Overseas Travel and the Defense Base Act

Basic question:   If a contractor employee, based in the United States, goes TDY to an overseas location during the course of performance of a DoD service contract, does the Defense Base Act   (DBA) apply?

Background: Suppose you have a DoD service contract where performance occurs within the United States, with the exception of an annual TDY that requires a contractor employee to travel overseas.   The employee (a U.S. citizen) lives in the United States and, aside from this TDY, also works in the United States.   The DBA clause is not included in the contract.   Assume that, since the employee is a U.S. citizen, there is no applicable waiver from the Department of Labor.

FAR 28.305(b) specifies, “ The Defense Base Act (42 U.S.C. 1651, et seq. ) extends the Longshoremen’s and Harbor Workers’ Compensation Act (33 U.S.C. 901) to various classes of employees working outside the United States…” 

In determining whether or not DBA applies, FAR 28.305(c) simply refers to 42 U.S.C. 1651.   The interpretation of 42 U.S.C. 1651 is very broad.   For instance, DPAP released a policy memo in 2003 titled “Inclusion of Defense Base Act Clause in DoD Overseas Contracts” which states, in part, “the Defense Base Act clause at FAR 52.228-3 should be included in all DoD service contracts to be performed (either entirely or in part) outside of the United States…”

So, based on the above, I make the assumption that even a single TDY overseas could be considered performing, in part, a DoD service contract outside of the United States.   Therefore, the DBA applies and the clause needs to be included in the contract.   This would have pretty enormous implications because this situation is pretty common, and the DBA clause is rarely included (at least in my agency) in contracts unless contractor employees are actually living and working overseas in places like Afghanistan/Iraq/Pakistan.

There’s really a dearth of information out there on the DBA specifically as it relates to its applicability in Gov’t contracting.  M y relatively fruitless searches are crowded out by a mass of results originating from the DBA industry, which apparently must be pretty lucrative.

If the clause is not in the contract the contractor did not procure DBA. If the contractor did not procure DBA then there is no coverage.

I believe that the contractor's normal insurance would cover the employee.

For the purpose of the question at hand, whether or not the employee is covered by DBA insurance does not concern me.  I am specifically concerned with whether or not the Act applies.

I think that the DPAP memo is clear. The DBA would apply unless it was waived. For further information, see  https://www.dol.gov/owcp/dlhwc/FAQ/DBAFaqs.htm .

This is not particularly my area of expertise, so I defer to you. On the other hand, the FAQ you cite as the basis for your answer contains the following language:

"This page does not necessarily contain an exhaustive or current treatment of the DBA and should not, under any circumstances, substitute for a party's own research into the statutory, regulatory, and case law authorities on any given subject addressed by the following FAQs. The FAQs are an informational tool, not a final authority, and should not be cited or otherwise considered an authoritative statement of agency policy."

It is required!  We are so reliant on our contract hire staff that this is a big problem with program offices sending thier contract hires overseas without much thought.  They just assume they can go TDY so can the contract hire.  If the employee is from a professional services company (may I say body shop) the odds are the company is not paying attention either.  No one really cares until something kills or injures the employee overseas and it all blows up in everyones face.

My answer is based on the DPAP memo , which is an authoritative statement of agency policy. I provided a link to the FAQs in response to this:

21 International Travel Checklist Items To Make Your Life Easier

Planning a big overseas trip–maybe even for the first or second time–and trying to put together the perfect international travel checklist to ensure you don’t forget anything before you leave?

We have you covered: as full-time travelers for more than 4 years across nearly 50 countries, we are well accustomed to preparing for international travel.

International Travel Checklist: Booking Your Trip

Calculate your travel budget and plan with your eyes open..

Before starting any of your trip planning, we recommend setting a budget for your travels.

Having a number in mind (though this is a very, very old post, we still stand by this formula for calculating your travel budget) will not only keep you from overspending, it’ll also keep you from underspending in the early planning stages.

