Das richtige Visum für Work and Travel in den USA

Für die USA gibt es leider kein klassisches Working Holiday Visum wie für Kanada , Neuseeland oder Australien , mit dem du für ein Jahr durch das Land reisen und dort jobben kannst, aber es gibt ein paar andere Möglichkeiten für einen Work and Travel-Aufenthalt in den USA. Im Anschluss findest du Infos zu verschiedenen Visa für die USA, wie du sie beantragst und welche Jobmöglichkeiten du damit hast. (Siehe hierzu auch das Thema Arbeit in den USA .)

Einreise ohne Visum / visumfreies Reisen (Visa Waiver Program)

Für einen Aufenthalt von bis zu drei Monaten ist für deutsche Staatsbürger, Österreicher und Schweizer kein Visum erforderlich. Erfolgt die Einreise in die USA per Flugzeug oder Schiff, wird vor Reiseantritt eine ESTA-Genehmigung benötigt. Die ESTA-Genehmigung kannst du im Internet unter folgendem Link beantragen: https://esta.cbp.dhs.gov/esta/ .

Die Kosten für die ESTA-Genehmigung betragen ca. 14 $, die mit einer Kreditkarte zu bezahlen sind.

Alternativ kannst du die ESTA auch über eine seriöse Visum-Agentur beantragen, dann kommen zu den 14 $ allerdings noch Servicegebühren hinzu. Mehr dazu erfährst du im Blog: ESTA über eine Agentur beantragen.

Ab dem Tag der Erteilung ist die ESTA-Genehmigung für zwei Jahre gültig oder bis dein Reisepass abläuft. Je nachdem was zuerst eintritt.

Erfolgt die Anreise von Kanada oder Mexiko aus über den Landweg, wird keine ESTA-Genehmigung benötigt. An der Grenze wird eine Gebühr von ca. 6 $ erhoben.

Das visumfreie Reisen ist für Urlauber und Touristen gedacht und beinhaltet keine Arbeitserlaubnis.

Besuchervisum B-1/B-2

Mit dem B-1/B-2 Besuchervisum kannst du bis zu 180 Tage am Stück als Tourist in den USA bleiben. Oft hat dieses Visum eine Gültigkeitsdauer von mehreren Jahren, was dir ermöglicht dich in dieser Zeit mehrmals bis zu 180 Tage am Stück in den USA aufzuhalten. Möchtest du dich länger in den USA aufhalten, so kannst du deinen Aufenthalt mit dem B-1/B-2 Visum vor Ort um weitere 180 Tage verlängern und somit insgesamt ein Jahr am Stück in den USA bleiben.

Das B-Visum ist für Urlauber und Touristen gedacht und beinhaltet keine Arbeitserlaubnis.

J-1-Visum für Au-Pair, Summerjobs, Summercamps und Praktika

Je nachdem, was für einen Job du mit dem J-1-Visum ausüben möchtest, werden verschiedene Voraussetzungen an dich gestellt.

Um das Visum für Summerjobs und Summercamps beantragen zu können, musst du Student sein. Für Praktika musst du entweder an einer Hochschule eingeschrieben sein oder eine Ausbildung machen. Wenn du schon eine Ausbildung abgeschlossen hast, darf diese nicht länger als ein Jahr zurückliegen. Für alle Jobvarianten gilt, dass du bereits vor der Beantragung des Visums eine Zusage für eine Arbeitsstelle haben solltest.

Das J-1-Visum für einen Au-pair Aufenthalt in den USA wird nur über Vermittleragenturen bzw. Organisationen vergeben. Falls du dich für Au-pair in den USA interessierst, kannst du bei diesen Organisationen an einem Programm teilnehmen. Das Programm umfasst dann die gesamte Organisation deines USA-Aufenthalts inklusive Visum.

Je nachdem was für eine Jobvariante du wählst, kann das J-1-Visum mit einer Aufenthaltserlaubnis von drei bis 12 Monaten ausgestellt werden. Bei Summerjobs und Summercamps beträgt die Gültigkeit in der Regel drei bis vier Monate plus einen Monat, der im Anschluss an deinen Job zum Reisen angehängt werden kann. Bei Praktika und Au-pair kann dir das J-1-Visum bis zu einem Jahr ausgestellt werden. Ein weiterer Monat zum Reisen durch die USA kann im Anschluss noch angehängt werden.

Das H-2 Visum für Saisonjobs in den USA

Ganz neu ist das H-2 Visum für saisonale Jobs in den USA. Dieses Visum gibt es für deutsche Staatsbürger erst seit Januar 2016. Das H-2 Visum gibt es in zwei verschiedenen Kategorien: H-2A (Temporary Agricultural Workers) für saisonale Jobs rund um die Agrikultur, wie z.B. Farm- und Erntehelferjobs und H-2B (Temporary Nonagricultural Workers) Saisonjobs, die nichts mit Agrikultur zu tun haben, z.B. Jobs als Ski- oder Snowboardlehrer etc.

Wenn du das Visum beantragen möchtest, brauchst du ein Jobangebot und dein zukünftiger Arbeitgeber muss nachweisen, dass es sich bei der angebotenen Arbeit um einen Saisonjob handelt bzw. es nicht genügend Arbeitskräfte für diesen Job in den USA gibt.

Wenn du mit dem H-2 Visum zum Arbeiten in die USA einreist, hast du nach Ende deines Jobs nicht wirklich Zeit noch zu Reisen, weil du gleich wieder ausreisen musst. Um trotzdem auch in den USA reisen zu können, kannst du zusätzlich zum H-2 Visum z.B. ein Besuchervisum (B-Visum) beantragen, mit dem du im Anschluss noch durch die USA reisen kannst. Allerdings musst du dazu vor Ort dann schriftlich einen Wechsel der Visumkategorie beantragen oder kurz aus den USA aus- und dann wieder einreisen, um das B-Visum zu aktivieren.

