An employment verification letter (EVL) is generally requested by an organization, such as a bank or landlord, to verify your current (or previous) job status and other details about your employment. The letter can also serve as supporting evidence for immigration purposes, such as when you’re applying for a green card or other visa.

Known by other terms — for example, “experience letter,” “proof of employment letter,” or “verification of employment” (VOE) — this letter should not be confused with the Employment Authorization Document , or EAD, commonly known as the “work permit.”

Applying for a green card

If you’re the sponsoring family member (the U.S. citizen or green card holder) on a family or marriage green card application, you’ll need to submit a financial support form (Form I-864, officially called the “Affidavit of Support”) to U.S. Citizenship and Immigration Services (USCIS). This form proves that you have sufficient financial resources to support the relative seeking a green card.

With this form, it’s important to provide supporting financial documents, such as an individual federal income-tax return, forms W-2 or 1099 (whichever is applicable), pay stubs (if employed), and an employment verification letter. The letter is especially important if you’ve recently switched jobs or if you’re combining your income with your spouse .

Self-employed green card sponsors

Immigration officers primarily rely on a sponsoring relative’s individual federal income-tax return for evaluating a family-based or marriage-based green card application, but some situations call for additional evidence to prove your eligibility to sponsor. This is especially true if you’re self-employed.

If you can’t provide a Form W-2 as financial evidence because you’re a business owner or an independent contractor, USCIS will still require an employment verification letter. You, however, must draft and sign the letter yourself. It generally should include the same information that would appear in a standard employment verification letter from an employer (see below for more details ). Some applicants choose to have the letter notarized, since the letter would be coming from you personally, but this is not required by USCIS.

Keep in mind that self-employed sponsors are often required to submit significantly more supporting evidence than would otherwise be necessary with a letter from a traditional employer. This additional evidence can include proof of your business’ existence (such as a state business registration or business bank account documents), contracts with clients, payment receipts from clients, and a corporate income-tax return.

Applying for a tourist visa

A B-2 visitor visa allows a traveler from another country to enter the United States temporarily as a tourist. When applying for this visa, USCIS will want to make sure that you:

  • Have solid ties and will return to your home country after visiting the United States.
  • Have the ability to financially support yourself during your trip to the United States.

An employment verification letter can prove that you’re employed in your home country and therefore have a job waiting for you upon your return. It can also prove that you earn an income through your employment, which will allow you to financially support yourself while you’re touring the United States. Applying for a work visa

There are multiple types of visas that allow people from other countries to work in the United States. Among these are the H-1B visa and the L-1A / L-1B intracompany transfer visa. For each of these visa categories, the purpose of the employment verification letter will be slightly different, but the focus of both letters should be your job experience.

Although not all H-1B visa applications require prior experience, USCIS will want to see your employment history . Evidence of this commonly includes your résumé or CV (curriculum vitae) but also an employment verification letter. In the L category, on the other hand, your eligibility for the visa not only depends on your ability to perform the duties of the position you seek, but also a minimum of one year’s experience prior to applying.

Applying for an employment-based green card

An employment-based green card generally requires an employment verification letter. Your eligibility for this type of green card strongly depends on your work experience, especially if the prospective employer indicates that past experience for the job is required.

Often more detailed and technical than an employment verification letter for a B-1 or B-2 visa, for example, the letter for an employment-based green card must describe your previous responsibilities in your previous jobs, in addition to your titles and dates of employment. The information in the letter is critical and can often mean the difference between approval and denial of your green card.

Applying for a temporary business visa

B-1 visas are intended for “Temporary Business Visitors” to the United States with (as you can guess) business-related purposes. Those purposes, however, may not involve doing actual work or receiving a salary from a U.S. source. Business visitors often come to attend meetings and seminars, negotiate contracts with business associates, appear as a guest speaker or lecturer, participate in training, or to purchase goods or property.

With a B-1 visa, you will need an employment verification letter to confirm your job status with your employer abroad and to describe the activities you’ll be participating in while in the United States. The letter should clearly state that you’re entering the United States only for a short visit, solely to engage in the activities described in the letter, and that you will not be working for or receiving payment from a U.S. source.

What the Letter Should Say

Although there’s no specific format required for the employment verification letter, it’s important to include the required details that the government needs to see. Some letters will require more detail than others, depending on the situation. But much of the information will generally be the same. It’s also important to ensure the accuracy of the letter — especially when submitting it as proof on a green card or visa application — to avoid delays or denial.

The letter should be written on your employer’s letterhead (or your own, if you’re self-employed), and should include the following key information (see below for templates ):

  • Date the letter was written (must be within the previous 3 months prior to filing the green card application — the closer to the filing date, the better)
  • Dates of your employment (start and end dates)
  • Your job title
  • Your employment classification (full-time, part-time, temporary, contract, or other)
  • Your annual compensation (salary or wage)
  • A description of your responsibilities, if applicable (see “ When It’s Needed ” above for situations that commonly require this information)
  • A signature line showing the drafter’s signature, full printed name, and official title

Furlough or unemployment due to COVID-19 pandemic

If you’ve been furloughed or laid off due to the pandemic, the U.S. government will look for official documentation (notice) from your employer showing the date the notice was given, your name, your employer’s name, and date you expect to return to work, if applicable.

There are different ways to request an employment verification letter from a current or former employer:

  • Ask your supervisor or manager. This is often the easiest way to request the letter. Just make sure to provide full details and context.
  • Contact Human Resources. Some companies have formal processes that require going through the human resources department.
  • Get a template from the company or organization requesting the letter. Sometimes, the people requesting the letter will provide their own template because it contains specific information they want. (USCIS does not provide a template for immigration applications.)
  • Use an employment verification service. If it’s particularly difficult to get the letter from your employer, it may be easier to use a service that sends them your request. Which Immigration Processes Require an Employment Verification Letter?

Employment verification letters prove that you or your sponsor can receive certain immigration benefits. Family-based green cards, employment-based green cards, work visas, B-1 temporary business visas, and B-2 tourist visas often require these letters.

Family-Based Green Cards

If you are a U.S. citizen or permanent resident sponsoring a relative for their green card, you must complete Form I-864 , Affidavit of Support. U.S. Citizenship and Immigration Services (USCIS) is a government agency of the Department of Homeland Security (DHS). Employment-Based Green Card

What is an employment verification letter?

