WEATHER ALERT

A rip current statement in effect for Coastal Broward and Coastal Miami Dade Regions

Man’s overboard death may be linked to davie unsolved murder.

Ian Margol , Reporter

DAVIE, Fla. – It has been more than 15 years since a Connecticut man named George Smith went overboard on a cruise ship. At the time, his death was considered suspicious and now the person who may have had answers about what happened on that ship has been murdered.

In July of 2005, 26-year-old George Smith went tumbling off a cruise ship balcony into the water below. Smith was never seen again and the mystery of how he went overboard has never been solved.

“Unfortunately, there’s a possibility that we may never find out now what happened to George,” Attorney Mike Jones, who represent’s Smith’s family, said.

Smith had just been married and he was on his honeymoon.

“At one point, at about 2 a.m., they were in a disco type setting at one of the bars,” said Jones  “Unfortunately, George and Jennifer actually got in a fight and Jennifer stormed out of the club and left George behind.”

After she stormed off, Smith kept partying with a group of guys that he had met on the ship.

Hours later, the men say they walked Smith back to his room.

“They claim they just left the room, but the evidence revealed afterward was that it was an attempted robbery gone wrong,” Jones said.

The next morning all that was left of Smith was a blood stain on an overhang below his cabin’s balcony and now, 15 years later, the case remains unsolved.

One person who may know something though is Gregory Rozenberg who was one of the men Smith was hanging out with that night on the ship.

In December of 2019, Rozenberg was murdered in front of his Davie home and police believe whoever murdered him had targeted him.

Rozenberg may have taken the truth of what happened to Smith with him when he died.

Davie police are hoping to find the truth behind his murder case now. And maybe help investigators solve the circumstances behind Smith’s death, too.

George Allen Smith IV Family Story

George A. Smith IV, aged 26 years old, our beloved son and brother, went missing from the Royal Caribbean “Brilliance of the Seas” on July 5, 2005 between Greece and Turkey. In the days following his disappearance, despite numerous desperate requests, we were informed by Royal Caribbean that they had “no news” regarding George’s disappearance with a ‘business as usual’ attitude. Royal Caribbean never even informed us that the Turkish authorities were conducting a criminal investigation into George’s disappearance. They also failed to tell us that there were suspicious circumstances surrounding his disappearance, such as George Allen Smith IV eyewitness complaints of fighting in his cabin and blood in his cabin and on a metal overhang below his balcony.

Royal Caribbean failed to lock down the cruise ship in Kusadasi, Turkey, the next port of call after George’s disappearance. Passengers and crew members were free to disembark as usual, potentially taking crucial evidence off of the cruise ship with them. The Turkish authorities investigated the crime onboard for approximately two hours after Royal Caribbean crew members had already contaminated the crime scene.

The Turkish police were rushed off the boat so that the cruise ship could make the next port of call on schedule. The “Brilliance of the Seas” sailed off into the sunset with the murderers on board, therefore, jeopardizing the safety of all the other passengers on board. George’s disappearance prompted a Congressional hearing in Washington, D.C. on December 12, 2005 on cruise safety. It has also received international media coverage.

Royal Caribbean’s response to the media coverage has been to hire a scandal management attorney, to consistently lie about their actions and inactions and to victimize and scandalize George and our family to draw attention away from Royal Caribbean’s misdeeds.

The Connecticut Federal Bureau of Investigation and Department of Justice continue to actively investigate the suspicious circumstances surrounding George’s disappearance. According to media reports, a grand jury has been convened in Connecticut to search for answers into who murdered George.

George’s life will not be taken in vain, as his death has already called attention to the dire need for reform in the under-regulated cruise industry

Startling New Evidence In George Smith Case

george allen smith cruise

It was a mystery that made headlines when a handsome groom vanished one night from his honeymoon cruise. Seven years later, the FBI says new evidence has surfaced that suggests he may have been murdered. INSIDE EDITION has the story.

It's a tantalizing mystery: A handsome groom goes overboard on his honeymoon cruise—his beautiful bride left a widow just 10 days after her wedding.

The body of 26-year-old George Smith has never been found.   But now, 7 years after the tragedy that made international headlines, new evidence suggests that he might have been murdered. Incredibly, some of the men who were the last to see George Smith alive reportedly videotaped themselves joking about having thrown him over the side. Michael Jones is the Smith family attorney. "They make some mocking comments with vulgar language about George's death. From what I understand, it's horrifying to watch. And then, at the end, one of them stands up and makes a self-incriminating statement," said Jones. One of the men reportedly says on the video, "We gave that guy a paragliding lesson without a parachute." INSIDE EDITION's Paul Boyd asked George Smith's mother, Maureen, "What was your reaction when you heard what was said about your son?"