You don’t want to get to the end of your trip and realize you could have splurged on that once-in-a-lifetime opportunity after all!

Sketch out your travel itinerary.

Once you have a budget in mind, go ahead and sketch out an itinerary for where you want to go once you arrive at your destination.

There is no limit to the variety of bucket list-worthy trips in the world, making narrowing down your options most of the challenge of this step!

Check visa requirements.

Depending on where you are coming from and where you are going, this step might vary from a cursory Google search all the way up to planning a year in advance so you have time to gather your documents and get to an interview.

For US citizens, we recommend checking visa requirements for your intended destination on the travel.state.gov website , which will always have the most up-to-date official information.

Check COVID-19 documentation requirements.

In 2021 (and let’s be real: probably in 2022 and quite possibly beyond that), it’s a whole new world as far as traveling abroad goes, and this checklist would not be complete without mentioning COVID-19 documentation.

Whether you need to show your vaccination card, a negative test, or both, odds are you’ll need to square away some documentation to travel internationally.

Don’t forget to check any requirements for coming home, too!

Buy your plane tickets!

Personally, the moment that we finally purchase our plane tickets is virtually always the moment that a trip really, truly starts to feel real.

It’s exhilarating, and hopefully, a highlight for you as you work through this international travel checklist as well!

Book your hotels & rental car.

Once you have your travel itinerary ready to go, your plane tickets purchased, and your visa sorted (if applicable), it’s time for the next phase of preparing for international travel: booking your hotels for each destination and your rental car.

We typically use Booking.com (and occasionally Airbnb ) to find our hotels and apartments, Get Your Guide to book most tours and tickets,  and use Discover Cars to find our rental cars.

Start learning phrases in the language of your destination.

For the vast majority of international trips, this is more out of politeness than an extreme necessity, but still: as your trip starts getting closer, start learning a few phrases in the language spoken in your destination!

A few to start with are: yes, no, please, thank you, hello, goodbye, I would like, where is the toilet, and excuse me.

International Travel Checklist: Getting Your Documents in Order

Check the expiration date on your passport..

For most countries, your passport will need to have an expiration date more than 6 months after you leave the country.

If yours is getting close to expired, get that taken care of ASAP, especially if your trip is coming up (like, start looking at the process of renewing your passport this second ).

Book onward travel if needed.

Technically speaking, most countries around the world require you to have your exit plan firmly in place in order to enter their country.

Depending on where exactly you’re going and your level of passport privilege, this may be a very important step on your international travel checklist or more of a CYA move, but either way, it’s good to have it taken care of.

If you have a round-trip plane ticket booked, no worries, this doesn’t apply to you.

If you have a one-way ticket booked, print out or download it to your phone (don’t rely on having the internet to look something up in your email–we’ve learned that one the hard way) proof of your plan to leave the country in question.

If you don’t have a plane ticket, perhaps because you are planning to take a train or bus to your next stop, a hotel reservation or visa for your next destination may sometimes work, but it depends on the immigration officer or airline employee (as they often are de facto in charge of enforcing these rules) in question.

Buy travel insurance.

Given how inexpensive travel insurance is as compared to traveling in general, and how much money and headache it can save you in the face of something going wrong, it is absolutely worth buying when preparing for international travel.

We don’t ever suggest traveling without travel insurance–anything can happen on the road, and traveling abroad is definitely a case of better safe than sorry.

For the vast majority of destinations, we use and recommend Safety Wing for travel insurance.

Get an international driving permit if needed.

If you’re planning on driving on your trip abroad, be sure to check and see if you need to add an international driving permit to your checklist for international travel before you go!

These are essentially translations of your license into many languages–some countries require them, some technically do and rarely enforce it, some require it only if your license isn’t in one of several languages, and some don’t require it at all.

You can obtain a permit at home before you go by following these steps .

If necessary, get vaccinated.

