A Dubai tourist visa holder has cried foul after he claimed he was “misled” into working for a company in the emirate while on tourist visa.

The individual, who opted to remain anonymous, said that he was under the impression that the company was in the process of applying for his residence visa. “At the 20-day mark, my tourist visa expired and I had to extend it at my own expense,” he said, adding that he continued to work for the company for a total of 37 days before he eventually resigned. He was partially compensated 20-days worth of salary, and asked a Dubai social media forum what his rights were.

“Move on, you might get into more trouble. Ignorance of the law is no excuse,” a social media user advised, echoing similar sentiments in the online forum. So what does the UAE law say about working in the country while under tourist visa, or even a visit visa for that matter?

Under UAE laws, it is illegal for visit visa or tourist visa holders to work in the country without a valid work permit issued by the Ministry of Human Resources and Emiratisation (MOHRE) or any free zone authority.

“The foreigner who obtains a visit visa may not work anywhere in the country with or without pay or for his own,” the law states. Violators face a fine and deportation, while companies that hire them will be subject to a fine of Dh50,000.

To be employed in the UAE, individuals must first obtain a work permit from MOHRE or any relevant free zones in the UAE. A UAE residence visa will then be issued.

The UAE Government has repeated warned tourists and visitors working in the country while under visit visa or tourist visa.

“Visitors and tourists should be aware that it is illegal to work in the UAE with or without pay while being on a visit or tourist visa,” according to the UAE Government in its website. “Violators may be liable to fines and deportation,” it added.

Hundreds of thousands of people come to the UAE on tourist visa or visit visa, with many using these visa types as a way to find work here. It is not illegal to apply for jobs in the UAE while on tourist visa or visit visa.

To make it simpler for people to enter the UAE to find work, the UAE Cabinet introduced a Job Exploration Entry Visa, also known as the jobseeker visa.

I have lived in the UAE for close to four months now. I am a domestic worker and serve as both maid and tutor to two children. My visit visa expired three months ago and my boss renewed it for 60 days after a delay of one month.

I joined an event company under DMCC in October last year. Following the interview, I returned to India and waited for my visa and tickets. But the company requested that I buy my own ticket and come on a tourist visa. When I came and gave them my documents for the employment visa, it never happened and the company kept putting it off. I was even asked me to exit the country twice to renew the tourist visa. In the end, I left the company when the department closed. The company owes me Dh18,000 - roughly 1.5 months' salary - which they have delayed for five months. I have tried contacting them many times. I know there is an internal body in DMCC to solve disputes, as well as labour courts. But if I go, will I be liable as I did not have any work visa. I only have the offer letter from the company and various e-mails.  

Pursuant to your questions, DMCC applies Federal Law No. 8 of 1980 of UAE regarding Regulation of Employment Relations (the "Labour Law'). It is illegal for an individual to work without a valid employment contract/visa approved by the Ministry of Human Resources & Emiratisation ("Ministry of Labour") or the concerned Free Zone Authority. Employing or getting employed in the UAE without valid employment contract/visa is a criminal offence in accordance with Article 11 of the Federal Law No. 6 of 1973 Concerning Immigration and Residence, states: "The alien who obtains a visit visa may not work anywhere in the country with or without pay or for his own. If the visa is issued to work for an individual or an establishment, holder may not work for another individual or establishment without the written consent of that individual or establishment and the approval of the Directorate of Nationality and Immigration". Any entity employing a person who is in the UAE on a visit visa is equally guilty as the person who takes up employment on visit visa. Two-month notice must for rent increase I'm living in a flat in Abu Dhabi for which contract renewal is coming up. Until this moment, I haven't got any increase notice from my landlord. I'd like to ask whether rent can be increased at the time of renewal without notice? Or is there a mandatory notice period that must be given before any rent increase? Law No. 20 of 2006 of the Emirate of Abu Dhabi regulates the relationship between the landlord and tenant (the "Rent Law") which is further amended by Law No. 4 of 2010 of Abu Dhabi (the 'Amended Rent Law'). The landlord can increase the rent up to five per cent by serving two months' notice before expiry of the tenancy term. Article 20 (1) of the Rent Law states: "Tenancy contract shall remain valid until end of the period specified. It may be renewed for identical period(s) unless either party declares willingness in writing to evacuate the subject of contract. For residential places, declaration shall be made in writing two months before the contract date of expiry". Amended Rent Law states that the landlord has legal rights to ask a tenant to vacate upon expiry of tenancy contract and could reject renewal but with the 'Notice of Eviction' as specified in the said law which is two months' notice for residential properties. In the case the landlord does not provide any notice of eviction or rent hike within the period mentioned above, the rental contract may be renewed on the same terms and amount. UAE Digital Government issues advisory for expats on residence visa cancellation

