Cork hotel ordered to pay €11,000 to Traveller family after it cancelled Confirmation booking

A FOUR-STAR CORK hotel has been ordered to pay €11,000 to members of a Traveller family after it cancelled a booking to celebrate a Confirmation.

The Workplace Relations Commission found that the family felt “humiliated” after they were “ushered out of the hotel” in Ballincollig, Cork.

Adjudication officer Thomas O’Driscoll said the family were left with the “great disappointment of not being able to celebrate an especially important occasion” as a result.

Margaret O’Sullivan, her sister Theresa O’Sullivan and her partner Joseph O’Donovan took the case against Oriel House Hotel through representation by the Free Legal Advice Centre (Flac).

The complaint of discrimination was made under the Equal Status Acts after the family’s booking for dinner and accommodation to mark her child’s Confirmation was cancelled upon their arrival at Oriel House Hotel.

Meal and accommodation

Margaret O’Sullivan told the WRC that her daughter had her Confirmation on 6 July 2021, and it was decided that they would celebrate by having an evening meal in a hotel as well as accommodation for the night.

She booked four rooms, an evening meal and breakfast for members of her family, including children, by phone at the hotel with the full sum of €600 paid up front.

She described how her children were extremely excited and had dressed up for the day, but she felt “uncomfortable” upon arrival after one staff member had noticed the family.

O’Sullivan said that when she reached the hotel desk, the first response from staff was to say “Sorry, we’re overbooked”, but when the complainant said that they had reservations, the family were told that their rooms were being cleaned.

Overbooking

Shortly after, two managers approached the family in the lobby. They were told that there was an overbooking and that accommodation could not be provided.

Margaret O’Sullivan told the WRC that this deeply upset her children, but alleged that no additional support was given by management, and they were “scurried” out of the lobby in front of other people.

During this conversation, the WRC heard that there was no mention of the meal they had booked, nor of an offer of alternative accommodation, but rather that that it was offered that taxis would be called for them.

Later, in the car park, one hotel manager then “took a wad amounting to €600 euro in cash that he was holding” and gave it to Theresa O’Sullivan for the booking.

In evidence, Margaret O’Sullivan said she believed that she was discriminated against because she was a member of the Traveller community and described how humiliated and hurt she felt in the refusal of the hotel to provide accommodation.

In his decision, adjudication officer O’Driscoll said that the eldest of the family’s children “knew the reason for refusal” by the hotel.

After finding that the family had been subject to unlawful discrimination, the adjudicator stated that he “found it hard to accept that the practice of a four-star hotel would be to corral discommoded guests with children, who were not members of the Traveller community, quickly out of the lobby in front of other people and offer them a substantial wad of notes as a refund in the carpark”.

O’Driscoll rejected the hotel’s assertion that the refusal of service was due to an overbooking on the basis of “inconsistencies” in its evidence and the absence of documentation which supported its explanation.

“…Fundamentally, the manager contradicted her own evidence when she stated that overbooking occurs “one or two days a week” when a record she exhibited showed that the only night the hotel was overbooked was the night the complainant had booked,” O’Driscoll said.

Furthermore, even if there had been an overbooking, I found it hard to accept that the practice of a four-star hotel would be to corral discommoded guests with children, who were not members of the Traveller community, quickly out of the lobby in front of other people and offer them a substantial wad of notes as a refund in the carpark.

The hotel was ordered to pay a total of €11,000 to the complainants who were “gravely affected” by the discriminatory treatment.

FLAC managing solicitor Sinéad Lucey said that FLAC welcomed the decisions in the family’s favour. 

“As well as being extremely important to our clients, these decisions include a number of important clarifications of the provisions of anti-discrimination law. The Adjudication Officer affirmed that cases against hotels concerning ‘accommodation and ancillary services’ should be heard by the WRC and not the District Court,” she said. 

“He also found that providers of goods and services may be taken to have ‘implied knowledge’ that people are members of the Traveller Community on the basis of their “distinct style of dress” – which he described as a “a badge of ethnicity and part of a culture of which the Complainant stated, Travellers proudly uphold”.

The family’s cases were referred to Flac by the Traveller Equality and Justice Project at University College Cork.

FLAC chief executive Eilis Barry said that instances of discrimination such as that experienced by their clients “deprives Travellers of the opportunity to celebrate life’s important events” in the same manner as the wider population.