Depending on where you’re going, what you’re doing, and how up-to-date your immunizations are, you may need anywhere from a slew of vaccines to prepare for your international trip, documentation of vaccines you’ve already received (especially in 2021), or nothing at all.

The more prep time you have to get any vaccines that you do need, the easier your trip planning will go!

Email a copy of your itinerary to yourself and a trusted loved one.

The odds of a loved one needing to access your itinerary during your trip abroad are small, but even still, there’s no downside to making sure someone back home knows where you are!

On your side, it’s always handy to have a copy of all your hotel bookings, rental car bookings, plane tickets, etc, handy–you never know when you might need to refer back to something.

Generally, as part of planning a trip, we make an email folder specifically for that trip and put all relevant reservations and information in there to ensure we’re able to keep track of everything.

International Travel Checklist: Taking Care of Your Home

Stop your mail..

Don’t let mail pile up at your home while you’re away–make sure it is held at the post office for you for the duration of your trip.

For travelers from the USA like us, you can easily set up a mail hold here through USPS online .

Let family and friends know how to contact you.

Do you plan to stay in touch with family and friends through an international phone plan? Skype? Whatsapp? Email? Social media?

Whatever the plan, be sure to let your loved ones know–especially if you’re planning a longer trip–and if it makes sense for your situation, help them set up any necessary apps that they may not have yet.

Hire a house or pet sitter if needed.

If you have plants that need watering, a pup that needs walking, a pool that needs cleaning, or just a house that needs someone to come by and make sure everything is okay, get a house and/or pet sitter worked out as far in advance of your trip as possible.

The closer to your travel dates that you start making arrangements, the more stressful the process can be.

International Travel Checklist: Getting Everything Packed

Make a packing list and buy anything you need..

Obviously, your packing list will vary dramatically based on your destination, but here are a few items that are on our own international travel checklist, typically regardless of destination.

Comfortable Day Bag  — We currently use  Pacsafe’s sleek anti-theft backpack  and love it, but if you don’t want to shell out the cash for this trip, that’s totally understandable. Just aim for something comfortable to wear, not flashy, and medium-sized–we used a  Northface Jester backpack  for years and loved it as well.

Money Belt  — This is up to you, but I’ll include it here due to its popularity. We no longer use a money belt, but if you’re more comfortable having your passports on your person while exploring you can consider bringing one.

Check your prescription medications.

Do you have enough of a supply to last the length of your trip?

If you need to bring it with you in your carry-on luggage, is it in original packaging?

Let your banks and credit card companies know that you’re traveling abroad.

For most banks, this can be done online these days, but you can also choose to call to set a travel notification in a pinch.

Generally, they’ll want to know what countries you’re visiting and for how long, and simply make a note in your file.

Forget to do this, though, and you risk your card being denied when you try to use it abroad!

Be sure you have all your long-haul flight essentials.

We’ve dedicated an entire post to making sure you bring the right things with you for the endurance event that is getting through a long haul flight semi-comfortably, but here are a few things to get you started: an eye mask , lip balm, cozy socks, hand sanitizer, offline entertainment, and a portable USB charger .

If you like to download things to watch or listen to for flights, consider picking out one of the best travel shows to watch along the way!

Weigh your luggage before you leave.

… and compare it to not only the airline you’re flying with to reach your initial destination, but also any other airlines you’re flying for different legs of your trip, as well.

For example, if you fly from New York to Paris with Delta but are flying from Paris to Rome with Ryanair, make sure your luggage meets Ryanair’s requirements as well to avoid a headache later in your trip.

International Travel Checklist: Streamlining Your Arrival

Keep a pen in your carry-on..

If you end up needing to fill out an arrival card before passing through immigration, either on the plane before landing or upon arrival before getting in line for processing, you’ll be so glad to have a pen with you!

Have a plan in place to get from the airport to your hotel.

The final step of your international travel checklist is as simple as it is important: make an arrival plan.

