Judge won’t dismiss Travis Scott from lawsuits filed over deadly Astroworld crowd crush

A judge has declined to dismiss hundreds of lawsuits filed against rap star Travis Scott over his role in the deadly 2021 Astroworld festival in which 10 people were killed in a crowd surge.
State District Judge Kristen Hawkins issued a one-page order denying Scott’s request that he and his touring and production company, XX Global, be dropped from the case. The order was signed Tuesday but made public on Wednesday.

Scott’s attorneys had argued during an April 15 hearing that he was not responsible for safety planning and watching for possible dangers at the concert on Nov. 5, 2021.
They argued Scott’s duties and responsibilities related to the festival dealt only with creative aspects, including performing and marketing.
However, Noah Wexler, an attorney for the family of Madison Dubiski, 23, one of the 10 people killed, said Scott, whose real name is Jacques Bermon Webster II, had a “conscious disregard for safety” at the sold-out festival. Wexler argued Scott encouraged people who didn’t have tickets to break in and ignored orders from festival organizers to stop the concert when told to do so as people in the crowd were hurt or dying.
Earlier this month, Hawkins dismissed lawsuits against Drake and several other individuals and companies involved in the show.

The lawsuit filed by Dubiski’s family is set to be the first one to go to trial on May 6.
The families of the 10 people who died, plus hundreds who were injured, sued Scott and Live Nation — the festival’s promoter — as well as dozens of other individuals and entities.
After an investigation by Houston police, no charges were filed against Scott , and a grand jury declined to indict him and five other people on any criminal counts related to the deadly concert.
Those killed, who ranged in age from 9 to 27, died from compression asphyxia, which an expert likened to being crushed by a car.
Some of the lawsuits filed by the families of the dead and the hundreds who were injured have been settled, including those filed by the families of four of the dead.

Travis Scott will face a civil trial stemming from the Astroworld tragedy after a judge denied the rapper’s bid to be dismissed from the pending lawsuits.
In March, with a civil trial looming, Scott’s lawyers filed a motion to dismiss the rapper from the pending litigation, arguing that “performers are not expected to render special protection to the audience, nor to safeguard them from the rest of the crowd.”
“No one disputes that tragedy struck the Astroworld Festival,” the motion stated. “But promoting and performing at a concert do not equate to the power to control a crowd or to design a venue safely. Basic tort principles prevent imposing liability on the Scott Defendants for a tragedy arising from forces legally controlled by others.”

Although Scott and Live Nation face billions in damages at the civil trials, a grand jury in Houston determined last June that Scott and several organizers behind the festival would not face criminal charges over the festival.
In documents obtained by Houston Landing in March, it was revealed that organizers were worried just 10 days before Astroworld over how the event would fit 50,000 people outside NRG Park. Court records showed that a miscalculation by organizers also contributed to too many ticketed attendees at the deadly fest. Other factors that likely contributed to the massive overcrowding in certain areas included the number of trees that obscured vantage points and led to overcrowding in areas with better sight lines, and gate-crashers.

HOUSTON (AP) — The start of the first civil trial stemming from the 2021 Astroworld festival , at which 10 people were killed in a crowd surge, has been delayed.
Jury selection had been set to begin next Tuesday in the wrongful-death lawsuit filed the family of Madison Dubiski , a 23-year-old Houston resident who was killed during the crowd crush at the Nov. 5, 2021, concert by rap superstar Travis Scott .
But Apple Inc., one of the more than 20 defendants going to trial next week, filed an appeal this week, automatically delaying the start of jury selection.
“Unless I hear differently, the trial is stayed,” state District Judge Kristen Hawkins said during a court hearing Thursday.
Apple, which livestreamed Scott’s concert, is appealing a ruling by Hawkins that denied the company’s motion to be dismissed from the case. Apple has argued that under Texas law, it can appeal Hawkins’ ruling because its defense claims are being made in part as a member of the electronic media.
Apple is arguing that in livestreaming Scott’s concert, it was acting as a member of the electronic media and its actions merit free speech protection.
“It remains our position that our conduct is protected by the First Amendment,” Kent Rutter, one of Apple’s attorneys, told Hawkins during a court hearing Thursday.
Just before the hearing ended, Hawkins said she had been notified that the appeals court earlier Thursday had denied a request by the lawyers for Dubiski’s family to lift the stay.
Jason Itkin, one of the attorneys for Dubiski’s family, said he planned to appeal that denial, likely up to the Texas Supreme Court.
Lawyers for Dubiski’s family have alleged that her death was caused by negligent planning and a lack of concern over capacity at the event. Her lawyers allege that how Apple placed its cameras around the concert site affected the placement of barriers and reduced available crowd space by the main stage.
Rutter argued that it was broadcasting an event “with significant public interest” and that by doing so, it was acting as a member of the media and gathering news.
Itkin said Apple has described itself in business records as a company that makes smartphones and computers but doesn’t mention news or news reporting. He added that the company’s Apple News app is a subscription service that aggregates the stories of other news organizations.
“This is not a free speech case. They know that,” Itkin said.
During the hearing, Hawkins appeared skeptical about Apple’s claims about being a member of the electronic media, asking Rutter that if a livestream were set up in a zoo to watch animals, would that be news.
“Yes, it would be,” Rutter said.
Over 4,000 plaintiffs filed hundreds of lawsuits following the concert. Dubiski’s case had been chosen by attorneys in the litigation to be the first to go to trial. More than 20 defendants, including Scott, Apple and Live Nation, the festival’s promoter, had been set to go on trial Tuesday.
Following a police investigation , a grand jury last year declined to indict Scott, along with five others connected to the festival.