Abu Dhabi: You must ensure your UAE residence visa is cancelled properly when you decide to leave the country permanently, as failure to close the residency status may result in complications in case you want to return to the UAE in the future.

The advisory has been shared on the website of the UAE Digital Government (u.ae).

Expats relocating to another country must also cancel the UAE visa of residents whom they have sponsored, such as family members.

The UAE Digital Government, through its website, states: “If you a have a [UAE] residence visa sponsored either by a family member or by your employer, and you decide to leave the country permanently, your residence visa must be cancelled officially.”

The website points out: “Normally, only the sponsor can cancel your residence visa. You cannot process the application on your own.”

What companies must do

If a company decides to cancel an employment visa of its employee, it must first approach Ministry of Human Resources and Emiratisation (MoHRE) with an application to cancel the employee’s labour contract and labour card. The employee must also sign this application. Then, the employer should apply to ICP (Federal Authority for Identity, Citizenship, Customs and Ports Security) for visa cancellation.

The company must also cancel the work permit. For this, it must submit a letter to MoHRE signed by the employee stating that he or she has already received all the dues, wages and end of services benefits from the employer.

What about individuals who are sponsors?

Individuals sponsoring their spouse, children and other dependents must cancel their dependents’ visas before they cancel their own visa. It normally costs around Dh110 to cancel the visa.

The UAE Digital Government explained that according to the procedures, only the sponsor or someone they delegate on their behalf (such as a PRO, for example, in the case of companies) can proceed with cancelling the residence visa of someone they have sponsored. The sponsored person cannot implement the request without the permission and signature of the sponsor.

Valid for 5 years, the renewable retirement visa is open to retired applicants who are at least 55 years old. They must also fulfil one of these financial options: 

Option 1 Minimum yearly income of AED180,000 (approx. US$49,000 annually or AED15,000/US$4,100 per month)

Option 2 AED1 million (approx. US$275,000) savings in a 3-year fixed deposit

Option 3 AED1 million (approx. US$275,000) unmortgaged property OR mortgaged property, for which the payment to date is at least AED1 million Option 4 A combination of Options 2 and 3, with a minimum value of AED1 million (approx. US$275,000) in a 3-year fixed deposit and property (worth at least AED500,000 each)

With the multiple-entry visa, you’ll be regarded as a resident of the UAE and can therefore freely travel and enter the country at your convenience. You’ll also have access to all the standard services that residents benefit from, including telecommunications and utilities.

Once you've decided which one of the three financial options you want to apply under – savings , property or a combination of both, you'll need to prepare official documentation that proves your financial status.

All international applicants will need to send their passport copy and those of their dependents (if any), along with a copy of their marriage certificate if sponsoring their spouse. UAE residents will need to additionally provide copies of their current visa and Emirates ID, both for themselves and any dependents. 

Once all your documents are ready, submit your application to one of two relevant authorities, based on which financial option you choose.

Option 1: income.

A sustainable yearly income of at least AED180,000 (approx. US$49,000), which equates to AED15,000 (approx. US$4,100) per month.

Option 2: Savings

AED1 million (approx. US$275,000) savings in a 3-year fixed deposit

AED1 million (approx. US$275,000) in unmortgaged property or mortgaged property, for which the payment to date is at least AED1 million