College and University students enrolled full time and pursuing studies at post-secondary accredited academic institutions located outside the United States come to the United States to share their culture and ideas with people of the United States through temporary work and travel opportunities.

Summer Work Travel Students must be:

  • Sufficiently proficient in English to successfully interact in an English speaking environment;
  • Post-secondary school students enrolled in and actively pursuing a degree or other full-time course of study at an accredited classroom based, post-secondary educational institution outside the United States;
  • Have successfully completed at least one semester or equivalent of post-secondary academic study; and
  • Pre-placed in a job prior to entry unless from a visa waiver country.

The Summer Work Travel program provides foreign students with an opportunity to live and work in the United States during their summer vacation from college or university to experience and to be exposed to the people and way of life in the United States.

Readmittance, Program Length, and Returning Home

  • Readmittance: Participants can be admitted to the program more than once;
  • Program Length: The maximum length of the program is four months; and
  • Returning Home: Students must return to their home country prior to the start date of their university or college.

Program Exclusions

Sponsors must not place participants:

  • In positions that could bring notoriety or disrepute to the Exchange Visitor Program;
  • In sales positions that require participants to purchase inventory that they must sell in order to support themselves;
  • In domestic help positions in private homes (e.g., child care, elder care, gardener, chauffeur);
  • As pedicab or rolling chair drivers or operators;
  • As operators or drivers of vehicles or vessels for which drivers’ licenses are required regardless of whether they carry passengers or not;
  • In positions related to clinical care that involves patient contact;
  • In any position in the adult entertainment industry (including, but not limited to jobs with escort services, adult book/video stores, and strip clubs);
  • In positions requiring work hours that fall predominantly between 10:00 pm and 6:00 am;
  • In positions declared hazardous to youth by the Secretary of Labor at Subpart E of 29 CFR part 570;
  • In positions that require sustained physical contact with other people and/or adherence to the Centers for Disease Control and Prevention’s Universal Blood and Body Fluid Precautions guidelines (e.g., body piercing, tattooing, massage, manicure);
  • In positions that are substantially commission-based and thus do not guarantee that participants will be paid minimum wage in accordance with federal and state standards;
  • In positions involved in gaming and gambling that include direct participation in wagering and/or betting;
  • In positions in chemical pest control, warehousing, catalogue/online order distribution centers;
  • In positions with traveling fairs or itinerant concessionaires;
  • In jobs that do not allow participants to work alongside U.S. citizens and interact regularly with U.S. citizens and to experience U.S. culture during the workday portion of their Summer Work Travel programs;
  • With employers that fill non-seasonal or non-temporary job openings with exchange visitors with staggered vacation schedules;
  • In positions that require licensing;
  • In positions for which there is another specific J visa category (e.g., Camp Counselor, Trainee, Intern);
  • Participants must be employees of and paid by the staffing agencies
  • Staffing agencies must provide full-time, primary, on-site supervision of the participants
  • Staffing agencies must effectively control the work sites, e.g., have hands-on management responsibility for the participants
  • After November 1, 2012, in positions in the North American Industry Classification System’s (NAICS) Goods-Producing Industries occupational categories industry sectors 11, 21, 23, 31-33 numbers (set forth at http://www.bls.gov/iag/tgs/iag_index_naics.htm ).

Sponsors must also:

  • Use extra caution when placing students in positions at employers in lines of business that are frequently associated with trafficking persons (e.g., modeling agencies, housekeeping, janitorial services);
  • Consider the availability of suitable, affordable housing (e.g., that meets local codes and ordinances) and reliable, affordable, and convenient transportation to and from work when making job placements;
  • Actively and immediately assist participants with arranging appropriate housing and transportation, if employers do not provide or arrange housing and/or transportation, or if participants decline employer-provided housing or transportation;
  • The number of job placements available with host employers
  • That host employers will not displace domestic U.S. workers at worksites where they will place program participants
  • That host employers have not experienced layoffs in the past 120 days and do not have workers on lockout or on strike

Sponsors may place participants only in jobs that:

  • Are seasonal or temporary;
  • Provide opportunities for regular communication and interaction with U.S. citizens and allow participants to experience U.S. culture.

Program Sponsors

Sponsors are required to:.

  • A copy of the Department of State Summer Work Travel Program Brochure;
  • The Department of State’s toll-free emergency hotline telephone number;
  • The sponsor’s 24/7 immediate contact telephone number;
  • Information advising participants of their obligation to notify their sponsor when they arrive in the United States and to provide information of any change in jobs or residence; and
  • Information concerning any contractual obligations related to participants’ acceptance of paid employment in the United States, if pre-arranged.
  • Ensure that participants entering the United States without prearranged employment have sufficient financial resources to support themselves during their search for employment;
  • Provide such participants with information on how to seek employment and secure lodging in the United States before they depart their home countries; and
  • Provide participants with a job directory that includes at least as many job listings as the number of participants in their program who are entering the United States without prearranged employment.
  • Sponsors must undertake reasonable efforts to secure suitable employment for participants unable to find jobs on their own after one week;
  • Sponsors must inform program participants of Federal Minimum Wage requirements and ensure that, at a minimum, participants are compensated at the prevailing local wage, which must meet the higher of either the applicable state or the Federal minimum wage requirement, including payment for overtime in accordance with state-specific employment; and
  • Sponsors must maintain, at a minimum, a monthly schedule of personal contact with the program participants (in-person, by telephone or via-electronic mail), document such contact, and ensure that issues affecting the health, safety and welfare of participants are addressed immediately.

