I did the Etna tour. I very much appreciated the switch of hiking and biking that allows one to visit different locations. For me the whole trip turned out to be very well-organized and fun of course. I've read some of the previous comments. However, judging by the three different guides I had on my tour I cannot confirm that there are problems with the English. You may find that the personnel of your accommodations is a bit more limited in which case your guides can help you out if need be. A found it a huge plus that the reorganisation of trips went smooth and easy when the wheather conditions (my trip was early April) required adjustment of plans, so no worries here. Do I need to comment on the food? I'd say no, it is Sicilia after all. You probably know what to expect from proper Italian food. In case you don't - try and find out, you won't be left dissappointed.

It is a culture filled with warmth and passion for all things Sicilian first, and Italian second – and captivates you in so many different ways as you traverse its deep agricultural heart, and take in the scenes around every windswept turn and up every rock-walled climb of what often feels like a forgotten land.

Travelling coast to coast, and from west to east, expect long, warm Spring days on daily rides that take you across the stunning and diverse landscape; from the sea to the mountains, and across the rugged hills, rolling farmlands and wildflower lined backroads in-between.

You’ll ride through countless beautiful villages and towns dotted across the landscape, including the captivating baroque towns of Ragusa, Caltagirone and Palazzolo Acreide; navigate delightful seaside towns from Trapani to Siracusa and San Vito to Avola; and find yourself immersed in the enchanting and timeless piazza’s of Ortigia and Taormina. You’ll spin past olive and pistachio groves, orange orchards and green-hued vineyards, ancient Roman hilltop villages, fields filled with black lava rocks and Greek temples that have been standing for 2500 years. The pinnacle will see you take on the tempestuous peak of Mt Etna and enjoy the 50km descent that follows.

An utterly spectacular start with a beautiful climb up to a charming and ancient Roman hilltop village. This will give you the opportunity to make micro adjustments to your bike set up as you stretch the legs after your travels

Highlight: The vista of the rugged mountain toward San Vito Lo Capo from the hairpin corners. Distance: 38.2km Elevation: 819m

Rolling out of our seaside village, we hug the coastline before heading into the rock-strewn rugged hills and through quiet villages on our way to one of Sicily’s iconic seaside spots

Highlight: The contrast of the vivid turquoise waters against the rugged backdrop. Distance: 87.2km Elevation: 975m

We will start the day with a short transfer in the van to our start location. From there we’ll proceed around the Sicani mountains and beautiful arid country dotted with olive groves as far as the eye can see, before changing tact and heading for the Valley of Temples.

Highlight: Rolling past Greek temples that have been standing for 2500 years. Distance: 101.9km Elevation: 1686m

An undulating day through the agricultural heart of Sicily on our way to Caltagirone and then on to our Masseria. We’ll wind our way through a landscape of open golden fields, patches of olive groves, roads lined with spring wildflowers and cacti, and punctuated with small villages and hills.

A short 75 minute transfer to our start location. From here we’ll ride around Mt Etna, with the gentle giant always visible over our shoulder. We’ll roll through orange orchards, pistachio groves, the black lunar landscapes from previous lava flows and past ancient hilltop towns, before a final 10km descent into our stunning mountain-side masseria.

Highlight: The continual view of Mt Etna through the changing landscapes. Distance: 75.5km Elevation: 1333m

The pinnacle of the tour where we we’ll tackle the gentle giant Etna. We’ll ease into the ascent and steadily climb for the first 27km through forests and old lava flows, before reaching the rifugio at the road’s end. Enjoy the view as we take in some refreshments before we have an utterly amazing descent back to our volcano side hotel

Of course, we’ll start with seafood, either “crudo”, cooked on charcoal, or in the sweet and sour “agrodolce” and progress through specialty pastas of each region with a long list of local ingredients that are often only grown in the rich volcanic soils of Sicily, or swim in the warm Tyrrhenian seas surrounding the island or available seasonally – from local sardines and prawns, pistachios and almonds, carciofi, wild fennel, agreti and pomodori daterini, marsala and of course the famous Sicilian citrus; we’ll all in season for our Spring tasting adventure.

You’ll try some wines that you may not have had before… including Etna Bianco, Insolia, Grillo, Catarratto. Frappato, Perricone, and some that you may have, including Nero d’Avola and the sensational Etna Rosso.

PRIOR TO THE EXCURSION/TOUR

INSTRUCTIONS FOR THE GUIDE/CHAPERONE:

  • Have a thorough understanding of what action will need to be taken if a Covid-related incident occurs during supervision of the activity.
  • Have all necessary hygienic equipment with you (face masks, gloves, hand sanitiser, glasses).
  • Know who to contact and how to manage any emergency and consequent quarantine period, e.g. contact the office immediately if anyone in the group suffers symptoms.
  • Follow the sanitation procedures of all rented equipment, after every single use, once returned by customers.
  • Respect, and ensure all customers respect, the government guidelines on social distancing and the use of face masks (other than the exceptions defined in the guidelines).

THE COMPANY TO CUSTOMERS:

  • For booking and payments, cashless is preferable. Booking, payments and receipts can all be processed online prior to the activity taking place.
  • Customers must be able to both receive and provide all necessary information via computer or smartphone, whether that be in relation to the equipment that they will need to bring (their daily sanitation and cleaning obligations), or on the more general rules to abide by during the activity (I ATTACH THE ‘CODE OF CONDUCT’ MANUAL).
  • Do not organise groups of more than 15 people per Guide (or choose a group size appropriate to the type of activity being carried out. In the case of excursions or experiences in caves, religious buildings, hermitages, enclosed spaces, the group size may need to be smaller or the visit may need to be split into staggered groups).
  • Customers must sign and send a release, in which they make a series of statements related to Covid (cf. ATTACHED TEMPLATE).
  • Customers must attend an online briefing, scheduled a couple of days prior to the commencement of the tour/excursion, highlighting all the security measures that will be put in place during the activity to ensure a smooth process, as well as the explanation of all aspects of the excursion and/or the holiday, subject to the activity.

THE COMPANY TO THE GUIDE/CHAPERONE:

  • The Company will provide the Guide/Chaperone with all important information about the group and all related factors.
  • The Company will supply the Guide/Chaperone with all sanitary products necessary to carry out the activity (face masks, gloves, hand sanitiser, glasses) and useful numbers to call in case of an emergency.
  • The Company will train the Guide /Chaperone on how to react in case of an emergency.

DURING THE EXCURSION/TOUR

 INSTRUCTIONS FOR THE GUIDE/CHAPERONE:

  • Before the activity begins, check the body temperature of all participants.
  • Check and ensure that all participants have the correct equipment at all times.
  • Hold group briefings in open spaces and with social distance, in which you must recap on the Code of Conduct during the activity and also mention the highlights of the activity.
  • Ensure that all participants respect the Code of Conduct for their own safety and the safety of others.
  • Narrate/explain the activity in open spaces, ensuring social distance is maintained between participants.
  • Take photos to document the trip without asking the group to pose close together, forcing them to break social distancing rules.

INSTRUCTIONS FOR THE CUSTOMER:

  • Respect the instructions of the Guide/Chaperone, accepting that any disrespectful behaviour or repeated complaints from others may result in your removal from the group.
  • Follow the rules of the Code of Conduct, sent by the Company.
  • Bring the necessary equipment for the activity, as well as what is needed for the security of your own personal health and hygiene.
  • Follow the sanitary procedures required for your own equipment, if not renting.
  • Take photos or videos without forcing people to pose together, to allow social distancing.

THE COMPANY:

  • Will control the activity throughout its duration, supporting the operation of the Guide/Chaperone in charge of the group.
  • Will monitor the movements of the group with evidence of the places and people encountered.

FOLLOWING THE EXCURSION/TOUR

 THE GUIDE/CHAPERONE:

–   Must sanitize all the equipment used during the activity.

–   Must submit a general report about the activity to the Company, including photos.

THE CUSTOMER:

  • Is advised to submit a Travel Feedback form to the Company, flagging any inappropriate behaviour by other participants or the Guide/Chaperone.
  • Is encouraged to rate and review their experience via the Company’s social media channels, highlighting the pros and cons of their experience, thus contributing to help future holidaymakers choose their activities.
  • Must take into account the feedback from the Guide/Chaperone and Customers, in order to remedy any shortcomings and find a solution for the safety of customers and staff.
  • Must run a Customer Satisfaction survey, with the aim of shaping each activity around the customers’ needs.

*REGULATORY FRAMEWORK:

The framework outlined makes it appropriate and necessary to reflect on legal issues of criminal and administrative importance , ex  Legislative Decree 231 of 2001, which could arise from the performance of activities under conditions that do not respect the appropriate precautionary levels established by the various regulatory sources.

The purpose of this contribution is therefore to analyze the criminal relevance of conduct attributable to  employers,  for non-compliance with safety standards in the workplace, as well as the related repercussions on the institution, pursuant to legislative decree  No.   231 of 2001 . In this regard, it should be emphasized that there is no doubt that Covid-19 contagion in the workplace should be considered as a valid  accident at work.  A confirmation of what has just been said is derived from Art.   42, paragraph 2,   of decree law n. 18, of March 17, 2020  (so-called Decreto Cura Italia), according to which the Coronavirus contagion must be treated by the public and private employer and by Inail as an accident. Even clearer on this point are the indications provided by Inail with circular no. 13, of 3 April 2020, according to which ” the rule referred to in the aforementioned article 42, second paragraph, clarifies some aspects concerning insurance protection in cases ascertained of infection with new coronavirus (SARS-CoV-2), which occurred during work. As a preliminary point, it should be pointed out that, according to the current approach on the treatment of cases of infectious and parasitic diseases, Inail protects these morbid diseases, placing them, in terms of insurance, in the category of accidents at work: in these cases, in fact, the virulent cause is equated with the violent one. In this context of morbid diseases, framed as accidents at work, cases of infection with new coronavirus occurred to any person insured by the Institute …”.

Then, with regards to of criminal law,   “ in the field of personal injury, ‘illness’ is constituted by any anatomical or functional alteration of the organism, even if localized, minor and not influential on general organic conditions , when the state of illness remains until the aforementioned process of alteration is in progress.  Quite correctly, therefore, the Territorial Court has claimed that the establishment in the body of a degenerative mechanism constitutes disease, which, if not confronted promptly and constantly with the intake of pharmacological treatment, leads to further alterations and the confirmed phase of AIDS.”  ( ex plurimis ,  Cass. pen., Sez.   V, no. 43763 of 29/09/2010 , Adam, Rv. 248778).

From this it follows, inevitably, as will be more widely analyzed in the following, that in cases of Covid contraction, by employees or third parties, within the workplace, a responsibility may arise both of the employer for the crimes of negligent injuries and manslaughter, committed in violation of the rules on the protection of health and safety at work, and of the company for violation of   legislative decree.   231   of 2001   .

DISCIPLINARY MEASURES TO CONTAIN AND PREVENT COVID19 INFECTION DURING GUIDED EXCURSIONS IN OUTDOOR ENVIRONMENTS

The Guide will be equipped with disposable health and safety items (single use gloves, hand sanitizer and either reusable or single use face masks) and will have extra items in case any participants have forgotten to bring their own.

The Guide will have ascertained during a Risk Assessment that the route does not present a certain need for physical contact with participants, to pass any critical steps (fords, impervious steps).

During the excursion, the Guide will be required to enforce a 2 metre distancing rule between participants, with the exception of cohabitants. The Guide will be vigilant about this.

The maximum number of participants will be 15, depending on the type of excursion (so that the Guide manages to keep the group in eyesight).

The Guide does not recommend sharing cars to reach the starting point of the excursion, with the exception of couples or cohabitants.

THE PARTICIPANT

Each Participant must be equipped with hand sanitizer and a single use/reusable face mask (ecological choice), to be kept on hand during the excursion but ready to use if in close contact with other hikers and, in any case, if the Guide requests you wear it.

It will be forbidden to exchange any item, food and drink between any member of the group, including the Guide.

The participant declares that they do not have any symptoms that may be attributable to CoVid-19.

BEFORE THE EXCURSION

For health and hygiene reasons, digital advance payment is recommended.

Each participant being registered must accept the updated TERMS AND CONDITIONS in relation to emergencies.

Standard terms and conditions for rental : Sicycling Tours s.n.c. ( Sicicla ), third companies or other parts working in connection with Sicicla (in this document: COMPANY) will provide customer sporting equipment, bicycles, parts, accessories and logistics services (in this document: GOODS) for rental.  Rental rates are fixed and determined at the time of quotation and accepted by the customer with booking payment confirmation. Customer declares that the GOODS provided by the COMPANY for the rental comply to the category agreed during the rental proposal and to the required usage for which they are rented. Supplied services are subject to terms and conditions set out in this document:

Pick up and Drop off: THE CUSTOMER confirms that the GOODS rented by the COMPANY are delivered and supplied according to their description, in perfect mechanical condition and without apparent defects. CUSTOMER must bring back the GOODS in the same conditions at drop off. If GOODS are used in breach of Terms and Conditions of use indicated in this rental contract, the COMPANY reserves the right to terminate the agreement and repossess GOODS at any time at CUSTOMER’s expense.

Damages and thefts: In the event of theft, loss or damages (also partial) of the GOODS during the rental period, the customer shall pay to the COMPANY the amount applied on the basis of average value of market (retail price from the listed public price at moment of theft) of the new GOODS and/or all resulting loss and expenses.   The COMPANY will obtain this compensation through traditional PayPal payment request using customer email address or by direct credit card payment via PayPal circuit. The COMPANY will charge the amount using credit card number data indicated in the agreement. The CUSTOMER authorizes the COMPANY to charge the amount of theft, loss or damages (also partial) to the GOODS provided for rental, calculated upon the damage and theft clause of this contract.  The COMPANY will notify to the customer by email the invoice, specification list and total amount of credit card charge.

Indemnity : As by Italian Law, the COMPANY cannot be considered responsible for any damage to persons or goods suffered by the customer, final users and /or by third parties, like accidents connected with the use of GOODS provided for rental by the COMPANY; loss or inconvenience resulting from delays on pick up and/or drop off of GOODS provided by THE COMPANY or third companies / parts working on logistics and rental services in connection with THE COMPANY; damages, delays, loss or inconvenience resulting from use or breakdown during the use of GOODS; loss, delays or expenses connected with thefts, damages, accidents or any other causes beyond The COMPANY’s control.  The customer assumes all responsibilities for the use of GOODS in case of an infraction of the Highway Code committed or irresponsible use of GOODS provided for rent by the COMPANY . 