In short, an employment verification letter is a letter that provides proof that an individual is gainfully employed.

In the context of immigration processes, employment letters verify that an individual or their sponsor may qualify for certain immigration benefits. For example, it can verify that someone applying for a tourist visa has a job in their home country that they plan to return to. And, along with tax returns and a W-2, it can help confirm income when applying for a green card .

U.S. citizens may also need an employment verification letter in situations such as:

If you’re a U.S. citizen or a permanent resident sponsoring someone on their green card application, you may want to submit an employment verification letter. 

Sponsors must submit a USCIS Form I-864 , Affidavit of Support, which is used to assess whether the sponsor has the financial means to support the individual applying for their green card. Form I-864 requires the sponsor to include detailed information about their employment status and income.

What to include in a letter of employment for immigration

The United States Citizenship and Immigration Services (USCIS) doesn’t provide a template or one-size-fits-all list of information to include in an employment verification letter for the various immigration processes. This is because the information required varies depending on the type of immigration application and the evidence sought by the requesting party. For example, some applications may require proof of certain specialized knowledge or qualifications, while others may require proof of financial status or means. 

In any event, the EVL should be on the employer’s letterhead, and most employment verification letters should include, at minimum, the following: 

  • The employee’s name
  • The employer’s name
  • The date the letter was written 
  • The employee’s position and job title
  • The dates of the employee’s employment
  • The employee’s hourly wage or annual salary
  • Whether the job is full- or part-time
  • The signature, printed name and title of the person who wrote the letter

How to request an employment verification letter

If you need an employment verification letter, in many cases, it’s best to check with your direct manager or supervisor. In some instances, you may need to make a formal request to your employer’s human resources department.

Before requesting the letter, know which immigration application you’re submitting. That way, you can provide your employer a specific list of information to be included in the EVL.

Hi! I am planning to go on a trip to Australia as a tourist kaso my income is about ₱15,000 a month. Guide: Employment Contract For The Schengen Visa Application

What is an employment contract for the schengen visa application.

An employment contract is a signed agreement between two parties (an individual employee and an employer or future employer) that establishes the rights and the responsibilities of the employee and the employer as well as the employment conditions .

In other words, an employment contract is an official labour union that sets out the specific “terms” for an individual’s work with a business (the work conditions, duties of the employee, and the rights and responsibilities of both parties are called the “terms” of the contract).

The contract has the purpose to clearly indicate to both parties their responsibilities and rights. 

For example, it can help an employee understand the role they have within the company as well as the compensation, bonuses, or expense accounts the company must pay at a specific time interval. It can also permit a company to protect critical trade secrets (usually, the contract prohibits employees from revealing the company’s trade secrets). 

Submitting the contract is a mandatory Schengen Visa requirement for every applicant who is employed in their country of residence and wants to travel to the Schengen Area. 

Not submitting a labour agreement or failing to prove that you have one with an employer in your home country can lead to the rejection of your Schengen Visa. This is because work commitment is the number one reason travellers return to their countries of origin after travelling to the Schengen Area. 

Important : In some non-Schengen countries, both written and verbal employment contracts are legal and valid. However, it can be very difficult to prove the terms, or even the existence, of an oral contract. This is the main reason why you must submit a written labour contract for your Schengen Visa .  

There are many types of employment contracts that can vary by individual state laws. In most states, they are divided into three types:

  • Permanent contracts (they can be for full or part-time work and are valid until terminated by either the employer or employee).
  • Fixed-term contracts (they give a set end date, for example, 6 months, one year, or any other specific period).
  • Casual contracts (they are signed when the employer cannot guarantee a regular working pattern, for example, a fixed number of working hours per day). 

Please note that not all the terms of employment are always written down in a formal document. Some contracts can mention only a part of the work conditions while other details can be based on an oral agreement between the parties. In an ideal scenario, you should submit a contract that shows all the details of your work conditions.

However, if some details are not clearly outlined or missing within your labour agreement (for example, details concerning your paid time off) you should not be worried. The Schengen Visa officers are trained to spot irregularities and to identify authentic documents – not to be experts in the clauses of a contract. This means that a legal employment agreement, even if it does not indicate all your work conditions, will help them anyway process your Schengen Visa.

In an ideal scenario, you should submit a permanent labour contract, as it provides stronger evidence of your intentions to return from the Schengen Area to your home country where you have a stable workplace. 

However, submitting a fixed-term contract, a casual contract, or any other type of contract according to the laws of your country doesn’t mean that your Schengen Visa will necessarily be rejected.

Note : In case you are asking yourself “What documents are required if I am self-employed?”, you should know that you are required to submit the following documents: a copy of your business license, your business income statements , Company Income Tax Return , and business bank statement of the last 6 months (outside of your Personal Income Tax Return and current bank statement of the last 6 months). 

Why Is The Employment Contract One Of The Most Important Schengen Visa Requirements?

  • The labour contract has been listed as mandatory for all the Schengen Country Embassies, meaning that you do not get the choice and must submit it together with other mandatory Schengen Visa requirements (e.g., valid passport, fully completed Visa application form , flight reservation , etc.).

Of course, the contract is mandatory only for those applicants who are employed, meaning that even if you are currently unemployed you can still apply for the Schengen Visa – the only difference is that you will have to submit specific documents depending on your situation  (e.g., a sponsorship letter ).

  • It provides strong proof of your employment status. For the Schengen Visa officers, it is highly important to know that you have contractual obligations in order to ensure you will return to your home country and will not stay in the Schengen Zone illegally.

Do not forget that most Schengen Visa applications are rejected because the applicants do not provide enough proof of their intentions to return from the Schengen Territory.

  • It is treated as another piece of validation that you are who you say you are. 

For example, in case of identity theft it is more difficult to provide a labour contract containing information that matches the one on the other documents, such as the full name and the address.

  • It provides proof that you are an honest person who has a clean criminal record because a respectable company signed a labour agreement with you. 

For example, if you have a criminal background or give the Employer any reason to believe you are not trustworthy it is more likely that a company will refuse to sign a labour agreement with you.

As a result, it provides additional evidence of your purpose of entry in a Schengen country (e.g., if you will be travelling for tourism the Visa officers have more reasons to believe that your travel purpose is genuine). 

