TripCase App

11.   Add an Item to Your Trip

Press “ Add an Item ” to open a list of activities.  Select the appropriate activity you’re trying to add, and fill-in the details (flight numbers, restaurant reservations, etc.).

TripCase App

What I Don’t Like About TripCase

TripCase is a helpful app for consolidating your travel details!  But there are some ways it can improve.

1.   Repetition in the Menus

There are multiple  ways to get to the same place inside the app.  For example, there are 3 different buttons to add an item to your itinerary.  The user interface could be simplified if they cut out all the duplicate shortcuts.

2.   No Auto-Import for Past Itineraries

If you want to import your previous adventures, you’ll have to do it manually.  The app will not scan your inbox to find your old itineraries.

3.   App Fails to Import Confirmation Numbers

This isn’t a huge deal, but the app doesn’t find confirmation numbers for hotels and car rentals.

While you rarely need to provide a confirmation number at the desk, it’s still nice to have at a glance.  You’ll have to enter it yourself if you want it in the app.

How Does It Compare to Similar Apps?

There are other apps like TripCase.  The most popular are:

1.   TripIt

I personally use  Tripit .  I like it because you can link it to other travel apps, like App in the Air , to enhance your experience outside the TripIt app.  It also tracks your various loyalty programs!

However, you have to pay $49 per year for the full benefits of the app.

2.   Google Trips

I haven’t used Google Trips  much, but I’ve heard excellent things!

When you download the app and attach your email address, your previous trips will instantly show in the app.  It’s a very clean and easy-to-read user interface.

Also, next to each destination you can download an offline map of the area.  So you’ll never get lost, even if you have no internet!

Bottom Line

This app competes with  Google Trips  and TripIt .  And while TripIt offers more features, it also costs money to access many of them.  With the TripCase app , you’ll receive real-time flight alerts for free.  That’s something TripIt charges for!

If you’re looking for a free app to help organize your travel, this is one of the best out there!

Traveling After PERM Approval: Timeline for Filing I-140 Petition

If the perm is approved before your travel, you must submit the i-140 petition as soon as possible. consider perm travel considerations and time frames for i-140 after perm approval..

Traveling After PERM Approval: Timeline for Filing I-140 Petition

Key Takeaways:

  • Understanding the PERM process for obtaining a green card and the importance of timing in filing subsequent immigration petitions.
  • The need to submit the I-140 petition within 180 days of PERM approval and how to handle travel during this period.
  • Tips for ensuring travel does not disrupt the immigration process, including notifying employers/attorneys, reviewing visa requirements, and maintaining immigration status.

Traveling Abroad While Your PERM is Under Process: What You Need to Know

Planning a trip abroad can be exciting, but it also requires thorough planning—especially when you’re in the midst of an important immigration process. If you’re an individual with a PERM (Program Electronic Review Management) labor certification application in progress, navigating the timing of your travels and subsequent steps in your immigration journey is critical.

Traveling After PERM Approval: Timeline for Filing I-140 Petition

Understanding PERM and Its Importance in the Immigration Pathway

Before we delve into the specifics of travel during the PERM process, let’s briefly understand what PERM is all about. PERM is a procedure for obtaining labor certification and is the first step for certain foreign nationals in obtaining an employment-based immigrant visa (also known as a green card). This procedure is crucial as it demonstrates that there are no suitable U.S. workers available for the position being offered to a foreign worker, and that hiring a foreign worker will not negatively affect the wages and working conditions of similarly employed U.S. workers.

What Happens After Your PERM Gets Approved?

When your PERM application is approved, it’s like clearing a major hurdle on the way to your green card. The next step in this journey is to submit the I-140 Immigrant Petition for Alien Worker. This is where timing becomes particularly important. Normally, once your PERM is approved, the I-140 petition should be filed with the U.S. Citizenship and Immigration Services (USCIS) within 180 days to avoid the expiration of the PERM certification.

PERM Travel Considerations: Navigating Your Travel Plans

If you are anticipating or planning to travel abroad while your PERM application is still pending, it’s essential to be well-informed about the implications and necessary actions to take if your PERM is approved during your trip. This knowledge is crucial because your ability to return to the United States and pursue your green card could be affected by your travel decisions.

