All About Visas

*Important* Processing Time and Admissibility

As a rule, the processing time of an admissible Schengen visa application should not exceed 15 calendar days (from the date the application is received at the Embassy).

If the checklist is incomplete , the application will be on hold until all the necessary documents are received by the Embassy. If further checks or additional documents are required , the processing time may increase up to 45 calendar days .

The transit time from the VFS Center to the Embassy and back to the applicant varies between 1 and 4 days one way , depending on the location.

The Embassy is not asking for confirmed air tickets. The Embassy recommends applicants to apply at least 4 weeks before their intended travel date (6 weeks during peak season from March to June).

If the application is received less than 15 calendar days before the intended travel date , the Embassy can deem your application inadmissible. If so, your visa application will not be processed by the Embassy and the application will be sent back to VFS along with the passport.

Important notice:

From 21 December 2021, Indian citizens holding a certificate proving a complete vaccination pattern issued by the authorities India will be authorised to enter the territory of the Grand Duchy of Luxembourg, including for non-essential travel, provided that the vaccine administered is accepted by the Grand Duchy. So far only Covishield is accepted by our authorities. All visa applications can therefore now be accepted if the applicant holds the aforementioned vaccination certificate.

The Embassy of Luxembourg in India is competent for/authorized to process visa applications for:

  • Indian citizens (short & long term visas)
  • Foreign nationals who are legal permanent residents in India (short & long term visas)

A visa application can be submitted by:

  • For Business, Visit to Family and Friends (Short Term), Cultural / Conference/ Sport Event, all Long Term categories like Work Permit, Family reunification and Study (Long Term & Short Term both), the applicant himself/herself, authorized company representative or a Travel Agent can come for the submission at VFS on applicant’s behalf.
  • For all Tourist visas only the applicant himself/ herself is eligible to submit the applications in person. Representatives & Travel Agents are not authorized to submit on the applicant's behalf.

Indian citizens traveling to the Grand-Duchy of Luxembourg have to apply for a Schengen visa. The application for a Schengen visa has to be made in the diplomatic mission of the country where the MAIN DESTINATION lies. Therefore, please check your travel plans before making your application to the Luxembourg Visa Application Centre. In case you are planning to travel to several Schengen countries within one trip, please apply to the Embassy/Consulate where you are going to stay for the longest period of time or the main purpose of stay. In case you are visiting several Schengen countries and planning to stay in each of them the same number of days/nights, you should apply for a visa at the Consulate/Embassy of the country of the first entry.

Applicants and authorized representatives in case of business visas can visit the Visa Application Centre within working hours to submit their applications. All minors must be accompanied by a parent/legal guardian at the time of application submission.

Visa Category chosen by an applicant must be based on the purpose of travel to Luxembourg and the decision must be made by the applicants themselves – Visa Application Centre staff will not be able to assist you taking this decision.

Required Documents for all Visa Categories: Please note that the following essentials must be met by all applicants submitting their applications for visa.

  • Passport should be valid for at least three months beyond the intended stay in Luxembourg. Passport should be valid for at least 6 months from the date of travel to Luxembourg in case of D Visa. Passport must have at least two blank pages to which a visa can be affixed, if not a new passport must be obtained before submitting your application. Please note: Passport cannot be valid for more than 10 years. Handwritten or not machine readable Indian passports issued after 01.04.2010 are not accepted.
  • All applicants have to submit a fully completed visa application form signed and dated, supporting documents appropriate to the type of visa and 1 original passport-size photograph.
  • The Embassy of Luxembourg will return processed passports to the Visa Application Centre.

In addition to the compulsory documentation required, the following documentation is required for applicants under the age of 18 (minors):

For children (under 18 years of age) traveling alone, written consent certified by public notary of both parents or guardians having the custody of the applicant.

For children (under 18 years of age) traveling with one parent only, written consent certified by public notary of the other parent or guardian.

BIOMETRICS COLLECTION

As from 2 November 2015 following the introduction of the Visa Information System (VIS), all Schengen visa applicants in India have to appear in person in order to provide biometric data (fingerprints and digital photography).

The photograph can be digitally taken at the time of the application or scanned from an existing one.

For subsequent applications within 5 years the fingerprints can be copied from the previous application file in the VIS.

In case of reasonable doubt regarding the identity of the applicant, the consulate will collect again fingerprints within the 5 year period specified above. Furthermore, the applicant may request that they be collected if, at the time when the application is lodged, it cannot be immediately confirmed that the fingerprints were collected within this 5-year period.

Visa applicants' biometric data can be collected by Schengen States' consulates and external service providers but not commercial intermediaries (e.g. travel agencies).

WHO IS WAIVED FROM THE REQUIREMENT TO GIVE FINGERPRINTS?

The following applicants shall be exempt from the requirement to give fingerprints:

  • children under the age of 12;
  • persons for whom fingerprinting is physically impossible. If the fingerprinting of fewer than 10 fingers is possible, the maximum number of fingerprints shall be taken. However, should the impossibility be temporary, the applicant shall be required to give the fingerprints at the following application. The competent authorities shall be entitled to ask for further clarification of the grounds for the temporary impossibility.
  • heads of State or government and members of a national government (Ministers and Ministers of State only) with accompanying spouses, and the members of their official delegation when they are invited by Member States’ governments or by international organisations for an official purpose.

This list is mandatory and exhaustive. Holders of diplomatic passports are not exempted as such from the fingerprinting requirement. They may be exempted if they are members of the official delegation of heads of State/members of a national government invited for an official purpose.

Required Travel Insurance

A travel medical insurance is a compulsory document and has to be included in each set of submitting documents from all prospective visitors applying for a visa to Luxembourg. The traveller must be covered for an amount of at least 30,000 Euros. Short Term Visa

If you intend to travel to Luxembourg for business, conference cultural or sport event, tourism or to visit family and friends, you must submit documents to obtain a short - term Schengen visa, permitting a stay in the territory of the Grand Duchy of Luxembourg as well as in the Schengen countries for up to 90 days in any 6-month period.

If you wish to reside in Luxembourg for a longer period of time (more than 90 days), you need to apply for a long term visa. Kindly check the information on the long term visa category on the current website.

