Back to Basics: Durable Powers of Attorney and Trusts for Pets

How much time, effort and money do you spend caring for your pet? If you are like most pet owners, the answer to this question can best be summed up as, “A lot.” As pet owners, we are extraordinarily compassionate about caring for our beloved animals, and there are no lengths to which we won’t go to ensure that they are safe, content, and well-fed.

But, what happens when you die? Or, what if you become incapacitated due to an illness or injury and you are no longer able to personally care for your pet? While these are questions no one likes to think about, answering them is important for your pet, for you, and for the loved ones who would need to care for your pet on your behalf.

2 Important Life Planning Tools for Protecting Your Pets

When it comes to providing for your pet in your life plan , there are two separate issues to consider. The first is your pet’s care in the event of your incapacity. The second is your pet’s ownership and care in the event of your death. We use separate life planning tools to address each of these issues:

1. Durable Powers of Attorney for Pet Care (Planning for Incapacity)

A durable power of attorney for pet care allows you to appoint someone to care for your pet on your behalf should you become unable to do so during your lifetime. While the most-common reason for incapacity is simply growing old, there are various ways that a person can become incapacitated at all stages of life. For example, being involved in a serious car accident, suffering a traumatic injury on the job, and suddenly falling ill are all risks worth considering when it comes to making sure your pet’s needs will always be met.

Critically, a durable power of attorney for pet care is (or can be) temporary. If you recover from your injury or illness and regain capacity, then you will be able to resume providing care for your pet. However, while you are unable to provide care, the person you name in your durable power of attorney will have the legal authority to ensure your pet continues to live a comfortable and fulfilling life.

2. Pet Trusts (Planning for Death)

While it is possible to bequeath your pet to a loved one in your will, this approach is generally inadvisable for a variety of different reasons. Instead, we typically recommend use of a pet trust.

Creating a pet trust allows you to choose who will care for your pet after your death. It also allows you to establish guidelines for your pet’s care, and you can require that your pet have access to specific foods, activities and other things he or she enjoyed during your lifetime. With a pet trust, you can also set aside funds specifically for meeting your pet’s needs, and you can give a gift to your chosen caretaker so that he or she can purchase the provisions necessary to comfortably move your pet into his or her home. How To Take Care Of Your Pet With Power of Attorney

If you are a pet parent, you want the best for your fur babies. From toys to exercise to food, your furry family member loves you just as much as you love them. But what happens if you can no longer take care of your pet? Do you have a plan in place? To make sure your pet is cared for if you can’t care for them yourself, a pet power of attorney is one way to ensure your pet is taken care of.

So, what exactly is a Pet Power of Attorney? It’s a written document that legally authorizes a designated person to act on another person’s behalf as it relates to your pet and their care. The main idea behind a pet power of attorney is to formalize the arrangement you have with a family member, friend, or anyone that will be caring for your pet if you can’t. This person is required by law, once the document is signed, to make sure your requests are adhered to as much as possible.

Yes, we all count our pets as family members, but unfortunately, the law treats them as property in most cases. What this means is that if you, for some reason, can’t take care of your pet, the law doesn’t offer specifics in terms of how to authorize care. That’s where a Power of Attorney can help your pet.

You want to consider two types of Pet Power of Attorney depending on your situation and how long you want this arrangement to be: Non-Durable (Limited) Power of Attorney and Durable Power of Attorney.

The Non-Durable Power of Attorney is for when you want to designate a person to make decisions when it comes to your pet temporarily. A limited durable pet power of attorney can only be enforced while you’re still alive and can take care of yourself. If you pass away or become incapacitated, you’ll have to make sure you have a more permanent solution.

A Durable Power of Attorney is a more permanent arrangement that doesn’t have an expiration date. You can have it take effect immediately and even stipulate that this person will take care of your pet even after you die or become incapacitated. Some states may have different regulations. There’s nothing wrong with trusting that your family member will know what to do when it comes to your pet. Creating a pet power of attorney will clarify what you want to take care of. A pet care power of attorney (or PoA) allows a dog owner to appoint someone to act on their behalf. It allows the appointed person to make decisions and take actions necessary on behalf of the dog owner in regards to their dog’s care, including any potential veterinary care. It is important to note that a Power of Attorney only gives the appointed person the power to make decisions for the owner during the owner’s lifetime and not following the owner’s death. So, owners should also make sure to have a more permanent arrangement in place for the future care of a dog/puppy (see our Breeder FAQ on estate planning for more information).