Also of Interest:

Google calls for us ai immigration policy reform to attract talent, immigration advocates urge tighter border security for air travel, when to submit the i-140 petition after perm approval.

An often-asked question among PERM applicants is: “If the PERM gets approved before my travel, how soon do I need to submit the I-140 petition?” As a rule of thumb, the I-140 petition should be filed as soon as possible, ideally immediately after the PERM approval. However, the mandatory time frame is that the I-140 needs to be submitted within 180 days of the PERM approval.

It’s important to note that during this period, if you are outside the country when the PERM is approved, your employer or attorney can still file the I-140 petition on your behalf. This process can continue without requiring your physical presence in the United States. Nevertheless, ensuring open communication with your employer and attorney is essential to ensure that this is done timely.

Ensuring Your Travel Does Not Interfere with the Immigration Process

While planning your travel, here are a few steps you should consider to make sure your trip does not interfere with the immigration process:

  • Notify Your Employer and Attorney: Keep your employer and attorney informed about your travel plans, so they can make necessary preparations and file any required documents in your absence.
  • Review Visa Requirements and Expiration: Ensure you have a valid visa for reentry to the U.S. Check the expiration date and the number of entries allowed; if you need to apply for a new visa, consider the time it will take to secure it.
  • Carry Essential Documents: Have copies of essential documents, such as your Employment Authorization Document (EAD), Advance Parole document if applicable, and any other documents that relate to your immigration status.
  • Maintain Your Status: It’s crucial to maintain your immigration status in the U.S. If you’re on a temporary work visa, like an H-1B visa , you should also ensure you follow all the regulations attached to your visa type.

Advice for Smooth Immigration Processing

“Maintaining accurate and up-to-date information with your immigration attorney is vital for seamless processing of your documents,” says one immigration expert. It’s a sentiment that rings true for every step of the immigration process, and especially when coordinating PERM and travel considerations.

Final Thoughts

Traveling outside the U.S. can be complex for immigrants awaiting their PERM approval. By understanding the timeline for submitting your I-140 petition after PERM approval and making preparations for a successful reentry into the U.S., you can ensure that your trip does not disrupt your long-term immigration plans. Remember the key 180-day deadline for the I-140 filing post-PERM approval, consult with your immigration attorney, and stay informed about the latest developments by visiting official immigration resources such as USCIS .

Safe travels and best of luck on your journey toward U.S. permanent residency.

Still Got Questions? Read Below to Know More

Can i start a new job in the u.s. immediately after returning from abroad if i just received my perm approval while i was away.

When you receive your PERM (Program Electronic Review Management) approval, it means that the U.S. Department of Labor has approved your employer’s application to hire you for a permanent position. However, PERM approval is just one of the steps in the process of acquiring a green card (lawful permanent residency) in the United States.

Before you can start your new job in the U.S., especially if you are transitioning from a different type of visa to an employment-based visa, your employer must complete the next steps, which include:

  • Filing of an immigrant petition (Form I-140) with the U.S. Citizenship and Immigration Services (USCIS).
  • After the I-140 is approved, you must apply to adjust your status to a permanent resident or go through consular processing if you’re outside the U.S. Only after you have adjusted status or received your immigrant visa through consular processing, can you start your new permanent job.

If you are already in the United States on a valid non-immigrant work visa (such as an H-1B) and your PERM application is for a future permanent job (not the one you currently hold), you may generally continue your current job, but you cannot start the new permanent job until the entire green card process is completed.

For the most authoritative and current information, always refer to the official USCIS website or consult with an immigration attorney. – USCIS official website for Green Card processes: USCIS Green Card – Department of Labor’s PERM process information can be found here: DOL PERM

Can I renew my work visa while my PERM application is being processed if I’m currently abroad?

Certainly, if you currently hold a U.S. work visa and are abroad while your PERM (Program Electronic Review Management) application is being processed, you can generally renew your work visa. However, the process for renewal depends on several factors, such as the type of work visa you have and the specific rules that apply to it. For example, if you have an H-1B visa, which is common for specialized workers, renewal while abroad typically involves the following steps:

  • File the Visa Renewal Application : You must file a renewal application with the U.S. consulate or embassy in your country. This involves submitting a Form DS-160, Online Nonimmigrant Visa Application.
  • Provide Supporting Documentation : Along with the application, provide the supporting documents required for your specific visa category. Typically, this may include evidence of your ongoing employment, such as a letter from your employer, and proof that your PERM application is in progress.
  • Attend a Visa Interview : Once your application and documents have been submitted, you’ll usually need to attend an interview at the embassy or consulate.