The holders of valid Schengen visas may travel to the Grand Duchy of Luxembourg. It is the applicant’s responsibility to check the number of entries and visa validity period for the intended stay in Luxembourg and plan his/her travel in accordance with the issued visa.

Your visa application shall be evaluated by the Embassy of Luxembourg in New Delhi. Applications which are admissible should, as a rule, be decided within 15 days of the date of receiving in Embassy - excluding the transit time i.e. for satellite locations in India 3 working days (4 days for Thiruvananthapuram, Kochi and Puducherry) and for Nepal 4 working days. A Tourist visa is only intended to allow a foreign national to visit Luxembourg for a limited period of time (up to 90 days). This category of visa caters to people wishing to visit Luxembourg for touristic purposes either through buying a tour or through self-bookings of tickets and hotel.

Without this certificate, the applicant should contact the embassy first in order to get his application approved under the essential travel category.

  • Employment contract or excerpt from the company register or similar document
  • Status of personal bank account for the last 3 months in letter from your bank, including the name and signature of the bank branch manager (original).
  • Letter from your bank (original) stating credit limit on your credit card.
  • Income Tax return for at least 2 years (Proof of paid income tax).
  • Overseas medical travel insurance valid for all Schengen countries for the whole duration of your stay with a minimum coverage of 30,000 Euros for all risks like accident, urgent medical attention, emergency hospital treatment and repatriation. For multiple entry visas, an additional declaration covering further journeys accordingly needs to be signed
  • Minors under the age of 18 if traveling alone have to provide a written consent certified by public notary of both parents or guardians having the custody of the minor. If traveling with one parent only, a written consent certified by public notary of the other parent or guardian is required. Important notice :

A Photograph submitted with the application for a visa should comply with the following specifications:

  • Must be an up-to-date photograph (dated max 6 month old)
  • Must be a color photograph printed on normal photographic paper
  • Should be sized between 35 – 45 mm
  • Full face taken straight forward 30 - 36 mm from point of the chin to top of hair
  • Taken against a white background
  • Without sunglasses
  • Without hat or other head covering unless you wear this for religious reasons
  • Spectacles should not have toned or reflecting glasses
  • The frame of the spectacles may not cover the eyes
  • The mouth must be shut
  • Applicants should clearly write their name and surname on the back of their photographs
  • The photo fixed on form needs to be less than 6 months old and non-edited and no-filter used.

  • Copies of Schengen visas obtained during the last 5 years, if applicable.”

A Business visa is only intended to allow a foreign national to visit Luxembourg for a limited period of time (up to 90 days). This category of visa caters for people wishing to visit Luxembourg for business reasons but does not allow carrying out a professional activity.

Cultural, Sport Event or Conference

A visa for a Cultural, Sport Event or Conference is only intended to allow a foreign national to visit Luxembourg for a limited period of time (up to 90 days). This category of visa caters for people wishing to visit Luxembourg with the purpose of participating in Cultural and Sport events or participating in a Conference.

  • One recent passport size photograph in colour on white background.
  • A copy of the return ticket to India or the reservation
  • Invitation letter from the inviting company, university, fair, congress, sport federation or organizer in Luxembourg mentioning the purpose of the visit including the complete program with activities and/or meetings to attend.

Proof of sufficient financial means to cover all expenses during your stay such as:

  • Letter from the inviting organization (original) + organization’s bank statements of the last three months if the inviting organization pays for the cost of travelling.
  • Salary slips + status of personal bank account for the last three months in letter from your bank (original) if the cost of travelling is paid by yourself.

Family member of EU/EEA/Swiss national

A Family member of EU/EEA/Swiss national visa is only intended to allow a foreign national to visit Luxembourg for a limited period of time (up to 90 days). Applicants will have to provide evidence that he/she falls under this category.

To benefit from a simplified procedure and from the visa fee exemption, you need to meet the following criteria:

(1) You are a family member of an EU/Iceland/Liechtenstein/Norway or Swiss national;

As per Article 2 (2) of the Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, ‘family member’ means:

(a) the spouse;

(b) the partner with whom the Union citizen has contracted a registered partnership, on the basis of the legislation of a Member State, if the legislation of the host Member State treats registered partnerships as equivalent to marriage and in accordance with the conditions laid down in the relevant legislation of the host Member State;

(c) the direct descendants who are under the age of 21 or are dependants and those of the spouse or partner as defined in point (b);

(d) the dependent direct relatives in the ascending line and those of the spouse or partner as defined in point (b);

(2) AND That EU/Iceland/Liechtenstein/Norway or Swiss national is residing in another Member State than that of which he/she is a national or travelling there to take up residence;

(3) AND You are accompanying the EU/Iceland/Liechtenstein/Norway or Swiss national or planning to join him/her for residence.

If you think you qualify for visa facilitation, you will need to show proof (-> see under Documents Required) that you meet these criteria when you submit your visa application.

  • Travel dates (reservation or booking; presentation of a paid ticket is not required).
  • Proof of family relationship with the EU/EEA/Swiss national with whom you are travelling or whom you will visit: An official copy of a birth certificate, marriage certificate or certificate of registered partnership (either legalized or issued with an apostille)
  • Proof that your family member is using or has recently used his/her right to free movement : Luxembourg residence permit of your EU/EEA/Swiss family member.
  • Proof that the applicant is accompanying or joining an EU/EEA/Swiss national: common travel reservation or EPC or sworn statement that the applicant is accompanying or joining an EU/EEA/Swiss national.
  • If the applicant is a dependant (child over the age of 21 or parent): proof of the status of dependant must be shown (regular and substantial financial contribution from the EU/EEA/Swiss national to the maintenance and/or education).
  • A legalized official copy of the minor’s birth certificate
  • Power of attorney, certified by a notary, from both parents or by the parent who is not travelling with the child, except in cases of a parent having sole custody, in which a court order or other proof of sole custody must be provided.
  • Copy of identification documents of the parent(s) having custody, bearing their signature.

As a rule, the processing time of an admissible Schengen visa application should not exceed 15 calendar days (from the date the application is received at the Embassy). If the checklist is incomplete, the application will be on hold until all the necessary documents are received by the Embassy. The transit time from the VFS Center to the Embassy and back to the applicant varies between 1 and 4 days one way, depending on the location. The Embassy is not asking for confirmed air tickets. The Embassy recommends applicants to plan their travel accordingly.