Conditions of use: The customer is responsible of the rented GOODS. It is forbidden to:  overload the bike by carrying another person; sub-rent this contract to third people; propel or tow any vehicle, trailer or other object; compete with other people. The CUSTOMER is also responsible for himself: in the event of intoxication with alcohol or if he is found under the effect of hallucinogens, narcotics, barbiturates, or any other substance impairing his consciousness or ability of react; In contravention of any custom, traffic or other regulations and for people driving the bike other than him. Above all in this case, no one can drive the rented bike unless notification to the COMPANY has been made and unless it has been previously designated and authorized by the same. Customer can use GOODS outside Italy with previous communication to THE COMPANY.  The customer is the only one responsible for the use of GOODS provided for rental by the COMPANY.

Corporate Civil Liability Insurance: the COMPANY is covered by Allianz S.P.A. Insurance # 79301000.

Cancellation Policy :  In case of cancellation and return (also partial) of GOODS before the last rental day indicated in this rental contract, the COMPANY is not obliged to pay any compensation. No refund on return of GOODS before the time designated in this contract. Eventual extra rental days will be subject to negotiation between parties.

Customers and health : Customer declare that the final users of the rental services provided by the COMPANY are able to use GOODS and to ride the bicycles on the roads of country where CUSTOMER or final users are using the GOODS provided by the COMPANY.  The Customer is responsible for minors and declares that minors can use GOODS provided for rental by the COMPANY and that these GOODS will be used only by the presence and supervision of an adult. Customers declare and certify that final users of rental services provided by the COMPANY and covered by this contract are in good health conditions and that they are able in every condition like training, entertainment, itinerant travels, sporting competitions, etc.  Company is not responsible for health problems resulting and consequent by the use of GOODS provided for rent with this contract.

Joint and several conditions : Customer is identified by passport document/driving license or identity card valid and unexpired. Anyone who signs this agreement, either in his name or on behalf of another person or entity shall be responsible with the principal for the obligations to THE COMPANY.

Jurisdiction in case of dispute the law court of Palermo (Italy) has exclusive jurisdiction in case of dispute.

Safety: Customer declares that the COMPANY supplied all the necessary GOODS to guarantee safety and visibility of the customers on the road. Customer must not use mp3 players or mobile phones during cycling and must ride safe using the safety accessories provided and delivered to the CUSTOMER by the COMPANY for the rental.

Confidentiality, Privacy and Customers datas Customer authorizes the company to process the personal data for the only internal use in accordance to DLGS 196 Italian Law and GDPR (General Data Protection Regulation Law) n. 2016/679. Customer authorizes the procession, publishing and sharing of pictures and GPS tracking data in corporate web site, social media and other platforms.

The Company will not share or sell the customers datas or information to third companies/parties and will destroy credit card data indicated in this form at the closure of the rental contract. The personal data keeper, controller and manager is Francesco Tuzzolino, administrator at Sicycling Tours s.n.c.

ISTRUZIONI PER LA GUIDA/ACCOMPAGNATORE:

  • Conoscere alla perfezione cosa fare durante la gestione dell’attività in caso di emergenza Covid nel gruppo;
  • Avere al seguito quanto necessario per la prima assistenza; (mascherine, guanti, gel a base alcolica, occhiali);
  • Sapere chi avvisare e come gestire l’emergenza e l’eventuale quarantena; (esempio: Comunicare subito all’Azienda eventuali sintomi riscontrati nel gruppo);
  • Essere preparato sulle pratiche di sanificazione, dopo ogni uso, delle attrezzature eventualmente noleggiate dai clienti;
  • Rispettare e far rispettare ai clienti, le indicazioni governative sul distanziamento sociale e sull’uso della mascherina oltre a tutte le norme riportate nel vademecum;

L’AZIENDA VERSO LA CLIENTELA

  • Booking e pagamenti preferibilmente cashless, prenotazione, pagamenti e ricevute tutte online e precedenti all’attività da svolgere;
  • realizzare e fornire tutte le informazioni necessarie su smartphone o PC, sia sulle attrezzature da portare al seguito, (loro sanificazione quotidiana e pulizia) sia sui comportamenti e regole da tenere durante l’attività ( INVIO VADEMECUM COMPORTAMENTALE )
  • Non organizzare gruppi maggiori di 15 persone per Guida  (o con numero adeguato alla tipologia di attività da realizzare. In caso di escursioni o esperienze in grotte, edifici religiosi, eremi, strutture al chiuso, il numero potrebbe anche essere inferiore oppure suddividere la visita in più scaglioni)
  • Invio e Firma di una liberatoria,  dove il cliente fa una serie di dichiarazioni su Covid ( cfr. MODELLO ALLEGATO)
  • Briefing online,  organizzato qualche giorno prima dell’avvio del tour/escursione, dove mettere in risalto tutte le azioni di sicurezza che verranno messe in atto durante l’attività, per garantire una corretta fruizione; (oltre naturalmente alla spiegazione di tutte le caratteristiche dell’escursione e/o della vacanza oggetto dell’attività)

PER L’AZIENDA VERSO LA GUIDA/ACCOMPAGNATORE

  • Fornire tutte le informazioni necessarie alla Guida/Accompagnatore, sulla consistenza del gruppo e relativi partecipanti;
  • Dotare la Guida/Accompagnatore di tutti gli strumenti sanitari necessari allo svolgimento dell’attività (mascherine, guanti, gel a base alcolica, occhiali) e dei numeri utili da chiamare in caso di emergenza;
  • Istruire la Guida/Accompagnatore sui comportamenti da tenere in caso di emergenza.

FASE DURANTE L’ESPERIENZA

 PER LA GUIDA/ACCOMPAGNATORE

  • Prima dell’accesso all’attività, controllo della temperatura corporea ad ogni partecipante;
  • Controllo e valutazione se tutti i partecipanti hanno al seguito l’attrezzatura necessaria;
  • Briefing, in spazi aperti e con distanziamento, dove ricordare tutte le norme comportamentali durante l’attività e gli  highlight  dell’attività acquistata;
  • Controllo dei partecipanti che rispettino le norme comportamentali per la propria e altrui sicurezza;
  • Effettuare la narrazione dell’attività in spazi all’aperto, con il rispetto delle distanze fra i partecipanti;
  • Realizzare documentazione fotografica senza mettere in posa il gruppo costringendo le persone ad avvicinarsi.

PER LA CLIENTELA

  • Rispetto delle indicazioni della Guida/Accompagnatore accettando che in caso di mancato rispetto e ripetuti richiami, possa esse allontanato dal gruppo;
  • Rispetto del Vademecum inviato dall’Azienda;
  • Portare con se tutta l’attrezzatura necessaria per l’attività ma anche quanto necessario per la propria sicurezza igienica personale;
  • Rispetto delle procedure di sanificazione della propria attrezzatura se non noleggiata;
  • Realizzare foto o video senza costringere le persone a mettersi in posa per osservare il distanziamento.

PER L’AZIENDA

  • Continuo controllo dell’attività in corso, sostenendo l’operatività della Guida/Accompagnatore al seguito del gruppo;
  • Monitoraggio degli spostamenti del gruppo con evidenza dei luoghi e delle persone incontrate.

FASE DOPO L’ESPERIENZA

–         Sanificazione di tutte le attrezzature utilizzate durante l’attività;

–         Consegnare all’Azienda Report generale dell’attività, anche fotografico.

  • Compilare apposito form Travel Feedback, segnalando all’Azienda eventuali comportamenti non appropriati di partecipanti o guida/accompagnatore;
  • Segnalare il proprio gradimento o meno, sui vari social dell’Azienda, determinando un beneficio o uno svantaggio all’Azienda, contribuendo in tal modo ad aiutare nella scelta, i futuri potenziali fruitori.
  • Prendere contezza delle varie segnalazioni della Guida/accompagnatore e della clientela, per intervenire in caso di mancanze e porre rimedio per la sicurezza dei clienti e del personale;
  • Attivare una attività di customer satisfaction, tendente ad organizzare la propria attività attorno al cliente.

*QUADRO NORMATIVO:

Il quadro delineato rende opportuna e doverosa una riflessione sulle questioni giuridiche di rilevanza penale e amministrativa,  ex  d.lgs. 231 del 2001 , che potrebbero sorgere dallo svolgimento di attività in presenza di condizioni che non rispettino gli adeguati livelli precauzionali stabiliti dalle diverse fonti normative.

Il presente contributo si propone, quindi, di analizzare la rilevanza penale delle condotte ascrivibili ai datori di lavoro, per il mancato rispetto degli standard di sicurezza nei luoghi di lavoro, nonché le correlate ricadute sull’ente, ai sensi del  d.lgs. n. 231 del 2001 . A tal proposito è opportuno sottolineare che non vi è dubbio alcuno che il contagio da Covid nei luoghi di lavoro vada considerato alla stregua di un vero e proprio  infortunio sul lavoro . Una conferma di quanto appena affermato si ricava dall’ art. 42, comma 2, del decreto legge n. 18, del 17 marzo 2020  (cosiddetto Decreto Cura Italia), secondo cui il contagio da Coronavirus deve essere trattato dal datore di lavoro pubblico e privato e dall’Inail come un infortunio. Ancora più chiare sul punto sono le indicazioni fornite dall’Inail con la circolare n. 13, del 3 aprile 2020, secondo cui “ la norma di cui al citato articolo 42, secondo comma, chiarisce alcuni aspetti concernenti la tutela assicurativa nei casi accertati di infezione da nuovo coronavirus (SARS-CoV-2), avvenuti in occasione di lavoro. In via preliminare si precisa che, secondo l’indirizzo vigente in materia di trattazione dei casi di malattie infettive e parassitarie, l’Inail tutela tali affezioni morbose, inquadrandole, per l’aspetto assicurativo, nella categoria degli infortuni sul lavoro: in questi casi, infatti, la causa virulenta è equiparata a quella violenta. In tale ambito delle affezioni morbose, inquadrate come infortuni sul lavoro, sono ricondotti anche i casi di infezione da nuovo coronavirus occorsi a qualsiasi soggetto assicurato dall’Istituto…”.

Per la giurisprudenza penale, poi, “ in tema di  lesioni personali , costituisce  “malattia”  qualsiasi  alterazione anatomica o funzionale dell’organismo, ancorché localizzata, di lieve entità e non influente sulle condizioni organiche generali, onde lo stato di malattia perdura fino a quando sia in atto il suddetto processo di alterazione . Del tutto correttamente, pertanto, la Corte territoriale ha ritenuto che costituisce malattia l’instaurazione nell’organismo di un meccanismo degenerativo, che, se non fronteggiato tempestivamente e costantemente con l’assunzione di terapia farmacologia, conduce ad ulteriori alterazioni e alla fase conclamata di AIDS. ” ( ex plurimis ,  Cass. pen., Sez. V, n. 43763 del 29/09/2010 , Adamo, Rv. 248778).

Da ciò discende, inevitabilmente, come verrà più diffusamente analizzato nel prosieguo, che nei casi di contrazione del Covid, da parte dei dipendenti o di terzi, all’interno dei luoghi di lavoro, potrebbe insorgere una responsabilità  sia del datore di lavoro per i   reati di lesioni colpose e omicidio colposo, commessi in violazione delle norme sulla tutela della salute e sicurezza sul lavoro, sia della società per violazione del  d.lgs. n. 231 del 2001 .

DISCIPLINARE SULLE MISURE DI CONTENIMENTO E

PREVENZIONE DAL COVID19 NELL’AMBITO DI ESCURSIONI

GUIDATE IN AMBIENTE NATURALE

La Guida Ambientale sarà equipaggiata di dispositivi di sicurezza sanitari (guanti monouso, gel disinfettante e mascherina

chirurgica o lavabile a norma) e disporrà di dispositivi nuovi a norma qualora alcuni Partecipanti avessero dimenticato di

portare la propria dotazione individuale.

La Guida Ambientale si è accertata in fase di sopralluogo che il percorso non presenti necessità certa di contatto fisico coi

Partecipanti per il superamento di eventuali passaggi critici (guadi, passaggi impervi).

Durante l’escursione sarà richiesto di mantenere almeno 2 metri di distanza tra i Partecipanti, ad eccezione di conviventi.

La Guida vigilerà su questo.

Il numero massimo di Partecipanti sarà di 15 secondo la tipologia di escursione (così che la Guida riesca a mantenere

a vista il gruppo).

Le Guida sconsiglia la condivisione dell’auto per raggiungere il punto di partenza dell’escursione a meno che non si tratti di coppie o conviventi.

IL PARTECIPANTE

Ogni Partecipante dovrà essere fornito di gel igenizzante e di mascherina chirurgica o lavabile a norma (scelta ecologica), da

tenere a portata di mano durante l’escursione ma pronta all’uso se si presenterà l’incontro con altri escursionisti e

comunque se la Guida farà richiesta di indossarla.

Sarà vietato scambiarsi qualsiasi oggetto, cibo e bevanda tra qualsiasi componente del gruppo, compresa la Guida.

Il partecipante dichiara di non presentare sintomi che possano essere riconducibili a CoVid-19.

PRIMA DELL’ESPERIENZA

Per motivi igienico-sanitari si consiglia il pagamento anticipato per via elettronica.

Ogni partecipante in fase di iscrizione dovrà accettare TERMINI e CONDIZIONI aggiornati per l’emergenza.