WA AG: Archdiocese of Seattle refusing to share sex abuse documents

The Archdiocese of Seattle is refusing to turn over documents showing how it handled child sexual abuse allegations by church leaders, Washington Attorney General Bob Ferguson said in a news conference Thursday.

The archdiocese is citing a legal exemption for religious organizations that shields the records from public disclosure, said Ferguson, who has asked a King County Superior Court judge to force the church to comply with the office’s subpoenas and turn over the documents. Ferguson has requested a May 22 hearing.

Ferguson’s motion comes months after his office issued subpoenas to the state’s three dioceses — Seattle, Spokane and Yakima — as part of an investigation into allegations that they misused charitable funds to cover up decades of sexual abuse by church leaders. The investigation also seeks to identify accused priests and determine the church’s role in how it had kept those in positions of power, Ferguson said.

Ferguson is among nearly two dozen state attorneys general in the country investigating alleged abuse by church leaders, he said at a news conference Thursday in Seattle.

He said states such as Illinois have found hundreds more “substantiated child sex abusers” compared to what Catholic officials have disclosed.

“This investigation is not about second guessing the church’s use of funds for legitimate religious or charitable purposes,” said Ferguson, who is running for governor. “Abuse of children is obviously not a religious or charitable purpose — that exemption does not apply to them.” 

His office will file similar motions for the Yakima and Spokane dioceses if they refuse to cooperate with the investigation, Ferguson said.

Ferguson said the Attorney General’s Office made a round of subpoenas to all three dioceses last summer and this spring.

In a statement Thursday, the Archdiocese of Seattle said it had cooperated with the Attorney General’s Office for the last 10 months and had already turned over some of the information requested in an April subpoena, including offering to share with the office this week a series of “private deposition documents.”

The archdiocese also referenced a list it made public in 2016 of all 83 clergy members in the archdiocese who had been credibly accused of sexual abuse of a minor, and said it had received no new reports since 2007.

“Only by addressing this issue directly, will victims and the Church find healing,” the organization said in a statement. “However, based on the recommendations and guidance of professionals, we must do so in a way that protects the privacy of victims and ensures they are not re-traumatized.”

The archdiocese said it had asked the Attorney General’s Office earlier this year if they could hold a joint news conference about the investigation, but was rebuffed.

The Attorney General’s Office does not typically discuss ongoing investigations, but did so Thursday because it is taking legal action against the Archdiocese of Seattle, Ferguson said. 

The Attorney General’s Office set up a hotline for victims and people with information to call at 833-952-6277. 

“There is still time for the church to do the right thing — I can’t say I’m optimistic, but there is still time,” Ferguson said. “I’m speaking more as a Catholic than as an attorney general, but I have personally asked them to do that and to do the right thing and to do it now.”

In a statement, Washington-based nonprofit Catholic Accountability Project called for Ferguson’s office to share with survivors and advocates documents it gets from the archdioceses as the investigation progresses. The organization also called for Ferguson’s office to work with the Vatican to obtain documents in its archive as well.

Terry Carroll, a retired King County judge and member of Heal Our Church, an organization pushing for transparency concerning sexual abuse allegations in the Catholic Church, said the Archdiocese of Seattle should have made the documents sought by the Attorney General’s Office public years ago. 

“What entity purporting to represent the teaching of our Lord would not welcome the idea of truth and reconciliation unless there was something to hide?” said Carroll, who is Catholic. “It is critical that the chips fall where they may with any conclusions of the attorney general in their investigation — this is essential for our church to heal and move on.”

U.S. District Judge Algenon Marbley slowing down after storied career

“Democracy dies in the dark,” U.S. District Judge Algenon L. Marbley famously said in 2012 in a Columbus courtroom during a voting rights case.

Does the quote sound familiar? In 2017, The Washington Post adopted the slogan "Democracy Dies in Darkness.”

Some news outlets have reported that the slogan is a variation of Marbley’s quote, while others have pointed to a 2002 First Amendment case in which Judge Damon J. Keith , of the 6th U.S. Cicuit Court of Appeals in Cincinnati, wrote: “Democracy dies behind closed doors.” 

Legendary Washington Post investigative reporter Bob Woodward, who reported on the Watergate scandal, used the phrase for years before 2017 and said he got it from a judge, but couldn’t recall who. 

“I'm just glad that sentiment is expressed,” Marbley said. “I don't need attribution. It is important that people understand that sentiment because we’re the world’s first and foremost multiracial constitutional democracy. And it must continue to evolve, but it must continue to evolve without abandoning democratic principles.”

