Tourists vehicles can now apply for All-India permit through online portal

According to the Ministry of Road Transport & Highways, the permit will be issued, after the submission of relevant documents and fees within 30 days of submission of such applications and the new set of rules will be applicable from April 1.

In a bid to promote tourism and grow state revenues, the Ministry of Road Transport and Highways has announced a new scheme, under which any tourist vehicle operator may apply for an "All India Tourist Authorisation/Permit" through online mode.

The ministry also informed that a new set of rules will be known as, All India Tourist Vehicles Authorisation and Permit Rules, 2021 which has been published vide GSR 166 (E) dated March 10 and will be applicable from April 1.

However, all existing permits shall continue to be in force during their validity.

"The new rules for permits are expected to go a long way in promoting tourism across the states in India, while simultaneously, growing the revenue of state governments. The step was discussed in the 39th and 40th Transport Development Council meetings and was appreciated by participants from the states. The rules come even as the Ministry is in the pursuit of providing seamless movement to tourist passenger vehicles, after the success of goods carriage vehicles under the National Permit Regime," read the release.

The scheme allows flexibility in the form of authorisation/permit being granted, for a period of three months or its multiples thereof, not exceeding three years at a time. This provision has been incorporated keeping in mind those areas of our country where there is a limited season of tourism and also for those operators who have limited financial capacity.

It will also consolidate a central database and fees of all such authorisation/permits, which might give a sense of tourist movements, scope for improvement, promotion of tourism.

Draft notification issued to supersede the All India tourist vehicle ( Authorisation or Permit) Rules, 2021

The Ministry of Road Transport and Highways (MoRTH) has issued a draft notification G.S.R 815(E) on 11 November 2022 to supersede the All India Tourist Vehicle (Authorisation or Permit) Rules, 2021.

The rules notified in 2021 provided a significant boost to the tourism sector in India by streamlining and simplifying the permit regime for tourist vehicles.

Now, with the proposed All India Tourist Vehicles (Permit) Rules, 2022, the tourist permit regime is proposed to be further streamlined and strengthened.

The key features of the proposed rules are as follows:

1.To simplify the procedure for All India Permit applicants and to reduce compliance burden, the provision of authorization and All India Tourist Permit has been made independent of each other.

2.More categories of tourist vehicles, with lesser permit fees for lesser capacity vehicles (less than ten) have been proposed. This is expected to provide considerable financial relief to smaller tourist operators having smaller vehicles with lower seating capacity as they will now be required to pay lower fees commensurate with the seating capacity of their vehicle(s).

3.To promote deployment of electric vehicles in large numbers a streamlined regulatory ecosystem at no cost to the operator(s) has been proposed.

On 10 th March, 2021, the Ministry of Road Transport and Highways has notified the All India Tourist Vehicles (Authorisation or Permit) Rules, 2021 which shall come on effect on 1 st April, 2021.

Key features of Rules have been discussed below:

• Application for authorisation and permit (Rule 3) : The authorisation and permit can be obtained only by a tourist vehicle operator by way of payment of fees as mentioned in Rule 5, according to the capacity of the vehicle. The procedure for grant of authorisation or renewal of authorisation is specified under Rule 3 and Rule 4 of the Rules. The application along with fee shall be in electronic form and the Transport Authority shall issue the authorisation or permit within period of thirty days from the date of receipt of application.
• Scope and Validity (Rule 7) : The authorisation or permit shall be valid throughout India. It could be used for the transport of passengers individually or in a group, along with their personal luggage. No individual or a group of individuals shall use the vehicle for the transport of passengers individually or in a group, without the authorisation or permit.
• Transfer of authorisation or permit (Rule 8): The authorisation or permit can be transferable from one person to another only with the permission of the jurisdictional Transport Authority. In cases of death of the owner, the prospective owner shall have to get the ownership transferred by the transport authority within three months from such death.
• Replacement of vehicle (Rule 9) : The holder of authorisation or permit can replace any tourist vehicle covered by the authorisation or permit with any other tourist vehicle of the same nature, with the permission of the jurisdictional Transport Authority.
• Distinguishing mark and List of Passengers (Rule 10 and 11): The authorised tourist vehicles shall display the words “All India Tourist Permit” on the rear left side of the vehicle in white letters in blue background along with the validity of the permit. A tourist vehicle should carry a list of passengers in electronic form or in physical form, which shall contain the details of origin and the destination of each passenger.
• Insurance (Rule 12): Authorised tourist vehicles should have a valid insurance coverage for passenger liability as well as the driver. The record of information of passengers should be kept by the authorised vehicle operator for at least a year.
• Cancellation (Rule 14): The authorisation or permit of the vehicle operator could be cancelled in cases such as: contravening provisions of these Rules; ceases to own the vehicle covered by authorisation or permit; obtained the authorisation or permit by fraud or misrepresentation, and acquires the citizenship of any foreign country.
• Appeals (Rule 15) : Any person aggrieved by the order of the jurisdictional Transport Authority may appeal to the State Transport Appellate Tribunal within 30 days of such order.

All India Tourist Vehicles (Authorisation or Permit) Rules, 2021

Published vide Notification No. G.S.R. 166(E), dated 10.03.2021.