  • The contract is the strongest proof you can bring that you can personally cover all of your expenses during your visit to the Schengen Zone, as it can show all the information concerning your financial means (e.g., wage, bonuses, commissions, insurance, expense accounts, and more).
  • The other employment documents required by the Schengen Visa officers, such as the Certificate of Employment (COE) or the No Objection Certificate (NOC) Letter from Employer can indicate your monthly or annual salary as well, but these documents do not always provide an overall summary of the total compensation you receive from the company you work for.

How To Get An Employment Contract For Your Schengen Visa Application?

Employers are legally required to provide employees with a written statement of the labour agreement (the contract). If you didn’t receive a copy of your written contract from your employer, it is your right to ask for a written contract to be given to you before applying for your Schengen Visa.

In most states, the law requires that all employers provide written details of the main terms of employment to employees within a few weeks or months of them taking up their position. 

Therefore, you can get your contract by simply asking your employer to give it to you (in the exceptional case that you didn’t receive one already or misplaced your original one). 

The Schengen Visa officers are not actually interested to know if your labour agreement contains specific terms (for example, they are not interested if you receive bonuses from your employer annually or quarterly). They only want to view it to ensure that you are employed and you receive enough money to cover your expenses during your stay within the Schengen Area.

In a few words, they want to ensure that you live a stable life in your home country before issuing a valid Visa for you.  

Mistakes To Avoid When Submitting An Employment Contract For Your Schengen Visa Application

● declaring to the schengen visa officers that you have a verbal work agreement.

A verbal or oral contract is very difficult to prove, and the Schengen Visa officers need to see exactly the details of your employment. 

In some countries, verbal contracts are legal while in others they are illegal. Even if verbal contracts are legal in the non-Schengen country where the contract is effective, you must provide the Visa officers with a written contract.

● Not submitting all the additional documents concerning your employment conditions

In some companies, not all the expressed terms agreed between an employer and an employee are mentioned in the labour agreement. Some of them can be written down in a subsidiary document or another written statement. 

If you signed a subsidiary document together with your labour contract, you must submit it as well. All of them are required documents that the Schengen Visa officers must carefully check.

● Details on your contract do not match the details on your other documents

All the documents you provide to the Embassy/Consulate for your Schengen Visa application must show consistency. This is the main reason why you must double-check in order to ensure all the details on your documents match.

For example, your salary, the date you started work, and your role within the company mentioned on your contract must match the information on your other documents, such as the Certificate of Employment (COE), No Objection Certificate (NOC) letter, bank statements, or your payslips for the last three months or more.  

● The contract shows you do not get statutory rights

The statutory rights are the rights given by the law of the state in which the contract is effective (for example, being paid at least the National Minimum Wage). 

Any rights you have under your labour contract are in addition to your statutory rights. A contract that shows you do not get statutory rights can be illegal and you should not submit it.

The Schengen Visa officers may believe that you do not have a stable employer in your country since you do not get the statutory rights that all the employees are entitled to. 

Therefore, they may think you have fewer reasons to come back to your home country after travelling to the Schengen Area.

● Your contract was not updated

If for any reason the expressed terms of the agreement you have with your employer have changed, your contract must be reviewed and last updated before applying for your Schengen Visa. 

Also, employment law can change as well. You must submit to the Embassy/Consulate a labour agreement that reflects the current law in the country where the contract is effective (and not a law that is not applicable anymore) as well as a contract that is still in effect (for example, it is not expired).

● Your contract was not signed by both parties

Sometimes, employees receive two printed copies of their employment contracts: one copy that they must sign and give it back to the employer and one copy that they must keep. 

Some employees sign the employer’s copy of the contract and forget to sign their own copy of the contract. 

If this is your situation, make sure you sign your copy before submitting it to the Embassy/Consulate (also, make sure no mistake has occurred and your employer signed the contract as well). 

● Your contract does not include the mandatory details required by the law of the country where the contract is effective

In most cases, the country where a labour agreement is effective is the country of residence of the employee. 

There is only one exception to the rule – when you work for a foreign employer and the contract reflects the law of the country of your employer (which is not your country of residence). 

For example, you are an Indian (living in India or any other country), you work remotely for an American company and your labour agreement follows the American law. 

If according to the law of the country where the contract is effective (whether it is your country of residence or not) some details must be included in the contract, such as the nature of the employment, the place of work, or any other detail, make sure your contract includes these details. This will bring additional proof to the Schengen Visa officers that you have a legal agreement that respects the law of a specific country.  

● Submitting a contract that shows you do not get enough money

According to the Schengen Visa requirements, your labour contract must prove that your salary is high enough to allow you to cover the expenses for your trip to Europe (e.g., hotel reservations , travel medical insurance , flight itinerary , day-to-day expenses, etc.).

Employment certificate, financial documents, and income tax return (ITR) are the staples of most visa applications. But there is one document that is usually overlooked — the cover letter.

A cover letter isn’t always a requirement when applying for a visa. However, it’s something that we often recommend to add to your pile of documents, especially if there is no interview and you have some explaining to do.

You see, sometimes, things don’t always fit the mold perfectly. There are cases wherein you can’t provide the exact document needed, but you have a very good alternative. Or maybe you just can’t provide something at all, but you have a perfectly valid reason. Or perhaps you’re traveling with a group or for a special purpose. These instances could probably benefit from a well-crafted explanation to give the visa officer a clearer picture of your situation.

When I apply for a visa, I usually submit a cover letter regardless of whether or not it’s one of the requirements. I always want to give a summary of my application and clarify some aspects that may be prone to misinterpretation.

WHAT'S COVERED IN THIS GUIDE?

What should be in a cover letter?

For me, a good cover letter must be able to provide the following:

  • A short introduction about yourself.
  • Your travel dates and the purpose of your trip
  • If traveling with a group: your companions and your relationship with them
  • If sponsored: your sponsor’s name, your relationship with them, and the reason why they are willing to sponsor you
  • If you’re missing some requirements: the reason why you won’t be able to provide them and the alternatives you are submitting instead
  • If applying for a double entry or multiple entry visa: the reason why you need to be allowed more than one entry
  • A quick rundown of the destinations you will be visiting
  • A quick summary of your travel history (if any), highlighting that you have NEVER violated visa rules in the past
  • A promise to return to your home country in time

Looks like a lot, huh? But here’s the thing: According to a couple of friends who used to work as visa officers at strict embassies, they usually had very little time to assess each application. Hence, if you’re going to make a cover letter, go straight to the point . One page should be enough. The key is being concise — finding the balance between giving enough information and keeping it short and sweet.