  • Lavati spesso le mani con acqua e sapone o con gel a base alcolica
  • Evita il contatto ravvicinato con persone che soffrono di infezioni respiratorie acute
  • Pratica l’igiene respiratoria (starnutisci o tossisci in un fazzoletto evitando il contatto delle mani con le secrezioni respiratorie)
  • Evita abbracci e strette di mano
  • Evita l’uso promiscuo di bottiglie e bicchieri, in particolare durante l’attività sportiva
  • Non toccarti occhi, naso e bocca con le mani
  • Copri bocca e naso quando starnutisci o tossisci
  • Non prendere farmaci antivirali né antibiotici a meno che non siano prescritti da un medico
  • Mantieni in ogni contatto sociale una distanza interpersonale di almeno un metro
  • Si raccomanda l’uso di guanti ed occhiali personali
  • Uso esclusivo e personale dell’elmetto protettivo fornito dal TO, precedentemente sanificato, quando non si usa possibilmente esponi lo stesso al sole dal lato interno
  • Non condividere con altre persone le attrezzature in genere (es. bicicletta, whisper, borse laterali, pompa, ecc…) fornite dal TO, precedentemente sanificate
  • Porta con te e tieni a portata di mano pronta all’uso mascherina a norma e gel igienizzante, consigliati in tema di prevenzione dal contagio da COVID-19

Clausole e condizioni standard per il servizio di noleggio: Sicicla, terze parti o società che collaborano con Sicicla (definita nel presente contratto: SOCIETA’) dispone di attrezzature sportive, biciclette, parti di biciclette, accessori e servizi (definiti nel presente contratto: BENI) per il noleggio. Le tariffe di noleggio sono fissate e determinate al momento della quotazione e accettate dal cliente attraverso la conferma di prenotazione. Il cliente dichiara che i BENI forniti e consegnati per il noleggio da parte della SOCIETA’ sono conformi all’uso richiesto per il quale sono stati noleggiati. I servizi forniti sono soggetti ai termini e alle condizioni stabiliti nel presente documento.

Consegna e restituzione: il CLIENTE riconosce che i BENI noleggiati dalla SOCIETA’ sono consegnati e forniti in perfette condizioni meccaniche e senza difetti evidenti. il CLIENTE restituirà alla SOCIETA’ i BENI nelle stesse condizioni in cui gli sono stati consegnati alla data definita tra le due parti al momento della sottoscrizione del presente contratto. Se i BENI saranno fruiti in violazione delle condizioni di utilizzo indicate nel presente contratto di noleggio, la SOCIETA’ si riserva il diritto di interrompere il contratto e di riappropriarsi dei BENI in qualsiasi momento a spese del CLIENTE. Danni e furti: in caso di furto, perdita o danno (anche parziale) durante il periodo di noleggio dei BENI noleggiati dalla SOCIETA’ – in assenza delle nostre clausole di assicurazione aziendale – il CLIENTE pagherà alla SOCIETA’ l’importo del valore di mercato (prezzo al dettaglio dal listino prezzi al pubblico al momento del furto) delle nuove merci e/o tutte le perdite o spese derivanti. La SOCIETA’ richiederà tale compenso a mezzo pagamento contante, assegno, carta di credito, PayPal utilizzando l’indirizzo email del cliente indicato nel contratto o tramite pagamento con carta di credito attraverso circuito PayPal.

La SOCIETA’ addebiterà l’importo utilizzando i dati della carta di credito indicati nel presente contratto. Il CLIENTE autorizza la SOCIETA’ ad addebitare l’ammontare per il furto, la perdita o il danno (anche se parziale) ai BENI noleggiati da parte della SOCIETA’ secondo la clausola di danno e di furto menzionata nel presente contratto. La SOCIETA’ notificherà al CLIENTE via e-mail la fattura, la lista dettagliata e l’importo totale addebitato sulla sua carta di credito.

Durante il periodo di noleggio, con o senza opzioni assicurative, il CLIENTE è responsabile della manutenzione e della pulizia dei BENI forniti in noleggio dalla SOCIETA’, in misura maggiore per i noleggi a lungo termine. Le tariffe proposte dalla SOCIETA’ includono, dopo la restituzione dell’attrezzatura noleggiata, la pulizia di biciclette e degli accessori, la manutenzione ordinaria meccanica, la normale usura delle biciclette, delle parti meccaniche, degli accessori e merci.

Indennità : come previsto dalla Legge, la SOCIETA’ non può essere ritenuta responsabile per danni a persone o a beni provocati dal CLIENTE o dagli utenti finali o da terzi, come  in caso di incidenti che rientrano nell’uso improprio dei  BENI forniti dalla SOCIETA’, perdita o inconveniente derivante da ritardi nella consegna e / o abbandono dei beni forniti a noleggio dalla  SOCIETA’ o da terze società o parti che lavorano nella logistica e nei servizi di noleggio in connessione con LA SOCIETA, danni, ritardi, perdite o inconvenienti derivanti dall’uso o dalla rottura durante l’uso di BENI o in caso di perdita, ritardi e spese in caso di furto, danni, incidenti o altre cause fuori dal controllo della SOCIETA’. Il CLIENTE si assume tutte le responsabilità per l’uso dei BENI a seguito di qualsiasi infrazione del codice stradale commesso o per uso irresponsabile dei BENI forniti dalla SOCIETA’. Il CLIENTE dichiara di essere stato informato sulla possibilità di stipulare apposita polizza assicurativa integrativa a copertura dei rischi relativi a spese sanitarie che lo stesso dovesse sostenere a seguito di incidente e danni fisici alla sua persona e di danni che dovesse causare a terzi a seguito di incidente con il veicolo dovuto a sua responsabilità.

Condizioni d’uso : Il CLIENTE è tenuto a custodire con attenzione i BENI e, in particolare, non deve: usare la bicicletta con sovraccarichi o per il trasporto di altre persone oltre il ciclista; sub-locare a terzi parti; spingere o rimorchiare qualsiasi altro tipo veicolo, rimorchio o qualsiasi altro oggetto, a meno che non sia preventivamente autorizzato dalla società e/o previsto nelle clausole contrattuali; utilizzare la bicicletta in nessuna gara, prova o competizione tra persone; se il  CLIENTE è sotto l’influenza di alcool, allucinogeni, narcotici, barbiturici o qualsiasi altra sostanza che alteri la coscienza o la capacità di reagire; in violazione di qualsiasi regolamentazione di traffico o di altra normativa; guidata da una persona diversa da quella registrata dal presente contratto di noleggio, a meno che tale persona non sia stata comunicata alla SOCIETA’ e precedentemente designata e autorizzata dalla stessa. Il CLIENTE può utilizzare i BENI al di fuori dell’Italia previa comunicazione scritta alla SOCIETÀ. Il cliente è l’unico responsabile per l’uso dei BENI forniti a noleggio dalla SOCIETA’.

Assicurazione di responsabilità della Società: LA SOCIETA’, per il suo operato, è coperta da un’assicurazione di responsabilità civile con Allianz s.p.a n. polizza 79301000

Cancellazione da parte del cliente : In caso di cancellazione e restituzione (anche parziale) di BENI prima dell’ultimo giorno di noleggio indicato in questo contratto di noleggio, la SOCIETA’  non restituirà alcun rimborso. Non è previsto nessun rimborso sulla riconsegna anticipata dei BENI prima del tempo indicato nel presente contratto. Eventuali giorni extra di noleggio saranno oggetto di negoziazione tra le parti.

Condizioni di salute del Cliente : il Cliente dichiara che, come utente finale del servizio di noleggio offerto dalla SCIETA’, è in grado di utilizzare i BENI e di condurre la bicicletta sulle strade del paese in cui il Cliente e gli utenti finali useranno i BENI forniti dalla SOCIETA’. Il cliente è responsabile di eventuali minori per i quali sono stati presi i BENI in noleggio e dichiara che i minori sono in grado di utilizzare i BENI forniti in noleggio dalla SOCIETA’ e che questi BENI saranno utilizzata dai minori solo sotto la supervisione di adulti e / o genitori. I clienti dichiarano e certificano che gli utenti finali dei servizi di noleggio coperti da questo contratto sono in buone condizioni di salute. Il cliente dichiara che le condizioni di salute degli utenti finali permettono di utilizzare i beni forniti in noleggio da parte della società per ogni uso e in ogni condizione come l’allenamento, il divertimento, i viaggi itineranti, i concorsi sportivi ecc. La Società non è responsabile di problemi di salute conseguenti all’uso dei beni forniti a noleggio con questo contratto.

Condizioni comuni e diverse Il cliente è identificato con il passaporto o la patente di guida o la carta d’identità valida e non scaduta. Chiunque firmi questo accordo, in suo nome o per conto di un’altra persona o entità, è responsabile sia congiuntamente che disgiuntamente con il soggetto principale per gli obblighi nei confronti della SOCIETA’.

Giurisdizione in caso di controversia: in caso di controversia la giurisdizione di Palermo (Italia) avrà competenza esclusiva.

Sicurezza: il CLIENTE afferma che la SOCIETA’ ha fornito i BENI necessari a garantire la sicurezza e la visibilità dei clienti su strada. Il CLIENTE accetta di non utilizzare lettori mp3 e telefoni cellulari durante l’uso della bicicletta e di guidare in sicurezza supportato dagli accessori di sicurezza forniti e consegnati al CLIENTE da parte della SOCIETA’ al momento del noleggio.

Confidenzialità, Privacy e Dati del Cliente : Il cliente autorizza la SOCIETA’ a elaborare i dati personali per l’unico uso interno, secondo la legge italiana DLGS 196 e GDPR (General Data Protection Regulation) n. 2016/679. Il CLIENTE autorizza a elaborare, pubblicare e condividere immagini e dati di monitoraggio dei gps nel sito web aziendale, nei social media e in altre piattaforme.

La SOCIETA’ non consegnerà, condividerà o venderà i dati dei clienti a terze aziende o parti e distruggerà i dati della carta di credito indicati in questo modulo al momento della chiusura del rapporto di noleggio. Il custode, controllore e manager dei dati personali è la Sicicla.

CONTENUTO DEL CONTRATTO DI PACCHETTO TURISTICO

Le condizioni generali che seguono costituiscono parte integrante del contratto di viaggio, unitamente alla descrizione del pacchetto turistico contenuta nel catalogo (online o cartaceo), ovvero nel separato programma di viaggio, nonché al preventivo ed alla conferma di prenotazione dei servizi richiesti dal turista/viaggiatore. Nel sottoscrivere la proposta di compravendita di pacchetto turistico, il turista/viaggiatore deve tener bene a mente che conferma di aver letto ed accettato, per sè e per i soggetti per i quali chiede la prenotazione del pacchetto turistico, sia il contratto di viaggio (pacchetto turistico) per come ivi disciplinato, sia le avvertenze e condizioni in essa contenute, sia le presenti condizioni generali.

  • FONTI LEGISLATIVE

La vendita di pacchetti turistici, che abbiano ad oggetto servizi da fornire in territorio sia nazionale sia internazionale, è disciplinata dal Codice del Turismo (artt. 32-51 – novies) così come modificato dal d.lgs. 62/2018 che attua la direttiva UE 2015/2302 e sue successive modificazioni e dalle disposizioni del codice civile in tema di trasporto e mandato, in quanto applicabili.

  • REGIME AMMINISTRATIVO

L’organizzatore e il venditore del pacchetto turistico, cui il viaggiatore si rivolge, devono essere abilitati all’esecuzione dell’attività in base alla legislazione vigente, anche regionale o comunale ed operare secondo quanto ivi previsto. L’organizzatore e il venditore stabiliti sul territorio italiano devono essere coperti da contratto di assicurazione per la responsabilità civile a favore del viaggiatore per il risarcimento dei danni derivanti dalla violazione dei rispettivi obblighi assunti con i rispettivi contratti. I contratti di organizzazione di pacchetto turistico sono assistiti da polizze assicurative o garanzie bancarie che, nei casi di insolvenza o fallimento dell’organizzatore o del venditore garantiscono, senza ritardo su richiesta del viaggiatore, il rimborso del prezzo versato per l’acquisto del pacchetto e il rientro immediato del viaggiatore nel caso in cui il pacchetto includa il trasporto del viaggiatore, nonché, se necessario, il pagamento del vitto e dell’alloggio prima del rientro. Tale obbligo si applica anche ai professionisti che agevolano servizi turistici collegati, per il rimborso di tutti i pagamenti che ricevono dai viaggiatori.

  • DEFINIZIONI

Ai fini del presente contratto s’intende per:

a) “viaggiatore”: chiunque intende concludere un contratto, stipula un contratto o e autorizzato a viaggiare in base a un contratto di pacchetto turistico o servizio turistico collegato;

b) “professionista”: qualsiasi persona fisica o giuridica pubblica o privata che, nell’ambito della sua attività

commerciale, industriale, artigianale o professionale agisce, nei contratti di pacchetto turistico o servizio turistico collegato, anche tramite altra persona che opera in suo nome o per suo conto, in veste di organizzatore, venditore, professionista che agevola servizi turistici collegati o di fornitore di servizi turistici, ai sensi della normativa vigente;

c) “organizzatore”: un professionista che combina pacchetti e li vende o li offre in vendita direttamente o tramite o unitamente a un altro professionista, oppure il professionista che trasmette i dati relativi al viaggiatore a un altro professionista conformemente alla lettera c), numero 2.4) dell’ 33 del Codice del Turismo;

d) “venditore”: il professionista diverso dall’organizzatore che vende o offre in vendita pacchetti combinati da un organizzatore;

e) “stabilimento”: lo stabilimento definito dall’articolo 8, comma 1, lettera e), del decreto legislativo 26 marzo 2010, n. 59;

f) “supporto durevole”: ogni strumento che permette al viaggiatore o al professionista di conservare le informazioni che gli sono personalmente indirizzate in modo da potervi accedere in futuro per un periodo di tempo adeguato alle finalità cui esse sono destinate e che consente la riproduzione identica delle informazioni memorizzate;

g) “circostanze inevitabili e straordinarie”: una situazione fuori dal controllo della parte che invoca una tale situazione e le cui conseguenze non sarebbero state evitate nemmeno adottando tutte le ragionevoli misure;

h) “difetto di conformità”: un inadempimento dei servizi turistici inclusi in un pacchetto;

i) “minore”: persona di età inferiore ai 18 anni;

l) “rientro”: il ritorno del viaggiatore al luogo di partenza o ad altro luogo concordato dalle parti contraenti.