Long Term Visa

If you wish to reside in the territory of the Grand Duchy of Luxembourg for an extended period of time (more than 90 days), you need to apply for a long term visa and an authorization to stay. Luxembourg entry visa for third-country nationals

Nationals from certain non-EU countries who wish to visit, transit through or work in Luxembourg must, before their departure, have a valid travel document with a visa issued by a consular authority from one of the countries in the Schengen area.

The visa enables free movement in the Schengen area : Germany, Austria, Belgium, Croatia, Denmark, Spain, Estonia, Finland, France, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Norway, Malta, Netherlands, Poland, Portugal, Czech Republic, Slovakia, Slovenia, Sweden and Switzerland.

The nationality of the non-EU national determines whether or not they are obliged to have a visa. Different types of visa exist depending on the duration and nature of the visit.

The Schengen visa must be requested at the consulate of the country the applicant intends to visit , or, if they intend to visit more than one Schengen state , at the consulate of the country of their primary destination (i.e. main purpose of stay or longest stay). If the applicant intends to visit several Schengen states for a stay of equal duration , the visa application must be sent to the consulate of the country whose external borders the applicant will cross first when entering the Schengen area .

As a general rule, the visa application must be submitted in the country in which the applicant legally resides , at a Luxembourg consulate or a diplomatic mission representing Luxembourg . Should there be no Luxembourg consulate in that country and should Luxembourg not be represented there, the application must be submitted to the consulate with territorial competence for visa applications.

The visa application and attached documents must be translated by a sworn translator if they are not drawn up in German, French or English.

Who is concerned?

Nationals from certain countries must have a visa to enter or pass through a country in the Schengen area.

Depending on the reason for the visit, they will need:

  • either an airport transit visa (visa A) to pass through the international zone in airports, but which does not allow travellers to enter Schengen countries;
  • tourist or family visits;
  • business trips (visiting professional partners, negotiating and concluding contracts, etc.);
  • participating in conferences (conference speakers and university lecturers) exhibitions, fairs or shows;
  • participating in board of directors' meetings and general meetings;
  • providing services within the same business group, etc.
  • the holder of a temporary authorisation to stay;
  • the holder of a work permit for the purpose of carrying out a salaried activity;
  • joining a family member who is an EU citizen .

If the third country national has a residence permit for family members of an EU citizen or a valid residence permit issued by another EU Member State, a visa is not required.

Prerequisites

In any case, the third country national must, before applying for a visa, have a valid passport which is valid for at least another 3 months after the expiration date of the visa applied for.

A reduced fee of EUR 35 is granted to nationals of Moldova, Ukraine, Serbia, Montenegro, Bosnia-Herzegovina, Albania, Georgia, the Republic of North Macedonia, Armenia and Azerbaijan.

Children between the age of 6 and 12 are subject to a reduced visa application fee of EUR 40 .

In accordance with Regulation (EC) No 539/2001 as amended, nationals of Albania, Bosnia and Herzegovina, the Republic of North Macedonia, Montenegro and Serbia (excluding holders of passports issued by the Serbian Coordination Directorate) holding biometric passports are exempt from the visa obligation .

No visa fee will be charged for:

  • children under 6 years of age;
  • pupils , students and teachers accompanying them on school trips or educational study trips;
  • third country researchers going abroad to carry out scientific research;
  • representatives of non-profit making organisations aged 25 years at most who participate in seminars, conferences, or sports, cultural or educational events;
  • family members of an EU/EEA national;
  • certain categories of nationals of Moldova , Ukraine , Serbia , Montenegro , Bosnia-Herzegovina , Albania , Georgia , the Republic of North Macedonia , Armenia , Azerbaijan and Cape Verde .

How to proceed

Applying for a short stay visa (visa c).

Third country nationals subject to a visa obligation who wish to stay in Luxembourg for less than 90 days over a period of 180 days for the purpose of business, family or tourist visits, etc. must apply for a short stay visa (visa C).

Visa applications should in principle be lodged at least 15 calendar days before the intended visit and cannot be lodged earlier than 6 months before the start of the intended visit .

Holders of a multiple-entry visa may lodge the application before the expiry of the visa valid for a period of at least 6 months.

The applicant must submit a completed and signed Schengen visa application (Pdf, 155 Kb) in person at:

  • the Luxembourg diplomatic mission or consulate in their country of residence;
  • or, failing that, the embassy or consulate of the country in the Schengen area which represents Luxembourg for the issuance of visas.

The application must be accompanied by the following documents :

  • 2 recent and identical identity photos;
  • a valid passport or a travel document accepted in the Schengen area, which is valid for at least another 3 months after the expiry date of the requested visa;
  • legalised financial statement of support (French, Pdf, 490 Kb) from the reference person in Luxembourg; It should be noted that the financial statement of support is not mandatory. But it is strongly recommended to submit this document in order to prove that the applicant is financially supported by a Luxembourg resident.
  • official letter of invitation for a business visit;
  • a hotel reservation;
  • a return airline ticket;
  • proof of sufficient means of subsistence (bank account statements, cash, credit cards, etc.); In certain cases, this proof can be replaced by a financial statement of support from a reference person in Luxembourg;
  • proof of legal residence in the usual country of residence;
  • health insurance covering the travel period.

Before sending the financial statement of support to the third country national for whom they are acting as guarantor, the guarantor must:

  • have their signature officially authenticated on the form at their commune of residence;
  • the last 3 salary slips or a document stating their monthly income;
  • a copy of the passport or national identity card;
  • if they are a foreign national, proof of lawful residence in Luxembourg;
  • a copy of the valid passport of the non-EU national being cared for.

If the application is accepted, the guarantor receives an official stamped copy of the document. The foreign national then has 6 months to use this document to apply for a visa.

The issuance of the visa alone does not necessarily give the right of entry or stay in Luxembourg.

Other supporting documentation, in relation to the purpose of the visit, may be requested.