Here are some samples. I intentionally used complicated situations to give you an idea how I usually explain them. If they don’t apply to you, feel free to modify these to match your case. Please use this only as a model for your own cover letter. Please do not copy-paste the whole thing without adjustments.

Hello, I will be applying for a Japan visa and will submit a cover letter din. I have a few questions:

  • If I am traveling with friends pero we will be submitting individual applications, do I need to include that in the cover letter na I am with them on this trip?
  • Do you need to submit all your savings account o kahit isa nalang?
  • Plan ko rin sana (dahil nabasa ko sa ibang posts nyo hehe) na payroll and savings account ipasa, pero kung nililipat ko rin naman yung laman ng payroll sa savings, need ko pa ba isubmit yung payroll account?
  • Sa ibang Japan visa application na napanuod ko, nagsusubmit sila ng bank certificate at bank statement. Do I need to do that?
  • If yes, need ko ba explain sa cover letter ko na tinatransfer ko sa digital bank muna yung pera saka ko tinatransfer sa savings account? (kasi baka makita, if may bank statement, na nanggaling sa ganitong account yung pumasok na pera)

2. OK lang kahit isa lang kung sa tingin mo strong enough ung account na yun. Pwede ring madami if feeling mo di enough ung isa lang.

4. Bank cert lang naman ang need ng Japan so kahit walang statement, ok lang.

5. If hindi ka magsusubmit ng statement, di na need iexplain kasi hindi lalabas. :)

I plan to visit Canada and have started my visa application. I selected visit friend for purpose instead of tourism as I would like to be fully honest with my application. My very purpose is to be with my boyfriend and meet his family and friends. Touring comes as a bonus. Would it be fine to add captions or narrations on the pdf document together with our pictures as proof? I also have our hotel and tour bookings and his boarding passes on the two times that he has visited me here in PH. This is the Proof of Relationship section on the application visa.

Citizens of Canada and Bermuda

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for a temporary stay, or an immigrant visa for permanent residence. Visitor visas are nonimmigrant visas for persons who want to enter the United States temporarily for business (visa category B-1), for tourism (visa category B-2), or for a combination of both purposes (B-1/B-2).

Here are some examples of activities permitted with a visitor visa:

Business (B-1)

  • Consult with business associates
  • Attend a scientific, educational, professional, or business convention or conference
  • Settle an estate
  • Negotiate a contract

Tourism (B-2)

  • Vacation (holiday)
  • Visit with friends or relatives
  • Medical treatment
  • Participation in social events hosted by fraternal, social, or service organizations
  • Participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating
  • Enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation)

Travel Purposes Not Permitted On Visitor Visas

These are some examples of activities that require different categories of visas and cannot be done while on a visitor visa:

  • Paid performances, or any professional performance before a paying audience
  • Arrival as a crewmember on a ship or aircraft
  • Work as foreign press, in radio, film, print journalism, or other information media
  • Permanent residence in the United States

Visitor visas will also not be issued for birth tourism (travel for the primary purpose of giving birth in the United States to obtain U.S. citizenship for their child).

How to Apply

There are several steps to apply for a visa. The order of these steps and how you complete them may vary by U.S. Embassy or Consulate. Please consult the instructions on the  U.S. Embassy or Consulate website .

Complete the Online Visa Application

  • Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160 . You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. Your photo must be in the format explained in the Photograph Requirements .

Schedule an Interview

Interviews are generally required for visa applicants with certain limited exceptions below. Consular officers may require an interview of any visa applicant.

You should schedule an appointment for your visa interview at the  U.S. Embassy or Consulate  in the country where you live. You may schedule your interview at another U.S. Embassy or Consulate, but be aware that it may be more difficult to qualify for a visa outside of the country where you live. 

Wait times for interview appointments vary by location, season, and visa category, so you should apply for your visa early. Review the interview wait time for the location where you will apply:

Check the estimated wait time for a nonimmigrant visa interview appointment at a U.S. Embassy or Consulate.

Note: Please check the individual Embassy or Consulate website to determine if your case is eligible for a waiver of the in-person interview.

Applicants scheduling visa appointments in a location different from their place of residence should check post websites for nonresident wait times.

  • Fees - Pay the non-refundable visa application fee , if you are required to pay it before your interview. If your visa is approved, you may also need to pay a visa issuance fee, if applicable to your nationality. Fee information is provided below:

Gather Required Documentation

Gather and prepare the following required documents before your visa interview:

  • Passport valid for travel to the United States – Your passport must be valid for at least six months beyond your period of stay in the United States (unless exempt by country-specific agreements ). Each individual who needs a visa must submit a separate application, including any family members listed in your passport.
  • Nonimmigrant Visa Application, Form DS-160 confirmation page.
  • Application fee payment receipt, if you are required to pay before your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. If the photo upload fails, you must bring one printed photo in the format explained in the Photograph Requirements .

Additional Documentation May Be Required

Review the instructions for how to apply for a visa on the website of the U.S. Embassy or Consulate where you will apply. Additional documents may be requested to establish if you are qualified. For example, additional requested documents may include evidence of:

  • The purpose of your trip,
  • Your intent to depart the United States after your trip, and/or
  • Your ability to pay all costs of the trip.   

Evidence of your employment and/or your family ties may be sufficient to show the purpose of your trip and your intent to return to your home country. If you cannot cover all the costs for your trip, you may show evidence that another person will cover some or all costs for your trip.

Note:  Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa.

Attend Your Visa Interview

A consular officer will interview you to determine whether you are qualified to receive a visitor visa. You must establish that you meet the requirements under U.S. law to receive a visa.   Ink-free, digital fingerprint scans are taken as part of the application process. They are usually taken during your interview, but this varies based on location.

After your visa interview, the consular officer may determine that your application requires further  administrative processing .  The consular officer will inform you if this required.