Voting rights is an issue close to his heart, he said, because he grew up under Jim Crow, what he calls American apartheid, in North Carolina.

Last month, Ohio State’s Office of Diversity and Inclusion inducted Marbley into its third Hall of Fame class.

When President Bill Clinton nominated Marbley in 1997 to a seat on the U.S. District Court for the Southern District of Ohio, Marbley was only the second African American judge in the district. In 2019, he became the first African American to serve as chief judge for the district.

In September, Marbley will turn 70 and have to relinquish the chief judge position due to age restrictions. He’s also preparing to take senior status, a kind of semi-retirement for federal judges during which he’ll be able to take on fewer cases. Marbley notified President Joe Biden in October 2023 that upon the confirmation of his successor, he would take senior status. 

Reflecting on a storied career that includes voting rights and fair housing cases, Marbley told The Dispatch he hopes every person who came before him in his court feels like he “treated their case as the most important case in the federal system.”

“As long as I will go down as a judge who was fair and relentless in my pursuit of justice, I'll rest easy at the end of my career,” he said.

Lawyers who practiced before him or worked with him told The Dispatch Marbley is always fair. They also described him as charming, intelligent and a workaholic dedicated to serving the community and parties before him in court. 

“I probably had more trials in front of him than anybody,” said Dave DeVillers, a former U.S. Attorney for the Southern District of Ohio who now practices as a defense attorney. “Not all of his rulings went my way. But you walk out of Marbley’s courtroom, and you know your side got a fair trial. … He works harder than anybody. He’ll be up at two in the morning writing opinions while you’re in bed. He outworks you.”

Attorneys emphasized to The Dispatch that Marbley’s decisions are often quoted because they’re “masterful and brilliant,” as Alycia Broz, one of Marbley’s first law clerks put it. He throws out Latin every once in a while in court, DeVillers added.

“In Marbley, the public got a public servant who’s dedicated and committed, and it just doesn’t get much better than that,” said Larry James, an attorney who’s practiced in front of Marbley, but has also been a longtime friend.

Still, Marbley has found time to be active in the Columbus community. He currently serves on the boards of Nationwide Children's Hospital, the KIPP (Knowledge Is Power Program) School, and the Columbus Symphony. 

He previously was on the Ohio State University board of trustees, but he resigned after the Ohio Ethics Commission questioned the lawfulness of him serving as a trustee while receiving payment to teach as an adjunct professor at OSU's Moritz College of Law. Marbley also agreed to teach for free for two semesters.

In his spare time, Marbley is an avid golfer. 

Primarily, he said he’s a family man dedicated to his wife, two adult sons, stepson, three granddaughters and two dogs. His first grandson is on the way. 

A storied career: voting rights, housing rights, policing and the Short North Posse

Although Marbley insists every case is important, there are cases of his that stand out.

The 2012 case in which Marbley said “democracy dies in the dark” involved then-Ohio Secretary of State Jon Husted’s office on the eve of the 2012 election issuing an order concerning provisional ballots.

The Northeast Ohio Coalition for the Homeless argued Husted’s order violated a previous consent decree and disenfranchised voters. Marbley would side with the coalition.

In 2021, Marbley granted a preliminary injunction that barred Columbus police from using tear gas, pepper spray, wooden bullets and other “non-lethal force” against nonviolent protesters. The decision favored protesters who alleged they were abused by officers during 2020 demonstrations against racial injustice after George Floyd’s murder. The city later adopted Marbley's rationale and passed a city ordinance barring officers from using these tactics during protests. 

Marbley sentenced many members of the Short North Posse, a gang that terrorized Weinland Park. In 2016, he presided over a nearly three-month jury trial of five Short North Posse members that included 11 defense attorneys, nine murders, 120 criminal allegations and more than 150 witnesses. The jury found them guilty on all counts. 

In 2008, Marbley presided over a fair housing case involving allegations that African American residents in the Coal Run neighborhood on the edge of Zanesville were discriminated against when the city and Muskingum County denied them city water access for 50 years. A jury awarded more than 60 plaintiffs over $10 million. 

And Marbley likely isn’t done with precedent-setting cases. Last year, Marbley made a ruling that allows for survivors of sex trafficking across the country to file in his court against the nation’s largest hotel chains for allegedly allowing exploitation under their roofs. Those cases are still pending.

Chief judge in a global pandemic 

According to Senior U.S. District Judge Susan J. Dlott, Marbley is the best chief judge the district has ever had. More than any other chief, he has increased the diversity among court staff, Dlott said. 