Host employers are required to:

  • Provide participants the number of hours of paid employment per week as identified on the job offer and agreed to when the sponsor vetted the jobs;
  • Pay those participants eligible for overtime worked in accordance with applicable state or federal law;
  • Notify sponsors promptly when participants arrive at the work site and begins their programs; when there are any changes or deviations in the job placements during the participants’ programs; when participants are not meeting the requirements of job placements; or when participants leave their position ahead of their planned departure; and
  • Contact sponsors immediately in the event of any emergency involving participants or any situation that impacts the health, safety or welfare of participants.

How Does the Program Work?

You will be welcomed as a visitor with a U.S. Department of State J-1 visa. This visa allows you to live and work in the United States for up to four months during your university summer break. It also gives you the possibility to travel for an additional 30 days after your job ends.

Visitors with J-1 visas require a sponsor. As a student in the CIEE Work & Travel USA program, CIEE is your sponsor. We’re responsible for making sure you are prepared to live in America, have access to a good job with a responsible employer, and have a meaningful cultural exchange experience. We also monitor your health, safety and well-being while you are in this country.

You will be working for one of thousands of employers located all across the United States. Your representative can tell you all you need to know about your employment options.

Are You Eligible?

To be eligible for the CIEE Work & Travel USA Program, you must:

  • Be at least 18 years old (check with your local representative for specific rules)
  • Be registered as a full-time university student
  • Be able to function in English, both at work and in a community
  • Have a pre-arranged job (CIEE can help)
  • Have at least $800 to support yourself upon arrival in the United States

ESTA is an automated system that determines the eligibility of visitors to travel to the United States under the Visa Waiver Program (VWP) . Authorization via ESTA does not determine whether a traveler is admissible to the United States. U.S. Customs and Border Protection officers determine admissibility upon travelers’ arrival. The ESTA application collects biographic information and answers to VWP eligibility questions. ESTA applications may be submitted at any time prior to travel, though it is recommended that travelers apply as soon as they begin preparing travel plans or prior to purchasing airline tickets.

What is the J1 work and travel programme?

Who is eligible to go on the programme.

  • A full-time student doing at least 12 credits per semester and be enroute to graduate as per programme stipulated period.
  • Pursuing a 2–4 year diploma/degree programme at an accredited tertiary-level institution.
  • Must be from ages 18-30 years old
  • Willing to attend physical and/or virtual orientation and interview sessions in your home country.
  • A national of the country from which you are participating.

How long can I stay in the US for?

Is there a grace period, how do i register to go on the programme.

  • First, create an online account at our website and submit the required documents. Once documents are validated, a payment authorization code will be emailed to the applicant, which they can use to make their first deposit to us.
  • Immediately after registration & programme fee deposit payment is validated, proceed to collect and upload the required documents. Applicants will also have access to job board/sponsor selection tab.

A citizen of a foreign country who wishes to work in the United States must first get the right visa.  If the employment is for a fixed period, the applicant can apply for a temporary employment visa.  There are 11 temporary worker visa categories.  Most applicants for temporary worker visas must have an approved petition.  The prospective employer must file the petition on behalf of the applicant.  U.S. Citizenship and Immigration Services (USCIS) reviews the petition. 

Temporary worker visa categories

Labor certification.

Certain visa categories need an approved labor certification. First, the prospective employer must apply for the labor certification with the Department of Labor .  Then, the prospective employer can file the Petition for a Nonimmigrant Worker, Form I-129, with USCIS.  Please refer to the Instructions for Form I-129   on the USCIS website to confirm if you need  the labor certification.

Petition Approval

Some temporary worker categories are limited in the total number of petitions which can be approved on a yearly basis. Before an applicant can apply for a temporary worker visa, USCIS must first approve the Petition for a Nonimmigrant Worker, Form I-129 .    For more information about the petition process, see Working in the U.S. and Temporary (Nonimmigrant) Workers on the USCIS website.  Once USCIS approves the petition, it will send the prospective employer a Notice of Action, Form I-797. 

Important Notice: Same-sex Marriage

Effective immediately, U.S. Embassies and Consulates will adjudicate visa applications that are based on a same-sex marriage in the same way that we adjudicate applications for opposite gender spouses. Please reference the specific guidance on the visa category for which you are applying for more details on documentation required for derivative spouses. For further information, please see our  FAQ’s .

How to Apply

You may apply for a visa when USCIS has approved your petition. There are several steps in the visa application process. The order of these steps and how you complete them may vary at the U.S. embassy or consulate where you apply. Please visit the embassy or consulate website for instructions on how to apply.

  • Online Nonimmigrant Visa Application, Form DS-160 – Learn more about completing the DS-160 . You must: 1) complete the online visa application and 2) print the application form confirmation page to bring to your interview.
  • Photo –You will upload your photo while completing the online Form DS-160. Your photo must be in the format explained in the Photograph Requirements .

Schedule an Interview

Applpicants of a certain age may not need to have an interview. Consular officers have the discretion to  interview any applicant, regardless of age.

You must schedule an appointment for your visa interview at any U.S. Embassy or Consulate where you live.  However, it may be difficult to qualify for a visa outside of your place of permanent residence.

Wait times for interview appointments vary by location, season, and visa category.  You should apply for your visa early.  Review the interview wait time for the location where you will apply:

Check the estimated wait time for a nonimmigrant visa interview appointment as a U.S. Embassy or Consulate. 

Note: Please check the individual Embassy or Consulate website to determine if your case is eligible for a waiver of the in-person interview.

Applicants scheduling visa appointments in a location different from their place of residence should check post websites for nonresident wait times.

You will need to provide the receipt number to schedule an interview.  The receipt number is printed on your approved Petition for a Nonimmigrant Worker, Form I-129, or Notice of Action, Form I-797.