When you arrive at your destination, you’re undoubtedly going to be exhausted, overwhelmed, and probably a bit jet-lagged, too!

No matter how many times we arrive in a new country, it never stops being a tiny bit stressful, simply because there are a lot of variables at play in the first few hours of arriving somewhere new.

Make life easier on yourself by thinking ahead: when planning your trip , figure out your exact steps of what will happen after the plane lands.

That means exactly how far away your hotel is, how you’ll get there from the airport (train, bus, rental car, taxi?), and if you’ll be traveling by taxi, what a reasonable price is and/or if there is set fare from the airport to the city center (there often is)

I’ve traveled to multiple countries over the years, yet, you gave me new things to consider and since it’s been awhile since I’ve traveled it’s helpful to have all of this info in one place! I was wondering whether you recommend we use our cell phones in Europe and talk to our carrier about an international plan or purchase a temporary one at our destination? We are traveling to France this summer and Ireland two times next year. Thank you so much!

Hi Marissa! If your phone is unlocked, purchasing a European SIM card will almost certainly be far cheaper than an international plan. 🙂 You can buy a SIM card once you arrive at the airport (there are virtually always stalls set up as you leave), or you can even buy one on Amazon before you go! I believe Orange sells theirs on Amazon.

2. Insurance coverage and features

(1)Overseas Travel Accident Insurance

During the period of insurance, if the Insured is injured in an accident and suffers disability of any grade in the attached “Assessment Standards of Injury and Disability for Personal Insurance (standard code JR/T0083-2013, hereinafter referred to as “Assessment Standards of Injury and Disability”) within 180 days due to the occurrence of such accident, the Insurer shall pay injury and disability benefit by multiplying the Accident Sum Insured specified in the policy by the corresponding percentage in Assessment Standards of Injury and Disability. If the treatment still continues after 180 days, the Insurer will pay the injury and disability benefit according to the Insured's physical condition examination on the 180th day.

(2) Traffic Accidental Death Double Indemnity Insurance

In case the Insured dies within 180 days because of a traffic accident occurring during the Insurance Period when it is taking a public vehicle as a passenger, in addition to the Accidental Death Benefit paid under the main insurance, the Insurer will pay a “Traffic Accidental Death Benefit” to the beneficiary, which is the same amount as Accident Death Benefit.

(3) Hotel Accommodation Accident Insurance

During the period of insurance, if the Insured suffers an accident occurred within the hotel establishments range and dies within 180 days due to the occurrence of such accident, the Insurer shall pay the Death Benefit according to the Accident Sum Insured and the Insurer’s liability for such Insured shall be terminated.

(4) Aviation Accident Insurance

During the period of insurance, if the Insured suffers an accident during taking passenger aircraft and dies within 180 days due to the occurrence of such accident, the Insurer shall pay the death benefit according to the Accident Sum Insured specified in the policy and the Insurer’s liability for the Insured shall be terminated.

(5) Medical Expenses Compensation Insurance

1) Overseas medical expenses benefit due to accidental injury or acute disease

During the period of this Rider, in the event that the Insured suffers any accidental injury or acute disease, once it is confirmed that the Insured needs medical treatment overseas, the Insurer shall indemnify the Insured “overseas medical expenses benefit due to accidental injury” or “Overseas medical expenses benefit due to acute disease” for the actually incurred medical expenses at the rate approved by the local government if the Insured is treated overseas as the needs completed or requested by the attending doctor according to the agreements in this Rider. The amount payable shall not exceed the limit of indemnity stated in the policy.

The aforementioned “medical expenses” include:

A. Hospitalization costs, including surgical fees.

B. Out-patient treatment, doctor diagnosis, prescription costs.

C. Prescription drugs, inspection and testing (including X-ray examination), nursing, medical supplies (such as bandages) and other expenses.

D. Limb auxiliary device (such as crutch, wheelchair) costs (provided that the Insured uses such device for the first time due to the insured event), the compensation for these costs per occurrence shall not exceed the limit of indemnity stated in the policy.