After the visa is approved, you may need to pay a visa issuance fee (if applicable to your nationality), and make arrangements for the return of the passport and visa to you.  Review the  visa processing times  to learn more.

Entering the United States

A visa allows a foreign citizen to travel to a U.S. port-of-entry (generally an airport) and request permission to enter the United States. A visa does not guarantee entry into the United States. The Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States. If you are allowed to enter the United States, the CBP official will provide an admission stamp or a paper Form I-94, Arrival/Departure Record. Learn more about admissions and entry requirements, restrictions about bringing food, agricultural products, and other restricted/prohibited goods, and more by reviewing the CBP website .

Extending Your Stay

See  Extend Your Stay  on the U.S. Citizenship and Immigration Services (USCIS) website to learn about requesting to extend your stay beyond the date indicated on your admission stamp or paper Form I-94. 

Failure to depart the United States on time will result in being  out of status . Under U.S. law, visas of individuals who are out of status are automatically voided ( Section 222(g) of the Immigration and Nationality Act ).  Any multiple entry visa that was voided due to being out of status will not be valid for future entries into the United States.

Change of Status

If your plans change while in the United States (for example, you marry a U.S. citizen or receive an offer of employment), you may be able to request a change in your nonimmigrant status to another category through U.S. Citizenship and Immigration Services (USCIS). See  Change My Nonimmigrant Status  on the USCIS website to learn more.

While you are in the United States, receiving a change of status from USCIS does not require you to apply for a new visa.  However, once you depart the United States you must apply for a new visa at a U.S. Embassy or Consulate in the appropriate category for your travel.

Additional Information

  • An individual on a visitor visa (B1/B2) is not permitted to accept employment or work in the United States.
  • There is no guarantee you will be issued a visa. Do not make final travel plans or buy tickets until you have a visa.
  • A valid U.S. visa in an expired passport is still valid. Unless canceled or revoked, a visa is valid until its expiration date. If you have a valid visa in your expired passport, do not remove it from your expired passport. You may use your valid visa in your expired passport along with a new valid passport for travel and admission to the United States. 

Travel for Medical Treatment

If you are seeking medical treatment in the United States, the consular officer may ask for further documents at your visa interview, which may include:

  • Medical diagnosis from a local physician, explaining the nature of the ailment and the reason you need treatment in the United States.
  • Letter from a physician or medical facility in the United States, stating they are willing to treat your specific ailment and detailing the projected length and cost of treatment (including doctors’ fees, hospitalization fees, and all medical-related expenses).
  • Proof that your transportation, medical, and living expenses in the United States will be paid. This may be in the form of bank or other statements of income/savings or certified copies of income tax returns (either yours or the person or organization paying for your treatment).

Visitor Visas for Personal or Domestic Employees (B-1)

You may apply for a B-1 visitor visa to work in the United States as a personal or domestic employee for your employer in limited situations. You may work in the United States on a visitor visa if your employer is:

  • A U.S. citizen who has a permanent home or is stationed in a foreign country, but is visiting or is assigned to the United States temporarily; or
  • A foreign citizen who is in the United States on one of the following nonimmigrant visa categories:  B, E, F, H, I, J, L, M, O, P, or Q.

Visa Renewal

Whether you are applying for the first time or renewing your visa, you will use the same application process (please review How to Apply , above). Some applicants seeking to renew their visas in certain visa classes may be eligible for the Interview Waiver (IW) which allows qualified individuals to apply for visa renewals without being interviewed in person by a U.S. consular officer. Review the instructions on the website of the U.S. Embassy or Consulate where you will apply to determine if the IW is available and if you qualify.

Do I need a visa if I have an ABTC?

Yes, you will still need a visa to travel to the United States, unless you qualify for the  Visa Waiver Program . Having an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC) does not change visa requirements, your visa status, or the visa process for travel to the United States.

How can I use my ABTC when I apply for my visa?

If you have an Asian-Pacific Economic Cooperation (APEC) Business Travelers Card (ABTC),  you might be able to schedule an expedited visa interview appointment. Review the instructions for scheduling expedited appointments on the website of the  embassy or consulate  where you will apply. 

Visa Annotations for Certain Maritime Industry Workers

Certain foreign maritime workers are eligible to apply for a Transportation Worker Identification Credential (TWIC) once in the U.S. If you, as a maritime industry worker, will perform services in secure port areas, your visa must be annotated “TWIC Letter Received.” Workers whose visas are not annotated will not be permitted by the Transportation Security Administration (TSA) to apply for a TWIC.

In order for your visa to be annotated, you must obtain a letter from your employer explaining the need for a TWIC and that you are a potential TWIC applicant. See a template example of this letter. You must present this letter when you apply for the B-1 visa. You must meet all other eligibility requirements for a B-1 visa.

Misrepresentation or Fraud

Attempting to obtain a visa by the willful misrepresentation of a material fact, or fraud, may result in the permanent refusal of a visa or denial of entry into the United States.

Citizens of China

In accordance with the agreement signed between the United States and China to extend visa validity, beginning on November 29, 2016, Chinese citizens with 10-year B1, B2 or B1/B2 visas in Peoples’ Republic of China passports will be required to update their biographical and other information from their visa application via a website every two years, or upon getting a new passport or B1, B2, or B1/B2 visa, whichever occurs first.  This mechanism is called EVUS - Electronic Visa Update System.

The EVUS website is now open to the public for enrollments at www.EVUS.gov .  CBP will not collect a fee for EVUS enrollment at this time. CBP anticipates the eventual implementation of an EVUS enrollment fee, but does not have a time frame. Until the implementation of a fee, travelers can enroll in EVUS without charge.  The Department of Homeland Security, Customs and Border Protection (CBP) will keep visa holders informed of new information throughout the year. For further information, please visit  www.cbp.gov/EVUS .‎

Citizens and permanent residents of Mexico generally must have a nonimmigrant visa or Border Crossing Card (also known as a "Laser Visa"). Visa Waiver Program  (VWP)

Tourist or business travelers who are citizens of participating countries may be eligible to visit the United States without a visa. Visits must be 90 days or less, and travelers must meet all requirements.

Citizens of Canada and Bermuda generally do not need visas for tourism and visits.