4. NOZIONE DI PACCHETTO TURISTICO E SERVIZIO TURISTICO COLLEGATO

4.1. Si intende “pacchetto turistico” la combinazione di almeno due tipi diversi di servizi turistici (ossia: 1. il trasporto di passeggeri; 2. l’alloggio che non costituisce parte integrante del trasporto di passeggeri e non è destinato a fini residenziali o per corsi di lingua di lungo periodo; 3. il noleggio di auto, di altri veicoli o motoveicoli e che richiedano una patente di guida di categoria A; 4. qualunque altro servizio turistico che non costituisce parte integrante di uno dei servizi turistici di cui ai numeri 1), 2) o 3), e non sia un servizio finanziario o assicurativo, nè qualificabile come “servizio turistico integrativo”) ai fini dello stesso viaggio o della stessa vacanza, se si verifica almeno una delle seguenti condizioni:

A) tali servizi sono combinati da un unico professionista, anche su richiesta del viaggiatore o conformemente a una sua selezione, prima che sia concluso un contratto unico per tutti i servizi;

B) tali servizi, anche se conclusi con contratti distinti con singoli fornitori di servizi turistici, sono:

B.1 acquistati presso un unico punto vendita e selezionati prima che il viaggiatore acconsenta al pagamento;

B.2 offerti, venduti a prezzo forfettario o globale;

B.3 pubblicizzati o venduti sotto la denominazione “pacchetto” o denominazione analoga;

B.4 combinati dopo la conclusione di un contratto con cui il professionista consente al viaggiatore di scegliere tra una selezione di tipi diversi di servizi turistici, oppure acquistati presso professionisti distinti attraverso processi collegati di prenotazione per via telematica ove il nome del viaggiatore, gli estremi del pagamento e l’indirizzo di posta elettronica siano trasmessi dal professionista con cui è concluso il primo contratto a uno o più professionisti e il contratto con quest’ultimo o questi ultimi professionisti sia concluso al più tardi 24 ore dopo la conferma della prenotazione del primo servizio turistico;

4.2. Si intende “servizio turistico collegato” almeno due tipi diversi di servizi turistici acquistati ai fini dello stesso viaggio o della stessa vacanza, che non costituiscono un pacchetto, e che comportano la conclusione di contratti distinti con i singoli fornitori di servizi turistici, se un professionista agevola, alternativamente: 1) al momento di un’unica visita o un unico contatto con il proprio punto vendita, la selezione distinta e il pagamento distinto di ogni servizio turistico da parte dei viaggiatori; 2) l’acquisto mirato di almeno un servizio turistico aggiuntivo presso un altro professionista quando tale acquisto e concluso entro le 24 ore dalla conferma della prenotazione del primo servizio turistico.

4.3 I contratti aventi ad oggetto l’offerta del solo servizio di trasporto, di soggiorno, ovvero di qualunque altro separato servizio turistico, non potendosi configurare come fattispecie negoziale di organizzazione di viaggio ovvero di pacchetto turistico, non godono delle tutele offerte dalla Direttiva UE 2015/2302 e del Cod. Tur. (artt. da 32 a 51nonies) e sono disciplinati dalle previsioni specificamente riferite alla vendita del singolo servizio oggetto di contratto.

  • INFORMAZIONI AL VIAGGIATORE – SCHEDA TECNICA

5.1. Prima della conclusione del contratto di pacchetto turistico o di un’offerta corrispondente l’organizzatore e il venditore forniscono al viaggiatore il pertinente “modulo informativo standard” e comunicano al viaggiatore le seguenti informazioni:

a) le caratteristiche principali dei servizi turistici, quali: 1) la destinazione o le destinazioni del viaggio, l’itinerario e i periodi di soggiorno con relative date e, se e incluso l’alloggio, il numero di notti comprese;

2) i mezzi, le caratteristiche e le categorie di trasporto, i luoghi, le date e gli orari di partenza e ritorno, la durata e la località di sosta intermedia e le coincidenze; nel caso in cui l’orario esatto non sia ancora stabilito, l’organizzatore e, se del caso, il venditore, informano il viaggiatore dell’orario approssimativo di partenza e ritorno; 3) l’ubicazione, le caratteristiche principali e, ove prevista, la categoria turistica dell’alloggio ai sensi della regolamentazione del paese di destinazione; 4) i pasti forniti; 5) le visite, le escursioni o altri servizi inclusi nel prezzo totale pattuito del pacchetto; 6) i servizi turistici prestati al viaggiatore in quanto membro di un gruppo e, in tal caso, le dimensioni approssimative del gruppo; 7) la lingua in cui sono prestati i servizi; 8) se il viaggio o la vacanza sono idonei a persone a mobilita ridotta e, su richiesta del viaggiatore, informazioni precise sull’idoneità del viaggio o della vacanza che tenga conto delle

esigenze del viaggiatore;

b) la denominazione commerciale e l’indirizzo geografico dell’organizzatore e del venditore, i loro recapiti telefonici e indirizzi di posta elettronica;

c) il prezzo totale del pacchetto comprensivo di tasse e tutti i diritti, imposte e altri costi aggiuntivi, ivi comprese le eventuali spese amministrative e di gestione delle pratiche, oppure, ove questi non siano ragionevolmente calcolabili prima della conclusione del contratto, un’indicazione del tipo di costi aggiuntivi che il viaggiatore potrebbe dover ancora sostenere;

d) le modalità di pagamento, compresi l’eventuale importo o percentuale del prezzo da versare a titolo di acconto e il calendario per il versamento del saldo, o le garanzie finanziarie che il viaggiatore e tenuto a pagare o fornire;

e) il numero minimo di persone richiesto per il pacchetto e il termine di cui all’articolo 41, comma 5, lettera a) prima dell’inizio del pacchetto per l’eventuale risoluzione del contratto in caso di mancato raggiungimento del numero;

f) le informazioni di carattere generale concernenti le condizioni in materia di passaporto e visti, compresi i tempi approssimativi per l’ottenimento dei visti, formalità sanitarie del paese di destinazione;

g) le informazioni sulla facoltà per il viaggiatore di recedere dal contratto in qualunque momento prima dell’inizio del pacchetto dietro pagamento di adeguate spese di recesso o, se previste, delle spese di recesso standard richieste dall’organizzatore;

h) le informazioni sulla sottoscrizione facoltativa o obbligatoria di un’assicurazione che copra le spese di recesso unilaterale dal contratto da parte del viaggiatore o le spese di assistenza, compreso il rientro, in caso di infortunio, malattia o decesso;

i) gli estremi della copertura a protezione in caso di insolvenza o fallimento nonché del contratto di assicurazione per la responsabilità civile a favore del viaggiatore;

l) informazioni sull’identità del vettore aereo operativo, ove non nota al momento della prenotazione, giusta previsione art.11 Reg. Ce 2111\05 (Art. 11, comma 2 Reg. Ce 2111/05: “Se l’identità del vettore aereo effettivo o dei vettori aerei effettivi non è ancora nota al momento della prenotazione, il contraente del trasporto aereo fa in modo che il passeggero sia informato del nome del vettore o dei vettori aerei che opereranno in quanto vettori aerei effettivi per il volo o i voli interessati. In tal caso, il contraente del trasporto aereo farà in modo che il passeggero sia informato dell’identità del vettore o dei vettori aerei effettivi non appena la loro identità sia stata accertata ed il loro eventuale divieto operativo nell’Unione Europea”

5.2. Per i contratti di pacchetto turistico stipulati per telefono, l’organizzatore o il professionista fornisce al viaggiatore le informazioni previste dal “modulo informativo standard” di cui all’allegato A, parte II, del Codice del Turismo.

5.3. In considerazione del largo anticipo con cui vengono pubblicati i cataloghi che riportano le informazioni

relative alle modalità di fruizione dei servizi, si precisa che gli orari e le tratte dei voli indicati nella accettazione della proposta di compravendita dei servizi potrebbero subire variazioni poiché soggetti a successiva convalida; gli orari definitivi dei voli verranno comunicati nei giorni antecedenti la partenza e il ritorno. Si precisa che i voli charter non sono soggetti, per definizione, ad una programmazione oraria sistematica.

  • PROPOSTA D’ACQUISTO – PRENOTAZIONI

6.1. Al momento della conclusione del contratto di pacchetto turistico o, comunque, appena possibile, l’organizzatore o il venditore fornisce al viaggiatore una copia o una conferma del contratto su un supporto durevole.

6.2 Il viaggiatore ha diritto a una copia cartacea qualora il contratto di pacchetto turistico sia stato stipulato alla contemporanea presenza fisica delle parti.

6.3. Per quanto riguarda i contratti negoziati fuori dei locali commerciali, definiti all’articolo 45, comma 1, lettera h), del decreto legislativo 6 settembre 2005, n. 206, una copia o la conferma del contratto di pacchetto turistico e fornita al viaggiatore su carta o, se il viaggiatore acconsente, su un altro supporto durevole.

6.4. ll contratto di pacchetto turistico si intende perfezionato, con conseguente conclusione del contratto, solo nel momento in cui l’organizzatore invierà conferma, anche a mezzo sistema telematico, al viaggiatore presso il venditore.

6.5 Il viaggiatore deve comunicare al venditore, prima della prenotazione, eventuali richieste specifiche che si considerano oggetto del contratto solamente se possibili, riportate per iscritto nel contratto ed accettate

Dall’organizzatore.

6.6. I documenti di viaggio (es. voucher) verranno consegnati al viaggiatore in tempo utile prima della partenza e il viaggiatore dovrà conservarli e portarli con se durante il viaggio, per poter usufruire dei servizi regolarmente prenotati, unitamente ad altri eventuali documenti (es. biglietti aerei) consegnati dal venditore. Il viaggiatore è tenuto a verificare la correttezza dei dati riportati sui predetti documenti e sul contratto di viaggio e a comunicare immediatamente al venditore eventuali errori. Il viaggiatore deve comunicare all’organizzatore i dati dei partecipanti esattamente come riportati sui documenti personali d’identità.

6.7. Eventuali escursioni, servizi o prestazioni acquistati e pagati dai viaggiatori a destinazione sono estranei al presente contratto. Pertanto nessuna responsabilità in merito a ciò potrà essere ascritta all’organizzatore o al venditore, neppure nell’eventualità che, a titolo di cortesia, personale residente, accompagnatori, guide o corrispondenti locali possano occuparsi della loro prenotazione.

7.1. All’atto della sottoscrizione del contratto dovrà essere corrisposta: a) la quota d’iscrizione o gestione pratica (vedi art. 8); b) acconto nella misura indicata dall’organizzatore o dal venditore che viene versato a titolo di caparra confirmatoria ed anticipo conto prezzo. Nel periodo di validità della proposta di compravendita del pacchetto e/o dei servizi turistici indicati e pertanto prima della eventuale conferma di prenotazione che costituisce perfezionamento del contratto, gli effetti di cui all’art.1385 c.c. non si producono.

Il saldo dovrà essere improrogabilmente versato entro il termine stabilito dall’organizzatore nel proprio catalogo o nella conferma di prenotazione;

7.2. Il mancato pagamento delle somme di cui sopra, alle date stabilite, al pari della mancata rimessione all’organizzatore delle somme versate dal viaggiatore al venditore comporterà la automatica risoluzione di diritto del contratto da operarsi con semplice comunicazione scritta, via fax o via e-mail, presso il venditore, o presso il domicilio anche elettronico, ove comunicato, del viaggiatore. Il saldo del prezzo si considera avvenuto quando le somme pervengono all’organizzatore direttamente dal viaggiatore o per il tramite del venditore.

  • PREZZO E REVISIONE DEL PREZZO

8.1 Il prezzo del pacchetto turistico è determinato nel contratto, con riferimento a quanto indicato in catalogo o sul sito web dell’organizzatore, o programma fuori catalogo/su misura ed agli eventuali aggiornamenti degli stessi cataloghi o programmi fuori catalogo successivamente intervenuti, o nel sito web dell’operatore. Esso potrà essere variato, in aumento o diminuzione, soltanto in conseguenza alle variazioni di: – prezzo del trasporto di passeggeri in funzione del costo del carburante o altre fonti di energia; – il livello di diritti e tasse sui servizi turistici inclusi nel contratto imposti da terzi non direttamente coinvolti nell’esecuzione del pacchetto, comprese le tasse di atterraggio, di sbarco o di imbarco nei porti e negli aeroporti; – tassi di cambio pertinenti al pacchetto in questione. Un aumento di prezzo è possibile solo previa comunicazione su supporto durevole da parte dell’organizzatore al viaggiatore unitamente alla giustificazione di tale aumento e alle modalità di calcolo, almeno 20 giorni prima dell’inizio del pacchetto. Se l’aumento di prezzo eccede l’8% del prezzo complessivo del pacchetto si applica il successivo punto 9.2 In caso di diminuzione del prezzo, l’organizzatore ha diritto di detrarre le spese amministrative e di gestione delle pratiche effettive dal rimborso dovuto al viaggiatore, delle quali e tenuto a fornire prova su richiesta del viaggiatore.

8.2. Il prezzo è composto da: a) quota di iscrizione o quota gestione pratica; b) quota di partecipazione: espressa in catalogo o nella quotazione del pacchetto fornita dal venditore al viaggiatore; c) costo eventuali polizze assicurative contro i rischi di annullamento, recesso e/o spese mediche o altri servizi richiesti; d) costo eventuali visti e tasse di ingresso ed uscita dai Paesi meta della vacanza; e) oneri e tasse aeroportuali e\o portuali.

  • MODIFICA, RECESSO DELL’ORGANIZZATORE O ANNULLAMENTO DEL PACCHETTO TURISTICO PRIMA DELLA PARTENZA

9.1. Prima dell’inizio del pacchetto, l’organizzatore può unilateralmente modificare le condizioni del contratto diverse dal prezzo, purché si tratti di modifiche di scarsa importanza, comunicandole al viaggiatore su un supporto durevole, anche tramite il venditore.

9.2. Se, prima dell’inizio del pacchetto, l’organizzatore è costretto a modificare in modo significativo una o più caratteristiche principali dei servizi turistici o non può soddisfare le richieste specifiche accettate in precedenza e riportate espressamente nel contratto oppure propone di aumentare il prezzo del pacchetto di oltre l’8%, il viaggiatore, entro un periodo ragionevole specificato dall’organizzatore contestualmente alla comunicazione di modifica, può accettare la modifica proposta oppure recedere dal contratto senza corrispondere spese di recesso.

In caso di recesso, l’organizzatore può offrire al viaggiatore un pacchetto sostitutivo di qualità equivalente o

superiore. La comunicazione di modifica indica al viaggiatore le modifiche proposte, la loro incidenza sul prezzo del pacchetto, il termine entro il quale il viaggiatore è tenuto a informare l’organizzatore della sua decisione e le conseguenze della mancata risposta del viaggiatore entro il predetto periodo nonché l’eventuale pacchetto sostitutivo offerto e il relativo prezzo.