(a) "Act" means the Motor Vehicles Act, 1988 (59 of 1988);

(b) "Authorisation" means an authorisation granted by the Transport Authority to enable tourist vehicles operator/ owner to ply tourist vehicle throughout the territory of India subject to the payment of taxes or fees, if any, levied by the State or Union territory through which it plies;

(c) "Form" means a Form appended to these rules;

(d) "Permit" means a permit issued by the Transport Authority to enable a tourist vehicle operator/ owner to ply tourist vehicle throughout the territory of India without payment of taxes or fee levied by the State or Union territory through which it plies;

(e) "Transport Authority" means the State Transport Authority constituted under sub-section (1) of section 68 of the Act.

(1) uses or causes or allows a tourist vehicle to be used in contravention to the provisions of these rules or the Act, as the case may be;

(2) ceases to own the vehicle covered by authorisation or permit, as the case may be;

(3) obtained the authorisation or permit by fraud or misrepresentation, and

(4) acquires the citizenship of any foreign country.

(1) refusal to issue authorisation or permit, as the case may be, under sub-rule (2) of rule 4; or

(2) suspension or cancellation of authorisation or permit, as the case may be, or any variation of the condition thereof; or

(3) order of refusal to transfer the authorisation or permit, as the case may be, under rule 8 or rule 9 of these rules; or

(4) order of refusal to renew the authorisation or permit, as the case may be, may within a period of thirty days from the date on which the said order is received by such person, appeal to the State Transport Appellate Tribunal, which shall give a decision thereon after giving such person an opportunity of being heard.

(a) Valid Authorisation or Authorisation application number;

(f) A self declared affidavit declaring that the driver of the tourist vehicle has proper uniform, driving license and adequate knowledge of taking the tourist for sight-seeing and that the applicant has proper parking space for the vehicles.

Destinations value Indian travelers, but lengthy visa processing times lasting months act as significant deterrents. The adoption of these new regulations by European authorities reflects a proactive effort to tackle these concerns, aiming to boost tourism flow.

The European Commission has introduced a new visa “cascade” regime for Indian nationals applying for Schengen visas in India. This regime looks to offer longer-term, multi-entry Schengen visas, based on the applicant’s travel history.

Indian travel agents had been complaining of Schengen visa delays as a major challenge to the summer travel rush from India.

• How does one qualify for the longer duration visas?

The European Commission can issue a two-year multiple-entry visa after a traveler “has obtained and lawfully used two visas within the previous three years.” This demonstrates a positive travel history and compliance with previous visa regulations.

Subsequently, after granting the two-year visa, authorities may issue a five-year visa if the passport has has adequate validity remaining.

• What benefits do holders of these extended visas enjoy?

During the validity period of these visas, holders can enjoy travel rights equivalent to visa-free nationals within the Schengen area, allowing for short stays of up to 90 days within a 180-day period.

• Which countries are part of the Schengen area?

The Schengen area comprises 29 European countries, including 25 European Union member states: Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Germany, Estonia, Greece, Spain, France, Italy, Latvia, Lithuania, Luxembourg, Hungary, Malta, Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Finland, and Sweden. Additionally, Iceland, Liechtenstein, Norway, and Switzerland are also part of the Schengen area.

• Are there any restrictions or conditions to these visas?

Schengen visas do not grant the right to work within the Schengen area and are for short stays only. Additionally, the visas are not purpose-bound, providing flexibility for travel within the specified period.

Skift also spoke to players in the Indian outbound travel industry to understand what has changed in the new Schengen visa rules.

• How is this different from the earlier visas that Schengen countries offered? Don’t they already offer multi-entry visas with longer duration to Indians?

Mahendra Vakharia, managing director of Pathfinders Holidays, said there was no standard policy of Schengen states for issuing these long-term visas earlier. Switzerland, France, Netherlands, Italy and Spain usually issued long-term visa, but it was all subjective. “With this new policy it should be a standard rule now,” Vakharia said.

• Travelers mainly complain of longer processing times, has that changed?

Here too, there is no standard processing time as it varies from country to country, according to Vakharia. “France and Spain have been processing visas within four days, and then there’s Croatia, which takes 60 days,” he said.

Processing time will not change as of now, it will take time for the visa rules to be enforced, said an industry source, while highlighting that the visa would be especially useful for corporate travelers.

What Promoted The Move?

Speaking on the possible motivations, Vakharia acknowledged various reasons, including administrative capacity constraints at embassies to cater to the huge inflow of applications.

“As there is an overwhelming demand from Indian travelers, the process of securing visa appointments has posed significant challenges , especially for travelers residing in cities lacking VFS Global centers,” he said.

The European Commission said in an statement that the decision reflects the EU-India Common Agenda on Migration and Mobility, aimed at fostering comprehensive cooperation on migration policy. Facilitating people-to-people contacts is a key aspect of this agenda, acknowledging India’s importance as an EU partner.

The decision also reflects a realization of the strong economic benefits derived through the spending power of Indian tourists. As Vakharia aptly puts it, “Why let go of the Golden Indian Goodie Bag?”