Exchange Visitors

The J-1 classification (exchange visitors) is authorized for those who intend to participate in an approved program for the purpose of teaching, instructing or lecturing, studying, observing, conducting research, consulting, demonstrating special skills, receiving training, or to receive graduate medical education or training.

In carrying out the responsibilities of the Exchange Visitor Program, the Department of State designates public and private entities to act as exchange sponsors. J-1 nonimmigrants are therefore sponsored by an exchange program that is designated as such by the U.S. Department of State. These programs are designed to promote the interchange of persons, knowledge, and skills, in the fields of education, arts, and science.

In January 2022, DOS announced measures to increase the flow of talent in science, technology, engineering, and math (STEM) fields. The Early Career STEM Research Initiative connects certain J-1 program sponsors with STEM-relevant sponsors, including businesses.

Information on the education, experience, and skills required to qualify is available at the DOS website .

Examples of exchange visitors include, but are not limited to:

  • Professors or scholars
  • Research assistants
  • Specialists
  • Camp counselors

The U.S. Department of State plays the primary role in administering the J-1 exchange visitor program, so the first step in obtaining a J-1 visa is to submit a Form DS-2019, Certificate of Eligibility for Exchange Visitor Status, (formerly known as an IAP-66). Your sponsoring agency will provide you this form. You should work closely with the officials at your sponsoring agency who will be assisting you through this process. An official who is authorized to issue Form DS-2019 is known as a responsible officer (RO) or alternate responsible officer (ARO). Your RO or ARO will explain to you what documents are needed in order to be issued a DS-2019.

After you have obtained a Form DS-2019, you may then apply for a J-1 visa through the U.S. Department of State at a U.S. Embassy or Consulate. The waiting time for an interview appointment for applicants can vary, so submitting your visa application as early as possible is strongly encouraged (though you may not enter the United States in J-1 status more than 30 days before your program begins).

Some J-1 nonimmigrants enter the United States specifically to work while others do not. Employment is authorized for J-1 nonimmigrants only under the terms of the exchange program. Please check with your sponsoring agency for more information on any restrictions that may apply to you working in the United States.

Your spouse and unmarried children under 21 years of age, regardless of nationality, are entitled to J-2 classification. Your spouse and children are entitled to employment authorization; however, their income may not be used to support you. To apply for employment authorization as a J-2 nonimmigrant, your spouse or child would file Form I-765, Application for Employment Authorization. To visit the UK, you need to show that you’re a genuine visitor.

You can do this by providing evidence that:

  • you’re coming to do a permitted activity – see Appendix Visitor: Permitted Activities
  • you’ll leave the UK at the end of your visit
  • you’re able to support yourself and any dependants for the duration of your trip
  • you’re able to pay for your return or onward journey and any other costs relating to your visit

Wherever possible, digital images should be taken of original documents, not copies.

If you submit a document that is not in English or Welsh, it must be accompanied by a full translation that can be independently verified by the Home Office. Each translation must contain:

  • confirmation from the translator that it is an accurate translation of the original document
  • the date of translation
  • the translator’s full name and signature
  • the translator’s contact details

You do not need to provide multiple copies of the same documents if you’re applying as a family or group at the same time.

If you’re applying to visit the UK as part of a Chinese tour group, you should read the specific guidance for ADS visitors .

Submitting or presenting any of the documents listed below does not guarantee that your application for a visit visa or entry at the border will be successful. You should bear this in mind when making any bookings, particularly if you need to apply for a visitor visa before you travel to the UK.

1. Travel document (passport)

You must provide a valid passport or other travel document with all applications and when travelling to the UK. Your passport must have at least 1 page blank if you use it to apply for a visa.

Some passport holders may need to provide alternative evidence of their identity and nationality.

2. Demonstrating personal circumstances

If you are intending to visit the UK you will need to show that you are a genuine visitor who is coming to the UK to undertake a permitted activity, that you will leave at the end of your visit and that you have sufficient funds for yourself and any dependants to cover all reasonable costs in relation to your visit.

It is recommended that you provide information about your circumstances in your home country and details of the activity that you will be doing in the UK.

The following provides information about the types of documents that you might want to provide to help us consider your application against the Immigration Rules for Visitors ( Appendix V: Visitor ). This list is not exhaustive.

  • what you will be doing in the UK, the reason for your visit and whether any costs are being met, including any letters from inviting or sending organisations
  • a letter from your employer on company headed paper, detailing your role, salary and length of employment
  • a letter from your education provider, on headed paper, confirming your enrolment and leave of absence
  • business registration documents or recent invoices that confirm on-going self-employment
  • copies of previous passports showing evidence of travel to other countries
  • confirmation of legal residence, if you are not a national of the country in which you are applying or your right to reside there is not included in your passport
  • bank statements which detail the origin of the funds held
  • building society books which detail the origin of the funds held
  • proof of earnings, such as a letter from your employer confirming employment details (start date of employment, salary, role, company contact details)

3. If you have a sponsor

If someone else (your sponsor) is providing your travel, maintenance or accommodation you should provide evidence showing:

  • what support is being provided and whether it extends to any dependent family
  • how this support is being provided

the person supporting you has enough funds to adequately support themselves and their dependents

the relationship between you and the sponsor, for example if they’re your family member or your employer

  • the person supporting you is legally in the UK (if applicable), for example if they have a British passport or residence document

4. If you’re a child (under 18)

You should show a legal document showing the relationship between you and at least 1 of your parents or guardians, for example a birth certificate or adoption papers.

You should show a copy of the photo page of at least 1 parent’s or guardian’s passport, including their signature and passport number, if they’re not also applying for a visa.

If you have a different family name to your parent/guardian, you may be asked to provide evidence of your relationship. Evidence you can provide may include:

a birth or adoption certificate showing your relationship to your parent or guardian

a divorce or marriage certificate for your parent or guardian

4.1 If you’re not travelling with your parent or guardian

You should provide additional documents to show that your parent or guardian is aware of your travel plans and that they give you permission to enter the UK. Your application may be refused if you don’t.

You should provide a signed letter from your parent or guardian confirming your travel arrangements, including:

  • your parent or guardian’s consent for you to travel to the UK
  • who’s travelling with you – you’ll need to provide their passport number if they’re an adult
  • who’ll look after you while you’re in the UK
  • how you’ll travel to the UK
  • If your parent or guardian does not have a passport, you should provide another official document that includes their signature

5. Visiting for business purposes

  • the relationship between you and the sponsor, for example if they’re your family member or your employer)

6. Attendees of business-related events or conferences

If you are attending a business event or conference, you should provide a letter of invitation from the organiser of the event you are attending.