Keep in mind that the approval of your work visa renewal is independent of the PERM process. The Department of State (DOS) and U.S. Citizenship and Immigration Services (USCIS) handle visa renewals, whereas the Department of Labor (DOL) manages PERM applications. Therefore, the processing of your PERM application does not directly affect your ability to renew your work visa.

To ensure accuracy, always check the latest guidelines and procedures on the official websites, such as: – U.S. Department of State – Bureau of Consular Affairs: Travel.State.Gov – U.S. Citizenship and Immigration Services: USCIS – U.S. Department of Labor – Office of Foreign Labor Certification: Foreign Labor Certification

Remember to also take note of any changes to immigration policies that may have occurred since the knowledge cutoff date for this response.

Is there a risk of my ongoing PERM process being canceled if I have to leave the U.S. for an emergency trip?

The PERM (Program Electronic Review Management) process is the first step for certain foreign nationals in obtaining an employment-based green card in the U.S. It involves your employer proving to the Department of Labor (DOL) that there are no willing or qualified U.S. workers for the job you are offered. If you’re currently in the U.S. and you have to leave for an emergency trip, it does not directly affect your ongoing PERM process since the PERM application is employer-driven and not dependent on your physical presence in the U.S. However, there are a few important points to consider:

  • Communication with Your Employer : Keep your employer informed about your trip and ensure there is a way for them to contact you if needed. During the PERM process, your employer might require additional information or documents from you.

Status Maintenance : Make sure that your travel does not affect your immigration status. For instance, if you are on a non-immigrant work visa (like H-1B), you need to maintain that status to protect your eligibility for eventual adjustment of status (green card application). Also, ensure you have the necessary documents and approvals (like a valid visa and, if necessary, advance parole) to re-enter the U.S.

Monitoring the Process : Stay updated on your PERM application status. If your PERM is approved while you are abroad, your employer can proceed to the next step, filing the I-140 (Immigrant Petition for Alien Worker). You’ll need to coordinate with them for any required signatures or documentation.

An emergency trip should not cancel your PERM application as long as your employer continues the process as required and your immigration status is properly maintained. For the most authoritative and up-to-date information, consult with your immigration attorney or refer to the official Department of Labor website: https://www.dol.gov/agencies/eta/foreign-labor.

Remember, the key to a smooth immigration process is maintaining open communication lines with your employer and staying compliant with all immigration regulations both inside and outside the U.S.

What should I do if my job situation changes while I’m traveling and I have a PERM application in progress?

If your job situation changes while you have a PERM (Program Electronic Review Management) application in progress, it’s important to understand the potential impacts on your application and take appropriate action. Here’s what you should consider doing:

  • Notify Your Employer : Your employer is the petitioner for your PERM application, so any changes in your job situation should be communicated to them immediately. They need to assess if the change affects the application.

Consult with Your Immigration Attorney : Changes in your job situation, such as a promotion, transfer, or termination, could have implications for your PERM application. An immigration attorney can help you understand these implications and guide you on the next steps.

Maintain Documentation : Keep a record of any employment-related documents or correspondence that pertains to the change in your job situation. These documents can be crucial for any required updates to your application or in answering queries from the Department of Labor.

If the changes in your job are substantial, such as a different employer or a role that differs significantly from the one described in the PERM application, it could necessitate starting the PERM process anew. However, if the changes are minor and do not affect the material terms and conditions of employment, it might not impact your application.

Remember, the PERM application is for a specific position with specific job duties and salary. Any significant change could potentially affect the outcome of your application. Always check with your immigration attorney and refer to the official U.S. Department of Labor’s Employment & Training Administration website for more guidance: Foreign Labor Certification .

Finally, if you’ve changed jobs and the new employer is willing to sponsor you, they will need to file a new PERM application on your behalf.

