N.L. cracking down on Airbnbs, short-term rentals with new tourism regulations

Short-term accommodations must be registered with province by april 2024, social sharing.

Newfoundland and Labrador is bringing in new regulations to move unlicensed accommodations like Airbnbs in line with licensed operators, forcing them to be registered with the provincial government by this time next year.

Tourism Minister Steve Crocker, announcing the regulations Tuesday, said the former Tourism Establishment Act has been renamed the Tourism Accommodations Act. The change will require all short-term accommodations, like Airbnbs or other short-term rentals, to register with the province and follow the same municipal and provincial regulations as established tourism operators.

Any accommodations currently licensed by the Department of Tourism, Culture, Arts and Recreation will be automatically registered under the new regulations, but those who aren't will have to register by March 31, 2024. The registration process will be free, Crocker said.

If they don't register, Crocker said, the province will work with online marketing platforms to make sure unlicensed accommodations can't be advertised.

"If you're not registered, and let's be clear, by March 31, 2024, you will no longer have access to the platforms," Crocker said.

Crocker said changes needed to be made to modernize the Tourism Establishment Act, which was introduced in the 1970s, to better reflect the current tourism industry. He said there has been an increase in unlicensed accommodations around the province, which can lead to a lack of health and safety measures.

Data from Destination St. John's suggests there are more than 800 unlicensed operators on the northeastern Avalon Peninsula alone, where there were 68,000 room nights booked with unlicensed operators, who made $14 million in revenue last year.

"Our partners and our members are telling us that it is an unfair playing field … and that is the case," said Destination St. John's chair Heather McKinnon.

"This is the next step to make this a level and fair playing field."

"We're excited about where this might lead us as an industry," Bourden said Tuesday.

"We always strive to be seen as always operating professionally. It's so important that we have these regulations there so that the short-term [accommodations] that are currently operating … are welcomed into our industry, that we have this level playing field so we can all move forward."

Crocker said the new regulations aren't meant to crack down on the number of short-term accommodations around Newfoundland and Labrador, saying they do have a place in the future of the industry — especially in rural areas where more traditional tourism accommodations aren't as prevalent.

"I hope we do see more Airbnbs or more people on these platforms. Because, you know, I think of my own region of the province that I represent. We do not have a lot of what I would [call] traditionally established tourism operators," said Crocker, the MHA for Carbonear-Trinity-Bay de Verde.

"[But] this is a professional industry, and we expect everybody to live up to that professional standard."

Deadline Extended to Register Tourist Accommodations

The deadline to register tourist accommodations with the Department of Tourism, Culture, Arts and Recreation is being extended from March 31 to June 30. In April 2023, the Government of Newfoundland and Labrador proclaimed the new Tourist Accommodations Act and Regulations with an aim to strengthen operating rules for short-term accommodations in the province.

The Department of Tourism, Culture, Arts and Recreation now has 2,200 registrations. This deadline extension will provide additional time to process these registrations and update the various partner platforms. Registration is a one-time, cost-free process. It provides the provincial government with a fulsome look at short-term accommodations across the province.

The Tourist Accommodations Act requires all tourist accommodations to comply with applicable municipal and provincial regulations, including the requirement for fire inspections and taxation.

The Tourist Accommodations Act has been proclaimed and associated regulations are now in effect. The Act and Regulations can be found here ( https://www.gov.nl.ca/tcar/tourism-division/registration/ ).   Updates to the NLTO Portal and the User Guide are in process. Accommodation and campground operators with existing Tourist Establishment Licences are automatically registered under the new TAA and regulations.   New accommodation operators can continue to use the Portal to register their business. Provincial and Federal Governments Receive Approval on National War Memorial Centennial Project Including Repatriation of an Unknown First World War Soldier from Northern France

The Government of Newfoundland and Labrador and the Government of Canada have received approval from the Commonwealth War Graves Commission in London on the National War Memorial Centennial Project.

The Government of Newfoundland and Labrador and the Government of Canada have received approval from the Commonwealth War Graves Commission in London on the National War Memorial Centennial Project. A special component of this project is the repatriation of an Unknown First World War Solider from Northern France. This soldier will be re-interred in a specifically designed tomb at the National War Memorial in St. John’s to represent Newfoundlanders and Labradorians who served in all branches of the military.

Premier Ball Announces Details of the Final Step in Completing the Trail of the Caribou

Newfoundland Vacation Rental Rules Coming Into Effect In 2024

The  Government of Newfoundland and Labrador proclaimed the new Tourist Accommodations Act and regulations, which aim to strengthen operating rules for short-term accommodations in Newfoundland and Labrador.

In the past, short-term accommodations had to be licensed by the Department of Tourism, Culture, Arts and Recreation under the Tourist Establishment Act. However, the new Tourist Accommodations Act requires all short-term accommodations to be registered with the department. This process will provide the department with a full registry of short-term accommodations in the province, all of which will be required to comply with applicable municipal and provincial regulations, including the requirement for fire inspections and taxation. The Department of Tourism, Culture, Arts and Recreation will work with other Provincial Government departments and municipalities to support the enforcement of the Act and regulations. Failure to comply with the new requirements could result in financial penalties, as offences will carry a minimum fine of $250 with a maximum fine of $2,000. To ease the transition process, any accommodations currently licensed by the department will be automatically registered. All others will have to register by March 31, 2024.