7. Intra-corporate visits

If you are visiting the UK to work with your UK based colleagues you should provide a letter from your employer confirming this, and if this will involve working with clients, your employer should confirm that this is not the main purpose of your visit.

8. Wet lease arrangements

If you are a pilot or cabin crew member travelling to the UK to work temporarily under a wet lease agreement, you should provide a letter from your employer confirming that you are employed by them and that a wet lease agreement is in place.

9. Visiting for training, research or paid engagements

9.1 academics coming to undertake research (12-month visa).

You should show that you’re highly qualified and working in your field at an academic or higher education institution. For example, you could provide:

  • a letter from your employer outlining the research to be undertaken
  • a letter from the UK host organisation confirming the arrangements for your research or exchange

You should check if you need a TB test .

You should check if your family members need a TB test if you’re bringing them to the UK with you.

9.2 Performers at one or more permit-free festivals

You may want to provide a letter of invitation from the organisers of each event, including the dates of your performances and details of any payments you’ll receive.

9.3 Professional and Linguistic Assessment Board (PLAB) test and Objective Structured Clinical Examination (OSCE) test

You’ll need to provide a letter from the General Medical Council or Nursing and Midwifery Council confirming your test.

9.4 Work-related training – unpaid clinical attachments and dental observer posts

You’ll need to provide confirmation of your offer to undertake a clinical attachment or dental observer post, that it involves no treatment of patients and that you’ve not previously undertaken this activity in the UK.

You should provide an acceptance letter from your course provider confirming the details of the course.

9.6 Study – medical electives 

You must provide written confirmation from your UK Higher Education provider confirming you have been accepted to undertake an elective relevant to your course of study overseas.

9.7 Study – research placements  

You must provide confirmation from your overseas course provider that the research or research tuition is part of, or relevant to, the course you’re doing overseas.

9.8 Permitted Paid Engagements

You’ll need to provide an invitation letter showing why you’re carrying out the engagement and how long it’s for from a relevant UK-based organisation, such as:

  • a Higher Education institution
  • an organisation in the creative arts or entertainment industries
  • a sports organisation, agent or broadcaster
  • a research organisation
  • an aviation training organisation regulated by the United Kingdom Civil Aviation Authority
  • a client, if you are a lawyer
  • the organiser of a conference or seminar confirming your invitation to speak at their event

You should provide evidence of professional status in your home country or expertise, depending on the engagement.

9.9 Lecturers or examiners

You can provide:

  • the names or details of your publications in your field of expertise
  • dates and times of lectures you’ve given in that field
  • a letter from your employer confirming where you work and your area of expertise

9.10 Entertainers/artists/sports people

  • dates and times of performances, screenings, concerts, talks, readings and exhibitions
  • details of any awards you’ve received
  • proof of recent performances

9.11 Air pilot examiners

You should provide evidence showing you’ve been invited by an approved training organisation. They must be based in the UK and regulated by the UK Civil Aviation Authority .

9.12 Lawyers

You’ll need to provide evidence that you’re a qualified lawyer, for example a practising certificate or equivalent document.

You should also show you’ve been invited to represent a client in the UK court, for example confirmation of your right to audience, or ‘temporary call’ (where required).

10. Visiting for private medical treatment

If you’re applying to visit the UK as an S2 Healthcare Visitor, you should read the specific guidance for S2 Healthcare Visitors

10.1 Private Medical Treatment

You’ll need to provide a letter written by a doctor or consultant , that includes:

  • details of the condition requiring consultation or treatment
  • estimated cost and likely duration of any treatment
  • details of where the consultation or treatment will take place.

If you are coming to the UK to receive medical treatment as part of a reciprocal healthcare arrangement between your country and the UK, you must provide an authorisation form from that country.

You should check if you need a TB test if you’re applying for an 11 month visa.

If you’re applying to extend your stay in the UK to receive private medical treatment you must show:

  • a letter explaining your medical condition from a registered medical practitioner
  • you’ve met the costs of the treatment you’ve already received

If you’re applying to extend your stay in the UK to continue receiving medical treatment as part of a reciprocal healthcare arrangement between your country and the UK, you must provide an authorisation form from that country which authorises further treatment.

10.2 Organ donors

You’ll need to provide a letter from either the lead nurse of the transplant team or a GMC-registered specialist , dated no more than 3 months before you intend to arrive in the UK, confirming:

  • you’re a confirmed match to the recipient with whom you have a genetic or close personal relationship, or you’re being tested to determine whether you are a potential donor
  • when and where the transplant or tests will take place

You should show the intended recipient is legally resident in the UK, such as a copy of their British passport or residence permit. You should provide the intended recipient’s name, nationality and date of birth if they are not legally resident in the UK and are applying for a visa at the same time.

11. Visiting for your marriage or civil partnership

You must apply for a marriage or civil partnership visitor visa to enter the UK to marry, form a civil partnership, or give notice of this.

You should provide evidence that you intend to give notice, marry or form a civil partnership during your stay, for example an appointment confirmation with a registrar or booking confirmation for your reception. If you’ve been married or in a civil partnership before, you should provide documents to show that you are free to marry or form a civil partnership.

You must be over 18.

12. Passing through the UK in transit

You should provide evidence that:

  • your outward journey from the UK has been confirmed and is within 48 hours of arrival, for example travel booking confirmation
  • you can enter the country you’re travelling to, for example a valid visa or residence permit

13. Documents you should not use as evidence

Some types of documents are less useful as evidence in visit applications. These include:

  • bank statements or letters issued more than 1 year before the date of application
  • credit card statements
  • driving licence
  • educational certificates that are not listed as required for your visa
  • evidence of car ownership
  • personal photographs
  • notarial certificates
  • business cards
  • hotel bookings
  • flight bookings (unless transiting)
  • photocopies of bank cards
  • certificates relating to leisure activities, for example sports trophies
  • travel insurance
  • sponsor’s utility bills
  • sponsor’s council tax bills

You may be asked to provide additional information by a decision maker.