9.3. Se le modifiche del contratto di pacchetto turistico o il pacchetto sostitutivo comportano un pacchetto di qualità o costo inferiore, il viaggiatore ha diritto a un’adeguata riduzione del prezzo.

9.4. In caso di recesso dal contratto di pacchetto turistico ai sensi del precedente comma, se il viaggiatore non accetta un pacchetto sostitutivo, l’organizzatore rimborsa senza ingiustificato ritardo e in ogni caso entro quattordici giorni dal recesso dal contratto tutti i pagamenti effettuati da o per conto del viaggiatore e si applicano le disposizioni di cui all’articolo 43, commi 2, 3, 4, 5, 6, 7, 8 Codice Turismo.

9.5. L’organizzatore può recedere dal contratto di pacchetto turistico e offrire al viaggiatore il rimborso integrale dei pagamenti effettuati per il pacchetto, ma non è tenuto a versare un indennizzo supplementare se: a) il numero di persone iscritte al pacchetto è inferiore al minimo previsto dal contratto e l’organizzatore comunica il recesso dal contratto al viaggiatore entro il termine fissato nel contratto e in ogni caso non più tardi di 20 giorni prima dell’inizio del pacchetto in caso di viaggi che durano più di 6 giorni, di 7 giorni prima dell’inizio del pacchetto in caso di viaggi che durano tra 2 e 6 giorni, di 48 ore prima dell’inizio del pacchetto nel caso di viaggi che durano meno di 2 giorni; b) l’organizzatore non è in grado di eseguire il contratto a causa di circostanze inevitabili e straordinarie e comunica il recesso dal medesimo al viaggiatore senza ingiustificato ritardo prima dell’inizio del pacchetto.

9.6 Per annullamenti diversi da quelli sopra esposti l’Organizzatore che annulla restituirà al viaggiatore una somma pari al doppio di quanto dallo stesso pagato ed effettivamente incassato dall’Organizzatore, tramite l’Agenzia di Viaggi.

  • RECESSO DEL VIAGGIATORE

10.1 In caso di circostanze inevitabili e straordinarie verificatesi nel luogo di destinazione o nelle sue immediate vicinanze e che hanno un’incidenza sostanziale sull’esecuzione del pacchetto o sul trasporto di passeggeri verso la destinazione, il viaggiatore ha diritto di recedere dal contratto, prima dell’inizio del pacchetto, senza corrispondere spese di recesso, ed al rimborso integrale dei pagamenti effettuati per il pacchetto, ma non ha diritto a un indennizzo supplementare. L’eventuale impossibilità sopravvenuta di usufruire del pacchetto da parte del viaggiatore non legittima il recesso senza penali, potendo il viaggiatore garantirsi dal rischio economico connesso a tale fattispecie di recesso dal contratto, con la stipula di apposita polizza assicurativa.

10.2 Al di fuori delle ipotesi esplicitamente indicate in questo articolo, il viaggiatore avrà diritto di recedere dal contratto in qualunque momento prima dell’inizio del viaggio, fermo l’obbligo di pagare le spese/penali di recesso come di seguito indicate – indipendentemente dal pagamento dell’acconto di cui sopra – oltre al costo individuale di gestione previste dall’organizzatore, che dipendono dalla destinazione prescelta e dal momento in cui il viaggiatore recede rispetto alla data di partenza. In assenza di specificazione delle spese standard di recesso, l’importo delle spese di recesso corrisponde al prezzo del pacchetto diminuito dei risparmi di costo e degli introiti che derivano dalla riallocazione dei servizi turistici.

Nel caso di gruppi precostituiti tali somme verranno stabilite di volta in volta nella proposta di contratto.

10.3 Il viaggiatore può stipulare delle polizze assicurative a copertura delle predette spese di recesso unilaterale da parte del viaggiatore o delle spese di assistenza, compreso il rientro, in caso di infortunio, malattia o decesso. In base al pacchetto prescelto, l’organizzatore informa il viaggiatore sulla sottoscrizione facoltativa o obbligatoria di tali assicurazioni.

10.4 Le spese di recesso non sono dovute per le ipotesi previste dal precedente articolo 9 punto 2.

10.5 In caso di recesso dal contratto di viaggio, il viaggiatore è comunque sempre tenuto al pagamento della quota di gestione della pratica, pari ad € 30,00 per persona.

10.6 Il computo dei giorni ai fini dell’applicazione delle penali di recesso si effettua conteggiando tutti i giorni lavorativi (sempre esclusi il sabato e festivi), escludendo dal conteggio il giorno dell’annullamento ed includendo invece il giorno della partenza.

10.7 Ai sensi dell’art. 41 comma 2 Codice Turismo vengono pattuite le seguenti penali per il recesso: -fino a 30 gg. prima dell’inizio del viaggio: 30% sull’importo totale; – da 29 a 21 gg. prima dell’inizio del viaggio: 40% sull’importo totale; da 20 a 14 gg. prima dell’inizio del viaggio: 60% sull’importo totale; da 13 a 6 gg. prima dell’inizio del viaggio: 80% sull’importo totale; nei 5 gg. prima dell’inizio del viaggio: 100% dell’importo totale. Le stesse somme dovranno essere corrisposte anche da chi non possa effettuare il viaggio per mancanza o irregolarità dei documenti personali di espatrio previsti; nel caso in cui il viaggiatore non si presenti al luogo di partenza stabilito nel programma di viaggio o decida di interrompere il viaggio o il soggiorno già intrapreso non può essere accordato alcun rimborso.

10.8 La validità della comunicazione di annullamento del viaggio è subordinata all’adozione della forma scritta.

10.9 Nei pacchetti turistici con volo o viaggio treno incluso: se il biglietto aereo/ferroviario è già stato emesso, la penale va calcolata sull’importo della vacanza detraendo il costo del biglietto, che andrà addebitato interamente.

  • MODIFICA DELLA PRENOTAZIONE

11.1 Per ogni e qualsiasi richiesta di modifica alla prenotazione già accettata saranno dovuti € 30,00 per persona a copertura delle spese operative.

11.2 La diminuzione del numero di persone e la richiesta di cambio data di partenza fatta entro i 30 gg. dalla stessa sono considerate come recesso e quindi soggetti alle penali di annullamento di annullamento indicate sopra (vedi punto 10 recesso del viaggiatore). Le modifiche richieste dal viaggiatore a prenotazione già accettata non obbligano l’Organizzatore nei casi in cui non possano essere soddisfatte.

  • MODIFICHE DOPO LA PARTENZA

L’Organizzatore, qualora dopo la partenza si trovi nell’impossibilità di fornire per qualsiasi ragione, tranne che per un fatto proprio del viaggiatore, una parte essenziale dei servizi contemplati in contratto, dovrà predisporre soluzioni alternative, senza supplementi di prezzo a carico del viaggiatore, oppure rimborsarlo nei limiti della differenza tra le prestazioni originariamente previste e quelle effettuate; qualora non risulti possibile alcuna soluzione alternativa, ovvero la ovvero la soluzione predisposta dall’organizzatore venga rifiutata dal viaggiatore per comprovati e giustificati motivi, l’organizzatore fornirà senza supplemento di prezzo, un mezzo di trasporto equivalente a quello originario previsto per il ritorno al luogo di partenza o al diverso luogo eventualmente pattuito, compatibilmente alle disponibilità del mezzo e di posti e lo rimborserà nella misura della differenza tra il costo delle prestazioni previste e quello delle prestazioni effettuate fino al momento del rientro anticipato.

  • SOSTITUZIONI

13.1 Il viaggiatore rinunciatario può farsi sostituire da altra persona sempre che:

  • a) l’organizzatore ne sia informato per iscritto almeno 7 giorni prima della data fissata per la partenza, ricevendo contestualmente comunicazione circa le generalità del soggetto subentrante;
  • b) il sostituto soddisfi tutte le condizioni per la fruizione del servizio (ex art. 38 Cod. Tur.) ed in particolare i requisiti relativi al passaporto, ai visti, ai certificati sanitari;
  • c) i servizi medesimi o altri servizi in sostituzione possano essere erogati a seguito della sostituzione;
  • d) vengano rimborsate all’Organizzatore tutte le spese aggiuntive sostenute per procedere alla sostituzione, nella misura che verrà quantificata al cedente prima della cessione.

13.2 Il cedente ed il cessionario sono solidalmente responsabili per il pagamento del saldo del prezzo nonché degli importi di cui alla lettera d) par. 13.1 del presente articolo.

  • OBBLIGHI DEI VIAGGIATORI

14.1 Nel corso delle trattative e comunque prima della conclusione del contratto, ai cittadini italiani sono fornite per iscritto le informazioni di carattere generale – aggiornate alla data di comunicazione del preventivo – relative agli obblighi sanitari e alla documentazione necessaria per l’espatrio. I cittadini stranieri reperiranno le corrispondenti informazioni attraverso le loro rappresentanze diplomatiche presenti in Italia e/o i rispettivi canali informativi governativi ufficiali. In ogni caso i viaggiatori provvederanno, prima della partenza, a verificarne l’aggiornamento presso le competenti Autorità (per i cittadini italiani le locali Questure ovvero il Ministero degli Affari Esteri tramite il sito www.viaggiaresicuri.it ovvero la Centrale Operativa Telefonica al numero 06.491115) adeguandovisi prima del viaggio. In assenza di tale verifica, nessuna responsabilità per la mancata partenza di uno o più viaggiatori potrà essere imputata all’intermediario o all’organizzatore.

14.2 I viaggiatori dovranno essere muniti di passaporto individuale o di altro documento valido per tutti i paesi toccati dall’itinerario, nonché dei visti di soggiorno e di transito e dei certificati sanitari che fossero eventualmente richiesti. Essi inoltre dovranno attenersi all’osservanza delle regole di normale prudenza e diligenza ed a quelle specifiche in vigore nei paesi destinazione del viaggio, a tutte le informazioni fornite loro dall’organizzatore, nonché ai regolamenti ed alle disposizioni amministrative o legislative relative al pacchetto turistico.

14.3 Al fine di valutare la situazione di sicurezza socio/politica, sanitaria e ogni altra informazione utile relativa ai Paesi di destinazione e, dunque, l’utilizzabilità oggettiva dei servizi acquistati o da acquistare, il viaggiatore avrà l’onere di assumere le informazioni ufficiali di carattere generale presso il Ministero Affari Esteri, e divulgate attraverso il sito istituzionale della Farnesina www.viaggiaresicuri.it . Tali informazioni non sono contenute nei cataloghi e/o nella documentazione fornita dall’organizzatore poiché essi contengono informazioni descrittive di carattere generale per come indicate nell’art. 34 del codice del Turismo e non informazioni temporalmente mutevoli. Le stesse pertanto dovranno essere assunte a cura del viaggiatore.

14.4 Ove alla data di prenotazione la destinazione prescelta risultasse, dai canali informativi istituzionali, località sconsigliata per motivi di sicurezza, il viaggiatore che successivamente dovesse esercitare il recesso non potrà invocare, ai fini dell’esonero o della riduzione della richiesta di indennizzo per il recesso operato, il venir meno della causa contrattuale connessa alle condizioni di sicurezza del Paese.

14.5 Il viaggiatore comunicherà altresì per iscritto all’organizzatore, all’atto della prenotazione, le particolari richieste personali che potranno formare oggetto di accordi specifici sulle modalità del viaggio, sempre che ne risulti possibile l’attuazione.

14.6 Il viaggiatore è sempre tenuto ad informare il venditore e l’organizzatore di eventuali sue esigenze o condizioni particolari (a titolo esemplificativo e non esaustivo, gravidanza, intolleranze alimentari, disabilità) ed a specificare esplicitamente la richiesta di relativi servizi personalizzati.

14.7 Il viaggiatore sarà chiamato a rispondere di tutti i danni che l’organizzatore o il venditore dovesse subire a causa dell’inadempienza alle obbligazioni del viaggiatore previste da questo contratto.

14.8 Ai sensi dell’art. 51quinques, comma 2, Cod. Tur., il viaggiatore è tenuto a fornire all’organizzatore o al venditore tutti i documenti, le informazioni e gli elementi in suo possesso utili per l’esercizio del diritto di surroga di quest’ultimo nei confronti dei terzi responsabili dell’evento da cui sia disceso un risarcimento del danno, indennizzo, diminuzione del prezzo o altro rimedio prestato dall’organizzatore o dal venditore in favore del viaggiatore. Il viaggiatore è responsabile verso l’organizzatore o il venditore di qualsiasi pregiudizio arrecato al diritto di surrogazione.

  • CLASSIFICAZIONE ALBERGHIERA

15.1 La classificazione ufficiale delle strutture alberghiere viene fornita in catalogo od in altro materiale informativo soltanto in base alle espresse e formali indicazioni delle competenti autorità del paese in cui il servizio è erogato.

15.2 In assenza di classificazioni ufficiali riconosciute dalle competenti Pubbliche Autorità dei paesi anche membri della UE cui il servizio si riferisce, l’organizzatore si riserva la facoltà di fornire in catalogo una propria descrizione della struttura ricettiva, tale da permettere una valutazione e conseguente accettazione della stessa da parte del viaggiatore.

  • REGIME DI RESPONSABILITA’

16.1 L’organizzatore è responsabile dell’esecuzione dei servizi turistici previsti dal contratto di pacchetto turistico, indipendentemente dal fatto che tali servizi turistici devono essere prestati dall’organizzatore stesso, dai suoi ausiliari o preposti quando agiscono nell’esercizio delle loro funzioni, dai terzi della cui opera si avvale o da altri fornitori di servizi turistici, ai sensi dell’art. 1228 del codice civile.

16.2 Il venditore presso il quale sia stata effettuata la prenotazione del pacchetto turistico non risponde in alcun caso delle obbligazioni nascenti dall’organizzazione del viaggio, ma è responsabile esclusivamente delle obbligazioni nascenti dalla sua qualità di intermediario. Il venditore che si obbliga a procurare a terzi, anche in via telematica, un servizio turistico disaggregato, è tenuto a rilasciare al viaggiatore i documenti relativi a questo servizio, che riportino la somma pagata per il servizio e non può in alcun modo essere considerato Organizzatore di viaggio.

