your dubious looking name card. Yang was in hot soup after the Singapore Chinese Chamber of Commerce & Industry made a police report against him for misrepresenting himself as the association’s director.

6. Lastly, have a better dress sense. The mafia dons always look sharp and dapper, even when appearing in court. Yang’s frazzled hairdo is too fun to spoof. Getting arrested wearing like this doesn’t help either:

Nice tee-shirt, nice belt, nice pants, nice jacket, nice hairdo and nice plastic bag. They all go very well together.

Obviously, this post is written tongue-in-cheek. Scammers deserve to go to jail. If you aspire to be like Yang Yin, at least learn from all his negative examples and be a better, smarter crook!