Applications shall be decided on within 15 calendar days of the date of their lodging . In particular cases, namely when further scrutiny of the application is needed or if the application is submitted to a consulate of a State representing Luxembourg , this period may be extended up to a maximum of 30 calendar days . As an exception , when additional documentation is needed in specific cases, the period may be extended up to a maximum of 45 calendar days .

When the visa is granted, it is affixed in the passport in the form of a visa sticker.

The visa type C allows for stays for a duration not exceeding 90 days over any 180-day period. The visa can be issued for one or several entries, depending on the reasons of stay.

The results shown by this tool are not legally binding .

It does not give the holder the right to carry out a paid activity in Luxembourg. In this case, the person must apply for a visa type D.

Possession of a visa does not confer an irrevocable right of entry . The holder of a visa is required to show evidence , at external borders , that they fulfil the conditions of entry in accordance with the Schengen Borders Code (article 5) .

Note that the Passport, Visa and Legalisation Office is competent for visa applications regarding stays not exceeding 90 days over any 180-day period . For applications concerning a stay of more than 3 months , the competent authority is the Department for Foreigners at the Immigration Directorate .

Refusal to issue the visa C

This decision is notified to the applicant by the consulate.

Applicants may lodge an appeal against this decision with the administrative tribunal . The appeal must be filed by a court lawyer within 3 months from the notification of the decision.

Extension of the visa C

When applying for a visa extension, the applicant must show that for reasons of force majeure or for humanitarian reasons they cannot leave Luxembourg before the expiry of their visa or the authorised period of stay.

As a rule, the visa can only be extended if the applicant has stayed less than 90 days in the Schengen area, in the course of the past 180 days , and if their current visa is not expired .

The application has to be sent to the Passport, Visa and Legalisation Office .

Applying for a long stay visa (visa D)

Staying for more than 3 months.

Third country nationals subject to a visa obligation who wish to stay in Luxembourg for more than 3 months must apply for a long stay visa (D).

Before applying for a type D visa, a third-country national must apply, from their country of origin, for a temporary authorisation to stay at the Immigration Directorate of the Luxembourg Ministry of Foreign and European Affairs, Defence, Development Cooperation and Foreign Trade, Defence, Cooperation and Foreign Trade ( ministère des Affaires étrangères et européennes, de la Défense, de la Coopération et du Commerce extérieur, de la Défense, de la Coopération et du Commerce extérieur ).

The application procedure for the authorisation to stay depends on the planned activity:

  • salaried worker (employee) ;
  • self-employed workers ;
  • highly qualified worker ;
  • researcher ;
  • private reasons ;
  • salaried worker posted by a company established outside the EU ;

Within 90 days following receipt of the temporary authorisation to stay, the applicant must submit, in person , a long stay visa application (D) (Pdf, 155 Kb) in 2 copies to the Luxembourg diplomatic or consular mission in their country of residence or, failing that, to the embassy or consulate of the country in the Schengen area which represents Luxembourg for the issuance of long-stay visas (only the Belgian embassy or consulate).

  • a valid passport or a travel document accepted in the Schengen area, which is valid for at least 3 months after the expiry date of the requested visa;
  • the temporary authorisation to stay.

When the visa is granted, it is affixed in the passport in the form of a stamp or vignette.

A visa type D is valid for a period of 90 days to one year maximum.

Staying less than 90 days and carrying out a paid activity

Third-country nationals subject to a visa obligation who wish to work in Luxembourg during a stay of less than 90 days must apply for a long stay visa (D).

Before applying for a visa type D, third-country nationals must apply, from their country of origin, for a work permit / authorisation to stay for trainees at the Immigration Directorate of the Luxembourg Ministry of Foreign and European Affairs, Defence, Development Cooperation and Foreign Trade, Defence, Cooperation and Foreign Trade ( ministère des Affaires étrangères et européennes, de la Défense, de la Coopération et du Commerce extérieur, de la Défense, de la Coopération et du Commerce extérieur ).

Family reunification with an EU citizen

The legal basis

The legal basis for the collection and the processing of personal data is set out in Regulation (EC) 767/2008 (VIS Regulation), Regulation (EU) 2019/1155 amending Regulation (EC) 810/2009 establishing a Community Code on Visas (Visa Code) and Council Decision 2008/633/JHA.

The processing of personal data

The data will be shared with the competent authorities of the Schengen Member States [1] and processed by these authorities for the purposes of decision-making on a visa application. Data and information relating to the decision taken on an application, whether to annul, revoke or extend an existing visa, will be entered and stored in the Visa Information System (VIS) for a maximum period of five years, during the course of which they will be accessible to the visa authorities and to the authorities responsible for carrying out visa checks at the external borders and within the Member States, to immigration and asylum authorities in the Member States, in order to check whether the conditions for entry, stay and legal residence on the territory of the Member States are fulfilled, to identify persons who do not meet or no longer meet these conditions, to examine an asylum application and to determine responsibility for this examination. Under certain conditions, the data will also be made available to the designated authorities of the Member States and to Europol for the purposes of the prevention, detection and investigation of terrorist offences and other serious criminal offences.

Third countries and international organisations

Personal data may also be transferred to third countries or international organizations in order to verify the identity of third-country nationals, including for return purposes. Such transfers only take place under certain conditions [2]. You can contact the authority responsible for data processing to obtain further information on these conditions and how they are met in your particular case.

Transparency and rights of the data subject

Under the General Data Protection Regulation [3] and the VIS Regulation [4], you have the right to obtain access to your personal data, including a copy thereof, as well as the identity of the Member State that transmitted it to the VIS. You also have the right to have inaccurate or incomplete personal data corrected or completed, to have the processing of your personal data restricted under certain conditions, and to have personal data that has been processed unlawfully deleted.

The Visa Information System (VIS) is a system for exchanging data on short-stay visas between Schengen states. The main objectives of the VIS are to facilitate visa application procedures and external border controls, and to enhance the security of the Schengen area.

The aim of the global VIS introduction process is to provide applicants with greater protection against identity theft, and to prevent document fraud and the practice of "visa shopping". Fingerprints are widely used in the EU as one of the most secure means of identification. The use of biometric data to identify a visa holder is a faster and more precise way of identifying a visa holder by the border police.

