Mrs L McMullen v Scottish African Safari Park Ltd (Scotland : Unfair Dismissal)

Lynsey McMullen (the claimant) was employed by Safari Park (the respondent) under a seasonal contract. Following the end of the contract, McMullen was offered work by Safari Park for tasks such as promoting a pantomime and working as a photographer. Safari Park also offered McMullen the position of Education and Conservation Team Leader, which she believed was a continuation of her seasonal contract. However, her contract actually ended on October 27, 2019, and she was not continuously employed for a period of not less than two years ending with her effective date of termination as required by section 108 of the Employment Rights Act 1996 to make a claim of unfair dismissal. McMullen claimed unfair dismissal, but the tribunal dismissed her claim as they had no jurisdiction to determine it.

Did the employment tribunal have jurisdiction to consider McMullen's claim of unfair dismissal?

Section 94(1) of the Employment Rights Act 1996 provides that "An employee has the right not to be unfairly dismissed by his employer." However, McMullen did not have the requisite service to claim unfair dismissal as she was not continuously employed for a period of not less than two years ending with her effective date of termination. The tribunal properly accepted that McMullen had continuity of service from January 13, 2020, until August 1, 2021, but without being able to "cast back" to early August 2019, McMullen did not satisfy section 108 of the 1996 Act. Therefore, the tribunal had no jurisdiction to hear her claim.

The tribunal dismissed McMullen's claim of unfair dismissal as they had no jurisdiction to determine it. McMullen was not continuously employed for a period of not less than two years ending with her effective date of termination, as required by section 108 of the Employment Rights Act 1996, to make a claim of unfair dismissal.