"I was devastated when I heard that. Devastated. Obviously, something really bad happened to my son," said George's mother, Maureen. The death of the businessman from Greenwich, Connecticut, came following a storybook wedding to his school teacher bride, Jennifer Hagel. For their honeymoon, they went on a Mediterranean cruise aboard the Royal Caribbean's Brilliance of the Seas.   After a night of out-of-control partying in the ship's casino, George got so drunk, he had to be carried back to his state room and put into bed. At some point, he went over the balcony. A large bloodstain shows where he landed on a metal canopy before tumbling into the sea off the coast of Turkey. Hagel was found unconscious in a corridor. She says she cannot remember anything about that night.

In videotaped depositions obtained by INSIDE EDITION, two of the passengers who carried George to his room repeatedly took the fifth when asked about George Smith's death.

"Do you know if George Smith was murdered?" asked an interrogator.

"I invoke my Fifth Amendment right," replied passenger Josh Askin. "Do you know who killed George Smith?" asked the interrogator.

"I'd like to invoke my Fifth Amendment right," answered the other passenger, Zachary Rozenberg. In another deposition, his cousin, Gregory Rozenberg, who was serving 3 years in prison for selling drugs, denies murdering Smith. "Did you have anything to do with George's death?" asked an interrogator.

"No. Never did, never thought about it—No," replied Gregory. Hagel has moved on. She remarried and has a child. There's a rift between her and the Smith family they say will never heal.

"We are disappointed that she didn't fight for George how we fought for George," said Bree, George's sister. Bree and Maureen believe George was murdered in a robbery that got out of control. "I want to know who took my son away from me. He wasn't a Dixie cup that you throw over the side of a ship," said Maureen. And they're hoping the new evidence will lead to arrests.   "We want the individuals that are responsible for throwing my brother George over his balcony at age 26 held accountable. We want them put in jail. We want them to rot in jail," said Bree.

New Evidence in Missing Cruise Ship Passenger Case Revealed, But Why is FBI Holding Back?

LM&W

Written by LM&W Lipcon, Margulies & Winkleman, P.A. is made up of attorneys who are nationally recognized industry leaders in the field of maritime and admiralty law. This weekend, 48 Hours reported on the mysterious disappearance of a cruise ship passenger whose case has yet to be closed. In the wake of two other passengers falling overboard from a Carnival cruise last week in Australia, the need to improve maritime safety regulations industry-wide is blatantly clear. Yet, the case of missing passenger George Allen Smith IV remains unsolved eight years after the tragic disappearance occurred and the cruise line on which he was sailing seems to have washed its hands of any responsibility in investigating the case.

Smith mysteriously disappeared from a cruise he was on for his honeymoon cruise nearly eight years ago. This Saturday night, 48 Hours aired a special titled “ 48 Hours: Murder at Sea? ” interviewing Smith’s loved ones and shedding new light into the unsolved case that many are calling a crime instead of an accident.

“You can’t look at the water and the sea without remembering what happened to George,” said Maureen Smith, the victim’s mother. “It’s got too many bad memories for me now.”

Smith’s family has maintained all these years that George was murdered by several men with whom George had an argument. And now, new evidence suggests there may be some truth to the allegations. A video tape created by the same men, and which has been in the hands of the FBI for some time, shows there may in fact have been a murder at sea all those years ago.

Smith disappeared from Royal Caribbean’s Brilliance of the Seas ship on July 5, 2005. Although his body was never recovered, bloodstains were found beneath the balcony of the cabin he was sharing with his new wife, Jennifer Hagel-Smith, who is now remarried.

The videotape in question was filmed by three Russian-Americans who have long been suspected of being involved in Smith’s disappearance due to their actions on July 4 and 5, before Smith was last seen. While it was reportedly filmed on the ship, shortly after Smith went missing, the video was only brought to the Smith family a few years ago.

In the video, the men film themselves joking about Smith’s death and make incriminating statements. The men first met Smith and his new wife on July 4. Everyone had been drinking and Smith and Jennifer ended up in an argument around 3:30 a.m., which resulted in Jennifer walking away alone. She ultimately passed out in a hallway.