Prepare for your Interview

  • Fees - Pay the non-refundable visa application fee , if you are required to pay it before your interview. When your visa is approved, you may also pay a visa issuance fee, if applicable to your nationality. Fee information is provided below:

Reciprocity Fees

Nonimmigrant visa applicants from certain countries*/areas of authority may be required to pay a visa issuance fee after their application is approved. These fees are based on the principle of reciprocity:  when a foreign government imposes fees on U.S. citizens for certain types of visas, the United States will impose a reciprocal fee on citizens of that country*/area of authority for similar types of visas.

  • Fee payment information is available on the website of the embassy or consulate where you will apply.
  • L visa applicants included in a L blanket petition : must also pay the Fraud Prevention and Detection fee and may need to pay the Border Security Act fee. Select  All Fees  to learn more.

Gather Required Documentation

Gather and prepare the following required documents before your visa interview:

  • Passport  valid for at least six months beyond your period of stay in the United States (unless exempt by country-specific agreements ).  Each person included in a single passport needs a separate visa application.
  • Nonimmigrant Visa Application, Form DS-160 confirmation page .
  • Application fee payment receipt, if you are required to pay before your interview.
  • Photo – You will upload your photo while completing the online Form DS-160. If the photo upload fails, you must bring one printed photo in the format explained in the Photograph Requirements . 
  • Petition Receipt Number as it appears on your Petition for a Nonimmigrant Worker, Form I-129, or Notice of Action, Form I-797.
  • L Visa Applicants  included in an L blanket petition, must bring Form I-129S to the interview.

Legal Rights and Protections

H-1B, H-2A, and H-2B visa applicants should read the Legal Rights and Protections pamphlet before applying for a visa.  The pamphlet includes information on your rights in the United States and protection available to you.

Additional Documentation May Be Required

Review the instructions on how to apply for a visa on the website of the embassy or consulate where you will apply. Additional documents may be requested to establish if you are qualified.  

Most visa applicants, except H-1B and L, need to show their intent to return to their home country after their temporary stay in the United States. They can do so by showing proof of compelling ties to the home country, which may include:

  • A residence abroad which you do not intend to abandon
  • Your family relationships
  • Your economic situation
  • Your long term plans

Attend your Visa Interview

During the visa interview, a consular officer will determine if you are eligible for the visa.  The consular officer will also determine if the visa category is appropriate for your purpose of travel. You will need to establish that you meet the requirements under U.S. law to receive the category of visa for which you are applying.

Ink-free, digital fingerprint scans will be taken as part of your application process. They are usually taken during your interview, but this varies based on location.

After your visa interview, your application may need further administrative processing . A consular officer will inform you if further processing is necessary for your application.

Depending on your nationality, you may need to pay a visa issuance fee.  You must pay this fee when the visa is approved.  The embassy will explain how your passport with visa will be returned to you.  Review the visa processing time , to learn how soon your passport with visa will generally be ready for pick-up or delivery by the courier.

Entering the United States

A visa allows a foreign citizen to travel to a U.S. port-of-entry (generally an airport).  A visa also allows you to request permission to enter the United States.  A visa does not guarantee entry into the United States.  U.S. Customs and Border Protection (CBP) officials at the port-of-entry have authority to permit or deny admission to the United States.  When admitted, you may get an admission stamp or  Form I-94, Arrival/Departure Record. Review the CBP website to learn more about entry requirements and customs restrictions.

Extending Your Stay

You must leave the United States on or before the date indicated on your admission stamp or Form I-94.  You can request to extend your stay by contacting USCIS.  Visit USCIS's Extend Your Stay website for more information.

Failure to leave the United States on time will result in you being out of status . Under U.S. law, visas of travelers who are out of status are automatically voided ( Section 222(g) of the Immigration and Nationality Act ). If you had a multiple-entry visa and it was voided due to you being out of status, it will not be valid for future entries into the United States.

Failure to leave the United States on time may also result in you being ineligible for visas you may apply for in the future. Review Visa Denials and Ineligibilities and Waivers: Laws to learn more.

Change of Status

While in the United States, you may be able to request a change to another nonimmigrant category.  See Change My Nonimmigrant Status on the USCIS website to learn more.

Requesting a change of status does not require that you apply for a new visa, as long as you remain in status. If you cannot remain in status while USCIS processes your change of status request, you must apply for a visa at a U.S. embassy or consulate.

Additional Information

  • The approval of a petition does not guarantee that you will get a visa. Do not make final travel plans or buy tickets until you have a visa.
  • Spouse and Children –
  • Your spouse and unmarried, minor children may also apply for the same visa category as you to accompany or join you.  The only exception is for Cultural Exchange Visitor Q-1 visa applicants.  You must be able to show that you will be able to financially support your family in the United States.

  • Unless canceled or revoked, a visa is valid until its expiration date.  Therefore, a valid U.S. visa in an expired passport is still valid. If you have a valid visa in your expired passport, do not remove it from your expired passport. You may use your valid visa in your expired passport along with a new valid passport for travel and admission to the United States.

Visa Renewal

The same visa application process applies for first-time applicants and renewals. Please review How to Apply for more information.  Some applicants may be eligible for interview waiver.  Interview waiver allows eligible individuals to renew their visa without an in-person interview. To determine if you are eligible for interview waiver, please review the instructions on the website of the U.S. Embassy or Consulate where you will apply.

Misrepresentation or Fraud

Attempting to obtain a visa by the willful misrepresentation of a material fact, or fraud, may result in the permanent refusal of a visa or denial of entry into the United States.

Citizen of Canada and Bermuda

Citizens of Canada and Bermuda do not need visas to enter the United States as temporary workers.  These applicants do need a temporary worker petition approved by USCIS. For more information see the  U.S. Embassy Ottawa website , the  U.S. Consulate Hamilton website  and the  CBP website .