Barry added that it effectively gives rise to “cultural segregation” of Travellers in society.

Armed gardaí swoop on feuding travellers

Gardaí raided the park after a YouTube video featured masked men firing guns into the air

More than 60 gardaí have raided a traveller camp in Cork to prevent a feud between two families turning violent.

Officers seized a bow and arrow, slash hooks, a golf club and a suspicious liquid stored in containers which has not been identified.

The raid followed the sharing of a video on YouTube in which at least two dozen masked travellers armed with machetes, batons and guns threatened another family.

Armed gardaí from the Regional Support Unit carried out the raid at St Anthony’s Park traveller camp in Hollyhill, Knocknaheeny, Cork city. They climbed ladders to search the eaves and gutters of houses and could be seen walking in a line through land next to the camp.

Sniffer dogs and the drug unit were also involved in the raid, which began at about 9am. Gardaí guarded the grotto at the entrance to the park. The search also extended to a housing estate in the north side of the city.

In the YouTube video, which was filmed at night, all of the men are carrying machetes, slash hooks, batons or other weapons.

One man in the centre of the group called his rival “one-eyed” and “an albino” and said that his group “wouldn’t lower ourselves to fight you”. The rival family, who are also from Cork, were told that they would be run out of the county. At the end of the video two men fired what appeared to be sawn-off shotguns into the air and all the men advanced towards the camera, holding up their weapons and shouting abuse at the rival family.

The previous day the person who uploaded the video had posted another film of two traveller men who had broken into a house. They can be seen running from the house armed with weapons while the owner chased after them.

The video is taken from a security camera beside the house and the narrator taunted those who fled and said that that would get the “dirty fight” they were looking for.

In less than a fortnight Cork will host a Unesco education conference at which traveller groups will be represented. The two-day event begins on September 18 and will feature delegates from around the world.

Last month Cork county council refused planning permission for a traveller grazing site on the outskirts of the city after opposition from residents.

The Cork Traveller Visibility Group had hoped to take over the 14-hectare site at Leemount and lease it to families so that they could graze 20 horses.

A frightening video was posted online on Tuesday night showing a group of men making threats to their traveller gang rivals.

Gardai are on high alert after two videos were posted showing the groups from Cork city declaring war on eachother.

In both clips, large mobs can be seen wearing balaclavas and goading the other side to come out and fight them, CorkBeo reports.

The first clip starts with a man telling the group's rivals that they will "come out in the next hour" and that they have "a load of people behind us".

He then tells the gang to "come out tonight and we will fight today and we will go dirty".

A second man approaches the camera and says "get everyone of ye out today and we will put this to bed once and for all".

The other gang involved in the feud, who are based in another part of Cork city, quickly responded with their own clip agreeing to take them on.

The video contained similar threats with a man saying they'd "cut heads off" and that "whoever is caught is getting butchered".

Gardai reacted to both quickly and had teams out monitoring the situation.

The rise in tensions come just days after another clip emerged showing a 13-year-old from one of the families waving a slash hook and making threats.

A man can also be seen wearing a balaclava before name-checking members of the families involved.

He goads his target saying they "didn't have the b*****ks" to come out and fight" before bringing a kid, 13, into the picture.

The child then makes threats saying: "When you're caught you're dead. When I see you you're getting that" before gesturing to the slash hook and holding his fist up.

"This way or what way you're getting it, you and your BMW, I'm going to scrap this on time on your mouth. I'm your boss."

The man then jumps back into the shot before making more threats screaming "one of you will be getting it, we'll cut you in bits".

Another smaller kid can be seen beside the man also holding a slash hook.

The two feuding families involved in so called "Call Out" videos shared widely on social media in Cork recently have made a further video, in which they say they have reached a peaceful settlement.

The two families - the McCarthys and the Stokes - have moved to calm tensions between them following the intervention of another north Cork family.

The apparent agreement between the families will be welcome news to the wider community on the north side of the city where tensions had been rising in a week that had already seen a number of unconnected violent incidents.

In the video, in which the faces of the men involved are not shown, three men identifying themselves as Martin McDonagh, Denis Stokes and Ciaran McCarthy talk about their desire to calm a situation that many feared could have been getting out of control.

The men thank Martin McDonagh and his brothers, from Kilmallock, for stepping in between the two families to see if any further conflict could be avoided and tensions lowered.