Dlott was appointed in 1995 to a seat on the bench in the U.S. District Court for the Southern District of Ohio, which includes Columbus. That was just before Judge Edmund A. Sargus Jr. in 1996 and Marbley in 1997. Dlott told The Dispatch the three are like siblings.

Marbley calls Dlott his “sister from another mother.”

Dlott and Sargus both served as chief judge of the district before Marbley since the post is based on seniority. Dlott said she and Sargus made sure to give up their positions before they reached their term limits so that Marbley would have a chance to serve as chief judge before he turned 70 and became ineligible.

While Dlott and Sargus faced their own challenges as chief judge, Dlott said Marbley had it the worst since he took over months before the COVID-19 pandemic hit . 

Marbley said he had no idea what Zoom was before 2020. But he worked hard to keep court staff and the public safe while keeping cases moving using tools like Zoom and plexiglass dividers in the courtroom.

How Algenon Lamont 'Monte' Marbley turned to the law 

Algenon Lamont (“Monte”) Marbley’s parents told him he was named after Algernon Lee Butler, a federal judge in North Carolina where Marbley grew up.

But that’s likely revisionist history since Marbley was born in 1954, five years before Butler took the bench. Marbley said his parents knew he wanted to be a lawyer — that or a baseball player, but his body didn’t “cooperate” — and wanted to encourage him.

Marbley became interested in the law early on because he wanted to change the world around him. Growing up in a small town during segregation, Marbley remembers being forced to sit in the balcony at the movie theater, go in the back of a restaurant for carry-out and attend separate schools from white children.

When David Duke, grand wizard of the Ku Klux Klan, came to speak at Marbley’s college, the University of North Carolina at Chapel Hill, he and the Black Student Movement, a group he chaired, shouted Duke off the stage.

“We decided that he represented an existential threat to the Black students because of the violent history of the Klan. And in North Carolina that violent history was real, it wasn’t an academic abstraction,” Marbley said.  

Marbley could have been expelled, but a student court decided 4-3 to exonerate Marbley. 

Marbley was able to go onto law school at Northwestern University and worked as a lawyer in Chicago until he moved to Columbus and spent 17 years at the law firm of Vorys, Sater, Seymour, and Pease.

Ohio attorney general warns student protesters in masks could face felony charges under anti-KKK law

COLUMBUS, Ohio – Ohio's top lawyer has advised the state's public universities that a law written to deter Ku Klux Klan demonstrations could be used to impose felony charges on students who wear face coverings while protesting the war in Gaza.

In a letter sent Monday, after weeks of pro-Palestinian campus protests around the country, Republican Attorney General Dave Yost advised the presidents of Ohio's 14 public, four-year universities — which his office represents — to forewarn students about the 1953 law.

“In our society, there are few more significant career-wreckers than a felony charge,” the letter said. “I write to you today to inform your student bodies of an Ohio law that, in the context of some behavior during the recent pro-Palestinian protests, could have that effect.”

The law is contained in a single sentence: “No person shall unite with two or more others to commit a misdemeanor while wearing white caps, masks, or other disguise.” Violating this “anti-disguise” law is punishable by a fourth-degree felony charge, up to $5,000 in fines and five years on community control, Yost wrote.

Protesters around the U.S. and the world have increasingly taken steps to remain anonymous by wearing a combination of head and face coverings, in a world where facial-recognition software can easily lead to negative repercussions. Not all do so to hide their identities, however. Some wear religious hijabs or medical masks used to prevent exposure to COVID-19, or as a political statement on the virus' ongoing impacts.

Yost, a fourth-term state official who is considering a run for governor in 2026, wrote that students should protest “within the bounds of the law," not commit crimes, not use the First Amendment as “a sword against fellow students,” and “own their advocacy and avoid wearing masks.”

Among Ohio's 34 public universities are Kent State , whose name is synonymous with clashes between Vietnam War protesters and National Guard members that left four dead in 1970, and Ohio State — a site of several protests in recent weeks where dozens have been arrested, most for criminal trespass.

Ohio State spokesperson Ben Johnson said the university had received Yost's letter and was reviewing it. In a March 6 letter, Yost had told President Ted Carter that Ohio law prevents the university from divesting its interests in Israeli assets, one of the calls of protesters.

Kent State and several other universities contacted by The Associated Press had no immediate comment. Nor did the Inter-University Council, which represents universities' interests, or the American Civil Liberties Union.

Bethany McCorkle, a spokesperson for Yost's office, said the letter regarding the “disguise law” was not a response to any specific request for legal advice by the universities.