In the event that the Insured is unable to move his body and can not be transported home before the scheduled return trip as a result of accidental injury or sudden acute disease, during which the Insurer shall be liable for overseas medical expenses until the Insured can move. The period during which the Insurer is liable for the overseas medical expenses of the Insured shall not exceed forty-five (45) days from the date of occurrence.

2) Domestic hospitalization benefit due to accidental injury or acute disease

In the event that the Insured still needs to be treated in hospital after being transferred to the People's Republic of China, the Insurer shall indemnify the Insured “Domestic hospitalization benefit due to accidental injury” or “Domestic hospitalization benefit due to acute disease” for hospitalization expenses as a result of the same disease or the same accident suffered overseas, actually occurred within the territory of the People's Republic and covered under local social basic medical insurance. The period of indemnity shall be subject to thirty (30) days from the date of being transferred to China.

In the case that the Insured can obtain compensation for medical expenses from the publicly funded health care, social basic medical insurance, other compensatory medical insurance, government agencies or social welfare agencies, the Insurer shall only liable for the residual part.

In the case that the Insurer has no publicly funded health care, social basic medical insurance, other compensatory medical insurance, government agencies or social welfare agencies, or has never obtained compensation for medical expenses from the publicly funded health care, social basic medical insurance, other compensatory medical insurance, government agencies or social welfare agencies, the Insurer shall indemnify the amount insured for reasonable and necessary hospitalization expenses actually paid by the Insured, but shall not exceed twenty percent (20%) of relevant insurance amount under this Rider stated in the policy.

During the period of insurance, the aggregate amount payable by the Insurer under the above Item 1 and 2 shall not exceed of the relevant insurance amount stated in the policy.

3) Accidental dental care services benefit

In the event that the Insured is arranged for any dental care service in order to ease the pain after his/her case of accidental injury during the period of overseas travel, the Insurer shall pay "Accident dental care services benefit" for reasonable and necessary expenses (including first visit and subsequent visit) actually spent simple or temporary fill or repair treatment so as to restore the functions of dentures or succession teeth according to the agreements in this Rider, but shall not exceed the relevant insurance amount stated in the policy.

The Insured shall be liable for the amount by the Insured him/herself within the agreed deductable for each dental care service.

(6) Emergency Medical Assistance Insurance

During the period of insurance, if the Insured suffers an accidental injury or acute illness during the course of oversea travel, he/she is obligated to immediately contact the Insurer’s authorized Assistance Organization through the call center, thus the Assistance Organization and its authorized doctors will provide the following emergency assistances and the Insurer will undertake relevant expenses arising therefrom within the Insurance Amount:

a. Emergency medical transfer and repatriation

In the event that the Insured suffers from an accidental injury or acute illness when travelling overseas (specific information refers to the declaration by the Insured), proceeding to the destination or returning therefrom to China, and receives medical treatment in a hospital, once the authorized doctor confirms that the hospital is unable to provide adequate treatment and the Insured needs further treatment, the Assistance Organization will arrange appropriate means of aid and medical escort team to transfer the Insured to a proper hospital, and repatriate the Insured back to his/her Place of Usual Residence by suitable means of communication and attenders according to the Insured’s status. All of the transfer and repatriation services should be subject to the prior written approval and arrangement of the Assistance Organization and the maximum payment shall not exceed the Insurance Amount specified in the Policy.

b. Body/Cremains Repatriation

If the Insured dies overseas due to an accidental injury or acute illness, the Assistance Organization will arrange to repatriate the Insured’s body or cremains to his/her Place of Usual Residence without violation of the local overseas laws. The Insurer will be liable for the repatriation cost that is subject to the Insurance Amount specified in the Policy.