It appears from the video that the family representatives met under the auspices of the McDonaghs and both men now say it is time to move on in peace.

A man identifying himself as Ciaran McCarthy tells the camera; "There is peace now between the two families. Whatever happened before was a misunderstanding between young fellas.

The response comes after two separate call out videos were posted online threatening violence against the families last week.

The first call out video between the two groups was posted last week where one of the groups promised to beat their rivals to death.

In the video, a group of masked men in poor lighting shout threats down a camera, they appeared to be armed with machetes and more weapons.

The apparent ring leader says: "We are waiting here all evening for ye to come up, ye are saying we are getting away with things, we are baiting ye all our lives and there's nothing ye can do about it.

"And the likes of any of ye we get around these roads, we are going to beat ye to death ye dirty t****s."

The group then raise their weapons and end the video with some loud roars as they approach the camera.

A reply video was then sent by the other group in which a man appears to be armed with a machete and calls-out their rival gang and says "they are not getting away with no more".

As the man makes the threats the large group of masked men behind him cheer and raise their weapons as more violence is promised.

Cork feud family warned not to post any messages to Facebook

A father, son and nephew have been warned not to post any messages on social media to a rival family with whom they have a feud or they will end up in jail.

Gerard Stokes (45), his son, Gerald Stokes (19) and his nephew, Patrick ‘Paidin’ Stokes (20) of Hollyhill in Cork appeared before Cork District Court where they were told they faced imprisonment if they made any contact with the rival family.

Judge Olann Kelleher said the terms of bail the for the three men would be considered breached if they posted messages on Facebook or any form of social media aimed at the McCarthy and Faulkner families.

The three men were charged with violent disorder at the Blarney Filling Station in Co Cork on April 16, as part of an ongoing feud between the Traveller families.

Paidin Stokes was also charged with producing an article, namely a hurley in the course of the dispute at the filling station.

The men agreed to abide by terms of bail set down by gardaí during the court hearing.

The incident, where a member of the Faulkner family was assaulted, was filmed by another man and posted online. 

It is the latest in a series of social media posts where the two factions have threatened violence against each other.

Det Garda Mossie Leahy gave evidence of arrest, charge and caution in relation to all three men. 

He told the court that none of the trio made any reply to the charges when they were put to them after caution.

Inspector Denis Lynch said that gardaí had no objection to bail once the men were willing to abide by a number of stringent bail conditions.

Gardai asked that Gerard and Gerald Stokes continue to live at their home address at St Anthony’s Park, Hollyhill. 

They also wanted Paidin Stokes to reside at his home at a separate address in the same park.

Gardai said that they wanted the men to sign on at Gurranabraher Garda Station three times a week and to have no contact direct or indirect with the named families.

Det Garda Leahy said gardaí were also seeking for all three accused to abide by the government’s 2km limit on movement during the Coronavirus pandemic and any further restrictions that the government might introduce.

Free legal aid was granted in the case as none of the men were employed. Judge Kelleher remanded the men on bail to appear in court on May 13th.

Feuding Galway factions enter into tentative mediation talks after spate of violence across city

The feuding factions involved in a shocking violent incident in a Galway shopping centre car park last weekend are entering into tentative mediation talks, the Irish Mail on Sunday has learned.

Martin Collins, Pavee Point codirector, said the Athlone-based National Traveller Mediation Service is trying to intervene and ‘broker some discussions’.

‘I understand there is some work on that [mediation] taking place… over the weekend,’ Mr Collins told the MoS.

‘I obviously welcome that and I hope that the disputing parties will get involved and hopefully try and put the issue to bed.’

However, Mr Martin cautioned that attempts to bring both sides of the dispute into a mediation process are challenging.

‘I would say, any kind of peace process – if I can call it that, not to be too alarmist – talks can break down,’ he warned.

‘I think that is inevitable in some respects, but I would encourage people to stick with it and to keep on trying.’

Four people required treatment in hospital after a car collided with a group of people at a shopping centre on the Headford Road, Co. Galway, last Sunday.

A large number of people were involved in the car park altercation, which was filmed and widely shared on social media.

The incident was linked to an ongoing feud between two Traveller families in the Galway area.

A number of raids were carried out by gardaí this week across numerous areas in Galway following a spate of violence across the city. Gardaí seized several weapons and vehicles at Headford Road on Sunday evening.