“For most employment-based green card categories, if your job situation changes, your new employer must file a new Form ETA-9089.” – This is a common protocol when job changes occur in the middle of a PERM application. Always seek personalized advice, as each situation can vary.

For detailed information and guidance on the PERM process, you can visit the U.S. Department of Labor’s page on the PERM labor certification process.

How can my family’s travel plans be affected if I’m waiting for my PERM approval and we’re all on dependent visas?

If you are awaiting PERM (Program Electronic Review Management) approval and your family members are on dependent visas, there are several things you need to consider regarding travel:

  • Your family’s ability to travel internationally may be restricted because the PERM process is part of the green card application, and you may need to maintain a valid immigration status.
  • If the principal visa holder (the person with the job) travels before the PERM is approved, it could delay the process or require starting over if they cannot return in time to maintain their status or attend necessary appointments.
  • Upon re-entry to the US, immigration officers at the port of entry will check the visa status of each family member. If the dependent visa status is tied to the employment situation of the principal applicant, the pending PERM may raise questions about intent to immigrate, and officers may scrutinize whether you intend to return to your home country or not.
  • If any family member’s visa has expired, or if there are any discrepancies in your immigration status, re-entry could be denied.
  • It’s crucial that all family members maintain valid visa status throughout the PERM process. Traveling abroad could complicate this if you are unable to return before your current visa expires.
  • If the PERM application is approved while you are outside the country, and your dependent visa does not allow for dual intent, you may face complications at the port of entry upon return. Dual intent refers to the concept that a nonimmigrant visa holder can intend to immigrate to the US in the future while maintaining a legal nonimmigrant status.

To avoid any issues, it’s advisable to consult with an immigration attorney before making any international travel plans while the PERM application is pending. Additionally, you should always check the latest information and travel advisories from the U.S. Citizenship and Immigration Services (USCIS) and the Department of State.

  • U.S. Citizenship and Immigration Services (USCIS) : USCIS Homepage
  • U.S. Department of State : Travel Advisories

Traveling during the PERM process is not prohibited, but you should proceed with caution to ensure that it does not negatively impact the status of your ongoing immigration applications or your ability to return to the United States.

What is PERM? An Overview of the PERM Process

August 19th, 2020

Categories: PERM Center Work In The US

Tags: green_cards PERM_Process

If you are an immigration lawyer, an employer who has sponsored a foreign worker for a green card, or a foreign worker yourself, chances are you have heard the term “PERM” before. The PERM certification is the primary step before a foreign national can continue their journey to achieving their employer-sponsored green card and is generally required for the EB-2 and EB-3 preference categories. But what exactly does the process to achieving a PERM certification entail?

What is PERM?

PERM, which stands for “Program Electronic Review Management,” is the first step of the green card process for foreign nationals seeking permanent residence through their employment. The U.S. Department of Labor (DOL) requires a sponsoring employer to pay the prevailing wage for the position, and to test the U.S. labor market to prove that no authorized U.S. worker is able, willing, and available to perform the required job.

How does it work?

To complete the PERM process, an employer must:

  • Submit a request for a Prevailing Wage Determination (PWD) to DOL;
  • Advertise and run a recruitment campaign as specified by PERM regulations; and
  • File a PERM with DOL for certification.

The employer’s job description for the permanent position must be sufficiently detailed with a description of daily job duties, minimum education requirements, and experience and skills required of a candidate to perform the role. The job description should also specify if travel or supervisory responsibilities are required of the position.

Prevailing Wage Determination (PWD)

An employer must submit a request for a PWD to DOL. The PWD is designed to make sure that hiring a foreign worker for the permanent position will not adversely affect U.S. workers. The employer must agree to pay a “prevailing wage” to the foreign worker, which is determined based upon job classification, minimum requirements for the position, and the area of employment.

Recruitment Activities

There are several recruitment advertisements that must be placed by the employer within 30 to 180 days before filing the PERM application with DOL.  Each of these advertisements requires special details and must be carefully drafted to satisfy PERM regulations. The required recruitment advertisements are:

  • One job order placed with a state workforce agency;
  • Two Sunday advertisements in a newspaper of general circulation in the area of intended employment;
  • One internal posting notice; and
  • Three additional advertisements from a predetermined list of options.