16.3 Se uno dei servizi turistici non è eseguito secondo quanto pattuito nel contratto di pacchetto turistico, l’Organizzatore pone rimedio al difetto di conformità, a meno che ciò risulti impossibile oppure risulti eccessivamente oneroso, tenendo conto dell’entità del difetto di conformità e del valore dei servizi turistici interessati dal difetto. Se l’organizzatore non pone rimedio al difetto, il viaggiatore ha diritto alla riduzione del prezzo nonché al risarcimento del danno che abbia subito in conseguenza del difetto di conformità, a meno che l’Organizzatore dimostri che il difetto di conformità (i) è imputabile al viaggiatore o ad un terzo estraneo alla fornitura dei servizi turistici; o (ii) ha carattere inevitabile o imprevedibile oppure dovuto a circostanze straordinarie ed inevitabili.

16.4 Se l’Organizzatore non pone rimedio al difetto di conformità entro un periodo ragionevole fissato dal viaggiatore nella sua contestazione, questi può ovviare personalmente al difetto e chiedere il rimborso delle spese necessarie, ragionevoli e documentate. Se un difetto di conformità costituisce un inadempimento di non scarsa importanza e l’Organizzatore non vi ha posto rimedio con la contestazione tempestiva effettuata dal viaggiatore, in relazione alla durata ed alle caratteristiche del pacchetto, il viaggiatore può risolvere il contratto con effetto immediato, o chiedere – se del caso – una riduzione del prezzo, salvo l’eventuale risarcimento del danno.

16.5 In ciascun caso, si applicano gli esoneri di cui all’art. 43 commi 1 e 3 Cod. Tur. per i casi in cui la mancata od inesatta esecuzione del contratto sia imputabile al viaggiatore o sia dipesa dal fatto di un terzo estraneo alla fornitura dei servizi a carattere imprevedibile o inevitabile, ovvero è dovuto a circostanze inevitabili e straordinarie.

  • LIMITI DEL RISARCIMENTO

17.1 I risarcimenti di cui all’art. 43 del Cod. Tur. e relativi termini di prescrizione, sono disciplinati da quanto ivi previsto e comunque nei limiti stabiliti, dalle Convenzioni Internazionali che disciplinano le prestazioni che formano oggetto del pacchetto turistico nonché dagli articoli 1783 e 1784 del codice civile.

17.2 Il diritto alla riduzione del prezzo o al risarcimento dei danni per le modifiche del contratto di pacchetto turistico o del pacchetto sostitutivo, si prescrive in due anni a decorrere dalla data del rientro del viaggiatore nel luogo di partenza.

17.3 Il diritto al risarcimento del danno alla persona si prescrive in tre anni a decorrere dalla data di rientro del viaggiatore nel luogo di partenza o nel più lungo periodo previsto per il risarcimento del danno alle persone dalle disposizioni che regolano i servizi compresi nel pacchetto.

17.4 Il limite massimo che può essere oggetto di risarcimento è pari a 3 volte il prezzo totale del pacchetto; quest’ultima limitazione non si applica per i casi di danni alla persona, e di danni causati intenzionalmente e/o per colpa dell’Organizzatore o del Venditore.

  • OBBLIGO DI ASSISTENZA

18.1 L’Organizzatore è tenuto a prestare le misure di assistenza al viaggiatore come previsto dall’art. 45 del Cod. Tur., in particolare fornendo le informazioni riguardo ai servizi sanitari, alle autorità locali e all’assistenza consolare.

18.2 L’organizzatore può pretendere il pagamento di un costo ragionevole per tale assistenza qualora il problema alla base della necessità di assistenza sia causato intenzionalmente dal viaggiatore o per sua colpa.

  • RECLAMI E DENUNCE

19.1 Ogni mancanza nell’esecuzione del contratto deve essere contestata dal viaggiatore all’Organizzatore – direttamente o tramite il venditore – tempestivamente (tenuto conto delle circostanze del caso) e in corso di viaggio affinché l’Organizzatore, il suo rappresentante locale o l’accompagnatore vi pongano tempestivamente rimedio. In caso contrario il risarcimento del danno sarà diminuito o escluso ai sensi dell’art. 1227.

19.2 Ai fi ni del rispetto dei termini o periodi di prescrizione, la data in cui il venditore riceve messaggi, richieste o reclami di cui al comma precedente, è considerata come data di ricezione anche per l’Organizzatore.

  • ASSICURAZIONE CONTRO LE SPESE DI RECESSO E DI RIMPATRIO

20.1 Se non espressamente comprese nel prezzo, è possibile, ed anzi consigliabile, stipulare al momento della prenotazione presso gli uffici dell’Organizzatore o del Venditore speciali polizze assicurative contro le spese derivanti dal recesso unilaterale dal contratto da parte del viaggiatore, infortuni e bagagli.  Sarà altresì possibile stipulare un contratto di assistenza che copra le spese di rimpatrio in caso di incidenti e malattie.

20.2 Il viaggiatore eserciterà i diritti nascenti da tali contratti esclusivamente nei confronti delle Compagnie di Assicurazioni stipulanti, alle condizioni e con le modalità previste da tali polizze.

  • STRUMENTI ALTERNATIVI DI RISOLUZIONE DELLE CONTROVERSIE

Ai sensi e per gli effetti di cui all’art. 67 Cod.Tur. l’Organizzatore potrà proporre al viaggiatore – nel preventivo, nella documentazione, nel proprio sito internet o in altre forme – modalità di risoluzione alternative delle contestazioni insorte. In tal caso l’Organizzatore indicherà la tipologia di risoluzione alternativa proposta e gli effetti che tale adesione comporta.

  • PROTEZIONE IN CASO DI INSOLVENZA O FALLIMENTO (art. 47 Cod. Tur.)

22.1 Ai sensi dell’art. 47, commi 2 e 3 del Cod. Tur., i contratti del turismo organizzato sono assistiti da idonee polizze assicurative o garanzie bancarie, che, per i viaggi all’estero e i viaggi che si svolgono all’interno di un singolo Paese (ivi compresi i viaggi in Italia), assicurino, nei casi di insolvenza o fallimento del venditore o dell’organizzatore, il rimborso del prezzo versato per l’acquisto del pacchetto e il rientro immediato del viaggiatore nel caso in cui il pacchetto include il trasporto del viaggiatore, nonché, se necessario, il pagamento del vitto e dell’alloggio prima del rientro.

22.2 All’acquirente del pacchetto turistico oggetto di vendita con il presente contratto vengono assicurate le garanzie di cui all’art. 47 del Cod. Tur. tramite l’adesione di Sicycling Tours s.n.c.  al Fondo di Garanzia “Fondo Vacanze Felici scarl” con sede in Milano, Via

Larga n. 6 (www.fondovacanzefelici.it), i cui recapiti sono stati portati a conoscenza del viaggiatore.

ADDENDUM CONDIZIONI GENERALI DI CONTRATTO DI VENDITA DI SINGOLI SERVIZI TURISTICI

  • REQUISITI DEI PARTECIPANTI: Ogni partecipante deve essere in uno stato di forma psicofisica che gli consenta di poter svolgere e completare l’itinerario della vacanza scelta. Le persone affette da patologie gravi, disturbi fisici e mentali, malattie che necessitino di particolari cure, devono obbligatoriamente comunicarlo al venditore o all’organizzatore in fase di prenotazione, che, nel caso di incompatibilità con il livello di difficoltà della vacanza, potrà rifiutare l’iscrizione al viaggio. Nei tour in gruppo la non osservanza di questa regola potrà comportare l’esclusione durante la vacanza a discrezione dell’accompagnatore.
  • SISTEMAZIONE NELLE VACANZE IN GRUPPO: Il partecipante che prenota individualmente può scegliere tra la sistemazione in camera singola (con supplemento, secondo disponibilità) o in abbinamento con altro partecipante assegnato dall’organizzatore. L’organizzatore non garantisce che sarà possibile effettuare un abbinamento al fine del pernottamento in camera doppia, possibilità che dipende anche dal numero dei viaggiatori nel gruppo e da altre circostanze al di fuori del controllo dell’Organizzatore. L’Organizzatore si riserva di richiedere ai viaggiatori che inviino singolarmente una richiesta di prenotazione per una vacanza in gruppo (quindi in mancanza di un abbinamento già individuato), una quota che varia dal 50 al 100% del supplemento singola, o quota forfettaria (l’importo è precisato in ogni scheda viaggio sul sito o nella scheda del programma di viaggio fornito al Viaggiatore).
  • BICICLETTE: Ad ogni partecipante verrà consegnata una bicicletta con lucchetto. Il viaggiatore avrà l’obbligo di utilizzare e custodire con diligenza tale bicicletta per tutta la durata della vacanza, in modo da riconsegnarla priva di danni e nelle stesse condizioni in cui la ha ricevuta, salvo la normale usura. In caso di furto (indipendentemente dalla chiusura o meno del lucchetto) o danno irreparabile, il viaggiatore sarà tenuto a corrispondere all’organizzatore l’intero costo della bicicletta; a seconda del paese e del modello tale costo va da 350 € a 600 € per la bicicletta muscolare e da 1.000 € a 3.500 € per la bicicletta elettrica / a pedalata assistita. Il noleggio di una nuova bicicletta per il resto della vacanza sarà totalmente a carico del viaggiatore. Il risarcimento è richiesto anche in caso di furto o danno degli accessori forniti (es. lucchetti, seggiolini, appendici per bambini, borse laterali, caschetti…). L’ammontare varia a seconda del paese e dell’accessorio e sarà quantificato dall’Organizzatore o dal fornitore locale.
  • PASTI E DIETE PARTICOLARI: I pasti inclusi nella quota sono a menù fisso.   • ESCURSIONI, VISITE GUIDATE E MUSEI: Per ragioni non dipendenti dalla volontà dell’Organizzatore (ad esempio funzioni religiose in corso, cambio di orari/giorni di visita, flusso turistico elevato, cause di forza maggiore), escursioni e visite in programma possono essere annullate o è possibile che ne venga modificato l’ordine. Dove possibile verranno sostituite con altre visite. I costi degli ingressi descritti nei singoli programmi sono indicativi e soggetti a variazioni. Le visite indicate come “guidate” sono effettuate con il supporto di una guida locale.
  • VALIDITÀ QUOTE PER VIAGGI IN GRUPPO: Le quote indicate sono valide per gruppi di minimo 12 persone (se non diversamente specificato nel singolo viaggio). Se non si riesce a raggiungere il numero minimo, l’Organizzatore potrà decidere di annullare la partenza: in questo caso i viaggiatori saranno avvisati almeno 21 giorni prima della partenza e potranno decidere se ricevere il rimborso della quota versata o lo spostamento della prenotazione su altro viaggio.
  • TASSE AEROPORTUALI: Le tasse aeroportuali dei pacchetti con volo incluso non sono incluse e vanno pagate interamente col saldo del viaggio. Possono subire variazioni dovute alle oscillazioni del carburante e alle decisioni delle compagnie aeree. L’importo esatto delle tasse verrà definito al momento dell’emissione del biglietto aereo: eventuali variazioni di prezzo saranno comunicate tempestivamente.
  • PARTENZA DA ALTRI AEROPORTI: In alcuni viaggi è possibile richiedere la partenza da un aeroporto diverso da quello previsto dal pacchetto. La variazione potrebbe comportare un aumento tariffario rispetto alla tariffa gruppo, variabile a seconda della compagnia aerea e del periodo di prenotazione. Tale importo non è quantificabile se non al momento dell’effettiva richiesta.
  • Wash your hands regularly with water and soap or with anti-bacterial handsanitising gel
  • Avoid close contact with people who are suffering with acute respiratory infection
  • Pratice respiratory hygiene (sneeze or cough into a tissue avoiding hand contact with respiratory ducts)
  • Avoid hugs and handshakes
  • Avoid mixed-use of bottles and cups, especially during sports activity
  • Do not touch your eyes, nose and mouth with your hands
  • Cover your mouth and nose when you sneeze or cough
  • Do not take anti-viral pharmaceuticals or antibiotics  unless they have been prescribed by a doctor
  • Maintain a social distance of at least one metre from other people
  • We recommend the use of personal gloves and goggles/glasses
  • Exclusive and personal use of the protective helmet from Sicicla, which has been sanitised, when not in use possibly expose it to the sun from the inside out
  • Do not share the general equipment with any other people (eg. Bicycle, whisper, side bags, pump, etc.) supplied by Sicicla, which has been sanitised in advance
  • Bring a mask and sanitising gel with you and keep it close at hand ready for use, recommended to prevent contagion of COVID-19

Clauses and standard conditions for rental service: Sicicla, third parties or organisations that collaborate with Sicicla (defined in this contract as: BUSINESS) has sports equipment, bicycles, bicycle parts, accessories and services (defined in this contract as: GOODS) for rental. The rental tariffs are fixed and determined at the time of the quotation and accepted by the customer with the booking confirmation. The customer declares that the GOODS provided and delivered for rent from the BUSINESS are compliant for the use they have been hired for. The serviced provided are subject to terms and conditions outlined in the this document.

Delivery and returns: the CUSTOMER acknowledges that the GOODS rented from the BUSINESS are delivered and supplied in perfect mechanical condition and without any evident defects. The CUSTOMER will return the GOODS to the BUSINESS in the same condition in which they were provided on the date determined by the two parties at the time this contract was signed.  If the GOODS should be used in violation to the conditions of use outlined in this rental contract, the BUSINESS reserves the rights to breach the contract and to reclaim the GOODS at any time at the expense of the CUSTOMER. Damage and theft: in case of theft, loss or damage (even partial) during the rental period of the BUSINESS’ rented GOODS – in the absence of our business insurance clauses – the CUSTOMER will pay the BUSINESS the equivalent of the market value amount (price as detailed in the public price list at the time of the theft) of the new goods and/or all the lost or derived costs. The BUSINESS will request this compensation to paid in cash, by cheque, credit card, PayPal using the customer’s e-mail address as outlined in the contract or by credit card payment via PayPal.

The BUSINESS will charge the total amount using the credit card details provided in this contract. The CUSTOMER authorises the business to charge the amount for the theft, loss or damage (even if partial) of the GOODS rented from the BUSINESS according to the damage and theft clause mentioned in this contract. The BUSINESS will notify the CUSTOMER via e-mail with the invoice, the detailed list and the total amount charged to the credit card.