c. Repatriation of the minor children of the Insured

In the event that any minor children under 16 years of age who are travelling together are unattended due to the accidental injury or acute disease suffered by the Insured, the Assistance Organization will repatriate the minor children to his/her Place of Usual Residence and the Insurer shall be liable for such repatriation cost. When necessary, the Assistance Organization will arrange a eligible escort for the minor children. The Insurer will exert itself to use the original return ticket and will take back the ticket for handling if it is invalid. The maximum payment for such service is RBM 40,000.

d. Burial/ Funeral Abroad Benefit

If the Insured dies overseas due to an accidental injury or acute illness, at request of the Insured’s relative and without violation of the local overseas law, the Assistance Organization or its authorized representative will arrange to bury or encoffin the deceased locally overseas, and the Insurer will undertake relevant funeral costs or the cost of the standard coffin (in case of body) , subject to RBM30,000.  

e. Passionate Visit

If the authorized doctor and the attending doctor both confirm that the Insured’s hospitalisation overseas looks likely to last for more than 7 days (not including 7 days), at request of the Insured and upon the consent of the Assistance Organization, one of the Insured’s adult direct relatives may have a passionate visit trip that shall not exceed 5 days to the Insured’s place of hospitalisation, and the Insurer will undertake the normal economic air ticket or hard sleeper train ticket for such trip and the accommodation fees not exceeding RMB 1500 /day.

f. Delivery of Required Medicine and Medical Equipment

The Insurer will provide the medicine and medical equipment that are short and required by the Insured in case of non-violation of the local laws. The Insurer only undertakes the delivery cost that is subject to RBM 20,000 and the cost of the medicine and medical equipment shall be borne by the Insured himself/herself.

g. Emergent Medical Consultation Service

If Insured feels unwell and needs relevant medical consultation, he/she can call service number to obtain such medical consultation.

(7) Loss of Travel Ticket and Certificate Insurance

During the period of insurance, if the Insured’s travel ticket and certificate (refers to passport, travel traffic ticket and other necessary certificates fir this trip) suffer a loss due to plunder or theft during the oversea travel, the Insurer shall indemnify the Insured for the official charges to obtain a same new certificate and extra reasonable and necessary traffic fee and hotel expense incurred by the Insured for obtaining such same new certificate as per the agreement of this rider, subject to the Insurance Amount specified in the Policy.

(8)Flight delay

a.If the flight that the insured plans to take is delayed by 3 hours or more due to bad weather, natural disasters, mechanical failure, strikes, hijacking or sabotage, temporary protests of other air, maritime workers, terrorist acts, air traffic control or airline overbooking, and the insured does take the flight to the destination, he/she can make a claim. If the flight that the insured plans to take is canceled due to any of the above reasons and the insured is delayed for three hours or more consecutively, the insured can make a claim, provided that the insured takes an alternative flight arranged by CSAir to the destination.

b.Delay time is determined by the following time, whichever is longer: (1) from the scheduled departure time to the actual time of departure, or to the departure time of alternative transportation arranged by the airline; or (2) from the scheduled arrival time to the actual time of arrival time, or to the arrival time of alternative transportation arranged by the airline.

c.Compensation standard: RMB300 for 3-hour delay, RMB100 for additional one-hour delay, the maximum compensation being RMB600.

d.If the insured does not take the original flight or its substitute flight, or claims refund, he/she is allowed to cancel the policy and no insurance payment will occure.

e.If the actual arrival time of the substitute flight arranged by the carrier is earlier than the scheduled arrival time of the original flight of the insured or the insured does not take the earliest substitute flight arranged by the carrier, then no insurance payment will occur.

f.This insurance policy won’t underwrite the flight delay or cancellation caused by the flight seasonal plan adjustment.

g.If the Insured willingly applies for more than one insurances which have the same coverage under different insurances (excluding the insurance of which the policy-holder is a group) underwritten by the Insurer for the same oversea working purpose, the Insurer will make the indemnity only under the policy that has the highest insured amount, and refund the corresponding insurance premiums collected under the same coverage for other insurances.