While recruiting, employers must consider any applicants that meet the required criteria and determine if they are qualified to fill the position. However, an employer can  reject an applicant  if it is determined that:

(1) The U.S. applicant does not meet the positions minimum requirements; and

(2) Any deficiencies cannot be remedied through reasonable on-the-job training.

Recruitment activities  must meet certain DOL standards, and a detailed recruitment report must be kept on file. The employer must maintain documentation of the recruitment and be prepared to submit this documentation in the event of an audit, or in response to a request from the Certifying Officer prior to rendering a final determination.

The PERM process can take anywhere from approximately 8 to 15 months, varying based on underlying strategy and DOL processing times.

What Is The PERM Labor Certification?

The PERM labor certification in the United States is used to sponsor a foreign national worker belonging to the  EB-2 visa and  EB-3 visa  categories. This certification must be requested from the United States Department of Labor (  DOL  ).

PERM stands for Program Electronic Review Management. It is the system used to obtain permanent Labor Certification in the USA. In addition, it is the first step in obtaining an employment-based immigrant visa or Green Card.

PERM Labor Certification Considerations

  • The PERM labor certification went into effect on March 28, 2005 in the US;
  • Its purpose is to regularize and streamline work permit applications for foreign national workers;
  • Previously, this same process took years and its approval was subject to the subjective criteria of the immigration official;
  • This process is different from the Labor Condition Application (LCA), which is used to obtain temporary work visas H-1B  and  E-3 visas ;
  • DOL has a list of occupations with insufficient demand for work in the US (Annex A) established in  20 CFR 656.15,  that is, there are not enough US workers so foreign workers can apply;
  • Schedule A states that the hiring of foreign nationals does not affect the wage level or working conditions of similarly employed US workers.

required documentation for PERM labor certificate

Labor certification should not be confused with work permits ( Employment Authorization Document  – EAD). Such permits are issued to people who apply for  asylum  or  refuge in the United States  and are waiting for a response from the government.

The United States PERM Labor Certification Step By Step In 2024

The process to apply for the United States PERM labor certification consists of several steps:

Step 1: Post A Job Offer In The United States

The first step requires a US employer or company to search for a worker in the United States. Said worker may be a citizen or lawful permanent resident who can meet the requirements of the job title.

They can search for a worker through a job posting by:

  • Radio and/or television advertisements;
  • Local newspapers;
  • The organization’s website;
  • Employment organizations or job search websites;
  • Labor or employment fairs.

Generally, this process must be completed within 30 to 180 days. Such a process makes it possible to guarantee that no American resident or citizen is available or qualified to perform the job.

Step 2: Request A Prevailing Wage Determination From The DOL

The employer or US business must provide all job details and submit an online application to DOL for Prevailing Wage Determination (PWD).

Only DOL will be the one to determine the prevailing wage for the job position that the foreign national worker will have.

Said salary will be established based on:

  • Geographic location;
  • Minimum requirements for the job;
  • Job functions.

Once DOL determines the prevailing wage, this will be the wage that the US employer or business must pay the foreign national worker at the time the alien worker becomes a permanent resident.

Note : The employer can pay the employee more, but cannot pay less than what the DOL stated in the PWD. This wage determination protects workers and assures them that they will not be paid less than what is required for the job.

If you want to know more about workers’ rights, we invite you to read our article on  workers’ compensation in California .

Step 3: Recruitment Process

Once the US employer or company has received the PWD, job advertisements can be placed to assess the labor market. It should be noted that:

  • This labor market assessment is for PERM purposes and will have to be done under the rules established by DOL;
  • This stage can take approximately 2 months;
  • If a US worker who is willing, qualified, or trained shows up, the DOL will stop this process and you will have to wait at least 6 months to re-evaluate the labor market.

Step 4: Submit The PERM Labor Certificate Application To DOL

If the above step has been completed without finding a qualified and willing US worker, the US employer or company can file the PERM application with DOL. For this you must:

  • File  DOL ETA Form 9089  online with DOL;
  • Wait for the response from DOL. The time of this process can range from 6 months or so, but the time can be extended if the case is audited.

Step 5: File Form I-140 With USCIS

Upon approval of the labor certification by the DOL, the employer will need to file with USCIS  Form I-140 , Petition for a Alien Worker.