During the rental period, with or without insurance options, the CUSTOMER is responsible for the maintenance and cleaning of the GOODS supplied for rental by the BUSINESS, to a greater extent for long-term rentals. The tariffs proposed by the BUSINESS include, after the return of the rented equipment, the cleaning of bicycles and accessories, the ordinary mechanical maintenance, the normal wear of the bicycles, the mechancial parts, the accessories and the goods.

Indemnity : as provided for the the Law, the BUSINESS can not be held responsible for personal damage or damage to the GOODS caused by the CUSTOMER or by final users or third parties, such as in the case accidents caused by the improper  use of the GOODS provided by the BUSINESS, losses or inconvience caused by delays to the delivery / or abbandment of the GOODS provided for rental from the  BUSINESS or from third parties or organisations that work in logistics and in rental services in connection with the BUSINESS, damages, delays, losses or inconveniences inferred from the use or breakage during the use of the GOODS or in the case of losses, delays and expenses in case of theft, damage, accidents or other causes that are outside of the BUSINESS’ control. The CUSTOMER takes full responsibility for the use of the GOODS following any violation of the highway code committed or for any irresponsible use of the GOODS supplied by the BUSINESS. The CUSTOMER declares that they have been informed of the possibility of stipulating specific supplementary insurance policies to cover risks related to any healthcare expenses that may be incurred following accidents and physical damage to their person and any damages that may caused to third parties following accidents with vehicles  that are down to their responsibility.

Conditions of Use : The CUSTOMER is obliged to take special care of the GOODS and, in particular, must not: overload the bicycle or use it to transport anyone other than the cyclist; sublet to third parties; push or tow any other type of trailer or any other object, unless it has been preventatively authorised by the business and/or mentioned in the contractual clauses; use the bicycle in any race, test or competition between people;  if the CUSTOMER is under the influence of alchohol sotto, hallucinogenics, narcotics, sedatives or any other substance that impairs your awareness or ability to react; in violation of any traffic regulations or other legislation; be driven by anyone other than the person registered on this rental contract, unless the person’s details are first communicated to the BUSINESS and assigned and authorised by the BUSINESS. The CUSTOMER can use the GOODS outside of Italy può utilizzare i GOODS al di fuori dell’Italia subject to written communication to the BUSINESS. The CUSTOMER is the only person responsible for the use of the GOODS supplied for rental from the BUSINESS.

The Business’ Insurance responsibilities: The BUSINESS is covered for its work by a liability insurance with Allianz s.p.a policy no. 79301000

Customer cancellation : In case of cancellation and return (even partial) of the GOODS before the final day of rental indicated in this rental contract, the BUSINESS will not pay back any refund. No refunds will be provided for the early return of the GOODS before the time indicated in this contract. Any eventual extra days of rental will be subject to negotiation between the parties.

Customer health conditions : the CUSTOMER declares that the final users of the rental service offered by the BUSINESS are capable of using the GOODS and are able to ride the bicycle on the roads of the city the CUSTOMER and final users will take the GOODS supplied by the BUSINESS. The CUSTOMER is responsible for any minors for whom the GOODS have been rented and declares that the minors are capable of using the GOODS that have been supplied for rental by the BUSINESS and that these GOODS will be used by the minors only under the supervision of adults and/or thei parents. The customers declare and certify that the final users of the rental services covered in this contract are in a state of good health. The CUSTOMER declares that the health conditions of the final users allow them to use the GOODS supplied for rental by the business for all use and in every condition for training, fun, travel itineraries, sports races etc. The BUSINESS is not responsible for health problems that should arise following the use of the GOODS supplied for rent with this contract.

Common conditions and other conditions The CUSTOMER is identified by valid passport or driving licence or identity card that have not expired. Whoever signs this agreement, in their name or on behalf of another person or entity, is responsible both in conjunction with and in disjunction with the main subject of obligation to the BUSINESS.

Jurisdiction in case of controversy: in case of any controversy, the jurisdiction of Palermo (Italy) will have exclusive jurisdiction.

Safety: the CUSTOMER affirms that the BUSINESS has supplied the GOODS required to ensure the safety and visibility of the customers on the road. The CUSTOMER accepts that they will not use mp3 players and mobile telephones during the use of the bicycle and will drive safely with the supported of the safety accessories supplied and delivered to the CUSTOMER by the BUSINESS at the time of rental.

Customer confidentiality, privacy and data : The CUSTOMER authorises the BUSINESS to capture personal data for internal use only, according to Italian law DLGS 196 and GDPR (General Data Protection Regulation) n. 2016/679. The CUSTOMER authorises the BUSINESS to capture, publish and share images and GPS tracking data on the business website, social media and on other platforms.

The BUSINESS will not deliver, share or sell the client’s data to third organisations or parties and will destroy the credit card details indicated in this document at the time the rental agreement ends. The custodian, controller and manager of personal data is Sicicla.

Although Sicily is part of Italy, the island can feel worlds away from the mainland, as it remains one of the country's most rural and economically challenged regions. Roads in Sicily are not always as well maintained as those found in other parts of Italy. Although our routes are quiet, you can expect some rough patches of road along the way. Cycling here is both a physical and cultural experience where a touch of patience and humor go a long way—watch out for that rooster!

It may come as a surprise that in such a beautiful part of the world, litter is quite evident, especially when approaching small villages. If you can't stand the thought of litter marring the setting, we understand. This may not be the trip for you. We are working behind the scenes to improve this aspect of our Sicily trips.

The Experience

As if its classical heritage weren’t formidable enough, Sicily is bursting at the seams with later artistic and architectural gems. In a short walk around Palermo you’ll see Arab domes and arches, Byzantine mosaics and Norman palace walls. Circle around to southeast Sicily and you’ll find a stunning array of baroque architectural masterpieces, from the golden-hued domes and palaces of Noto to the multi-tiered cathedral facades of Ragusa and Modica. Meanwhile, throughout the island you’ll find yourself stumbling upon the evocative remains of Arab and Norman castles. This embarrassment of cultural riches remains one of the island’s most distinctive attractions.

Food & Wine

A delectable layer-cake of culinary influences, Sicily’s ancient cuisine continues to rely on a few key island-grown ingredients: shellfish and citrus, tuna and swordfish, pistachios, almonds and ricotta. Talk to the septuagenarian chef at a Catania restaurant and she’ll confide that she still uses her grandmother’s recipe for  pasta alla Norma , joyfully sharing the poetic imagery that links it to Mt Etna: the tomatoes are lava; the aubergines, cinders; the basil, leafy greenery; the ricotta, snow. Modern chefs may play with the details, but Sicily’s timeless recipes – from the simplest  cannolo  to the most exquisite fish couscous – live on.

Sicily’s varied landscape makes a dramatic first impression. Fly into Catania and the smoking hulk of Etna greets you; arrive in Palermo and it’s the sparkling Golfo di Castellammare. This juxtaposition of sea, volcano and mountain scenery makes a stunning backdrop for outdoor activities. Cyclists can wind along precipitous coastlines, climb erupting volcanoes and traipse through flowery mountain meadows; birders benefit from the plethora of species on the Africa-Europe migration route; and divers and swimmers enjoy some of the Mediterranean’s most pristine waters. Whatever your personal predilections, Sicily and its dozen-plus offshore islands offer enough activities to build an entire vacation around.

Multiple-day bike tour in southernmost Europe.  At the crossroads of Africa, the Indo-Asia and Europe, Sicily is pure magic. Cycle the breathtaking landscapes and cities around, like  Val di Noto (one of many Unesco World Heritage sites visited on this tour).

Our Itinerary focuses entirely across the countryside of the Hyblaean area, giving you an amazing chance to discover and visit many of the marvellous naturalistic sites which embellish this part of land. You set off from Cava d’Ispica, where a 13 km-long canyon still preserves its untainted ecosystem.

Then, cycle through an area famous for the presence of the oldest trees in Sicily which leads us to Frigintini, a village clustering with farms devoted to high-quality in production.  Pedal onwards for the crossing of another valley, chiselled by Fiumara creek, guiding the way into Scicli.

This itinerary will lead you to the discovery of Europe’s most southern shoreline, with its marvelous beaches of golden, satin sand dunes, deriving from the Sahara Desert and its lush Mediterranean vegetation.

Day 1 Benvenuti to Sicily. Welcome Meeting in Noto.

Arrive at Catania Airport and transfer to Noto on your own. Meet & Greet with BTS local representative. Noto is the capital of Sicilian Baroque and a living art gallery. Noto, along with every other city in the area, was completely razed by a devastating earthquake in 1693. Its noble aristocracy decided to rebuild the city stone‐for‐stone, 3 km from its original site. If you have enough time on your holidays, we strongly suggest to visit Siracusa, not far from Noto. We can include your extra nights and transfer arrangements under request. Welcome meeting with local BTS representative at your first hotel, set in the old town.

Day 2 Noto Loop & the Barocco Siciliano. 42 or 73km / 26 or 45mi. Rolling hills

Loop Bike ride from Noto to the coastline and cycling through the inland. Today you have two options to ride around Noto. You will ride into the verdant Val di Noto with its flourishing almond and olive groves and discover its caves carved into rock. Climb past Castelluccio and up to the coastal plateau to take in hypnotic views of the Mediterranean, then descend into Noto: the Baroque city. In town, you can taste the local granita. A more challenging ride: Hop on your bike and pedal up a difficult climb to Avola Antica and “Cavagrande del Cassibile nature reserve”. Here the landscape begins to change from the norm and the view is now dominated by “Sicily’s Grand Canyon,” the deepest canyon in Europe, whose steep walls descend 800 feet to a picturesque river below. Meals included: Breakfast

Day 3 Noto to Portopalo di Capo Passero. 35 or 72 km / 21 or 45 mi. Rolling hills or hilly

Today, your destination is the Southernmost point of Sicily and Italy, more precisely, Portopalo di Capo Passero, an old fishermen village. A distance of 11 km from Noto on the route, there is the Roman Villa Tellaro, a 4th century, partially‐excavated palace, boasting magnificent mosaic floors which tell stories of Roman life. Scenes of hunting, erotic dances, Illiad tales, an unusual geometric designs. A visit to Villa Tellaro cannot be missed. You set off again towards the marvellous Vendicari Nature Reserve. A visit here may only be done on foot if one wishes to enter. Then, ride further on through Contrada Buonivini, the cradle of Nero d’Avola. Just few more kilometers and you reach Portopalo with its nice beaches and an important fishing port. Here you can taste the best local and fresh fish! We suggest to visit the village. Walk along the pedestrian central area containing popular restaurants, cafés and boutiques. The views from here welcome you to its beach and clear waters. Additional views of an ancient tuna factory and the small island of Capo Passero with its fishermen houses are also spectacular. Meals included: Breakfast

Day 4 Portopalo to Modica. 56 or 76 km / 34 or 47 mi. Rolling hills to Hilly

Your ride today follows the cycle paths of wine country in Val di Noto, transitioning you through Notos countryside and cross Tellaro valley along the river. Once on top of the valley, the stunning view of the Hyblean Plateau will delight you. In this stage you will get acquainted with the varied food production of traditional peasant gourmet. Homemade breads to sauces, bio honey, cheese, olive oils and wines. From here is a lovely view of the extreme eastern spur of the Hyblean Mountains which form the border between Siracusa and Noto provinces. Here, the peaceful and quiet mule-track is shaded by the wide crowns of carob trees, allowing for cover while roaming for many cycling kilometers. Meals included: Breakfast

Day 5 Modica Loop to Ragusa. 45 or 64 km / 27 or 40mi. Downhill & flat.

This moderate challenging, rise and fall stage unrolls like a film of snapshots from the past: olive and carob trees, farmhouses and villas of the rural past aristocracy. The profile of the hilly area gradually changes its shape as we get further in a harmonious plateau area. You can enjoy the spectacular views of Tellaro valley from here. The section of the route with its continuous series of ups and downs is quite demanding, but your effort will be rewarded by views of unequalled beauty at each turn or hilltop. You arrive in the magnificent Baroque city of Ragusa, where you can visit the awesome Iblean Garden by foot and the Old Town, called IBLA; here you will find a lot of churches, gelaterias and street food shops. Then we will loop back to Modica for the rest of the ride. For dinner, choose from many wonderful local restaurants such as hole‐in‐the‐wall trattorias to Slow Food and Michelin‐starred restaurants. (we’ll give you some favorite suggestions) Meals included: Breakfast

Day 6 Modica to Donnalucata. 37 or 65 km / 22 or 40 mi. Flat terrain or rolling hills

Today you leave Modica going on through the Fiumara Valley, surrounded by a lush vegetation: this wild wooded part of the route will lead you straight to Scicli’s historic center. Starting out, you go along the ancient street leading from Scicli to Donnalucata, stretching above a typical Iblean cave. After about 4 km you will reach a panoramic street hanging between countryside and sea; here you meet the Sgarlata farmhouse, renowned for its ricotta cheese and delicious flavored caciotte (you can experience a cheese-making laboratory and a tasting under request). Here you can also find the Milizie cloister, legendary battle ground between the Normans and Saracens. Further on, the cycling path goes on plunging in between olive, carob and almond orchards. Finally you arrive to the sea and in Donnalucata, you will be ready for a rewarding Italian Gelato. Also in front of the sea, a fantastic dinner awaits for you, in a romantic place. Meals included: Breakfast

Day 7 Arrivederci! Good bye!

After breakfast, end of tour. Transfer to the train station or to Catania or Comiso Airports is available. under request Meals included: Breakfast

EXTRA DAYS Under Request

We can provide extra days with arrival to Mount Etna and Taormina but it takes about 9-10 nights total. Or just one or two additional cycling days with arrival to Caltagirone to admire the artistic production of ceramics and terra-cotta sculptures. Or return to Piazza Armerina where you can visit the Famous “Villa Romana del Casale”. Just contact us to inquire on options.

Day 1 & 2 – Porta Reale Hotel , Noto

Set among baroque buildings, Hotel Porta Reale is part of the historic center and since the main entrance you can feel the spirit, in the name of sobriety, elegance and modernity. The small Hotel is spread over 3 floors and the recent renovations wanted all the spaces functional and comfortable.

Superb Sicilian tour Having had a brilliant week with Mauro in Sardinia last year, eight of us opted for his Sicilian trip, a week on ebikes in the South East of the island. It was regarded by all as the best cycling holiday we have ever had. Mauro takes great trouble, as does his Sicilian colleague, Raffaele. Everything was thus really good: itinerary, support, quality of bikes and accommodation, ideas about food and visits, responsiveness to any questions. 1. What is the Grand Cycling Tour of Sicily?