The VIS incorporates a central database, a national interface in each Schengen state, and a communication infrastructure between the central database and the national interface. The VIS is linked to the national visa systems of all the Schengen States via the national interfaces, enabling the competent authorities in the Schengen States to process data on visa applications and on visas either issued, refused, annulled, revoked or extended.

The VIS consists of two systems: the VIS database, which conducts alphanumeric searches, and the Automated Fingerprint Identification System (AFIS), which compares fingerprints received with the database and returns a positive or negative response, including any matches.

The main central VIS is located in Strasbourg (France) and a back-up central VIS, capable of providing all the functions of the main central VIS, is located in Sankt Johann in Pongau (Austria).

The VIS is continually processing information gathered by the consulates of the Schengen states. For instance, information entered locally by visa authorities can be available in the VIS in a matter of minutes. The VIS offers rapid verification services for visa holders at border crossings, taking just a few seconds to conduct a visa check.

The Commission was responsible for developing the central database, the national interfaces and the communication infrastructure between the central VIS and the national interfaces. Individual Schengen States are responsible for the development, management and operation of their respective national systems.

The EU Agency for large-scale IT systems, eu-LISA, is responsible for the operational management of VIS.

What is the legal basis for the VIS?

The main acts constituting the legal framework of the VIS are the following:

·                  Council Decision 2004/512/EC of 8 June 2004 establishing the Visa Information System (VIS), OJUE L 213, 15.6.2004, p. 5.

·                  Regulation (EC) No 767/2008 of the European Parliament and of the Council of 9 July 2008 concerning the VIS and the exchange of data between Member States on short-stay visas (VIS Regulation), OJUE L 218, 13.8.2008, p. 60.

What are the consequences of VIS in practice for visa applicants?

First-time visa applicants must always present themselves in person when submitting their application to provide their photograph and fingerprints.

The photograph is currently scanned from an existing paper photograph. At a later stage, the photograph will be taken digitally at the moment of the application.

For all new subsequent applications submitted within a period of 59 months, the fingerprints can be copied into the VIS from the previous application file.

Nevertheless, it should be stressed that in the event of reasonable doubt as to the applicant's identity, the consulate will collect fingerprints again within the 59 months referred to above. Moreover, the applicant may ask for fingerprints to be taken if, at the time the application is submitted, it is not immediately possible to confirm that the fingerprints were taken within the aforementioned period.

The biometric data of visa applicants may be collected by Schengen State consulates and external service providers (such as VFS, TLS and others), but not by commercial intermediaries (e.g. travel agencies).

Upon arrival at the Schengen external border, visa holders must provide their fingerprints for comparison with those registered in the VIS, at the request of the Schengen States' border control authorities. Searches in the VIS by Schengen border guards are based on the visa sticker number in combination with fingerprints.

Visa holders whose fingerprints have not been taken at the time of application, on the grounds that they have been exempted from this requirement, will not be asked to provide fingerprints at the border.

What happens to those who refuse to provide fingerprints for various reasons?

As a result, a Schengen visa will not be issued if biometric data is not provided. However, in accordance with Article 13(7) of the Visa Code, there are several categories of citizens who are not required to provide this data, as indicated in the FAQ under Question 18.

If I already have a biometric passport, do I also need to submit my fingerprints?

Yes, holders of biometric passports must also appear in person when applying for a short-stay Schengen visa for the first time to submit their fingerprints.

How is my biometric data protected in the VIS?

Strict data protection rules are defined in the VIS regulation and are subject to control by national and European data protection authorities.

Data is kept in the VIS for a maximum of five years from the visa expiry date, if a visa has been issued, or from the new visa expiry date, if a visa has been extended, or from the date on which a refusal decision is issued by the visa authorities.

All individuals have the right to obtain communication of the data recorded in the VIS concerning them from the Schengen State which entered the data in the system. Individuals may also request that inaccurate data concerning them be rectified, and that illegally recorded data be deleted.

In each Schengen State, the national supervisory authorities independently monitor the processing of personal data recorded in the VIS by the respective Schengen State.

The European Data Protection Supervisor monitors the data processing activities of the VIS Management Authority.

Which data are registered in the VIS?

The visa authorities in each Schengen state register data relating to short-stay visa applications (i.e. applications to stay in the Schengen area for 90 days or less) in the VIS. Data relating to national long-stay visas are not yet recorded in the VIS.

Upon reception of an application, the visa authorities of the relevant Schengen State create an application file in VIS and record the alphanumeric data contained in the Schengen visa application form, the applicant's digital photograph and the ten fingerprints collected.

If the applicant is traveling in a group, the travelers' application files will be linked in the VIS. If a previous application has been registered for the same applicant, the two applications will also be linked in the VIS.

Once a decision has been taken on the application (visa granted/refused) or post-decision (annulment, revocation, extension), the information is recorded in the VIS by the visa authorities of the relevant Schengen States. Once the visa has been issued and all applicant data - including fingerprints - have been recorded in the VIS, a code is inserted in the visa sticker.

Which authorities have access to the VIS?

The visa authorities of the Schengen States have access to the VIS for both data recording and consultation. Application and decision data are entered into the VIS by the visa authorities of the Schengen State responsible for examining the application or taking the decision. The data entered by one Schengen State can then be consulted by the visa authorities of all the other Schengen States, for example when examining another application from the same applicant.

Other authorities from the Schengen States have access to the VIS for consultation only.

National border authorities have access to the VIS in order to verify the identity of the visa holder, the authenticity of the visa and whether the conditions for entry into the territory of the Schengen states have been fulfilled. VIS checks at the Schengen area's external borders, with systematic fingerprint verification, are compulsory, except in a limited number of cases.

The national authorities responsible for carrying out identity checks on the territory of the Schengen states have access to the VIS in order to verify the identity of the visa holder, the authenticity of the visa and whether the conditions for entry, stay or residence on the territory of the Schengen states have been fulfilled.

National asylum authorities have access to the VIS to determine the Member State responsible for examining an asylum application in accordance with Regulation (EC) No 343/2003 and for processing the application.

Europol has access to the VIS for consultation purposes as part of the prevention, detection and investigation of terrorist offences and other serious criminal offences.