  • This form should only be filed with USCIS if notification of PERM approval is received;
  • The presentation of the I-140 will have a validity period of 180 days. Such period begins from the day the PERM approval notice is received;
  • Processing time is typically 6-8 months, but  Form I-907 , Application for Premium Processing, can be filed with USCIS to expedite time.

Step 6: Wait For Priority Date Update

An alien visa number is not usually immediately available, so keep informed with the  visa bulletin .

If the priority date is in effect when the labor certification is approved,  Form I-485 , Application to Register Permanent Residence or Adjust Status, may be filed with USCIS.

what does the priority date mean for immigration

Not sure  what the immigration priority date is ? Check out our post for more information.

Step 7: Request Form I-485

The I-485 application is for the alien employee to obtain the Green Card. As long as the priority date is available, the I-485 can be filed alongside the I-140 or after the latter has been approved.

  • This step is focused on the eligibility of alien employees to receive a Green Card;
  • The employee who will receive the Green Card must be absent of a criminal record or other reasons that make him ineligible for the Green Card;
  • The  adjustment of status  process allows the foreign national worker to apply for travel or employment authorization while the I-485 is pending.

Step 8: Go To The Interview With USCIS

Time after all the documentation required for the labor certification has been submitted, USCIS will notify the foreign national worker that they must attend an interview.

  • At the interview, the immigration officer will review the foreigner’s application for the Green Card and all the documents that they posses;
  • During the interview, the alien must confirm that the job offer is still valid and available for them;
  • Medical exam. Must be completed on  Form I-693 , medical report, and immunization record;
  • Approval of your visa;
  • Visa stamps.

Don’t have a stamp in your passport? Don’t worry, you can get more information on this topic in our article “ My passport was not stamped when I entered the United States ”.

benefits of a labor certification

How Do I Get My PERM Labor Certification?

Obtaining a PERM Labor Certification for aliens requires five conditions:

  • Meet the qualifying requirements for the employment visa;
  • Have a sponsoring employer willing to process the labor certification;
  • Request the labor certificate from the United States Department of Labor;
  • Obtain permanent labor certification, issued by the Employment and Training Administration of the Department of Labor;
  • File an employment-based petition with USCIS.

Finally, if the worker is abroad, it is required to apply for the approval of an immigrant visa. This procedure is carried out through the so-called  consular process  at an embassy or consulate.

What Should A Labor Certificate Include?

For an application for a labor certificate to be valid, the petitioner and beneficiary must sign the ETA 9089 form. Additionally, it must have the DOL certification seal, the signature of the DOL certifying officer, and the date of certification.

Documentation For The PERM

  • Diagnosis of the local labor market with evidence of a lack of trained personnel and/or eligible for employment;
  • Request for prevailing or minimum wage. DOL determines the prevailing wage based on location and job requirements;
  • Work orders;
  • Notices placed in the media and in employment organizations;
  • Job advertisements placed on the company’s website;
  • United States Employer Audit File;
  • Immigrant Petition;
  • Completed ETA Form 9089.

What Are The Requirements To Apply For A PERM Labor Certification?

Federal Regulations (  CFR § 656.10 (c)  ) establish that the requirements that a US employer or business must meet to apply for a PERM labor certification are as follows:

  • Wages offered to the alien worker must be greater than or equal to the prevailing wages for the job;
  • The job listing was made available to American workers;
  • The prospective alien employee will be on the payroll prior to or on the day of arrival in the United States;
  • Salaries do not depend on bonuses, commissions or economic incentives of any kind. Unless the employer guarantees that the prospective employee will continue to earn wages greater than or equal to prevailing wages;
  • Any job applicant who is American has been denied the job title for legal reasons;
  • Employer has enough money to pay the promised wages;
  • The job in question is a full-time or permanent job position;
  • The employer is not the same individual as the non-US citizen;
  • Working conditions and terms of employment comply with legal regulations, including federal, state and local statutes.
  • During the job offer, the employer did not discriminate against the prospective alien employee on the basis of age, sex, race, religion, national origin, color, disability, or citizenship.

  • Demonstrate to DOL that qualified or willing US workers are not available for the job;
  • Demonstrate that the hiring of a foreign national worker will not adversely affect the US labor market.
  • Have an account and registered user on the official DOL website. If you don’t have it yet, you can register through the  following link .