“The letter was proactive guidance to universities that he is counsel for to make sure no one becomes an unintentional felon,” she said in a text message.

More than 100 MPs have said they will not be standing at the next general election.

Those who have announced their intention to leave parliament range from the longest-serving female MP, Labour's Harriet Harman, to one of those only elected at the last election in 2019, Conservative MP Dehenna Davison.

This election is seeing the constituency boundaries changed, leading to some MPs deciding to step aside as their seat is gutted or entirely excised.

The vast majority of those leaving are Conservatives, with more than 60 Tory MPs stepping aside.

The average age of Labour MPs standing down is 67 - a full 11 years higher than the Conservatives at 56 and the SNP at 55.

In a dramatic move just moments before Prime Minister's Questions got under way this week, Natalie Elphicke joined Labour as her surprised Conservative colleagues looked on.

What exactly happens when an MP defects to another party?

Ms Elphicke  is far from the first MP to change sides between elections, but it was incredibly rare - until recently - for a member of the governing party to switch to the opposition.

She is the third Tory to do so in just over two years, following  Christian Wakeford in 2022  over the partygate scandal and  Dan Poulter just two weeks ago  over the Tories' handling of the NHS.

Before that, it hadn't happened since 1995, when Alan Howarth became the first ever Conservative to cross to Labour on the eve of his party conference, citing the "divisiveness" of policies under John Major's leadership.

Only three MPs in the past 25 years have gone the other way - from main opposition to government - all leaving the Conservatives to join Labour.

Defecting to smaller parties happens more often, such as moves  from both Conservative and Labour to Change UK  during the Brexit years, or  Douglas Carswell  and  Mark Reckless  heading over to UKIP ahead of the referendum.

Scotland's new first minister has told Sky News that the controversial gender recognition reforms "cannot be implemented."

John Swinney,  who became first minister this week , has faced questions over his stance on gender recognition after MSPs voted in 2022 to pass a bill to make it simpler for people to change their gender without having to obtain a medical diagnosis.

The UK government blocked the bill from being made into law and the Supreme Court rejected a request by the Scottish government for a judicial review.

Asked if he would be fighting to push the bill through, Mr Swinney told Sky News: "The reality of the situation we face is that the Supreme Court has said that we can't legislate in that area. We can't take forward that legislation."

Mark Garnier, the Conservative MP for Wyre Forest, has been speaking about his former colleague Natalie Elphicke and her decision to defect to Labour.

He says it was "very very strange" - and that Ms Elphicke was one of the Tory's "most right-wing politicians".

Speaking to Politics Home , Mr Garnier said: "Had she gone to Reform or the BNP we would have kind of understood it, but it was very, very strange."

Horns blared. Headlights flashed. Placards were waved. Traffic in central London ground to a halt as hundreds of tractors filled the roads, headed for parliament.

Farmers gathered in Westminster in March to share their fears for their industry's future. It was a headline-grabbing moment and the culmination of years of frustration.

The problems farmers face are complex. They blame the government for pushing them out of business, pointing to the lack of affordable labour after Brexit; the need to tackle climate change - with agriculture accounting for 10% of the UK's total greenhouse gas emissions - leading to new regulations, and the growing realisation that for most people buying British is a luxury they can't afford.

Pollsters at JL Partners have asked 2,001 people in Great Britain for their thoughts on a string of issues - one of them being migration.

People were asked: "The UK's Illegal Migration Act is now law.

"The Act would see those who enter the UK via unauthorised routes removed to their home country, or a 'safe' third country, such as Rwanda. 

"Do you support or oppose this policy?"  

In response, 55% of people said they support it - 33% strongly and 22% somewhat so.

Meanwhile, 22% of people oppose it - 14% strongly and 8% somewhat.

A total of 7% responded don't know, while 15% neither support nor oppose".

Michael Fabricant, the Conservative MP, is speaking about what Sir Keir Starmer announced this morning on stopping small boats.

Mr Fabricant says all the initiatives "are things that the government and other agencies are already doing".

This does not include what Mr Fabricant calls the "rather sparkling name" of the Border Security Command.

Asked about the defection of Natalie Elphicke to Labour and Sir Keir Starmer, Mr Fabricant said it was "amazing" to see them together.

He says he spoke with Ms Elphicke at a Christmas event in which she said the Royal Navy should "open fire" on the French Navy if they do not accept small boats being returned.

He adds that Ms Elphicke wanted to see small boats being "nudged back".

Mr Fabricant says he does not think Ms Elphicke is a "good fit" in the Labour Party - and that she "wasn't a good fit in the Conservative Party either".