How to sponsor a temporary worker

Wenn Sie in den Vereinigten Staaten von Amerika vorübergehend als Nichteinwanderer gemäss dem US-Einwanderungsgesetz tätig sein möchten, benötigen Sie ein spezifisches Visum, je nach der Art der Tätigkeit, welche Sie ausüben möchten. Bei den meisten Kategorien für Zeitarbeitnehmer muss Ihr potentieller Arbeitgeber oder Vertreter eine Petition einreichen, welche daraufhin von der amerikanischen Staatsbürgerschafts- und Einwanderungsbehörde (USCIS) in den Vereinigten Staaten von Amerika genehmigt werden muss, bevor Sie ein Arbeitsvisum beantragen können.

Sämtliche Antragsteller auf H, L, O, P und Q-Visa müssen über eine von USCIS genehmigte Petition verfügen. Diese Petition, Formular I-129 , muss zunächst genehmigt werden, bevor Sie bei einer US-Botschaft ein Arbeitsvisum beantragen können. Wenn Ihre Petition genehmigt wird, erhält Ihr Arbeitgeber oder Vertreter eine Benachrichtigung in Form des Formulars I-797 ("Notice of Action"), durch die Sie über die Genehmigung Ihrer Petition informiert werden. H-1B (Spezialberufe)

Ein H-1B-Visum wird benötigt, wenn Sie in die Vereinigten Staaten von Amerika einreisen, um Dienste im Rahmen eines im Vorhinein vereinbarten Berufes zu erbringen. Mit Chile und Singapur unterzeichnete Freihandelsabkommen ermöglichen qualifizierten chilenischen Bürgern und Bürgern von Singapur unter gewissen Umständen, zeitliche befristet in den Vereinigten Staaten zu arbeiten. Nur chilenische Staatsbürger und Staatsbürger von Singapur haben das vorrangige Recht, hierfür Bewerbungen einzureichen, auch wenn ihre Ehepartner und Kinder andere Staatsangehörigkeiten haben können.

Bewerber für ein H-1B1 Visum sollten bereits ein Arbeitsangebot für ihren jeweiligen Arbeitsbereich von einem Arbeitgeber aus den USA vorweisen können, aber der Arbeitgeber braucht nicht das Antragsformular I-129, Petition for Nonimmigrant Worker auszufüllen, wie auch der Bewerber kein Formblatt I-797 Notice of Approval erhält, bevor er den Visumsantrag abgibt. Jedoch muss der Einreichende, bevor er sich um ein Visum bewirbt, beim Arbeitsministerium (Department of Labor) einen Antrag auf Ausstellung einer Foreign Labor Certification stellen. H-2A (landwirtschaftliche Saisonkräfte)

Ein H-2A-Visum erlaubt es Arbeitgebern in den Vereinigten Staaten von Amerika, ausländische Arbeitskräfte in die Vereinigten Staaten zu bringen, um temporäre Arbeitsplätze in der Landwirtschaft zu füllen, für die keine Arbeitskräfte aus den Vereinigten Staaten verfügbar sind. Dieses Visum ist erforderlich, wenn Sie in die Vereinigten Staaten von Amerika einreisen, um eine Arbeit durchzuführen, die temporärer oder saisonbedingter Natur ist, und für die ein Mangel an Arbeitskräften in den Vereinigten Staaten besteht. Dazu muss Ihr Arbeitgeber zunächst eine Zertifizierung durch das Arbeitsministerium (Department of Labor) einholen, durch die bestätigt wird, dass ein Mangel an Arbeitern in den Vereinigten Staaten besteht, die für die Art Beschäftigung, auf der Ihre Petition basiert, in Frage kommen.

H-3 (Praktikanten)

Ein H-3-Visum ist dann erforderlich, wenn Sie in die Vereinigten Staaten von Amerika einreisen, um von einem Arbeitgeber über einen Zeitraum von maximal zwei Jahren in jedem beliebigen Beschäftigungsfeld ausser der postakademischen Ausbildung eine berufliche Ausbildung erhalten. Sie können für diese Ausbildung bezahlt werden, und praktische Arbeit ist erlaubt. Diese Ausbildung darf nicht für Beschäftigungen in der Produktion verwendet werden, und darf in Ihrem Heimatland nicht zur Verfügung stehen.

H-4 (Anhängige)

Wenn Sie selbst Inhaber eines gültigen H-Visums sind, ist es für Ihren Ehepartner bzw. Ihre ledigen Kinder (unter 21 Jahren) möglich, ein H-4-Visum zu erhalten, um Sie auf Ihrer Reise in die Vereinigten Staaten von Amerika zu begleiten. Diese sind jedoch nicht dazu berechtigt, in den Vereinigten Staaten von Amerika zu arbeiten.

L-1 (Firmeninterner Ortswechsel von Angestellten)

Ein L-1-Visum ist erforderlich, wenn Sie ein Angestellter eines internationalen Unternehmens sind, und vorübergehend in ein Mutterunternehmen, ein verbundenes Unternehmen oder ein Tochterunternehmen in den Vereinigten Staaten von Amerika versetzt werden. Dabei kann es sich entweder um eine Organisation in den Vereinigten Staaten von Amerika oder im Ausland handeln. Um sich für ein L-1-Visum zu qualifizieren, müssen Sie eine Position innerhalb der Geschäftsführung oder auf Management-Ebene bekleiden, oder über spezielle Kenntnisse verfügen, oder versetzt werden, um innerhalb des Unternehmens in den Vereinigten Staaten von Amerika auf einer dieser Ebenen tätig zu sein, wobei es sich nicht notwendigerweise um dieselbe Position handeln muss, die Sie vorher innehatten. Ausserdem müssen Sie innerhalb des internationalen Unternehmens innerhalb der drei Jahre vor der Beantragung Ihres Visums mindestens ein Jahr lang durchgehend ausserhalb der Vereinigten Staaten von Amerika beschäftigt gewesen sein. Sie sind erst dann dazu berechtigt, ein L-1-Visum zu beantragen, nachdem Ihr Unternehmen in den Vereinigten Staaten von Amerika oder ein verbundenes Unternehmen von USCIS eine genehmigte Petition erhalten hat, entweder auf pauschaler oder individueller Basis.

