This European Country Has The Highest Multiple-Entry Schengen Visa Approval Rate

When visiting multiple countries in the Schengen zone, it is important to apply for a visa from the country you are entering first or where you are spending the maximum number of days. If that country happens to be Germany, then you are in luck, as data shows that it is the best country for getting a multiple-entry Schengen visa approved.

The multiple-entry visas (MEVs) allow travellers to enter and exit the Schengen Area, comprising 27 European countries, multiple times before the expiry of the visa. In 2022, Germany came out on top for having the highest share of MEVs in the total number of visas issued, according to data on Schengen Visa Info . Of 8,17,307 visas Germany approved, 7,40,356 were MEVs — an approval rate of 90 percent.

Apart from Germany, Slovenia and Estonia also had the highest issuance rate for MEVs. Of the total visas issued, Slovenia granted 81.6 percent visas for more than one entry, and Estonia granted 81.3 percent MEVs. Following them closely was Austria (79.4 percent) and Italy (73.8 percent).

Nordic countries — Iceland (5.8 percent), Norway (33.6 per cent) and Sweden (33.6 per cent) — were at the contrasting end for having the lowest approval rates of multiple entry visas.

France and Spain, the top two most visited destinations in Europe, received more applications than Germany but had a lower share of granting multiple entry visas. France received almost two million applications in 2022. Out of these, just 40 percent were allowed to enter multiple times. Following closely behind, Spain issued only 39.3 percent visas for multiple entries, according to the Schengen Visa Info data.

In addition to having the highest multiple entry visa rate, Germany also had one of the lowest overall visa rejection rates when compared to other Schengen countries. According to this 2022 data, Germany only rejected 16.2 percent of applications it received, which is even lower than the Schengen member states’ average — 17.9 percent.

Malta, Sweden, Belgium and France are the countries that saw the highest rejection rates in 2022. In contrast, Iceland , Lithuania, Finland and Latvia were the countries to have the lowest overall rejection rates, according to the data.

What is a multiple entry visa?

A multiple entry visa means one can leave and enter the Schengen Area more than once but without violating the 90/180 rule. According to this rule, you cannot stay in Schengen zone for more than 90 days in a period of 180 days. Depending on the frequency of travel, one can apply for multiple entry visas for one year, three years or five years.

Under § 71(2) German Residence Act (Aufenthaltsgesetz) it is the embassies and consulates of Germany which are responsible for issuing German visas. These embassies and consulates are located in the applicant’s home country. When making the application, the applicant must make sure that they submit the right documents including the application form for the appropriate visa. Reasons for Rejection of German Visa Application

A German visa application can be rejected for a number of reasons. Knowing the most common reasons for the rejection of German visa applications is the best way to avoid making the same mistakes in your case.

Lack of Clarity regarding Willingness to Return

For short-term visas such as the Schengen Visa and the Business Visa , lack of clarity as regards whether the applicant intends to return afterwards is the primary reason for rejecting the application. These types of visas are short-term in nature and thus the applicant should not look for them in the expectation of remaining in Germany after their expiry. Overstaying a Schengen Visa in Germany can also lead to criminal and administrative sanctions under German law. In order to avoid suspicion of unwillingness to return to your home country, it is important to demonstrate in your application that your home country remains your intended place of residence. This can be demonstrated by showing:

  • family ties and relationships in your home country,
  • employment / professional activity in your home country,
  • evidence of property ownership.

It may be seen as unfair but the reality is that if you do have a job in your home country, if you do not have family there and you have no clear ties to your country of origin, your application for a German visa has a greater chance of rejection.

Improper, False or Missing Documentation

When applying for your German visa it is crucial to have your documentation in order. The documents you will be required to submit will depend on which visa you are applying for, but it is vital to read carefully and make sure that all the appropriate documents are submitted. For short-term Schengen Visas this will likely include the completed application form, photos for identification purposes, your itinerary in Germany / the Schengen Zone, proof of employment and financial statements. Equally important is to ensure that your visa application form is filled in correctly and that your signature is in the appropriate sections. Finally, check your passport! Your passport needs to be in date and valid for the duration of your time in Germany.

Supplying false documentation or trying to get into Germany with a fake identity will lead to the rejection of your visa application and possible further legal action.

Purpose of Visit: Appropriate Visa

When applying for a German visa, make sure to apply for the appropriate visa for your purpose . Differing visas will require documentation appropriate to their purpose. There is no point in submitting documents for a tourist visa when you are applying for a Business Visa. Similarly, your purpose must be deemed “credible” . Therefore, your application and documents submitted should attest to your purpose. If you have applied for a Business Visa on the grounds of conducting business for a company you do not work for, then your application will likely be rejected. However, this can be relatively easy to demonstrate. The main point here is to be careful with the documents you submit and that your application form matches the visa you have applied for.