Smith, however, stayed behind. After finding himself intoxicated a few minutes later, Smith was said to have needed the three Russian-Americans’ help returning to his cabin, and so they escorted him back, accompanied by a fourth man. The story of what happens next has been changed several times.

The Russians alleged they helped Smith back to his room, took off his shoes and put him to bed, however, passengers who were in their cabins near the scene recalled hearing a lot of noise and yelling from Smith’s stateroom around that time. One passenger even recounts hearing large objects like furniture being thrown across the room.

Another passenger reported the noise disturbance to the ship’s guest relation’s desk just after 4 a.m., but the ship’s crew did not respond until nearly half an hour later. Had they responded in time, perhaps Smith would be alive today.

At around 4:25 a.m., Smith went over the rail of his cabin’s balcony and landed several floors below on the metal awning over the lifeboats, then fell into the water. Bloodstains were discovered later that day which when tested, were determined to have been Smith’s.

The investigation appears to have been over before it even started. Ship crew members never even called Smith’s cabin to make sure everyone was ok. The next morning, crews cleaned the blood off the awning with a high-pressure hose, never even telling Jennifer about the blood stains.

But by far, the most incriminating piece of evidence in the case suggesting foul play was the video, which shows the Russian men commenting about Smith’s death, saying “we gave that guy a paragliding lesson without a parachute, and one man was even recorded flashing gang signs, claiming “Told ya I was gangsta” and making it seem as though he was proud of what happened to Smith.

Meanwhile, the Smith family is shocked that the FBI has not pressed any charges, or at the least, interrogated the men regarding the video, especially given the fact that one of the suspects is an ex-con who served three years in prison.

George Smith IV would have turned 34 this year. Sadly, he isn’t the only cruise ship passenger whose case remains unsolved. Hundreds of passengers have gone missing from cruise ships and nothing has been done to give the victims’ loved ones justice or peace of mind.

The International Cruise Victims Association (ICV) is dedicated to helping the loved ones of passengers who have been involved in crimes at sea, especially those who have disappeared at sea.  But despite the many stories that have been published regarding missing passengers and the cruise lines’ blatant cover-up of overboard accidents, incidents are still happening to this very day that prove the cruise industry doesn’t seem to care much about passenger safety.

Hopefully Smith’s story will shed some light into the hidden world of cruise lines and how – more often than not – they fail to provide a safe environment for those onboard.

Wife's whereabouts detailed in cruise probe

SMITH

A woman whose husband disappeared during their honeymoon cruise last summer was found sleeping in a corridor far from the couple’s cabin the night he vanished, the cruise line said Wednesday.

George Allen Smith IV of Greenwich disappeared July 5 from a Royal Caribbean ship in the Mediterranean Sea between Turkey and Greece. The FBI has been investigating, but no one has been charged and no body has been recovered.

Blood stains were found running from the balcony of Smith’s cabin to life boats.

The whereabouts of his wife, Jennifer Hagel-Smith of Cromwell, during the time around his disappearance have largely been a mystery to the public. Federal authorities have said she is cooperating in the investigation, but she has declined to comment on details of the cruise, citing the ongoing probe.

After facing criticism from Smith’s family and Hagel-Smith for its handling of the disappearance, Royal Caribbean issued its first detailed account of the events surrounding Smith’s disappearance.

Alleged rape under investigation The cruise line also said the FBI was investigating an alleged rape of a female passenger by the same young men last seen with Smith. The alleged sexual assault occurred three days after Smith disappeared, and was videotaped by the young men, according to Royal Caribbean.

The FBI has declined to comment.

The company denied allegations from Smith’s family that it mishandled the investigation and from Smith’s wife, Jennifer Hagel-Smith, that she was treated poorly after her husband disappeared. A female guest relations manager accompanied Hagel-Smith during the investigation after her husband’s disappearance, Royal Caribbean said.

“This situation was very serious. We took it very serious,” the ship’s captain, Michael Lachtaridis, told The Associated Press in an interview in New York. “We never abandoned Jennifer.”

Royal Caribbean said it promptly called authorities, sealed the cabin and did not clean the blood until given permission by Turkish authorities.

Turkish authorities have said Smith and his wife had been drinking heavily and had been gambling at the ship’s casino before his disappearance.

On the night her husband disappeared, Hagel-Smith was found at about 4:30 a.m. sleeping on the floor of a corridor on the other side of the ship, far from her cabin, according to Royal Caribbean. She was taken back to her cabin by wheelchair — a standard procedure — at 4:47 a.m. by two security guards and a female supervisor, the cruise line said.