L-2 (Angehörige)

Wenn Sie selbst Inhaber eines gültigen L-Visums sind, können Ihr Ehepartner bzw. Ihre ledigen Kinder (unter 21 Jahren) dieses derivative Visum erhalten. Aufgrund einer kürzlich erfolgten Gesetzesänderung ist Ihr Ehepartner auch dazu berechtigt, auf eine Arbeitserlaubnis anzusuchen. Dazu muss Ihr Ehepartner mit einem eigenen L-2-Visum in die Vereinigten Staaten von Amerika einreisen, und dann das ausgefüllte Formular I-765 (bei USCIS erhältlich) einreichen, und die entsprechende Antragsgebühr bezahlen. Ihre Kinder sind jedoch nicht dazu berechtigt, in den Vereinigten Staaten von Amerika zu arbeiten.

O-Visa werden für Personen ausgestellt, die über aussergewöhnliche Fähigkeiten in den Bereichen Wissenschaft, Kunst, Erziehung und Bildung, Wirtschaft oder Sport verfügen oder aussergewöhnliche Leistungen in den Bereichen Film und Fernsehen erbracht haben; diese Art Visum kann auch für Assistenten solcher Personen ausgestellt werden.

P (Künstler, Unterhalter)

P-Visa werden für bestimmte Sportler, Unterhalter und Künstler sowie deren Assistenten ausgestellt, die zum Zwecke einer Darbietung in die Vereinigten Staaten von Amerika einreisen.

Ein Q-Visum ist dann erforderlich, wenn Sie in die Vereinigten Staaten von Amerika einreisen, um an einem internationalen kulturellen Austauschprogramm zum Zwecke des praktischen Trainings, der Berufstätigkeit oder der Vermittlung Geschichte, Kultur und Tradition Ihres Heimatlandes einreisen. Dazu muss von dem Sponsor des Programms eine Petition für Sie eingereicht und von USCIS genehmigt werden.

Die US-Botschaft kann Ihren Antrag auf H, L, O, P oder Q-Visa bis zu 90 Tage vor dem Beginn Ihres Arbeitsverhältnisses bearbeiten, der auf Ihrem I-797 vermerkt ist. Beachten Sie jedoch, dass Sie aufgrund der Bestimmungen der amerikanischen Regierung frühestens 10 Tage vor der genehmigten Periode, die auf Ihrem I-797 vermerkt ist, in die Vereinigten Staaten von Amerika einreisen dürfen.

Commuting to, from and around the “city so nice that they named it twice” can be a pain. Rush hour traffic, random street closures and mass transit delays are all daily grind nuisances.

But the harrowing hassle of hustling and busting isn’t limited to the city’s limits.

“Workers in New York State [have] the longest commute times,” stated an April 2024 report from the US Department of Energy. 

The DOE, which manages the nation’s nuclear infrastructure and administers the country’s energy policy, used 2022 data on the average 9-to-5er’s one-way travel time to work to compile a list of the top 10 worst states for commuting. 

Researchers determined that most New Yorkers spend approximately 33.2 minutes during their trek to the office. 

And while riding in a train, bus or car for just over a half hour might not sound so terrible, the trip has yet earned the Empire State the No. 1 spot on the longest commute roster. 

Straphangers in Maryland, New Jersey and the District of Columbia have it almost as bad. 

The findings revealed that folks in each province, too, lose a little more than 30 minutes of their lives high-tailing it to their cubicles Monday through Friday.

DOE analysts attributed the lengthy jaunts around the densely populated states to “traffic and urban sprawl.”

The experts also noted that the average one-way commute time across the US is approximately 27 minutes. 

But staffers in the Midwest have it the best.

“South Dakota and North Dakota had average commute times of less than 18 minutes,” read the report. 

Workers in similarly provincial regions such as Kansas, Iowa, Nebraska and Montana also enjoy quickie shuffles just under the 20-minute mark.

However, some business bigwigs don’t mind a long haul.

NYC “super commuter” Susan Miller gladly hops on a plane every week to work as a full-time professor at the University of Michigan.

And hairdresser Kaitlin Jay, 30, told The Post she’s perfectly content spending nearly six hours commuting door-to-door from her home in Charlotte, North Carolina to work at an Upper West Side salon on a biweekly basis. 

“I love what I do in New York and I love life in Charlotte,” she said. “I get the best of both worlds.”

Traffic sign replacement begins April 29 in South Central and Southwest Minnesota

MANKATO, Minn. – The replacement of traffic signs which are at the end of their service lives will begin on April 29 along several highways in southcentral and southwest Minnesota, according to the Minnesota Department of Transportation.

Traffic signs located on various highways in the following counties will be replaced: Blue Earth, Brown, Nobles and Rock.   

MnDOT replaces traffic signs on a 15-year cycle to ensure signs are legible for motorists during the day and at night. Over time, traffic signs experience wear and tear, and frequently lose reflectivity in low-light conditions long before indications of their age are obvious in normal conditions.

Sign replacement on Highway 22 in Mankato will occur during evening hours to take advantage of reduced traffic impacts for the safety of the workers, as well as the traveling public.

There will be little impact to traffic on other state highways during the sign replacement, however, MnDOT reminds motorists to drive with caution and watch for crews working near the roadway. The project is expected to be completed by mid-August, weather permitting.

NTTK, Inc. was awarded the project with a bid of $849,906.64.