What are your Options: Rejection of German Visa Application

The rejection of a German visa application can be a frustrating experience as often there is little indication as to why the application failed. When reason is given as to the rejection, it is often vague and non-specific . It is also the case that you may not have been given information as to the legal remedies you can seek in the event of visa application rejection. This vagueness is allowed for under § 77(2) German Residence Act (Aufenthaltsgesetz).

The legal options open to you depend on the nature of the visa applied for. In the case of a short-term visa a “ remonstration ” is allowed for, whereas longer term residence permits or visas applicants can bring about both a remonstration and legal action at the Administrative Court in Berlin. § 83 German Residence Act does not allow for short-term visa disputes to be brought to appeal in courts. As a legal appeal can be brought after a remonstration, it is advisable to try the remonstration route first before applying to bring the case before the Administrative Court.

The Remonstration

“Remonstration” means to complain about something. In legal terms a remonstration is an application made to the German embassy in order to reassess the situation once again. The remonstration must be filed with the consulate or embassy where the application was rejected. It is often the case that the visa application has been rejected because certain elements of the application may have been missing or were deemed suspicious. Through the remonstration process the applicant can resolve the issues that led to the rejection.

The remonstration process involves submitting, in writing, your opinion of why the decision made by the Embassy was incorrect and request for the examination of the rejected visa application. At the embassy it is advisable to seek the reason for why your application was rejected in the first place. Knowing the reason for the rejection of your German visa application means that you can better prepare your remonstration.

After submitting the remonstration, the applicant will either receive the visa sought after or a remonstration notification will be issued explaining the reasons for rejecting the remonstration. The process of receiving an answer to your remonstration can take several weeks, however if there is no answer or decision made after three months it may be possible to take legal action for failing to act.

Should a remonstration be rejected it may be possible to submit a legal appeal to the Administrative Court in Berlin.

Legal Appeal to the Administrative Court

The step of making an appeal to the Administrative Court in Berlin is not one which should be taken lightly. Upon notification of the rejection of the remonstration, the applicant has one month to submit their intention to make a legal appeal. Although legal action provides the applicant with another chance to overcome the rejection of their German visa application it is a decision worth considering. Legal action can be lengthy and costly. In such a process, the court will also make a final decision on the matter.

Dealing with the Administrative Court is an action which requires serious planning and preparation .  The court will carefully analyse the evidence you place before them and will have certain rules regarding what evidence can be used and how they can be used. Generally speaking, all other foreigners require a visa for stays in Germany. A visa is not required for visits of up to 90 days in an 180‑day period for nationals of those countries for which the European Community has abolished the visa requirement.

Under German law (section 71 (2) of the Residence Act), responsibility for issuing visas lies with the missions of the Federal Republic of Germany, i.e. its embassies and consulates‑general. In principle, the Federal Foreign Office is not involved in decisions on individual visa applications, nor does it have any knowledge of the status of individual applications being processed by the missions.

Ratione loci competence (local responsibility) for issuing the visa lies with the mission responsible for the area in which the applicant has his/her ordinary residence or domicile.

Ratione materiae competence (subject‑matter responsibility) lies with the mission of the Schengen state in whose territory the sole or main destination is situated.

As a rule, missions require between two and ten working days to decide on an application for a short stay visa. Applications for visas entitling the holder to a longer stay or to take up gainful employment may take several months to process.

During the peak travel season there may be a waiting period for making an application to a German mission. Persons requiring a visa to enter Germany should therefore submit their applications in good time.

As a rule, applicants must submit visa applications, together with all necessary documents, in person at the German mission responsible for their place of residence. In order to avoid time‑consuming requests for additional information or documentation, applicants should consult the website of the respective mission well in advance of their departure date to find out about the visa procedure and about the documentation which has to be submitted.

Visa application forms can be obtained from the mission free of charge (in the local language). Applicants may also download the forms at the bottom of this page. The forms submitted must be original versions in the appropriate language of the mission in question. Application forms may also be downloaded free of charge from the website of the competent mission.

Since 5 April 2010, Regulation (EC) No. 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code) forms the statutory basis under European law in all Schengen states for the issuing of visas for transit through the Schengen area or for short‑term stays in the Schengen area not exceeding 90 days in any 180‑day period.

The Visa Code standardises the visa requirements which must be examined by the mission in the course of the visa procedure. The respective mission makes a decision on the visa application at its own discretion, taking into account all the circumstances in any given individual case.