Who Can Be The Employer Or The Company That Sponsors A Foreign National Worker?

The employer or sponsoring company must be:

  • American citizen;
  • Micro business;
  • Small company;
  • Medium business;
  • Big company.

Who Can Apply For The PERM Program?

  • Any alien who wishes to work in the United States and meets all the requirements for it;
  • Aliens who are lawfully in the US;
  • University graduates, with master’s degrees or a doctorate;
  • Alien investors;
  • Aliens under the  NACARA law  program;
  • Workers without university studies who know any trade. For example, nannies, domestic workers, plumbers, gardeners, cooks, among others;
  • Aliens with an approved work visa;
  • Aliens under Temporary Protected Status (TPS).

Don’t know  what TPS is in the United States ? You may be able to qualify for this immigration program. By checking our blog, you will find the necessary requirements to be eligible.

How Much Does A PERM Labor Certification Cost In 2024?

The Department of Labor does not charge a fee for the PERM petition. However, there are other costs related to this process. For example, USCIS sets a fee of $700 for the filing of the alien worker petition.

Other common costs for this certification are:

  • Approximately $1,225 for filing Form I-485;
  • $2,500 if the premium processing request is filed with USCIS. Such request is optional.

The good news for aliens is that both the cost of filing the application and the other associated costs must be paid by the US employer or company and not by the foreign national worker.

How Long Does It Take To Obtain A PERM Labor Certification?

Generally, PERM labor certification acceptance and processing can take anywhere from 6 to 18 months, depending on the workload and resources available in each DOL region.

It should be noted that:

  • The immigration visa petition to USCIS through form I-140, can take from 4 to 12 months, depending on the category of visa preference petition and geographic location;
  • The adjustment of status presented at one of the USCIS Regional Service Centers usually takes 8 to 36 months.

The PERM labor certification to obtain the Green Card for work is a complex and time-consuming process. If you want more information on this topic, you can come to our offices located in downtown Los Angeles, call us or send us an email.

situation after PERM approval

How Long Does It Take To Get A Labor Certification Approved?

Currently, DOL takes a minimum of 30 days to make a final decision on a labor certification. However, there are no standardized time frames, so the waiting time for approval can extend beyond 30 days.

Note : An approved permanent labor certification is not evidence that the DOL has determined that the alien named on the labor certification qualifies for the job. Only USCIS has the authority to determine whether or not the alien qualifies.

Can I Travel While PERM Is Pending?

The application for the labor certificate does not affect the beneficiary’s ability to travel outside the United States. The only caveat is that you must again obtain a visa for re-entry into the country. It is also advisable to notify your immigration attorney so that he can take the necessary steps.

Can The Labor Certification Be Denied?

Just as the DOL can approve a PERM labor certification, it can also deny it. Commonly, the reasons DOL denies PERM include:

  • Failure to comply with the deadlines for publication of the job offer;
  • Hidden information regarding family relationships between the employer and the sponsored alien worker;
  • Ineligibility by the foreign national worker;
  • Failure to comply with the requested collections.

What Happens After PERM Approval?

After the labor certification is approved, the employers must go to USCIS. There they file Form I-140 and the alien worker petition process is formally initiated.

  • If the worker is already in the United States legally, they must wait for a visa to be available for their category;
  • If there is not one yet, they cannot apply for adjustment of status to obtain a Green Card;
  • When the worker resides abroad and an immigrant visa is available, consular processing begins. In this way, the visa is obtained to legally enter the United States.
  • When the adjustment of status is approved and the alien enters the US, the Green Card is immediately activated. If there is no visa available, you will still have to wait then.

PERM Labor Certification FAQs

It is possible to stay in the US after PERM approval. However, you must wait for a visa category to become available to apply for adjustment of status. Only then can you obtain permanent residence.

There are cases in which this can happen, since the approval of the PERM certification does not guarantee obtaining the Green Card. Sometimes, depending on the reason for the ineligibility, the alien worker can go through this procedure again.  However, there are others where it is not, so you will need to consult with our experienced immigration attorney.

Generally, it is not possible to change jobs once the DOL has approved the PERM labor certification. This is because certification is only granted for a particular type of employment and employer.