A Garda spokesperson yesterday confirmed three more people were arrested in connection with the incident, bringing the total number of arrests to 15. A Garda public order unit is now on standby to deal with potential further violence.

Responding to public concern about the scale of the violence, Mr Collins said: ‘It is important that people don’t suggest this behaviour is inherent in our culture because that stereotype has been peddled and it is not acceptable.

‘It is not inherent in our culture – it is not inherent in our ethnicity.

‘These are just a number of individuals who are engaging in dangerous behaviour, and it is not representative of the Traveller community, so I hope the majority of the population will not further stigmatise Travellers because of a behaviour of a few. Those who are guilty need to be prosecuted and those who are innocent should not be persecuted.’

Asked why Pavee Point had not come out to condemn the violence before this, Mr Collins explained: ‘The situation is we didn’t want to be the first in the media. We have been a little bit reluctant to make any media comment.

‘We wanted the media to confirm whether or not it was members of the Travelling community and effectively, by us engaging with the media, we were doing that, so there is an issue here of principle.

‘I think The Pat Kenny Show was the first mainstream media outlet to reference the fact they were Travellers – I’m not aware of any other mainstream media. We think it is really unnecessary for people to emphasise the ethnicity of the people concerned.

‘It is totally irrelevant. It’s not an issue – it just so happens that they are Travellers.

‘Of course, this is in a wider context of antisocial behaviour and feuding right across the country and we have seen that in the North Inner City [in Dublin] in the last while where various incidents have taken place and some tourists have been attacked and I haven’t seen anybody in the mainstream media identifying their ethnicity as members of the settled community. I think there is an issue of ethics here and fair play, so we don’t think it’s really necessary in our view to emphasise the ethnic affiliation of those concerned – it’s irrelevant.’

Mr Collins urged the people involved in the feud to ‘exercise restraint’.

He told the MoS: ‘We don’t want to see any further escalations of tensions because there is a real potential of people being seriously hurt – or worse, some people potentially losing their lives – and we would call on the parties concerned to engage in mediation.

‘It’s in the public domain now that they are members of the Travelling community. I just hope that people won’t generalise and stereotype all Travellers as inherently violent. This is not representative of the Travelling community. The vast majority of Travellers are just getting on with their lives leading a peaceful life. So I hope people won’t generalise and use this as a stick to beat all Travellers with.’

Gardaí in Galway continue to appeal to those who were in the College Road and Headford Road areas in Galway, between 5.45pm and 6.45pm on Sunday evening, and observed any violent behaviour, to contact them. Individuals with camera footage from the area – including dash cam recordings – are urged to provide this material to the gardaí.

A chainsaw was one of the weapons allegedly produced during a “horrible, unsavoury” incident last Sunday afternoon at an Ennis housing estate.

At Ennis District Court after viewing CCTV evidence of the flashpoint at Davitt Terrace, Cloughleigh at 12.30pm last Sunday afternoon, solicitor for three accused men in the case, Daragh Hassett, admitted the video “is not Bord Fáilte material for Ennis”.

On Wednesday, Mr Hassett told the court: “It is unsavoury. It is horrible and it shouldn’t have happened but my clients say they are not guilty of the charges before the court.” 

Mr Hassett said the CCTV footage produced by the State doesn’t help the State case in the charges against his clients.

Mr Hassett said the footage showed one man with an “active chainsaw”, who is not one of his own clients.

Objecting to bail against the three accused, Bernard McDonagh, 55, Thomas McDonagh, 21, and Michael McDonagh, 32, all of the unofficial halting site at Kilrush Rd, Ennis, Detective Garda Noelle Bergin said a feud between two sides of the wider McDonagh family is currently "volatile".

The charges against the three McDonaghs arise from the three allegedly going to the property of cousins at Davitt Terrace, Cloughleigh, last Sunday afternoon.

Thomas McDonagh is charged with producing a slash hook during the incident while Bernard McDonagh and Michael McDonagh are each charged with producing a knife in the course of a dispute.

Thomas McDonagh is also facing three counts of alleged criminal damage.

Det Bergin said: “This is an incident which is part of an ongoing feud between two Traveller families. A number of persons arising from this feud are currently before the courts charged with serious offences.”

She said: “It is the Garda belief that tensions between both sides are extremely high”.