There is no automatic entitlement to a Schengen visa.

The mission must ensure that the following requirements have been met in each individual case:

  • The purpose of the trip to Germany must be plausible and comprehensible.
  • The applicant must be in a position to finance his/her living and travel costs from his/her own funds or income.
  • The visa holder must be prepared to leave the Schengen area before the visa expires.
  • Documentary evidence must be provided of travel health insurance with a minimum coverage of 30,000 euros valid for the entire Schengen area.

Should an applicant be unable to prove that he/she can finance the journey and stay from his/her own funds, a third person may undertake to cover all costs associated with the trip in accordance with sections 66 and 68 of the Residence Act. This undertaking is normally to be made to the foreigners authority in the place of residence of the person making the undertaking.

Persons whose entry into the Schengen area would jeopardise security or public order in the Schengen states or who do not fulfil one or more of the above‑mentioned requirements, cannot be granted a visa.

Should a visa application be rejected, the applicant will be informed of the main reasons for the rejection. Every applicant is entitled to take legal recourse against the mission’s decision.

As a rule, all foreigners require visas for stays of more than three months or stays leading to gainful employment. Exemptions apply to EU and EEA (European Economic Area) citizens and Swiss nationals.

Furthermore, citizens of Australia, Canada, Israel, Japan, New Zealand, the Republic of Korea, the United Kingdom and the United States of America may obtain any residence permit that may be required after entering Germany. Citizens of all other countries planning a longer stay in Germany must apply for visas at the competent mission before arriving in the country. Such visa applications must be approved by the relevant foreigners authority in Germany, i.e. the foreigners authority in the place where the applicant intends to take up residence. If the approval of the foreigners authority is necessary before a visa can be issued, the procedure can take up to three months, in some cases longer, since the foreigners authority will often consult other authorities (e.g. the Federal Employment Agency). Missions may only issue visas once they have obtained the approval of the foreigners authority.

Visas entitling holders to take up gainful employment often do not require the approval of the foreigners authority, which speeds up the application process.

Visa application forms for a long‑term stay (longer than three months) can be obtained from the relevant mission free of charge. They can also be downloaded here (German, English, French, Italian). The forms submitted must be original versions (at least two sets) in the appropriate language of the mission in question. Please contact the mission beforehand to find out exactly which forms are required.

The foreigners authorities are also responsible for measures and decisions pertaining to residence law for foreigners already residing in Germany. Foreigners authorities are not subordinate agencies of the Federal Foreign Office, and the Federal Foreign Office cannot influence their decisions. They are in fact accountable to and operate under the supervision of the respective interior ministries and senators of the Länder (federal states).

As a result of Regulation 265/2010 it is now possible for anyone in possession of a national visa (D visa) and a valid travel document to move freely in the Schengen area up to three months in any six‑month period.

The possibility of downloading and filling in visa application forms online, and then taking the completed and printed out form to the interview at the visa section where they can be scanned in electronically via a barcode has done much to reduce the time required to process the application at the visa counter. In addition, many German missions have introduced an electronic appointments system to help manage the number of visitors to the mission and thus shorten waiting times.

The increasing number of visas issued which entitle holders to multiple short stays in the Schengen area over a long period of time means it is no longer necessary to submit visa applications repeatedly. This option is of particular benefit to persons who have to travel frequently for professional or private reasons and have proven their reliability by using previous visa legally.

In future all missions will electronically scan in applicants’ fingerprints when accepting visa applications. This biometric procedure will be introduced gradually region by region, probably by the end of 2014. Once a person’s fingerprints have been scanned in, an interview at the mission will only be necessary in exceptional cases when submitting a visa application. A renewed biometric procedure is envisaged after five years.

Write an Appeal Letter

  • The Embassy will advise you to appeal within one month if you think the rejection was incorrect. The appeal letter should be written on an objective basis. In other words, you should state why you think the rejection was incorrect. For this firstly you have to identify the reasons that led to the rejection. You should identify the basis of fact or law to be reconsidered. The appeal letter has to be in a convincing manner providing strong reasons. Some more pieces of evidence can be presented to prove the eligibility and reverse the rejection decision.  
  • You should know that each embassy has its appointed time within which you must submit your appeal letter. Also please note, that submitting an appeal letter does not guarantee that you will be granted your visa. 

Reapply for Your Student Visa

You also have a chance of re-applying for your student visa to Germany. You can solve the reasons behind the rejection and reapply with a fee of 60 EUR. The processing time is around 25 days. But for this to succeed, you must identify and learn from your mistakes. Gather all the necessary documents, prepare for the interview correctly, and correct the reasons which might have contributed to the student visa rejection in the first place.