(9)Baggage delay

During the period of insurance, if the Insured’s checked baggage during the oversea travel dose not arrive within the specified time after the carrying conveyance has arrived the destination, according to the Policy, the Insurer will make the payment as per the corresponding specified Insurance Amount.

(10) Kidnapping and Illegal Detention

During the period of insurance, the Insurer shall indemnify the Insured in accordance with the daily amount of indemnification specified in the policy and the actual days that the Insured has been kidnapped or illegally detained if the Insured is kidnapped or illegally detained during travel.

(11) Loss of Checked Baggage Insurance

During the period of insurance, if the Insured’s checked baggage that is controlled by the carrier is lost or damaged due to the carrier’s or any other third parties’ liability during the Insured’s oversea travel, the Insurer will indemnify the actual value or repair costs of the baggage, whichever is lower, as per the agreement of this rider, subject to the Insurance Amount specified in the Policy.

For photo, film, video, audio or media data, the Insurer will only pay the value of the material carrying such photo, film, video, audio or media data, excluding the date itself.

(12) Theft and Robbery of Bank Card and Check

During the period of insurance, in case the bank card or check carried by the Insured is lost, pilfered, robbed or grabbed, which results an unauthorized person to use the bank card or check in the following circumstances, the Insurer shall indemnify the Insured for the loss of funds caused by the same reason under the account opened in the card issuer within the limit of indemnity for this Rider specified in the policy after deducting the deductibles:

1. Use the bank card or check to withdraw deposit or transfer at the bank counter;

2. Use the bank card or check to withdraw deposit or transfer at an ATM;

3. Use the bank card for consumption, including not limited to online shopping.

However, the loss of funds must occur within 48 hours before reporting the loss of bank card or check during the valid period of this Rider and the Insured must report the loss of bank card or check within 24 hours after the bank card or check is lost, pilfered, robbed or grabbed.

(13) Household Property Insurance

During the period of insurance, if the indoor insured property located at the Insured’s place of usual residence within the territory and specified in the Policy is damaged by the following reasons during the Insured’s oversea travel, the Insurer shall be liable for the direct loss or damage according the agreement of this rider. The Insurer will calculate the payment as per the insured property’s actual value at the time of loss or the repairing expenses, whichever is lower, subject to the Insurance Amount specified in the Policy:

a.Fire and explosion;

b.The falling of flying objects, collapse of external objects;

c.Typhoon, windstorm, rainstorm, tornado, lightning strike, flood, hail, snow, cliff slide, icicle, mud-rock flow, and earth subsidence or sinking caused by natural disaster.

3. Exclusions

4.Age limit: The entry age of the insured must be within the scope from 14days to 80 years old

5. Excluded groups

(1) Individuals who have had epilepsy, psychosis or schizophrenia;

(2) Individuals whose travel aboard is for the purpose of diagnosis, treatment or seeking other medical services;

(3) Pregnant women;

(4) Individuals who are not suitable for overseas travel according to a medical practitioner;

(5) Insureds whose overseas travel is for the purpose of immigration or settling down abroad with no intention of come back to China in the short term;

(6) Insureds who have had certain illness and are waiting for treatment;

(7) Insureds who have been out of the People’s Republic of China when applying for this insurance;

  • Access to information about the children including educational and medical information – which can mean sharing the details of each child
  • Telephone and video communications between the children and each parent – it’s often important to set boundaries around who can connect with each child at certain times
  • Restrictions on the children relocating outside a certain distance – stipulating where a child can live so as to not separate too far from each parent
  • Non-denigration clauses that prevent denigration of parents and extended family members – this involves being firm about unfairly criticising or insulting the other partner or their family members in front of the children
  • Interstate and overseas travel arrangements including obtaining and maintaining passports for the children. – being clear about what travel is allowed and what is required for this process

Having these set of clauses means that both parents understand what rules and responsibilities each have for the children involved in a separation.

In general, these clauses should be realistic, practical and in the best interests of the children.