Det Bergin added that Bernie McDonagh is the father of the McDonaghs and alleged he “is the driving force behind the feud at this time”.

Mr Hassett said his instructions are that "there is no feud, there is nothing to row about”.

The solicitor said there are tensions around the recent death by suicide of a man in the wider McDonagh family “and about the acceptance and non-acceptance by family members about what could have been done to stop their relative from taking his own life. This will be resolved in time."

Mr Hassett said one of his clients, Michael McDonagh “lost a child recently and that has been used by his cousins to taunt him”.

He said one of the complainants against his three clients put a video on YouTube that injuries he got were self-inflicted to try to bring charges against someone else.

Mr Hassett said his clients live in an unofficial halting site that was a recent "cause celebre" in the Supreme Court where the court decided the McDonagh family should stay there.

He argued that bail could be granted to his clients with strong conditions, such as daily signing on and curfews with a cash lodgement.

However, Judge Mary Larkin refused bail to all three and remanded them in custody to re-appear in court via video link on June 8 next.

US comedian reacts to 'brilliant' Irish pastime and vows to bring it to Los Angeles

A merican tourists visit Ireland for all sorts of reasons - to trace family trees, to see the stunning monuments, to sample the famous cuisine - but it looks like there's a new attraction on the rise, as one US TikToker has introduced road bowling to his millions of viewers.

It's a quintessential sport in Co Cork and Co Armagh, dating back to the 1600s. The rules are straightforward: a thrower tosses a metal ball along the road, and a mark is made wherever it lands.

The ball is thrown again in this way until the course is complete. The winner is the bowler who gets the ball to the end of the route with the fewest throws.

Los Angeles comedian Lawrence Johnson came across a clip of Irish men road bowling and took straight to TikTok to share it with his followers: "Why have I just discovered road bowling, and secondly, why do we not have it in America?"

He explained the sport to his viewers and explained: "1600s, Cork, Ireland - the first ever people to ever do it." He added: "This my new Sunday activity I want to be a part of. I will be out here every Sunday in LA road bowling until I find my opponents in my community."

Lawrence isn't the first person outside of Ireland to find his interest piqued by road bowling. In 1957, the British British Pathé newsreel company visited Cork City to shoot a little feature on the sport. The reporter explained that road bowling was banned by the Brits in the 1700s as a "dangerous and revolutionary game":

50 years later in 2007, an RTÉ crew flew to a village named Ireland in West Virginia, where the locals enjoy a spot of road bowling themselves. Father Jerry McSweeney, a priest from Co Cork living in West Virginia, said it was "tremendous" to see the Americans carrying on the Irish tradition.

It's not just Americans who love to watch a bit of road bowling. In January, English 80s kids TV star Timmy Mallet was enthralled by a game between Co Armagh and Co Cork while visiting Ireland.

As a game with such simple rules and universal appeal, it seems road bowling is here to stay - surviving a ban by the Brits, migration to the US, and now even TikTok fame .

ELEVEN MEN were taken to waiting prison vans at the Circuit Criminal Court in Tralee and ferried to two different prisons to begin jail terms of between six and 16 months after they withdrew appeals against sentences handed down last month for offences arising from an ongoing Traveller feud in Co Kerry.

Committal warrants were issued for three others who failed to appear but who were also withdrawing their appeals, solicitors told Judge Carroll Moran.

The appeals lodged were against the severity of sentence. A special sitting of the Circuit Court had been scheduled in Tralee to deal with them. The 14 had been convicted of a range of offences at a special sitting on November 13th including possession of weapons, assault, affray, criminal damage, rear-ending of vehicles and public order offences on a number of dates this year in Tralee.

All had been released on bail since lodging their appeals. Gardaí manned checkpoints outside the court and set up search rooms at the entrance to the court precincts. Barrister Brian McInerney, representing several of the appellants, asked Judge Moran that a number of named men be accommodated in different prisons, saying there was “a reason” for the request.

Judge Moran said he had no power to grant the request, but recommended it be complied with.

Michael Quilligan, Martin Quilligan, Chris Fitzgerald, Denis Fitzgerald, John Casey and Jimmy Quilligan are to be held in Portlaoise Prison, while Christopher Quilligan is to serve his sentence in Cork Prison. All had pleaded guilty to charges related to violence between the Quilligan and Coffey clans who are supported by other Traveller families in the Tralee and Castleisland areas.