America’s most loathed airport is cool now

NEW YORK — From an arriving plane, taxiing up to a gate in the new Terminal B at New York’s LaGuardia Airport is like approaching a steel-and-glass fortress. Flat gray walls at ground level immediately meet the eye. The building’s notable touches — its floor-to-ceiling windows, pedestrian bridges and other architectural flourishes — all rise above you.

After that fortress-like approach, deplaning into the building is a pleasant departure from its dreary reputation . The concourse is light and airy with a rising roofline that visually guides travelers to the bridge to the terminal and the city beyond.

Concessions, including local favorites like Irving Farm coffee roasters and national chains like Wendy’s, beckon with dining options. Forget a book? Grab one at beloved New York bookstore Strand . Need a gift for the kids? The Lego store has you covered.

Or just want to relax away from the traveling masses? Credit card provider Chase recently opened a gleaming new lounge, joining ones managed by Air Canada, American Airlines, United Airlines and American Express.

This isn’t the LaGuardia of “ airport sushi ” infamy anymore.

The airport has come a long way since Vice President Joe Biden described it as “third world” in 2014. Gone is the 1960s-era Central Terminal Building with its leaky roofs , lack of food options and nowhere to sit. Terminal B replaced it in 2020. And Terminal C, which is still under construction, will replace Terminals C and D when it is completed later this year.

“This is gorgeous,” one female traveler stopped to tell Port Authority of New York and New Jersey Executive Director Rick Cotton, the man who oversaw the transformation of LaGuardia, as he watched a water feature falling from the ceiling in the middle of Terminal B.

“I feel like I’m not at home,” she added before disappearing to catch a flight as “New York, New York” played in the background.

Reactions like these are common, Cotton said on a walk through Terminal B last month. The Port Authority, which operates LaGuardia, receives similar feedback from travelers.

“This is civic architecture,” he said while looking out one of those walls of glass you can see from taxiing planes. “It should be inspiring and appealing.”

And an inspiring and appealing edifice is what the Port Authority and its private partners have achieved: a pleasant, art-filled, Instagrammable place — and this time in a good way.

From last to first place

There are many problems with LaGuardia. For one, in a world of large, mega-airports like Dallas-Fort Worth, it’s minuscule. The airport, with just 680 acres, is smaller than Central Park.

On top of that, LaGuardia was built without a master plan, Cotton said. The original terminal — Terminal A, later known as the Marine Air Terminal — opened in 1940 and Terminal B was completed in 1964. Later came Terminals C and D in the 1980s and 1990s.

“It was ‘we’ll just build this one new terminal building,’ and it was how the Port Authority had approached the airport as a whole … No plan. Piecemeal,” Cotton said.

Then came former New York governor Andrew M. Cuomo.

Cuomo, in January 2015, announced an “aggressive infrastructure redesign” of New York’s John F. Kennedy and LaGuardia airports after years of inaction. Cotton noted that, among other reasons, rebuilding the World Trade Center after the Sept. 11, 2001 terrorist attacks took “an enormous amount of the resources of the agency.”

By summer 2015, New York State had selected private partners to redevelop Terminals B, C and D at LaGuardia, including LaGuardia Gateway Partners for Terminal B and Delta Air Lines for Terminal C. Construction began on Terminal B in 2016 and Terminal C a year later.

“There was a real continuity of top leadership support,” Cotton said. He cited Cuomo and New York Gov. Kathy Hochul for their support.

“You need that in terms of committing the funding, and you need that in terms of a thousand different problems that come into play,” Cotton added, who was named Port Authority executive director in 2017.

What the Port Authority and its private partners did was no small feat. “You have a fully operational airport with passengers and you’re fully reconstructing that facility,” said TJ Schulz, president of the trade group Airports Consultants Council.

He likened the reconstruction of LaGuardia to “changing a tire on a car that’s moving on the interstate.”

It paid off: the trade group Airports Council International World recently named LaGuardia as having the best customer experience for airports its size in North America, which is a dramatic turnaround from its historical last or near-last place standing. Skytrax , the publisher of global airline and airport quality rankings, lists LaGuardia Terminal B as one of just three facilities in North America with the top five-star rating. LaGuardia Airport as a whole is rated four stars.

A work in progress

The design of the new Terminal B, which was completed in 2022, aims to reduce stress and create a “calm, frictionless experience” for travelers, as LaGuardia Gateway Partners CEO Suzette Noble put it.

“Once you’re through security, this great window looks out on the airfield. You can see the two bridges, [and] you can see the airplanes,” said Peter Ruggiero, a design principal at architecture firm HOK that designed Terminal B, in a 2020 talk. “You know where you’re going; you have a sense of those distances.”

When asked about all of the vertical movements travelers must make — at least three from curb to gate — Noble said it was solely the result of the terminal site’s small size. It’s not something LaGuardia Gateway Partners has, at least not publicly, received many complaints about. She said complaints are typically about WiFi and flight delays.

In addition to improving the inside, the Port Authority, along with the Metropolitan Transportation Authority and city officials, is working to improve the journey to LaGuardia with bus upgrades. A new direct shuttle service is planned from the end of a nearby subway line. A controversial AirTrain to the subway, like the one at JFK, was canceled in early 2023 due to spiraling costs.

The new Terminal C, which is home to Delta Air Lines, is still under construction with two-and-a-half of the four new concourses open. The rest is expected to open this summer.

Construction on the building is still very obvious. Look out the panoramic windows after security, and you see half of the former Terminal D amid arriving and departing planes with an old Delta sign — “NEW YORK’S #1 AIRLINE” — still hanging above the former curbside drop-off area.

Travelers, though, already like what they see.

Like Terminal B, Terminal C goes up where most airport spaces go out. There’s no great hall welcoming travelers when they enter from departures; instead ticketing is on one level and security a level above connected by two three-story atriums filled with public art. A massive, digital screen spanning the space above the security queues shows changing images that reflect the destination of a soon-to-depart flight.