National law enforcement authorities have access to VIS data for the same purposes, provided certain legal conditions are respected: access to VIS data must be necessary in a particular case, and there must be reasonable grounds for considering that consultation of the data will make a substantial contribution to the prevention, detection and investigation of terrorism and other serious crimes.

As a general rule, VIS data may not be transferred or made available to a third country or international organization. By way of derogation, certain data recorded in the VIS (name, nationality, travel document number, residence) may be communicated to a third country or international organization when a specific case requires it to prove the identity of a third-country national, including for return purposes.

European Union adopts more favourable Schengen visa rules for Indians

Indian Nationals can now apply for a multiple entry Schengen visa with longer validity

On 18 April 2024, the European Commission adopted specific rules on the issuing of multiple entry visas to Indian nationals, which are more favourable than the standard rules of the Visa Code that applied to date. This new visa ‘cascade’ regime for Indian nationals residing in India who apply for Schengen (short-stay) visas in India will provide easier access to visas with multi-year validity for travellers with an established travel history, if the passport validity allows. 

According to the newly adopted visa “cascade” regime for India, Indian nationals can now be issued long-term, multi-entry Schengen visas valid for two years after having obtained and lawfully used two visas within the previous three years. The two-year visa will normally be followed by a five-year visa, if the passport has sufficient validity remaining. During the validity period of these visas, holders enjoy travel rights equivalent to visa-free nationals.

This decision comes in the context of strengthened relations under the EU-India Common Agenda on Migration and Mobility, which seeks comprehensive cooperation on migration policy between the EU and India, with facilitation of people-to-people contacts being of key aspect due to the importance of India as a partner for the EU. 

Schengen visas allow the holder to travel freely in the Schengen area for short stays of a maximum of 90 days in any 180-day period. The visas are not purpose-bound, but they do not grant the right to work. The Schengen area consists of 29 European countries (of which 25 are EU states): Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Germany, Estonia, Greece, Spain, France, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland and Sweden, along with Iceland, Liechtenstein, Norway and Switzerland.

Being under the category of the C type Schengen, this permit is issued for a stay duration of up to 90 days in a 180-day period and can be obtained in single-entry type, double-entry, and even multiple-entries. With this, you can travel to Luxembourg and any other Schengen countries as well. 

The process of applying for a Luxembourg tourist visa from India is done offline. There is no online process for this permit. The application handling, however, is outsourced to VACs in India (Visa Application Center) by the Luxembourg embassy. Before starting your application, you must ensure that you are eligible to travel to the country as a tourist. After this, you may make the application as follows - 

  • Obtain all the documents necessary for the application. 
  • Visit the website of the embassy of Luxembourg in India or the website of the VAC and download the application form. The form is the same as a general Schengen application. However, you will have to mention your purpose of visit as ‘tourism’.  
  • Fill in your details and take a print out of the completed Luxembourg tourist visa application form. 
  • Book an appointment at one of the VACs located across India. You may do this by visiting the website of the VAC and using the online portal. You may visit the VAC without an appointment, but due to the high volume of applications, it is strongly advised to make an appointment. 
  • Visit the VAC for the application and biometric submission along with your documents, duly filled and signed application form and fees. 

Please note that if you have submitted your biometrics for a Schengen visa in the past 5 years, you do not have to submit them again. Ensure that you submit only the genuine documents and provide correct information. Providing fake documents and information can lead to visa rejection. 

To be able to apply for a tourist permit, you must meet the following conditions - 

  • You must be living in a country where you are lodging the application. If you are residing in a residence permit in any foreign nation, you may apply it to the corresponding visa authority in that country.
  • You must possess a valid passport as per the regulations.
  • The primary purpose of your visit must be to take part in tourism activities.
  • You must possess sufficient funds to cover your expenses during the entire stay in the country.
  • You must apply for the permit only if -
  • Luxembourg is your only destination, or
  • Luxembourg is one of your multiple Schengen destinations, in which case you will be spending the majority of the time here, or, 
  • Luxembourg must be your port of entry into the Schengen region.

As per the Luxembourg tourist visa for Indian citizens, the following are the list of documents required for the application - 

  • A valid passport- 
  • It must consist of at least 2 blank pages.
  • It should not be older than 10 years.
  • It should be valid for at least 6 months from the date of entry into the country.
  • Old passports, if any, are to be attached.
  • This must include the applicant's details.
  • It should clearly mention the source of funds.
  • It should clearly state the purpose and duration of the visit.
  • It should be signed by the applicant and addressed to the Embassy of the Republic of Luxembourg
  • Medical travel insurance coverage up to at least 30000 Euros
  • Proof of occupation - 

Proof of occupation such as employment letter, Copy of business license, etc

  • Financial documents -

Financial documents such as bank statements of past 3 months, Passbook copy, ITR, etc.

  • Dimensions: 35mm X 45mm
  • Colour: Coloured
  • Head must occupy the central position
  • Must be captured within the last 3 months

The time taken to process the tourist permit is dependent on several factors such as the entry type, the duration of the permit, the volume of applications at the embassy, as well as your previous travel history. Normally, it would take around 15 working days to process. However, due to the uncertainty, it is suggested that you apply for it well in advance.

The total fees for the tourist permit depend upon a few factors such as the number of entries, the biometric charges, as well as any other service charges. It can also vary upon the foreign exchange rates. As a result, it is suggested to check the exact amount before starting the application.

Once you have made the application at the VAC, the application will be sent to the Embassy of the Grand Duchy of Luxembourg for processing. The embassy is solely responsible for the processing. The VAC is responsible for only the handling of the application and as a result, cannot influence the processing. 

While you are waiting for a response, you may perform the Luxembourg tourist visa status tracking by visiting https://www.vfsvisaonline.com/Global-Passporttracking/Track   and entering your reference number and date of birth.

Once you have this visa, you must keep in mind the following points to ensure that you have a pleasant journey. 

  • Keep note of the expiry date, duration of stay, as well as the number of entries mentioned on the visa sticker. You must not stay longer than the allowed stay duration. 
  • Carry all the travel documents before travelling. 
  • Ensure that you travel to Luxembourg within 6 months of the issue date, or as mentioned. After this date, your permit will become invalid and you will not be able to enter the country. 
  • While you are travelling within the country, carry a copy of your travel documents with you. If you are travelling to other countries within the Schengen, you will have to carry your original travel documents.
  • While you are on a tourist permit, you cannot work. 
  • You will not be able to extend the tourist visa in any normal conditions
  • You can move freely within the Schengen zone. And depending on your entry type, you may enter or exit the Schengen as permitted.