Smith was not in the cabin and his wife said she was OK, Royal Caribbean said.

‘Negligent and insensitive’ James Walker, Hagel-Smith’s attorney, slammed the cruise line for not getting her medical help or noticing blood around the cabin. He described her as unconscious when found, while Royal Caribbean said she was sleeping.

“It sounds quite outrageous, negligent and insensitive,” Walker said. “You can’t take an unconscious person and dump them in the cabin and not seek medical attention and reunite them with their next of kin,” Walker said.

Royal Caribbean said “nothing appeared amiss” in the cabin when Smith’s wife was brought back to it.

After the blood was discovered around 8:30 a.m., Smith’s wife was found shortly before 10 a.m. getting a massage in the spa, wearing the same clothes from the night before, the cruise line said.

“She responded that she was not aware that Mr. Smith was missing or where he was,” Royal Caribbean said in a statement. “Mrs. Hagel-Smith said he might be sleeping in another cabin because he had done so on at least one previous night during the cruise.”

After Hagel-Smith was found in the spa, a young man who had been with the couple the night before asked a staff captain whether blood was found on the outside of the ship, Royal Caribbean said.

Taking On Crime Aboard Cruise Ships

By John Files

  • Dec. 14, 2005

WASHINGTON, Dec. 13 - Five months after a Connecticut man disappeared from a cruise ship while on his honeymoon, a congressman implored federal law enforcement and Coast Guard officials to determine whether the cruise industry has been lax in reporting and investigating crime at sea.

The congressman, Christopher Shays, Republican of Connecticut, said on Tuesday that he thought that the government was not getting an accurate picture from the industry about the number of crimes and potential criminal activity aboard cruise ships.

"Cruise passengers can be blinded to the very real perils of the sea by ship operators unwilling to interrupt the party for security warnings," Mr. Shays said at a joint hearing of the House Subcommittee on National Security, Emerging Threats and International Relations and a House panel that oversees criminal justice and drug policy. "And after an incident occurs, a thorough investigation can be profoundly difficult when the crime scene literally floats away, on schedule, to its next port of call."

He said that "jurisdictional and bureaucratic tangles" can also impede the investigation of crimes at sea.

The family of George Allen Smith IV, 26, 0f Greenwich, who disappeared from a Royal Caribbean ship in the Mediterranean in July, attended the hearing, and lawmakers repeatedly referred to the case.

Mr. Smith was reported missing after the ship he and his wife had been aboard arrived in Turkey from Greece. While the cruise line initially released a statement saying that one of its passengers appeared to have fallen overboard, a lawyer for the family said here on Tuesday, "We believe a murder was committed."

Mr. Smith's wife, Jennifer Hagel Smith, submitted a statement before the hearing, but did not testify. She said she had been mistreated by officials from the cruise company and by the Turkish police after her husband disappeared. She also said that she was mocked and taunted at a Turkish police station, taken to a hospital where a man lifted her shirt and looked down her pants.

When that when she returned to the port, she said in her statement, she found that her belongings and those of her husband had been removed from the ship and left on the dock.

"The ship sailed without me that evening," she wrote.

"I was left with no money, no plane ticket, no food, nothing. The cruise line did not offer to help with a flight, hotel arrangements or anything. I could not speak the native language and I felt abandoned."

Mr. Shays, who read portions of Ms. Hagel Smith's statement during the proceedings, said: "That just sends a shiver down my back. I'm wrestling with how we can trust any statistic from any cruise line who can do what they did to a young bride."

Gregory M. Purdy, Royal Caribbean's director of safety, security and environment for Royal Caribbean, apologized to the Smith family at the hearing but contended that the company had handled the incident "correctly and responsibly."

"The Smith family has suffered a tragic loss," he said. "We extend our deepest sympathies to the family. We do not know what happened to George Smith -- only that he tragically disappeared from the cruise -- but we continue to cooperate fully with the F.B.I. in the hope that the agency will be able to provide solid answers and some measure of closure for the Smith family."

Royal Caribbean has said it promptly notified the F.B.I., the American Embassy, the Turkish police, the Greek Coast Guard and the Bahamas Maritime Authority about Mr. Smith's case.

The Smith family has said it plans to file a lawsuit against the cruise line, which is based in Miami and registers its ships in the Bahamas. And Ms. Hagel Smith has announced a $100,000 reward for information leading to arrests in the case.

Representative Elijah E. Cummings, Democrat of Maryland, called the industry policy of voluntary reporting of crimes "a major problem." He said: "We have to figure out a way. We have to do better."