“New York City is such a vertical city,” said Jay Liese, the project principal on Terminal C at architecture firm Corgan. “In some ways we see the three-level [terminal] as being a little bit of a metaphor for New York.”

One thing Corgan and architectural partner Gensler did after security was create soaring atriums at the entrance to the concourses in Terminal C. That makes the place where travelers wait to board their flights feel much larger, and significantly increases the space for restaurants , restrooms and kid play areas.

The concourse atriums are the concessions space in Terminal C, a more dispersed approach than the central hub in Terminal B.

“It becomes a more organic part of the customer’s journey to their gate,” Liese said of the decision to spread out amenities across the terminal.

You can eat a sandwich or pizza at Sunday Supper looking out a floor-to-ceiling window on the ramp where planes are coming and going, or down on the travelers milling about as they wait for their flights. From there, it’s a quick escalator ride down to the concourse floor and walk to the gate for your flight out.

“It has exceeded, frankly, my highest hopes and expectations,” Cotton said of the new LaGuardia while sitting in Terminal B. “The combination of the architecture — light and airy, and you compare that to the old, dark, undersized LaGuardia. [It’s] night and day.”

BRUSSELS — (AP) — The European Commission proposed Thursday to start negotiations with the United Kingdom to allow young people to move freely, work and study in both regions after Brexit — the U.K.'s departure from the EU four years ago.

According to the EU, the withdrawal of the United Kingdom from the EU following a referendum in 2016 has damaged mobility between the two areas.

“This situation has particularly affected the opportunities for young people to experience life on the other side of the Channel and to benefit from youth, cultural, educational, research and training exchanges,” the Commission said.

When the U.K. was still a member of the economic and political bloc, its nationals had the right to live and work freely in the EU, with reciprocity for EU nationals in the U.K. Under the agreement proposed by the EU's executive arm, EU and UK citizens between 18 and 30 years old would be eligible to stay up to four years in the destination country.

The deal would also allow equal treatment of EU and UK students in the field of university tuition fees. Most EU students must now pay international tuition fees if they want to study in the U.K. The Commission says these vary between 11,400 and 38,000 pounds ($14,200-$47,300) per year and are a strong deterrent for EU students who generally don't have to pay as much within the bloc.

The Commission’s recommendation will be discussed by EU member countries who must give the green light before the executive arm can start negotiations with the UK.

“We have successful Youth Mobility Schemes with 13 countries, including Australia and New Zealand, and remain open to agreeing them with our international partners, including EU member states,” the British government said in a statement.

The U.K. has its own Youth Mobility Scheme, which it has offered to some EU member states. The Commission believes the British plan is less ambitious than its own proposal.

“Our agreements provide a valuable route for cultural exchanges providing partner countries are also willing to offer the same opportunities for young British people,” the British government added.

Remote workers with dreams of working from the rolling hills of Tuscany or the cliffs of Positano are now one step closer to making that reality. Italy launched a new digital nomad visa.

Two years after its announcement, the highly anticipated digital nomad visa officially became available for those eligible on April 4.  

“Italian-style, everything happens slowly,” said Nick Metta, a lawyer for the law firm Studio Legale Metta , which has helped Americans relocate to Italy for decades. “Now there is a pipeline of people waiting just to file the application. It's been a long-awaited visa.” 

Most of Metta’s clients would previously apply for a student visa, which allowed them to work part time in Italy. 

Under the new visa, people will be able to work from Italy for one year, with the option to renew once their visa is due for expiration. Without a visa, U.S. travelers could only stay in Italy for up to 90 days without the ability to work.

The launch makes Italy the latest European country to offer a digital nomad visa , which has already been available in Greece and Hungary.

Who can apply for a digital nomad visa in Italy?

According to the official decree , the visa is meant for those who “carry out a highly qualified work activity through the use of technological tools that allow you to work remotely.” 

The regulations define eligible applicants as “digital nomads,” self-employed freelancers, “remote workers,” or those employed by a company outside of Italy and can work from anywhere, according to Studio Legale Metta.

To qualify for the visa, the applicant has to meet certain requirements:

◾ A university or college degree or an accredited professional license.

◾ Six months of work experience in the industry, or five years for applicants without a university degree.

◾ An existing employment contract.

◾ A criminal record check.

◾ Proof of an annual income of 28,000 euros (about $29,880.06).

◾ Evidence of housing in Italy.

◾ Evidence of health insurance coverage.

Applicants can also apply to have family members join them on their Italian move, but the government has to give the final approval. 

How do I apply for the digital nomad visa in Italy?

Thankfully, Metta said the paperwork for the digital nomad visa isn’t “too complicated.” 

The first stop for interested applicants will be the Italian Consulate for their area. “Consulates are basically the front of the government to receive the applications,” Metta said. Interested applicants can book an appointment with the consulate and start gathering their necessary documents. People can also apply by mailing in their application. (However, Metta did mention consulate websites are often confusing and outdated, so working with a relocation service can make things easier.)

To apply, applicants will also need a passport with an expiration date at least three months after the end of the visa period and two passport-sized photos.

Relocation services can also help people navigate the sometimes complicated process of applying for a visa, such as negotiating early termination penalties with landlords in Italy. 

These services also help people with state and tax planning, especially if people own assets in the U.S., like a house. Once in Italy, people need to register their residency with the town hall, which will determine what sort of taxes they’ll pay. People can speak to an international tax specialist to figure out their future taxes as well. 

How much will the visa cost?

According to Studio Legale Metta, the application fee is 116 euros (about $123.78) per person.

How long will the application process take?

Not too long, actually. Metta estimates the process could take just three weeks if applicants are “well-organized and have all your tax documents filed.”