How can i extend my luxembourg schengen tourist visa.

It is not possible to extend the tourist permit under normal conditions. Being a type of the Schengen C category, these are non-extendable. However, in extreme cases such as a Force Majeure, or other humanitarian reasons, you may be granted an extension. In all other cases, you must leave the country if you do not receive an extension.

After Expiring My Luxembourg Tourist permit, How Long Can I Stay?

Being a short term visa, there is no grace period for the tourist permit. As a result, you cannot stay back any longer after your permit expires. You must leave Luxembourg before the expiry date. Staying back after this period is considered an offence and can get you deported or even be banned from re-entry into the Schengen region. 

What is the Medical Test for Luxembourg Schengen Tourist Visa?

Since the permitted duration of stay will only be less than 90 days, there are no mandatory medical test requirements. However, for the long term categories, there may be medical requirements. In both cases, it is suggested that you get a medical checkup before travelling to a new country. 

Can I Convert My Luxembourg Schengen Tourist Visa into Work permit?

It is not possible to convert a short term permit into a work permit. Schengen short term visas are non-convertible. You are also not allowed to work while you are on this permit. If you do require a work permit, you must apply for one once you are back in your home country. 

Can I Travel other Schengen and European country on Luxembourg tourist permit?

Yes, you are allowed to visit other Schengen countries with this. Being a Schengen country themselves, Luxembourg takes part in the visa-free arrangement. As a result, you can enter other Schengen countries as long as you meet their individual entry requirements. However, you cannot visit all of the European nations. You can only visit the European countries that are a part of the Schengen. Apart from this, you may visit certain countries that permit you entry with a Schengen visa.  Eg: - Croatia.

The European Union (EU) has updated visa rules which now allow Indian nationals to get multiple-entry Schengen visas with an extended validity period. Known as t he “cascade” system, the new regime aims to simplify the visa application process for frequent travellers with proven travel history, provided their passport validity allows it.

The new rules, adopted on April 18, have been made in the context of “strengthened relations” under the EU-India Common Agenda on Migration and Mobility, which aims to enhance the relationship between the EU and India by promoting greater interaction between their people. The agenda also emphasises the importance of a collaborative approach to migration policy between the EU and India.

“According to the newly adopted visa “cascade” regime for India, Indian nationals can now be issued long-term, multi-entry Schengen visas valid for two years after having obtained and lawfully used two visas within the previous three years. What is a Schengen visa?

A Schengen visa is a type of entry permit that allows the holder to visit any of the countries that are part of the Schengen area for a short period of time. EU relaxes Schengen visa norms for Indian nationals; here's what you need to know

I n a promising development for Indian citizens, the European Union (EU) announced on Monday that individuals from India can now seek a multiple-entry visa with extended validity.

The European Commission stated in a release that the regulations, endorsed on April 18, present a more advantageous framework than the previous standard provisions of the visa code.

Under the newly instituted visa 'cascade' arrangement for India, individuals can obtain long-term, multi-entry Schengen visas valid for two years after successfully obtaining and utilizing two visas within the preceding three years.

"The initial two-year visa is typically succeeded by a five-year visa, contingent upon the remaining validity of the passport. Throughout the duration of these visas, holders enjoy travel privileges equivalent to visa-exempt nationals," the statement explained.

EU's statement further pointed out that this decision of theirs aligns with the deepening ties outlined in the EU-India Common Agenda on migration and mobility, which aims for comprehensive collaboration on migration policy between the EU and India.

Taking to X, EU ambassador, Herve Delphin said, "Unlocking Easier Access to Europe! EU Diplomat Hervé Delphin Champions New Schengen Visa Regime, Extending to Indian Frequent Travelers for Up to 5 Years. Strengthening People-to-People Ties!"

Under the Schengen visa, holders are permitted to freely explore the Schengen area, allowing for short stays of up to 90 days within any 180-day period.

While these visas are not restricted by purpose, it's important to note that they do not confer the right to work.

The Schengen area comprises 29 European countries, including 25 EU member states: Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Germany, Estonia, Greece, Spain, France, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland, and Sweden. Additionally, it encompasses Iceland, Liechtenstein, Norway, and Switzerland.

Entry requirements

This advice reflects the UK government’s understanding of current rules for people travelling on a full ‘British citizen’ passport from the UK, for the most common types of travel.

The authorities in Luxembourg set and enforce entry rules. If you’re not sure how these requirements apply to you, contact the Embassy of Luxembourg in London .

COVID-19 rules

There are no COVID-19 testing or vaccination requirements for travellers entering Luxembourg.

Passport validity requirements

To travel to Luxembourg, you must follow the Schengen area passport requirements .

To enter Luxembourg (and all Schengen countries) your passport must:

  • have a ‘date of issue’ less than 10 years before the date you arrive. Passports issued after 1 October 2018 are now valid for only 10 years, but for passports issued before 1 October 2018, extra months may have been added if you renewed a passport early
  • have an ‘expiry date’ at least 3 months after the day you plan to leave

Check with your travel provider that your passport and other travel documents meet requirements. Renew your passport if you need to.

You will be denied entry if you do not have a valid travel document, or try to use a passport that has been reported lost or stolen.

Checks at border control

Make sure you get your passport stamped.

If you’re a visitor, your passport must be stamped when you enter or leave the Schengen area (which includes Luxembourg). Border guards will use passport stamps to check you have not overstayed the 90-day visa-free limit for stays in the Schengen area. If your passport was not stamped, border guards will presume you have overstayed the visa-free limit.

If your passport was not stamped, show evidence of when and where you entered or left the Schengen area (for example, boarding passes or tickets) and ask the border guards to add the date and location in your passport.

Visa requirements

You can travel without a visa to the Schengen area (including Luxembourg)  for up to 90 days in any 180-day period. This applies if you travel:

  • as a tourist
  • to visit family or friends

to attend business meetings, cultural or sports events

  • for short-term studies or training

If you’re travelling to Luxembourg and other Schengen countries without a visa, make sure your whole visit is within the 90-day limit. Visits to Schengen countries in the 180 days before you travel count towards your 90 days.