In sharp exchanges with Chris Swecker, an assistant director of the Criminal Investigative division of the F.B.I. and one of the witnesses, Mr. Shays declared that the crime data provided to federal law enforcement by the industry was "meaningless" because it is incomplete.

Mr. Swecker said that the bureau had investigated about 300 cases of "crime on the open seas" in the last five years, nearly half of them sexual and physical assaults that occurred on cruise ships. He said that each year about 10 million Americans travel abroad on cruise ships.

"We need to find a way to get accurate statistics," he said. But he added, "We can only collect data on what is reported to us, and it's very difficult to quantify what is not reported."

Mr. Shays said that he would conduct further hearings on the safety and security of cruise ships, including an exploration into the risks of piracy in international waters. Officials from the Navy and Coast Guard, as well as Mr. Swecker, said they would try to study the reporting problem further to provide guidance to lawmakers about the need for laws or regulations.

Cruise Passenger Mystery Deepens

By Brian Dakss

August 1, 2005 / 7:01 AM EDT / CBS

United States authorities are probing the disappearance early last month of a Connecticut man who was on a honeymoon cruise through the Mediterranean. They say it appears foul play may have been involved.

George Allen Smith IV was halfway into the cruise with his bride, Jennifer Hagel, when he vanished while the ship was off the Turkish coast, according to The Early Show co-anchor Hannah Storm.

"The captain came on and announced to everyone that there was a passenger missing," says Linda Bruck, who was on board the Royal Caribbean's "Brilliance of the Sea" with her husband, Larry Bruck.

They say they didn't see Smith or Hagel, but heard all the rumors.

"That there was a possibility he had winnings that people knew he had won and that they were after," is how Larry Bruck describes one such rumor.

"The most outrageous rumor I heard was that there was an old boyfriend on board," says Linda Bruck.

Another passenger thought something might be amiss when Smith disappeared.

Clete Hyman, who was in an adjoining cabin to that of Smith and Hagel, recently recalled what he heard through the walls in the early morning hours of July 5: "The impact, it sounded like something really heavy, and my first thought was maybe throwing furniture overboard," Hyman said on "Scarborough Country" on MSNBC. "All of a sudden, there (was) some very loud arguing out on the balcony."

Candid testimony like that is unlikely to be repeated anytime soon, Storm observes, since Turkish authorities turned the case over to Washington, and the FBI and U.S. Attorney's Office are now in charge of the investigation.

Witnesses have been gagged, and the U.S. officials are doing all the talking. Says U.S. Attorney Kevin O'Connor: "This is not going to be an easy case. We have a moving crime scene, we have a group of international passengers who have dispersed. So, it may take a long time to piece together what happened that night."

Turkish authorities had interviewed and released Hagel, and a Turkish prosecutor has said Hagel isn't a suspect.

Defense attorney and CBS News legal consultant Mickey Sherman went to high school in Greenwich, Conn. with George Smith IV's father, though it's been years since they've spoken.

Sherman, who still lives in Greenwich, says he has been watching the case take shape.

On The Early Show Monday, he told Storm the Smiths are a "well-known family. …Everyone has always had nothing but the best regard for this family. Never any trouble. The best reputation. Nice people, active in the community. Again, I don't know them now, but I know of them. No one would have anything negative to say about them at any time."

Hagel and both her and Smith's families have been completely tightlipped, which Sherman says he respects: "A lot of people are not disappointed, but frustrated with that. We in the media seem to be frustrated by that. But, as opposed to some of the other cases that we've seen, whether it's (Michael) Jackson or (Scott) Peterson, I laud them, both sides, for not parading out lawyers or family spokespeople or whatnot.

"According to the U.S. Attorney in Connecticut (Kevin O'Connor), who has now got control of this case, they've been nothing but cooperative, both sides. And that's all they really need to do."

Turkish authorities say Hagel told them she and her husband had been in the casino, drinking and gambling, and she doesn't remember what happened when they got back to their room. Yet, Hyman says he heard arguments, perhaps furniture being moved around.

Sherman discounts the apparent discrepancy: "You have to assume on a cruise ship, everyone is there to enjoy themselves. You can't vilify them that they were drinking. That's what you are supposed to do on vacation and on your honeymoon."

Sherman agrees with O'Connor that probers have their work cut out for them: "(This wasn't) just a crime scene, it was a moving crime scene. And a private crime scene. Who knows if the cruise ship security people are cooperating fully? They have (potential) civil liability."