The United States remains one of the most desirable job markets in the world. It’s an incredibly large country, with some of the largest, most innovative companies. How to Find a Job in the U.S.

The most straightforward way to get a job in the U.S. is if you are already in-country. For work authorization, you need to apply for an  Employment Authorization Document (EAD) . It’s not a visa, and physical presence in the U.S. doesn’t make you automatically eligible. You must be lawfully present in a status that accommodates employment authorization. For example, visitors on B-2 or F-1 visa generally are not eligible. Some common categories where you can apply for an EAD include:

Adjustment of Status Applicants

The end result of the  adjustment of status process  is a green card. A green card provides work authorization in the U.S. for the permanent resident. But adjustment of status applications (Form I-485) take a while to process, and many people would like to work while waiting. Getting an EAD allows you to work while you wait for your permanent status.

DACA or TPS

Individuals whom the USCIS has granted Deferred Action for Childhood Arrivals (DACA) or Temporary Protected Status (TPS) are in a lawful status that also is eligible for work authorization.

Generally, enrolled students are not in a category that’s eligible for employment authorization. If you have an F or M visa, you would apply for your EAD as part of your  Optional Practical Training  (OPT) application, which lets you get experience related to your area of study once you finish your college degree in the U.S. The Career Services office at your college or university is a great place to start if you’re looking for a job.

Asylum Seekers

If you are requesting asylum in the United States, you can apply for an EAD while your case is processed. The EAD application is the same for asylum seekers as it is for other immigrants.

How to Get a U.S. Work Visa as a Foreign National Who is Outside the U.S.

You do need explicit permission to work in the United States. You can’t just show up on a visitor visa and begin job search. By law, U.S. employers must verify the identity and employment authorization of individuals hired for employment. Therefore, you typically need to enter with a U.S. work visa that permits employment. There are several types of visas designed for this purpose. The specific type of visa you need depends on your:

  • Field of work;
  • Connection to your employer (are you employed on a local branch or no previous relation); and
  • Country of origin (some countries have visa quotas or may have more options than others because of partnership agreements in specific fields like education and nursing).

If you’re not authorized to work in the United States, there are still ways in which you can find a job. Let’s go over a few possible options:

Investor Visas

E-2 visa for treaty investors.

Nationals of countries that maintain a treaty of commerce and navigation with the United States may be eligible for an investment-based non-immigrant visa. The E-2 visa is designed to give certain foreign nationals the ability to start a business and develop jobs in the U.S. It does have a requirement for a substantial financial investment, and you must be a national from one of these countries.

Temporary Employment Visas

L-1a visa for executives and managers.

If you are in an executive or management position in a multinational company, you could transfer to the U.S. to work for your same company. Under this visa, you could come to work in the U.S. either at the U.S. office of your company, or to set up a new office if there isn’t one operating yet. To qualify for the L-1A visa, you must have worked in an executive or managerial position for your company for at least a year from the previous three years before applying. If you get it, the L-1A visa allows you to stay in the U.S. for a year, with possible two-year renewals until you reach seven years.

TN Visa for Canadians or Mexicans

Canadian and Mexican citizens have a unique opportunity to qualify for an employment-based visa that allows work in a wide variety of industries. It’s also fairly simple to obtain. In addition to citizenship in Canada or Mexico, you’ll need an education or commensurate experience in your job field. With TN status, you can live and work in the United States for an initial period of three years. You may renew your status in three-year increments as long as needed.

The H-1B visa gets a lot of attention because of its popularity. These visas routinely run out quickly because of the demand. U.S. employers sometimes cannot find employees within the domestic workforce to fill certain specialty occupations. This is common in the technology sector. After going through an exhaustive  labor certification process , these employers may hire foreign nationals to fill the positions. The jobs are generally highly-skilled and well-compensated positions. The initial duration of stay for the H-1B visa is three years, but employers can generally extend the duration.

Seasonal and Temporary Jobs

The United States does provide visas for unskilled labor to enter the country for seasonal and temporary jobs in certain farming and non-agricultural jobs. The U.S. employer starts the process for obtaining a temporary H-2 work visa with a request that they cannot find the workers needed inside the U.S. Once approved by the U.S. government, the employer will send the documents to the foreign national. The company does all the paperwork in the U.S., and the applicant only goes to the U.S. embassy or consulate as a final step to process the visa once the employer sends you these documents.

Types of Seasonal and Temporary Visas

Seasonal and temporary jobs are divided in two types:

  • Agricultural (H-2A visa)
  • Non-Agricultural (H-2B visa)

The Department of Labor’s  Seasonal Jobs  website is a great place to start looking for these types of jobs. Agricultural positions may include work planting, picking, greenhouse care, applying fertilizer, and general farm maintenance using hand tools, among others. Some agricultural positions are outside in weather that could be harsh, and may involve long periods of standing or kneeling. Keep that in mind if you have any injuries.

Non-agricultural positions may include landscaping and gardening, housekeeping, restaurant work, seafood processing and packing, and working in construction.

The Seasonal Jobs website highlights top categories of jobs, specific locations (which may be important if you want to go somewhere you have family or friends), categories of seasonal jobs, and even crops if you’re an agricultural worker that wants to pick something specific based on your experience.

A similar website to find and apply for seasonal and temporary jobs is the  H2 Job Board . Similar to the DOL’s website, you can create a profile and apply for jobs in different parts of the United States. You can also sign up for job alerts to receive notifications on jobs that match your profile.

You may renew an H-2 visa; however, they are subject to numerical and country caps. There are specific visas set aside for workers from the Northern Triangle (Guatemala, Honduras, and El Salvador). The rest of the numerical cap goes to all other applicants. In recent years, businesses hiring workers under these visas have  requested numerical increases , which signals a high need for seasonal workers.

Visitor Exchange Programs

BridgeUSA  is a State Department program through which professionals like teachers and physicians work in the U.S. in their field. It also connects au pairs, camp counselors, interns, and professors, among other categories. You can see the requirements of each type of position in this  comparison chart . Generally, these visitor exchange visas are valid for one year, and you may potentially renew them for up to three years.

To apply to a visitor exchange program, you can click on the  program categories  to find a sponsoring institution and apply for openings. You are only allowed to work for your sponsoring employer in the activity listed on your visa application.