To stay longer (to work or study, for business travel or for other reasons), you must meet the Luxembourg government’s entry requirements. Check which type of visa or work permit you need with the Embassy of Luxembourg in London .

If you stay in Luxembourg with a residence permit or long-stay visa, this does not count towards your 90-day visa-free limit.

Check with the Embassy of Luxembourg in London what type of visa or work permit you may need.

Customs rules

There are strict rules about goods that can be brought into and taken out of Luxembourg. You must declare anything that may be prohibited or subject to tax or duty.

You cannot take meat, milk or products containing them into EU countries. There are some exceptions for medical reasons, for example certain amounts of powdered infant milk, infant food, or pet food. Check the rules about taking food and drink into the EU on the European Commission website.

Taking money into Luxembourg

If you bring more than 10,000 euros in cash (even in transit) into Luxembourg, you must complete a cash declaration form. You must declare this to the Customs and Excise Agency (Administration des douanes et accises – ADA) .

What is the Schengen visa “cascade” regime for Indian passport holders?

As per the recently implemented visa "cascade" policy for India, citizens of India are eligible to receive long-term, multiple-entry Schengen visas that are valid for two years, provided they have legally secured and utilised two visas in the preceding three years. If there is still enough validity on the passport, the two-year visa will usually be followed by a five-year visa. The validity period of these visas allows their holders to travel with the same freedoms as citizens of other countries.

This decision is made within the framework of enhanced relations under the EU-India Common Agenda on Migration and Mobility, which aims to achieve comprehensive cooperation between the EU and India on migration policy. Given the significance of India as an EU partner, one important aspect of this cooperation is the facilitation of people-to-people contacts. 

How to apply for a multi-year Schengen visa?

  • According to the India Today report, if you have applied for and been granted two Schengen visas in the last three years, you are eligible to apply for a two-year multiple-entry visa.
  • If your passport's validity permits, a five-year visa will then be issued in place of this two-year one.
  • You have the same travel privileges as citizens of countries without a visa to enter the region as long as your Schengen visa is valid.

With a valid Schengen visa, an individual can visit any part of the Schengen region without restriction for up to 90 days out of 180 days. Although the visas have no specific purpose, they do not give the ability to work. The Schengen area consists of 29 European countries (of which 25 are EU states): Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Germany, Estonia, Greece, Spain, France, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland and Sweden, along with Iceland, Liechtenstein, Norway and Switzerland.

The “Tourist Visa-on-Arrival” for citizens of a select list of countries which includes nationals from the Grand Duchy of Luxembourg has been replaced with a n "e-Tourist Visa" (eTV).

The e-Tourist Visa scheme facilitates nationals of a select list of countries including Luxembourg to travel to India for tourism for a short stay of 30 days.

This facility is available to Foreigners whose sole objective of visiting India is recreation, sight- seeing, short duration medical treatment, casual business visit, casual visit to meet friends or relatives etc. and not valid for any other purpose/activities. This will allow entry into India within 30 days from the date of approval of the eTV and will be valid for 30 days stay in India from the date of arrival in India. The eTV cannot be availed more than twice in a calendar year. The facility is available at 28 designated Airports i.e. Ahmedabad, Amritsar, Bagdogra, Bengaluru, Bhubaneshwar, Calicut, Chennai, Chandigarh, Cochin, Coimbatore, Delhi, Gaya, Goa, Guwahati, Hyderabad, Jaipur, Kolkata, Lucknow, Madurai, Mangalore, Mumbai, Nagpur, Port Blair, Pune, Tiruchirapalli, Trivandrum, Varanasi & Visakhapatnam, and 5 designated seaports (i.e. Cochin, Goa, Mangalore, Chennai and Mumbai seaports). You may depart from any of the Indian Immigration Check Posts (ICPs).

The e-Tourist Visa enables the prospective visitor to apply for an Indian Visa from his/her home country online without visiting the Indian Mission and also pay the visa fee online. Once approved, the applicant will receive an email authorising him/her to travel to India and he/she can travel with a print out of this authorization. On arrival, the visitor has to present the authorisation to the immigration authorities who would then stamp the entry into the country.

Travelling to Europe has become much more convenient for GCC and Indian visitors. The European Commission has approved new regulations for the issuance of Schengen visas to citizens of Saudi Arabia, Bahrain, Oman and India who live in their home countries.

Under the new system, Saudi, Bahraini and Omanis will now have access to multiple-entry visas, allowing them to travel to 29 European countries using the same visa within five years.

This implementation has significantly simplified the process of obtaining a Schengen visa, making it much more convenient for eligible applicants, even first-time applicants. They can now look forward to receiving a multiple-entry visa that remains valid for up to five years, relieving them of the stress of frequent visa applications.

"The European Commission has adopted new rules for the issuance of Schengen visas for Saudi, Bahraini and Omani nationals residing in their home country. It is an important step promoting people-to-people contacts and facilitating exchanges between the EU and GCC citizens," the delegation of the European Union in GCC posted on X.

Kuwaitis can be issued with long-term, multi-entry Schengen visas valid for five years. UAE nationals enjoy visa-free travel to the Schengen nations, permitting stays of up to three months at a time. However, a Schengen visa is a must for UAE residents.

Additionally, the European Commission adopted specific rules on issuing multiple entry visas to Indians. Under the new regulations, Indian travellers are now eligible to obtain a two-year Schengen visa, a significant enhancement compared to the shorter validity periods previously offered.

To qualify for this extended visa, applicants must have obtained and used two Schengen visas within the last three years in accordance with the regulations. Upon successfully utilising the two-year visa, travellers can typically anticipate eligibility for a five-year Schengen visa, subject to the maintenance of sufficient passport validity.

This decision comes in the context of strengthened relations under the EU-India Common Agenda on Migration and Mobility, which seeks comprehensive cooperation on migration policy between the EU and India, with the facilitation of people-to-people contacts being a key aspect due to the importance of India as a partner for the EU.

These changes ease the visa application process and facilitate smoother travel experiences.