The Grand Cycling Tour of Sicily by bike is the cycling itinerary that goes around Sicily by bike in 21 stages. The route takes place on secondary roads with little traffic, rural, local and urban roads and cycle paths reserved for bicycles. In Palermo, Trapani and Catania, the Cycling Tour of Sicily by gravel bike crosses Sicily Divide Gravel Adventure, the most famous gravel itinerary in Sicily.

It is not a cycle path in Sicily but a cycling itinerary that uses all types of roads: cycle paths, rural roads, urban roads, provincial roads, state roads. All the roads included in the Periplus of Sicily have been chosen because they have little or no traffic.

2. How challenging is the itinerary?

The Grand Cycling Tour of Sicily by gravel bike is not demanding from a technical point of view because it does not include particularly challenging dirt roads or technical segments that require great skill in riding a bicycle. The commitment, however, exists because it is still a cycle touring itinerary that goes around Sicily by bicycle for a total of over 1200 km.

For this reason, the circumnavigation of Sicily in gravel has been divided into 3 sections called semi-circles of about 400 km each which correspond, more or less, to a week-long bike trip.

La Via dei Tramonti

The Via dei Tramonti, the itinerary from Palermo to Agrigento by bike on the coast is about 400 kilometers long with 3500 meters of total ascent, therefore, rather easy to cover. the stages are those included from 1 to 7. The name derives from the fact that every evening we witness a spectacular sunset from a dream location.

La Via della Liberazione

The Via della Liberazione, the cycling itinerary from Agrigento to Catania, is about 418 kilometers long with a total ascent of 2800 metres. The name derives from the fact that it crosses the places where the soldiers of Operation Husky landed during the Second World War.

Finally, the Northern Way is the one that goes from Catania to Palermo and skirts woods and castles that overlook cliffs overlooking the sea. A sort of small Normandy in Sicily. The itinerary is about 416 kilometers long with 2300 meters of total ascent.

3. How to get to Sicily?​

To get to Sicily with a bicycle, it is possible to use the transport service of the bicycle accompanied by the airlines, that of Trenitalia and that of the ferries. It all sounds very simple but in reality, these solutions can endanger the bicycle and the contents of the luggage.

Transporting a bicycle by plane, in addition to the normal risk of loss of luggage (which does not spare bicycles), exposes the bicycle to the obvious risk of mechanical damage. In fact, airport baggage handlers are quite used to handling baggage quickly and cannot always use the greatest possible caution. For a suitcase this is not a problem, for a bicycle it is. On several occasions, cycle tourists have been seen arriving at airports all over the world (Sicily included) with irreversible damage to the frames and mechanical parts of the bicycle which interrupt the journey by bicycle even before it begins. The transport of the bicycle by train is permitted only if the bicycle is disassembled and placed in a special suitcase and provides for luggage dimensions which are only possible with a folding bicycle. The solution offered by intercity trains is more convenient for transport in racks made especially for bikes, but there are few trains and you need to book well in advance to find available places for bikes. Transporting the bicycle by ship, on the other hand, is much simpler but requires very long journeys and above all to reach the port of departure of the ferry which can also be very far from where you live.

From Palermo to Terrasini is the first stage of the circumnavigation of Sicily in gravel. You go along one of the most beautiful coasts of western Sicily. From the capital city of Sicily we continue towards some very famous and renowned centers both for their architectural beauties and for the recent history of Italy made up of more or less beautiful adventures to remember but nonetheless all absolutely unmissable. You cross places like Carini, Capaci, Isola delle Femmine and Terrasini by bicycle.

2 - from Terrasini to Castellammare del Golfo along the Grand Cycling Tour of Sicily

From Terrasini to Castellammare del Gorlfo is the second stage of the circumnavigation of Sicily in gravel. The itinerary, mainly on asphalt, allows you to explore some of the most beautiful villages on the northern coast with stops at uncrowded beaches with golden sand.

From Licata to Gela is the ninth stage of the Circumnavigation of Sicily in gravel. This is a demanding stage, a roller coaster between forgotten provincial roads, rock formations with curious and mysterious shapes, abandoned mills and quarries, the reborn Montelungo and the surprising city of Gela, an ancient and powerful Greek city that struggles, with resilience, against the ugliness of the old petrochemical plant.

10 - from Gela to Marina di Ragusa along the Grand Cycling Tour of Sicily

From Gela to Marina di Ragusa is the tenth stage of the circumnavigation of Sicily in gravel. From here you enter the realm of the Baroque and of Inspector Montalbano, of detective stories and rebirth after the 1693 earthquake. Marina di Ragusa is one of the most bike-friendly towns on the southern coast.

11 - from Marina di Ragusa to Pozzallo along the Grand Cycling Tour of Sicily

From Marina di Ragusa to Pozzallo is the eleventh stage of the circumnavigation of Sicily in gravel. Don’t be deceived by the completely relaxing route with an average slope of 1%, we won’t be able to hurry. It will be difficult not to stop and take pictures among fossil dunes, pristine beaches, ancient towers and small seaside villages. But we are gravel cyclists and we like this.

12 - from Pozzallo to Marzamemi along the Grand Cycling Tour of Sicily

From Pozzallo to Marzamemi is the twelfth stage of the circumnavigation of Sicily in gravel. The itinerary of this stage is a continuous turning towards the sea where the sand and the dunes plunge into the waves. We will ride in the exact point where the Ionian and Mediterranean meet and mix, in the southernmost point of Italy.

13 - from Marzamemi to Siracusa along the Grand Cycling Tour of Sicily

From Marzamemi to Syracuse is the thirteenth stage of the circumnavigation of Sicily in gravel. We leave behind the romantic village reborn after the RAF bombings of the Second World War and head towards Syracuse, one of the most beautiful cities in eastern Sicily, an incredible mix of Baroque, classical Greek and Renaissance style kissing a beautiful sea and fertile plains rich in famous products. A true paradise for gravel climbers like us.

14 - from Siracusa to Catania along the Grand Cycling Tour of Sicily

From Syracuse to Catania is the fourteenth stage of the circumnavigation of Sicily in gravel. The itinerary up to the Magnisi Peninsula is a splendor but then, due to the immense petrochemical plant, it loses all its charm and becomes uninteresting. In fact, we recommend taking the train from Priolo-Melilli and going directly to Catania, the city of Etna to enjoy the gravel roads with black sand.

15 - from Catania to Taormina along the Grand Cycling Tour of Sicily

From Catania to Taormina is the fifteenth stage of the circumnavigation of Sicily in gravel. After having traveled the Riviera dei Ciclopi on a panoramic cycle path, we begin to touch the dry lava stone walls until we reach Acireale and its beautiful Timpa on a dirt road.

16 - from Taormina to Messina along the Grand Cycling Tour of Sicily

From Taormina to Messina is the sixteenth stage of the circumnavigation of Sicily in gravel. This stage is really not very demanding with an average slope of less than 1% and takes place almost exclusively on the national road which is the only available route. Messina amazes us with its nightlife and its elegant liberty avenues in which to stroll.

17 - from Messina to Milazzo along the Grand Cycling Tour of Sicily

From Messina to Milazzo is the seventeenth stage of the circumnavigation of Sicily in gravel. After having covered the entire Messina coast on a beautiful cycle path up to the Ganzirri lakes, we stop at the beach of Capo Peloro with its immense “piluni” to then make our way towards Milazzo and its beautiful cliffs.

18 - from Milazzo to Capo d'Orlando along the Grand Cycling Tour of Sicily

From Milazzo to Capo d’Orlando is the eighteenth stage of the circumnavigation of Sicily in gravel. Along the way of this stage we will encounter a lot of asphalt but also a lot of sea. A riot of sea in which to dive in the warmer months to cool off a bit. The real gem of the day are the Marinello lakes and the ascent by bike to the Sanctuary of Tindari.

19 - from Capo d'Orlando to Castel di Tusa along the Grand Cycling Tour of Sicily

From Capo d’Orlando to Castel di Tusa is the nineteenth stage of the circumnavigation of Sicily in gravel. After having covered the beautiful cycle path on the sea of ​​Torrenova, we enter and exit a thousand times from the SS113, with little traffic and very panoramic, to visit the thousand fishing villages that doze silently along the coast. Castel di Tusa, then, welcomes us with its beautiful medieval castle that stands out on the gulf.

20 - from Castel di Tusa to Cefalù along the Grand Cycling Tour of Sicily

From Castel di Tusa to Cefalù is the twentieth stage of the circumnavigation of Sicily in gravel. A very short stage to regain some strength. We don’t mind arriving early at our destination as we will be able to enjoy Cefalù, one of the most beautiful and famous seaside villages in Sicily.

Stephens Increases Overall Tour of the Gila Lead, Winning Tyrone Time Trial

Cynisca Cycling’s Lauren Stephens raced to victory in Tyrone for Stage 3 of the Tour of the Gila 2024. Having won on the same course in 2015, she improved her previous best time by 23 seconds. Her victory at the Tyrone Individual Time Trial also increased her lead on the General Classification by 2:01, ahead of Nadia Gontova on GC. The DNA Pro Cycling rider was fourth on the stage. Alia Shafi finished 51 seconds behind Stephens, clocking a time of 39:03; 23 seconds ahead of Cécile Lejeune, racing for the Steve Tilford Foundation, finishing with 33:26 in third.

“It was quite windy out there,” Stephens said after the finish. “It was a great ride; I couldn’t have asked for anything more.”

Emily Ehrlich had been the heavy favorite coming into the time trial, after winning the TT at the Redlands Bicycle Classic and two gold medals at the Pan American Track Championships. Speaking ahead of her

start, Ehrlich said, “I honestly feel it’s the best TT we have in the country. I’ve only done it once, obviously, but it’s my favorite. I really love it!”

Ehrlich started her TT strong, with her head down in the tight position she is accustomed to.

Unfortunately, the Virginia’s Blue Ridge Twenty24 rider crashed coming down the descent of the Little Burro on the way out. She was then forced to abandon the race due to injury. The team later confirmed Ehrlich suffered a broken collarbone and possibly other fractures and is “absolutely covered in road rash.” Ehrlich had been expected to win the stage; with Stephens admitting that once she had seen that Ehrlich had crashed, she had backed off her speed.

“I hope Emily is okay,” Stephens added. “I saw her when I came over the top of the climb, which reminded me to focus on safety first.”

Ehrlich was also expected to be a top contender at the Olympic trials in two weeks’ time. She has managed to send a message to the race organization, stating she is in good spirits, and doesn’t want people to worry about her. “She will be okay,” her team reassured.

At the end of the day, the GC saw a shake-up in the standings under Stephens and Nadia Gontova, who continue to sit in the top two spots. Alia Shafi moved into the top ten on GC, following her second-place finish for Fount Cycling Guild. Her teammate, Eleanor Wiseman, also moved up to fourth from tenth place as she heads into Saturday’s crit. PAS/Steve Tilford Foundation Racing’s Marcela Prieto slid down to fifth after finishing nineteenth on the stage. Cynisca Cycling’s Ashley Frye finished fourth, moving her into a podium position in third ahead of Saturday.

Stites Blasts Into Victory, Taking the Overall Lead at Tour of the Gila

At Tour of the Gila on Friday, Project Echelon’s Tyler Stites blasted through the finish, seizing the win with a time of 33:07 at the Tyrone Individual Time Trial presented by Freeport McMoran. He came close to the course record of 32:59 that was set by Levi Leipheimer in 2009. The current Pan Am Time Trial Champion, Walter Vargas, was second for Team Medellín, clocking a time of 33:18. Jonas Walton rounded the podium in third, finishing in 33:45 and moving into the lead of the Best Young Rider Classification.

Stites’s win marks the second stage win for the team at Tour of the Gila 2024, after winning four out of five stages at Redlands earlier this month. Stites takes over the GC with his victory with two stages

remaining. Team Medellín’s Wilmar Paredes had a tough day, finishing in 36:33 and sliding down to fourth on GC.

“It’s a tough course, the main goal was to win the stage and take the red which I accomplished,” Stites said. “I’m really happy about that. I definitely had my eye on the course record but came up short; it was a tough day out there. I was chasing Walter, which was my minute-man, so that was a good carrot to be chasing. I had him in sight so I had a good day.”

The 16.15-mile Individual Time Trial out-and-back course in Tyrone featured 1,188 feet (362 meters) of climbing. Straight out of the start house, the road pitches up for a Category 4 Little Burro climb, rapidly shifts into a fast descent passing the Freeport-McMoran Tyrone mine, the end of which signals the turn around to head back to the finish. Five miles before the finish, the Little Burro greets the riders again, this time descending at a gradient of 6-7% before streaming down into the finishing shoot.

Owen Wright of CS Velo Racing sat in the hot seat for most of the day, starting within the first 20 riders out of the start house. Wright clocked in at 34:02, enough to finish fifth. His teammate, Joshua Lebo, crossed the finish with his CS Velo team cheering him on, becoming the first rider to clock in under 34 minutes with 33:59 and ending up fourth on the stage.

The hot seat began to change rapidly once the final ten riders were coming in to the finish. Disappointment showed through the smile Vargas displayed as he talked about his performance. He had won the stage last year, and was hoping to defend his win, but still gave respect to Stites as he outshone him in Tyrone.

“This was a pretty demanding time trial, and the wind here is strong,” Vargas said. “I felt good and had good legs but Tyler [Stites] is also in very good form. I knew that he had won another race before Gila here in the United States, so he’s going very strong.”

Despite his loss on Friday, Vargas and Team Medellín look ahead to the final two stages, ready to battle for the GC.

“I’m sitting second on GC with two demanding stages to go, including the final that is a very, very hard stage,” Vargas said. “We hope to give everything and make it a good race on Sunday. Tomorrow, we have the crit, which is a fast and explosive one, so we will give it our all in these last two days.”

Stites won the Downtown Silver City Criterium in 2022, and expects the team to contest the sprint on Saturday before the final showdown Sunday. Important time bonuses will be available at the finish Saturday for the top three finishers, earning ten, six and four seconds respectively.

The pro men take the stage at 3:10 p.m. after a full day of amateur racing and following the pro women.
